The paper presents the results of analysis of the status of organizational and legal mechanism of public administration of electronic consultations (e-consultations) as well as scientific and theoretical substantiation of recommendations to Ukrainian authorities on their improvement. The study of national and international laws in regard to functioning of the mechanism of e-consultations has been conducted to determine positive and negative factors influencing its application. Ways to improve specified mechanism regarding the structure of units of central (regional, local) executive bodies and local governments, legal normative acts concerning e-consultations and participation of public councils in the process of e-consultations have been offered. The main shortcomings of the organizational and legal mechanism of public administration of national e-consultations have been identified, including: low 36 Yanis Yansons quality of e-consultations; unwillingness of the subjects of power to allow the civil society to have a real impact on state affairs, lack of responsibility for ignoring the law in regard to organization and conduct of e-consultations, distrust of the authorities and “digital inequality” etc. Based on the analysis of international experience in implementing the tool of e-consultations, ways to improve the procedure for its implementation in Ukraine, changes to national laws and recommendations to central (regional, local) executive bodies and local governments, public councils and the civil society to improve the organizational and legal mechanism managing tool of econsultations implementation, operation and development.

It can be striking for us today that when so little divides us there is still so much that separates us from each other. We observe the fragility of social cohesion and witness the degradation of social capital even though some say that our religious belief as well as material conditions or differences in political rights no longer divide us. In the light of critical observations, one can say that there is a need to reconcile people with each other, to establish bonds between us, that we need to establish civil society. When trying to establish a well-functioning civil society we have to ask ourselves a few crucial questions. These questions include: How can Western individualism be combined with the values of community and social solidarity? What are the necessary conditions for freedom and solidarity among people? To answer these questions it is worth reaching the philosophical thought of John Dewey and Roberto Unger. In his text Roberto Unger points out that today’s social and political order is not something solid and stable. Even our democratic order that I was referring to in this paper faces challenges that may undermine its base. Without the right preparation to face these challenges-through responsible and critical public participation and deliberation-it is possible that instead of us having some sort of possibility of steering the growth of our societies and having an impact on political and economic evolution, the evolving situations will steer us. If this happens, we will be left behind, being unable to grasp and handle the different new situations.

Celem opracowania jest wskazanie na konieczność teoretycznego ujęcia demokracji, zawierającej dwa poziomy wyrażania wolności człowieka – poziom jednostkowy i wspólnotowy. Teoria demokracji ma istotne znaczenie dla kształtowania relacji społeczno- -ekonomicznych. Obecnie relacje ekonomiczne są dominujące w określaniu kształtu demokracji. Za ich siłą stoją założenia gospodarki neoliberalnej. W kontekście takiego podejścia obserwowane są urynkowione aspekty stosowanej demokracji, wywołujące głębokie zniekształcenia w praktycznych procedurach demokracji. Tematyka została opracowana w trzech punktach prezentujących kolejno: krytykę demokracji posadowionej w systemie gospodarki neoliberalnej, problematykę społeczeństwa obywatelskiego (SO) i kierunki doskonalenia demokracji zapewniającej funkcjonowanie tego społeczeństwa.
The aim of this study is to indicate the need for a theoretical approach to democracy containing two levels of human freedom: the individual and community level. The theory of democracy is essential for shaping socio-economic relations. Nowadays, economic relations are dominant in defining the shape of democracy. Their strength is supported by the assumptions of the neoliberal economy. In the context of such an approach, the market- oriented aspects of the applied democracy are observed, causing profound distortions in practical procedures of democracy. Definitely a democratic theory is necessary, expressing the synthesis of the freedom of the human individual at the level of their individual will and their freedom in the social field. Society cannot be treated as a human group, but as a unified whole with socialized relations.

The topic of this article is civil capital and its influence on a civil society development. The goal of this paper is to answer if the civil capital is an important factor of the civil society and its diversity among the states, for example Poland and the United States. The hypothesis is when the level of the civil capital is getting higher then citizens are more willing to take part in the process of a political participation. The research has been done basing on the World Values Survey, Wave 6 2010–2014

