    Opis:
    The paper describes and compares selected methods for measuring the quality of governance and the effectiveness of public administration. These methods are used by international institutions such as the World Bank, the European Central Bank, the International Institute for Management Development, and the World Economic Forum. The analysis is based on reports published by these organizations and takes into account the key criteria of governance process evaluation and types of statistical data used. All these institutions measure governance quality from different angles. The World Bank and the International Institute for Management Development focus on measuring the effectiveness and efficacy of governance processes. The European Central Bank evaluates the quality of public administration, while the World Economic Forum measures the efficiency of public institutions. The paper offers a comparative analysis of all these methods, using Person’s correlation coefficients and a grading procedure. Despite different criteria used similar governance quality indicators were obtained. The indexes given by the authors have diagnostic and informative value and offer a comprehensive picture of governance quality.

    Celem tekstu jest opis uwarunkowań działań komunikacyjnych Zarządu Miejskiego i organizacji miejskich w Olsztynie. Analizie poddano strukturę administracyjną i przykłady porozumiewania się w organizacji. Zakłada się, że czynnikiem warunkującym porozumiewanie się był wielowarstwowy system zależności władzy i płynna granica między sferą prywatną i publiczną. Odzwierciedlało się to w zarządzaniu dobrami materialnymi oraz podczas konstrukcji struktur, norm i reguł administracyjnych. Działania te realizowano podczas wymiany ludności i tworzenia nowych kodów kulturowych. Istotne znaczenie miał niski stan bezpieczeństwa, zniszczenie infrastruktury, niepewność co do własności nieruchomości i przebiegu granicy państwowej. Zaznaczał się silny wpływ Armii Czerwonej oraz nieukształtowana opinia publiczna. W tekście wykorzystano jakościową analizę zawartości dokumentów urzędowych ze zbiorów Muzeum Warmii i Mazur oraz wybrane zasoby Archiwum Państwowego w Olsztynie i prasę lokalną.
    The aim of this text is to describe the determinants of communication activities of the Municipal Board and municipal organisations in Olsztyn. The administrative structure and examples of communication in the organisation are analysed. It is assumed that one of the determinants of communication was the multi-layered system of power relations and the fluid boundary between the private and public spheres. This was reflected in the management of tangible goods and in the construction of administrative structures, norms and rules. These activities were carried out during population exchanges and the creation of new cultural codes. The low state of security, the destruction of infrastructure, the uncertainty of property ownership and the course of the national border were all important factors. There was a strong influence of the Red Army and unformed public opinion. The text uses a qualitative content analysis of official documents from the collection of the Museum of Warmia and Masuria and selected resources from the State Archive in Olsztyn, and the local press.

