    Opis:
    The paper presents the mechanisms that led to the first American legal regulations and organizations for the protection of minors and the elimination of child abuse. The background for the considerations is the case that shocked the American public opinion in the second half of the 19th century. It concerned a 10-year-old girl, Mary Ellen Wilson, who was a victim of violence and neglect on the part of her guardians. The attempts to save the child showed that the American system of social welfare lacked adequate institutional and organizational instruments to protect a child who was a victim of violence and abuse. Based on the literature and available archival materials – official documents and press publications from the discussed period – the course of the trial was reconstructed, as well as the initiatives undertaken after its completion, which led to the establishment of the first American organization aimed to protect children. The summary presents the characteristics of the American movement for the protection of children against the background of European initiatives undertaken in this field.

    Opis:
    This article comprises a synthetic general review, presentation analysis and assessment of interpretation and efficiency of main legal sources of protection of children’s rights in international, European and Polish home law. As well as other problems of social and individual safety of children and youth, against of all forms of violence and abuse, social orphanage and other pathologies, aimed at building of a general common feelings of their safety in everyday life and activities. Authors present the two complementary spheres of organized institutional protection, prevention and intervention of children’s rights, based on the most important sources of law and asses their implementation and functioning in practice in Poland. The first sphere of the Polish model and system of protection of children’s rights, based on both legal and material guarantees and instruments, are public – state and territorial self-governing administration authorities, dedicated organs, institutions such as Ombudsman of children’s rights, regional and local centers of social care, safety and protection of family life and all forms of intervention in case of all forms of crises, violence and abuse of children and youth. The second complementary spheres of very dynamic manifold activities and social initiatives of various NGO’s and informal groups and individual persons, aiming at effective protection of children’s rights. These nongovernmental activities, both initiate, stimulate and control different forms of real prevention, protection, intervention and defense of children and their rights and counteracting all forms of social orphanage, violence and abuse in social relations with children and adolescents in different domains of our life, as well private and public. Their main aim is increasing of the feeling of safety of children and youth in Poland on the grounds of proper implementation and interpretation of respective legal regulations

    Wstęp: Fundamentalnie zapisany w obowiązującym prawie etos lekarza: niesienie pomocy chorym oraz respektowanie woli pacjenta, jak również Karta Praw Pacjenta, obligują zespół operacyjny do proponowania rodzicom udziału w wyborze znieczu- lenia dziecka do zabiegu. Powstaje więc pytanie, czy obowiązek prawny nie wyprzedza praktyki, czy rodzice oczekują informacji odnośnie znieczulenia ich dziecka do operacji i czy są gotowi przyjąć współodpowiedzialność za wybór znieczulenia. Cel pracy: Określenie gotowości rodziców do czynnego udziału w wyborze rodzaju znieczulenia u swoich dzieci oraz zdefni- owanie ich obaw związanych ze znieczuleniem. Materiał i metody: Badania przeprowadzono na przełomie maja i czerwca 2012 roku. Grupę badawczą (215 osób) stanowili rodzice dzieci operowanych w województwach: opolskim i śląskim. Narzędzie badawcze – autorski kwestionariusz ankiety. Wyniki: 51,7% badanych rodziców odrzuciło możliwość współdecydowania o rodzaju znieczulenia u ich dziecka. Wolę współpracy zadeklarowało zaledwie 30,7%. Informacji na temat znieczulenia udzielał najczęściej lekarz anestezjolog (74,8%). 86,9% rodziców oceniło informacje te jako zrozumiałe i kompletne. Wystąpienia powikłań bała się ponad połowa rodziców (53,3%). Wnioski: Z przyznanego rodzicom prawa do uczestniczenia w wyborze rodzaju znieczulenia ich dziecka korzysta zaledwie co trzeci ankietowany. Większości rodzicom towarzyszy wiele obaw związanych ze znieczuleniem, często irracjonalnych.
    Introduction: Doctors' ethos, fundamentally assured in the binding law: assissting patients and respecting their will, as well as the Patient Rights Charter, oblige the operating team to ofer the parents possibility of participation in the choice of the type of anesthesia for treatment of their children. Thus the question arises whether the legal obligation is not ahead of practice-whether parents expect information on their children's anesthesia and whether they are ready to bear co-responsibility for the choice of the type of anesthesia. Aim of research: To determine the readiness of parents to actively participate in the selection of the type of anaesthesia for their children and to defne their concerns about anaesthesia. Material and Methods: The research was conducted at the turn of May and June 2012. The research group (215 persons) con- sisted of the parents of children operated in Opole and Silesian voivodeships:. Research tool – authors' questionnaire survey. Results: 51.7% of surveyed parents rejected the possibility to co-determine the kind of anesthesia for their child. Will to cooperate was declared by solely 30.7% of them. Information on the anesthesia was provided mainly by physician anesthesiologist (74.8%). 86.9% of parents evaluated this information as clear and complete. More than half of parents (53,3%) feared the occurence of complications. Conclusions: The granted law of parents to participate in the choice of method of anesthesia for their children is used merely by one third of the surveyed. Most parents display many concerns about anesthesia which are often irrational.

    W artykule omówiono wyniki ogólnopolskich badań surveyowych prowadzonych na zlecenie Rzecznika Praw Dziecka dotyczących postaw polskich rodziców wobec kar cielesnych, stosowania ich wobec własnych dzieci oraz wiedzy nt. prawnego zakazu stosowania takich kar w Polsce. Zaproponowano także kierunki działań służących ograniczeniu stosowania kar cielesnych przez polskich rodziców.
    The article discusses the results of nationwide surveys conducted at the request of the Children’s Ombudsman regarding the attitudes of Polish parents towards corporal punishment, their use of corporal punishment and knowledge about the legal prohibition of it in Poland. Article also propose directions of activities aimed at limiting the use of corporal punishment by Polish parents.
