    In response to questions from the managing team of the Chancellery of the Sejm’s he author of the opinion claims that an entity which carries out professional lobbying activities and whose representatives are lobbyists registered in the Sejm, has a right to submit petition addressed to the Sejm concerning amendment of an act connected with their actions as the entity who carries out professional lobbying activities. A person who carries out professional lobbying activities and a person who is entitled to represent the entity which carries out such activities may attend sittings of the Committee on Petitions’ sitting upon an invitation of the committee’s presidium’s or a chairperson.

    Opis:
    The analysis concerns the issue of whether a committee considering, based on the indicated provision, amendments submitted during the second reading, should vote on their acceptance or rejection separately for each amendment, or if it is possible, after consideration of the amendment, to automatically (without separate vote) draw a recommendation concerning other amendments, in case it is a logical consequence of acceptance or rejection of the former amendment. The author assessed that there are no obstacles to apply, at this stage of legislative work, per analogiam the institution of the third-reading voting applied in the first instance to the “most far-reaching amendments”, i.e. those whose adoption or rejection determines decision concerning other amendments.

    Opis:
    Notification to committee members about a committee sitting (date and agenda) should take place at least three days before the sitting, unless the meeting was convened as a result of decisions taken at the sitting of the Sejm. The discussed rule allows each member of the committee to plan a calendar of activities taking into account all individual responsibilities. The author emphasizes that with Article 152 para. 5 of the Standing Orders of the Sejm causes a few interpretation concerns, what indicates a need of its amendment.

    Opis:
    The Sejm, as a body of legislative power, is not a public administration body within the meaning of the Code of Administrative Procedure. Thus there is no obligation to apply the provisions of this act. The Sejm committees, which are internal organs of the chamber, also have no obligation to do so. They cannot be a party to proceedings before an administrative court. The Code of Administrative Procedure provides for the possibility of referring a complaint to the Sejm or its internal body (committee), but there are no legal provisions regulating the procedure of examining complaints against state authorities other than executive organs.

    The Standing Orders of the Sejm imposes a duty on a committee chair, upon a motion, to convene a committee sitting in order to consider a case described in the motion. The sitting should be held within 30 days after the submission of the motion In case the subject of the sitting convened pursuant to Article 152 para. 2 is a discreet issue, it shall be held in camera. The committee chair should undertake actions to organise a sitting in such circumstances.

    The author notes the existence of a legal loophole in the Standing Orders of the Sejm with regard to the issue of consent for broadcasting committee sittings in the Sejm Information System. The systemic inconsistency between the Standing Orders of the Sejm, the Committee’s Rules of Procedure and the rules set forth in the resolution of the Presidium of the Sejm, on the basis of which broadcasts of committee proceedings are included in the Sejm Information System, makes it fundamentally difficult to resolve the doubts in this regard. By way of interpretation per analogiam, the author assumes that since the chairperson of a committee decides on the presence of media representatives at a committee meeting, it is also up to this body to decide on the broadcasting in the Sejm Information System.

    Opis:
    The subject of the opinion is the admissibility of consideration by a committee of motions to carry out a control in connection with the lack of general principles of carrying it out set out in the Standing Orders of the Sejm. Motions to carry out the control submitted to the National Defence Committee stay within the scope of the subject matter of activities of the committee. The author claims that one of the motions rises some concerns of a legal nature. The subject of the request was defined in a problem way, whereas committee’s control relates to enforcement and executing statutes and Sejm resolutions, what leads to a conclusion that the scope of the control should be related to a given act or resolution.