The paper attempts to diagnose the level of civic participation in local issues by means of the three existing possibilities: applying the procedures of a representative democracy, participatory democratic institutions and more or less institutionalised forms of civil society. The starting point is the assumption that, perhaps, the way to stimulate citizens, most of whom do not participate in the procedures of a strongly party-dependent representative democracy, will be based on the introduction of elements of participatory democracy, or the formation of loosely institutionalised social movements that constitute a civil society. On the basis of the collected data, it can be said that from the current point of view there is no indication that the status quo might be changed and the level of participation raised. In addition, it seems that the majority of society are reluctant to actively participate in public affairs, regardless of the existing institutional opportunities, the reasons for which are not entirely clear – they may include a persistent low level of trust in other people, and a lack of circumstances, forcing them to take action.
W tekście podjęto próbę diagnozy poziomu partycypacji obywatelskiej dotyczącej spraw lokalnych w ramach trzech istniejących możliwości: poprzez procedury demokracji przedstawicielskiej, instytucje demokracji uczestniczącej oraz mniej czy bardziej zinstytucjonalizowane formy społeczeństwa obywatelskiego. Punktem wyjścia było założenie, że być może sposobem aktywizacji obywateli, którzy w większości nie uczestniczą w procedurach silnie upartyjnionej demokracji przedstawicielskiej, będzie wprowadzenie elementów demokracji uczestniczącej czy też ukształtowanie się słabo zinstytucjonalizowanych ruchów społecznych składających się na społeczeństwo obywatelskie. W oparciu o zgromadzone dane można jednak stwierdzić, że z obecnego punktu widzenia nic nie wskazuje na możliwość zmiany istniejącego stanu rzeczy i podniesienia poziomu uczestnictwa Wydaje się przy tym, że istnieje niechęć większości społeczeństwa do aktywnego uczestnictwa w sprawach publicznych, niezależna od istniejących możliwości instytucjonalnych,  której przyczyny nie są do końca jasne – jednymi z możliwych może być utrzymujące się niskie zaufanie do innych ludzi oraz brak okoliczności zmuszających do podjęcia działań.

This paper studies the concept of “hybrid regimes”, not so much in defining and authenticating their functionality but, above all, to exhibit them as so-called “partial” constitutional concepts. Articulating the tensions, divergences, and antagonisms characteristic of these regimes, as well as highlighting the blurring boundaries between democratic systems and authoritarianism “with adjectives”, emphasizes the importance of the examined issues. The author introduces an alternative conceptualization and typology of hybrid regimes and a configurational approach. Instead of placing political regimes on a linear continuum – from authoritarianism to democracy – multidimensional solutions facilitating an alternative typology of the analyzed concepts have been exposed. The configuration approach, however, provides an analytically valuable way to evaluate and integrate hybrid regimes with other classification schemes. Such innovations, therefore, help alleviate conceptual confusion in the literature. Moreover, deepening the understanding of the concept of hybrid regimes, along with emphasizing its conceptual ambiguities and complexity – especially concerning the “politically correct” discourse on the current problems of fragile and politically unstable states – is necessary to better understand the complex and confusing nature of modern regimes of power frequently operating in the most politically unstable regions of the contemporary world.

The article departs from the discussion of the sources of the scholar interest in civil society and proceeds to the functional expectations about it. It claims that the concept of civil society, as it is frequently used in scientific and political debates, has specific cultural roots, which makes a trans-cultural analysis difficult or perhaps even impossible. Furthermore, the article addresses three conceptual problems of civil society, namely the issue of what constitutes civil society, its autonomy and impact as well as the challenge of civil society to the state. The central argument of the article is that in order to examine the impact of civil society on governance and democracy, it is recommendable to include three levels of analysis, namely the structure and functions of civil society (including also the possibly negative impact of civil society), the type of state co-existing with civil society as well as the character of the relationship between state and civil society.

The problem of both political and sociological backgrounds is often the quality and level of political civic competence. They point out their importance for the development and consolidation of democracy as well as the quality of public life. Research on this topic is accompanied by a lack of interest in politics, knowledge of its basic mechanisms, limited social trust, and marginal participation, which may be the turnout in individual elections. At the same time, there is a lack of reflection on the sources of such behaviors, assuming (usually a priori) that they are in the historical experience, mentality, tradition or political culture prevailing in a given society. However, the observation of public life makes it possible to argue that the quality and level of political civic competences largely depend on the practice of political parties with regard to citizens in terms of both conventional and unconventional participation. Of course, it is difficult not to notice the interplay of political parties and citizens, one can even risk the notion that the "quality of citizenship" depends on the rulers, and these reflect the "quality of citizenship."

The paper describes a problem of collision between the concept of solidarity which is based on concern for the others interests of others with the liberal concept of implementing particular goals. Institutional solutions adopted in Poland, as well as the theories and tools and methods for their description and interpretation, still have imitative character. The result is a hybrid conglomerate of institutional arrangements that are created along the lines of the existing organizational structure of the EU countries. The structure and the way of functioning of those institutions are most commonly analyzed by using borrowed theoretical solutions present in the European or American sociological literature. Social dialogue and civic dialogue do not work so as to bring the expected results which causes permanent institutional and intellectual crisis. The paper postulates to use the new dialogue for the reflection about intellectual mechanisms that create the world better suited to people's expectations.

