    Opis:
    Can 965 CIC states that only a priest is the minister of the sacrament of penance. A sacerdotal character and faculty is necessary to administer validly the sacrament of penance. Every priest should aim to give an opportunity to faithful people that they successfully benefit from going to confession. A priest is obliged to take care of his own spiritual and intellectual growth, and in exercising his ministry he must adhere faithfully to the doctrine of the Magisterium, but he should remember that the imposition of a penance by the confessor must be individualised. The confessor is to impose salutary and appropriate penances in proportion to the kind and matter of sin confessed, taking into account the condition of the penitent. He should be especially sensitive to those people who by being in ecclesiastical suspense cannot receive a sacramental absolution. He should also be available to minister to people from other churches which do not have full unity with the Catholic Church. It should be in the situations provided by the law. Finally the priest is obliged to observe the secrecy of the confessional, which no one can release him from – the sacramental seal is inviolable.

    Opis:
    In this paper, the Author presents the competency of the Apostolic Penitentiary which extends to all occult or secret matters that are able to be solved in the internal forum and he is focusing on the meaning and the finality of the “censures” and the irregularities in canon law. All cases of censures "latae sententiae", when they are strictly such, that is, when they have been incurred "ipso facto" and have not been the object of a judicial sentence or of a declaration, can be dealt with in the internal Forum. Some censures can be remitted by the local Ordinary or by major Superiors of religious for their own subjects; others can be remitted only by the Apostolic See. They are pointed out and subsequently analyzed: the excommunication of one who sacrilegiously profanes the Consecrated Species (can. 1367); the excommunication of one who uses physical violence against the Roman Pontiff (can. 1370 § 1); the excommunication of a priest who absolves his own accomplice in sins against the VI Commandment (can. 1378 §1). This type of absolution not only incurs an excommunication for the priest who absolves; it is also intrinsically invalid (can. 977), except in the case of danger of death; the excommunication of a bishop who consecrates a bishop without a pontifical mandate. The bishop consecrated is also excommunicated (can. 1382); the excommunication for attempted sacred ordination of a woman and attempted reception of sacred orders by a woman; lastly, the excommunication of a confessor who directly violates the sacramental seal of confession (can. 1388). The author highlights that also the occult cases of irregularity, either for the reception of sacred orders or for their exercise, are dealt with in the internal forum. An irregularity is of its nature perpetual. It does not cease automatically but it can be dispensed. A simple impediment may cease automatically, e.g., a man’s wife dies, the impediment to ordination ceases. On the other hand, an impediment could be dispensed, e.g., when a married man is allowed ordination. The only irregularities or simple impediments now existing in the 1983 Code are those listed in the following canons. Irregularities which impede reception of orders: Amentia or other psychic illness (can. 1041, 1°); apostasy, heresy, or schism (can. 1041, 2°), attempted marriage (can. 1041, 3°); voluntary homicide or a completed abortion (can. 1041, 4°); self-mutilation or attempted suicide (can. 1041, 5°); act of orders reserved (can. 1041, 6°). Simple Impediments which impede the Reception of Orders: a man who has a wife (can. 1042, 1°); an office or administration forbidden to clerics (can. 1042, 2°); a neophyte (can. 1042, 3°). Lastly there are irregularities and impediments which affect those already in orders: orders received while being affected by an irregularity (can. 1044, §1, 1°); public apostasy, heresy or schism (can. 1044, §1, 2°); delict in can. 1041, nn. 3, 4, 5, 6; amentia or psychological infirmity (can. 1044, §2, 1°)
