This is a case study analysis based on the decision No. DOK-5/2020 issued by the President of the Office of Competition and Consumer Protection (hereinafter: UOKiK) of 3 December 2020. The main part of the text will be devoted to the analysis of the scope of competences of the President of Energy Regulatory Office (hereinafter: URE) (the NRA) and the President of UOKiK (the NCA) regarding the regulation of heat prices (taking into account Polish and EU doctrine and jurisprudence). In contrast to other publications on the relationship between the competences of the President of URE and the President of UOKiK in supervising the heat market, the paper will focus on the following issues: the process of exchanging information between generators and distributors, the practice of tariff proceedings before the President of URE and the role of the President of UOKiK in the process of tariffing heat prices. The conclusion of the text will be that due to the provisions of Polish energy law, the role of the President of URE in the tariff process, the public nature of tariff applications and approved tariffs, no unauthorised coordination of information exchange between heating companies is possible. The thesis will be supported by de lege ferenda arguments.
Ce commentaire est basé sur la décision n° DOK-5/2020 émise par le président de l’Office polonais de la concurrence et de la protection des consommateurs (ci-après: UOKiK) du 3 décembre 2020. La partie principale du texte est dédiée à l’analyse de la portée des compétences du président de l’Office de régulation de l’énergie (ci-après : URE) et du président de l’UOKiK en ce qui concerne la régulation des prix de la chaleur (en tenant compte de la doctrine et de la jurisprudence polonaises et européennes). Contrairement à d’autres publications sur la relation entre les compétences du président de l’URE et du président de l’UOKiK dans la supervision du marché de la chaleur, le commentarie se focalise sur les questions suivantes: le processus d’échange d’informations entre les producteurs et les distributeurs, la pratique des procédures tarifaires devant le président de l’URE et le rôle du président de l’UOKiK dans le processus de tarification des prix de la chaleur. La conclusion du commentaire est qu’en raison des dispositions de la loi polonaise sur l’énergie, du rôle du président de l’URE dans le processus de tarification, du caractère public des demandes de tarifs et des tarifs approuvés, aucune coordination non autorisée de l’échange d’informations entre les sociétés de chauffage n’est possible. La thèse sera soutenue par des arguments de lege ferenda.

Opis:
The main aim of this article is to present current judicial practice, concerning hearing cases stemming from appeals of Polish Competition Authority decisions. The relevant court tends to review the cases only on merits, omitting to address procedural infringements, clearly stated by the parties in appeals. In author’s opinion this common practice does not have a legal leg to stand on. Author analyses relevant laws and precedents pointing out, that full review of the decision is Court’s duty, which could not be neglected. Furthermore, according to ECHR rulings procedural guaranties should be assured on high level, especially in matters, where quasi-criminal fines are concerned. As a legal practitioner Author perceives possible crippling effect on effectiveness, assuming that the Court would have to review all steps of the proceedings before Competition Authority. So in conclusion Author proposes a compromise solution asserting, that the Court should at least address all procedural infringement counts stated in appeal.
Cet article vise essentiellement à présenter la pratique judiciaire actuelle pour ce qui est de connaître les affaires résultant d’un recours contre les décisions de l’autorité polonaise de concurrence. Le juge compétent pour ces affaires fait preuve d’une tendance à en connaître exclusivement le fond sans considérer les violations de procédure soulevées expressément dans les recours des parties. L’auteur est d’avis que cette pratique juridictionnelle est dépourvue de fondements juridiques. Il analyse les textes appropriés et l’acquis de la jurisprudence pour montrer qu’un contrôle complet de la décision est une obligation du juge, qui ne saurait être négligée. En plus de cela, conformément à la jurisprudence de la Cour européenne des droits de l’homme, un niveau élevé de garanties procédurales doit être assuré, notamment dans les affaires susceptibles de sanctions quasi-pénales. L’auteur, qui est un praticien, y voit le risque potentiel de compromettre l’efficience de la procédure, en admettant que le juge soit amené à contrôler toutes les étapes de la procédure avant l’autorité de concurrence. Pour conclure, l’auteur propose une solution de compromis qui admettrait que le juge devrait au moins se prononcer sur les exceptions procédurales soulevées dans le recours.

The study aims to identify of the specific models of cooperation between government and opposition in Czechoslovakia in transition period. In the article the prerequisites of confrontational relationships and their projection on the level of political competition and the formation of new political institutions in terms of democratization are determined. Was proved that the character of the relationship between government and opposition in Czechoslovakia was largely determined by degree of democratization of the regime and the opposition force, it`s goals and strategies. In the late 80th under pressure of the opposition, parties have moved from confrontation to cooperation, what reflected on co-option of the opposition members to the government. However, at the coalition government in fact was no division on pro-government and opposition forces, which made adaptation of opposition to the new socio-political conditions more complicated. A fundamental difference between the relationship of government and opposition in West European countries and Czechoslovakia was noted. In West European countries, the relationship found expression in both legal and political norms. They were characterized by the fact that they are in mutual consent of the parties to act before all in the public interest without going beyond existing law. In Czechoslovakia the main opponents of the ruling forces were communists who had radically different understanding of the main goals of social development. As for the anti-communist opposition, which operated until 1989, its isolation and the virtual disappearance were observed. The elections did not lead to authority post-communist forces, as it were observed in Poland and Hungary. The weakness of the opposition until 1989 gave her little chances at a new political conditions. It was weakened by internal divisions. Against the background of a weak opposition increased level of competition between pro-government parties. This, to some extent, contributed the establishment of new informal rules of electing of the president and prime minister of the federal government. After the first free parliamentary elections, relations between the government and the opposition have changed to a more confrontational with minimal consensus. In Czechoslovakia, in contradistinction to Poland and Hungary, there was no opposition repositioning, i.e. its transformation from outsider of changes of political order to an active participant in the parliament. Post-opposition forces remained weak and separated political entities. In 1991-1992 clear division between progovernment and opposition forces cannot be traced. Blurred boundaries between political opponents were intensified duality of political regime, that combines the features of the previous and democratic, centrifugal tendencies, regionalization of political parties. The competition took the form of real competition within the ruling group, formally differentiated by geographic criteria into two political parties. All this weakens the inter-party competition at the level of «government-parliamentary opposition» at the national level and put the problems of democratization to the second plan, giving priority to processes of formation of independent states of Czech Republic and Slovakia.

Artykuł przedstawia najważniejsze aspekty regulacji rynków zakańczania połączeń w sieciach telefonii ruchomej w Unii Europejskiej, w szczególności sposób ustalania wysokości stawek za zakańczanie połączeń. Kluczowe w tym zakresie jest wydane w 2009 r. Zalecenie Komisji Europejskiej, które w sposób precyzyjny określiło dalsze kierunki tej regulacji na poziomie wspólnotowym. W celu zobrazowania praktyki regulacyjnej jaka ma obecnie miejsce w artykule omówiono również wybrane propozycje krajowych organów regulacyjnych, jakie zostały przedstawione Komisji Europejskiej w ciągu ostatniego roku.
The article presents the main aspects of regulation of the markets for call termination on mobile networks in the European Union, in particular the methods of determining the termination rates. Key in this regard is issued in 2009, the Commission’s Recommendation, which accurately determined the future course of regulation at Community level. In order to illustrate the regulatory practice, which is currently taking place, the article also discusses selected proposals of national regulatory authorities, which were notified to the European Commission over the last year.