The aim of this essay is to confront Hegel’s political philosophy regarding ethical community and civil society with the objective of betzavta, which is an educational method promoting democratic decision-making processes. The concepts of freedom and ethical community were strongly present in Hegel’s Philosophy of Right and later on discussed by Zbigniew Pelczynski (1971, 1984a, 1984b), ShlomoAvineri (1972), Charles Taylor (1979) and Marek Siemek (1995,1998). This article reconstructs these Hegelian conceptsbased on their liberalinterpretations andconfrontsthem with contemporary challenges related to minority rights, conflict of values, decision-making processes and political participationin relation to the experiences gained during thebetzavta workshops.The main problem defined is the question whether it’s possible to reach a consensus in a given society that would conclude with the establishment of ethical community. The general assumption of this article is that because of the impossibility to obtain a consensus on fundamental values (lack of compromise on same-sex marriage or abortion), an ethical community that would secure both particular and public freedom cannot be reached. The clash between subjective and objective freedom can be perceived through the lenses of the classical problem of a tyranny of majority, where minorities are pushed towards a submissive compromise with the rules set by the majority. An experience of theBetzavta Method will also be included in the general reflections on the essence of freedom in political participation and the silent presence of certain members in decision taking-processes. null

Speaking about democratic choice we are mainly interested in the common features in the motivation of post-colonial, post-totalitarian and post-authoritarian societies, their leaders, elites and people, which determine attractiveness of democracy in the contemporary world. The intention to be democratic today is often connected with the intention to be free, modern, safe, developed state, which is accepted in the circle of developed countries on the conditions of friendly and equal partnership. Based on the experience in building democracy in the “third wave” countries (S. Huntington) and on the other conceptual assumptions of institutionalists, we can come to the conclusion of necessity to review the traditional approaches to the problem of democratic transit. These approaches considered democratic transit, firstly, as the issue of the ideological (or value, in a wider sense) choice, and, secondly, as the issue of destruction of non-democratic social institutions with the aim to build institutions of liberal democracy in their place. Therefore, they referred to the following as to the major directions of building democracy: a) understanding by the active part of the society of the liberal paradigm of public consciousness; b) maximal denationalisation of the public sphere; c) harmonisation of the national institutions and standards with the Western samples. The Western expert community arrived at the conclusion that the so called civil society should become a driving force for democratic changes in the former USSR countries. These approaches considered democratic transit, firstly, as the issue of the ideological (or value, in a wider sense) choice, and, secondly, as the issue of destruction of non-democratic social institutions with the aim to build institutions of liberal democracy in their place. Therefore, they referred to the following as to the major directions of building democracy: a) understanding by the active part of the society of the liberal paradigm of public consciousness; b) maximal denationalisation of the public sphere; c) harmonisation of the national institutions and standards with the Western samples. However, the modern views enable not to define democracy as just an ideological choice or an institutional model, but as social innovation. This definition opens to us a somewhat different outlook of the study on the problems of building democracy and the problems of practical democratic reforms. As we speak about innovation, the most important aspects of its study and design in a specific social organism are as follows: a) motivation; b) preconditions; and c) algorithm of its launch. The issue of a subject of democratic transformations has not lost its topicality, either, though in case of innovation, it would rather mean an initiative core, as well as perceptiveness to novelties and interest towards them by various social groups and political actors. Returning to the issue of motivation, we should detail the interrelation between democratisation and modernisation. The matter is that intention to modernisation, which is quite understandable to world-system periphery countries, is often understood as readiness for democracy. As a matter of fact, motivation with regard to these two strategies for national development only coincides partially. Modernisation is the shortest way to development and, in certain sense, safety. But often modernisation does not account for motivation of freedom and in certain cases, is conducted much more efficiently and quickly when freedom is restricted. To Ukraine, motivation of freedom is traditionally one of the leading public values. As for two other aspects of a democratic choice, safety and development motivations, these characteristics of a democratic order were learned and assessed by the Ukrainian society much later. The democratic social innovation in Ukraine is accompanied by processes of national development and the struggle to redistribute the social product. The main trends of Ukraine democracy building include the targeting on state, nation and civil society development. We can distinguish several key collisions in understanding democracy, which imposed a serious obstacle to building an efficient democracy in Ukraine. The major problem of Ukrainians’ democratic self-determination is related to the correlation between freedom and law. Other issues are the correlation between rights and obligations and the correlation between the will of the majority and the right of the minority. Having defined the democratic development objective in Ukraine as a transition from imitation to essence, we have highlighted the key markers of this transformation. These include negotiation of such widespread phenomena as the sword-law, citizens’ passivity, corruption, uncertainty about powers and areas of responsibility of state bodies, political appropriateness, failure to comply with procedures, informational closeness and politicians’ lies, as well as other features of immature public organization, which continue existing under the lee of democratic institutions.