    Artykuł porusza problem wyłączenia pracownika organu od udziału w postępowaniu administracyjnym w sytuacji, w której pomiędzy nim a stroną zachodzi stosunek prawny tego rodzaju, że wynik sprawy może mieć wpływ na prawa i obowiązki pracownika (art. 24 § 1 in fine k.p.a.). Do wyłączenie dochodzi wówczas  z mocy prawa i jest podyktowane dążeniem do załatwiania spraw administracyjnych z uwzględnieniem wymogu bezstronności pracownika. Konstrukcja omawianej przesłanki opiera się na dwóch elementach. Po pierwsze, do wyłączenia na podstawie wskazywanego przepisu dochodzi jedynie wtedy, gdy stronę i pracownika łączy stosunek prawny. Analizowana podstawa wyłączenia nie zachodzi zatem wtedy, gdy stosunek ten ma charakter jedynie faktyczny lub np. gdy istniał w przeszłości. Po drugie, stosunek ten musi charakteryzować się swoistą relacją pomiędzy wynikiem sprawy a zakresem praw lub obowiązków pracownika – mogą one ulec modyfikacji przy określonym rozstrzygnięciu.  Wyłączenie pracownika na podstawie omawianej przesłanki wydaje się niezwykle złożone: obie ze wskazanych przesłanek muszą wystąpić łącznie, przy czym mają one charakter ocenny. Z tej przyczyny autor proponuje wykreślenie z k.p.a. omawianej podstawy wyłączenia pracownika oraz objęcie uregulowanych w niej przypadków wyłączeniem na wniosek (art. 24 § 3 k.p.a.). Będzie to zgodne z zasadami: szybkości postępowania, budzenia zaufania uczestników postępowania do władzy publicznej oraz legalizmu.
    The article addresses the problem of excluding an employee of the public administration from participation in proceedings in a situation where there is a legal relationship between the employee and the party of such a nature that the outcome of the case may influence the rights and duties of the employee (Article 24 § 1 in fine of the Code of Administrative Proceedings). The exclusion then takes place ex lege and is justified by the need for the impartiality of the administrative body. The structure of the discussed premise is based on two elements. First, the exclusion under the indicated provision occurs only when the party and the employee have a legal relationship. Therefore, the analysed ground for exclusion does not occur when this relationship is only factual or, for example, when it existed in the past. Secondly, the outcome of the proceedings must have a special impact on the employee’s rights or obligations arising from the relationship. Justifying the exclusion of an employee on the basis of the discussed premise seems extremely difficult: both of the indicated premises must appear jointly, and they are of an evaluative nature. For this reason, the author proposes to remove the discussed ground from the Code of Administrative Procedure and to cover the cases regulated therein with exclusion upon request (Article 24 § 3 of the Code of Civil Procedure). This will be in line with the principles of speed of proceedings and of fostering the trust of participants in the proceedings in the public authority and legalism.

    Opis:
    It was in the early 1990s that the World Bank first introduced the term “good governance” in its documents and aid programs. After the reorganization of 1997, a list of six indicators of good governance was compiled. The indicators were subsequently used in the research on the quality of governance in Poland. The results clearly showed that the country scored low in all aspects of good governance, notably in public sector transparency, quality of regulation, law enforcement, as well as efficiency and effectiveness of carrying out public duties by the administration.The pathway to shared prosperity in Poland is built around growth, inclusion and sustainability objectives, but success will ultimately depend on a more strategic, effective, and accountable state. Poland has done remarkably well, boasting strong growth over three decades. Looking forward, this argues that a new level of sophistication is required to meet the challenges such as rapidly aging population and evolving global economy. This includes developing a more strategic, effective, and accountable state and it is administration that can facilitate a strong consensus around consistent policies to foster growth, inclusion and sustainability. Improved consistency, commitment, coordination, and cooperation would strengthen Poland’s institutions, making them more strategic, effective and accountable.The paper describes the quality of governance and the effectiveness of public administration. The analysis is based on reports published by different institutions and takes into account measuring the effectiveness and quality of public administration and the efficiency of public institutions.
    Artykuł dotyczy jakości rządzenia i efektywności administracji publicznej. Analizy dokonano przede wszystkim na podstawie dokumentów strategicznych i opublikowanych raportów różnych instytucji, uwzględniając ocenę efektywności i jakości administracji publicznej oraz sprawność instytucji publicznych.Pojęcie dobrego rządzenia wprowadził na początku lat 90. XX w. Bank Światowy. Po jego reorganizacji w 1997 r. opracowano listę sześciu kluczowych wskaźników dobrego rządzenia, które zostały zastosowane do badania jego jakości m.in. w Polsce. Badania dowiodły, że Polska osiąga niskie standardy we wszystkich wymiarach dobrego rządzenia, przede wszystkim w zakresie przejrzystości działania sfery publicznej, jakości regulacji, egzekwowania prawa, efektywności oraz skuteczności realizacji zadań publicznych przez administrację. Mimo tego Polska poradziła sobie zaskakująco dobrze, wypracowując w ciągu 30 lat silny wzrost gospodarczy. W najbliższej przyszłości niezbędne będzie jednak podjęcie zdecydowanych działań, by sprostać takim wyzwaniom, jak starzejące się społeczeństwo czy zmiany na rynkach światowych. Sytuacja wymaga wypracowania strategii opartej na funkcjonowaniu sprawnego państwa i jego efektywnej administracji, by wspierać rozwój gospodarczy i funkcjonowanie instytucji publicznych w Polsce.