    W niniejszym artykule autor przedstawia kompetencje Penitencjarii Apostolskiej, obejmujące wszelkie kwestie, które mogą być rozwiązane na forum wewnętrznym i koncentruje się w sposób szczególny na znaczeniu i celowości cenzur oraz nieregularności w prawie kanonicznym. Wszystkie przypadki cenzur „latae sententiae” zaciągnięte „ipso facto” i nie będące przedmiotem wyroku sądowego, mogą być rozpatrywane na forum wewnętrznym . Niektóre z nich mogą zostać uchylone przez lokalnego ordynariusza lub przez wyższych  przełożonych zakonnych, inne podlegają wyłącznej kompetencji Stolicy Apostolskiej. Autor wymienia i szczegółowo analizuje kolejne z nich: profanacja postaci konsekrowanych (kan. 1367); naruszenie bezpośrednio tajemnicy sakramentalnej (kan. 1388, § 1); rozgrzeszenie wspólnika w grzechu przeciw szóstemu przykazaniu Dekalogu (kan. 1378, § 1) nieważne poza niebezpieczeństwem śmierci (kan. 977); stosowanie przymusu fizycznego wobec Biskupa Rzymskiego (kan. 1370); udzielenie i przyjęcie konsekracji biskupiej bez papieskiego mandatu (kan. 1382); usiłowanie udzielenia święceń kapłańskich kobiecie jak i usiłowanie ich przyjęcia przez kobietę (SST, art. 5, n. 1). Autor podkreśla, że również tajne nieprawidłowości, zarówno co do przyjęcia sakramentu święceń jak i co do ich sprawowania, rozpatrywane są na forum wewnętrznym. Nieprawidłowości mogą mieć jako swoje źródło fakt przestępstwa, nie są one jednak karami kanonicznymi. Jest to zakazem kanoniczny o charakterze stałym, który wyłącza z możliwości przyjęcia sakramentu święceń lub z godnego wypełniania święceń już przyjętych, o ile nie została udzielona uprzednio dyspensa kompetentnej władzy. Nieprawidłowość nie ustaje automatycznie, ale może być udzielona dyspensa. zwykła przeszkoda może się skończyć automatycznie, np. żona mężczyzny umiera i przeszkoda do święceń wygasa. Jedynymi nieprawidłowościami lub zwykłymi przeszkodami są te wymienione Kodeksie z 1983 r. w następujących kanonach. Nieprawidłowości do przyjęcia święceń: amencja lub inna choroba psychiczna (kan.1041, 1°); apostazja, herezja lub schizma (kan.1041, 2°), usiłowanie małżeństwa (kan. 1041, 3°); dobrowolne zabójstwo lub spędzenie płodu, gdy skutek nastąpił (kan. 1041, 4°); samookaleczenie lub próba samobójstwa (kan. 1041, 5°); akt święceń zarezerwowany (kan. 1041, 6°). Zwykłe przeszkody nie pozwalające przyjąć święceń: mężczyzna żonaty (kan. 1042, 1°); urząd lub zarząd zakazany duchownym (kan. 1042, 2°); neofita (kan. 1042, 3°). W końcu nieprawidłowości i zwykłe przeszkody do wykonywania święceń: nieprawne przyjęcie święceń przez osobę związaną nieprawidłowością (kan. 1044, §1, 1°); publiczna apostazja, herezja lub schizma (kan. 1044, §1, 2°); delikt o charakterze publicznym opisany w kan. 1041, nn. 3, 4, 5, 6; amencja lub inne upośledzenie psychiczne (kan. 1044, §2, 1°).

    W niniejszym opracowaniu Autor przedstawia modus operandi Penitencjarii Apostolskiej, Trybunału Kurii Rzymskiej, mającego kompetencje we wszystkim tym, co dotyczy forum wewnętrznego i udzielania odpustów, jako wyrazu miłosierdzia Bożego. W tym celu, po krótkim scharakteryzowaniu pojęcia forum wewnętrznego, tzn. ukrytego obszaru osobistych, duchowych relacji między Miłosiernym Bogiem a wiernym, penitentem, przedstawione zostały kompetencje Penitencjarii Apostolskiej w świetle opublikowanej w ostatnim czasie konstytucji apostolskiej Praedicate Evangelium papieża Franciszka, i następnie koncentruje się szczególnie na sześciu przestępstwach zarezerwowanych Stolicy Apostolskiej oraz na tym, jak powinien się zachować spowiednik wobec penitenta, który zaciągnął karę ekskomuniki latae sententiae. Po omówieniu sposobu postępowania Penitencjarii Apostolskiej w zakresie zwalniania z kar kościelnych, stosowna uwaga została poświęcona udzielaniu dyspens od nieprawidłowości i innych łask, odsyłając, w razie potrzeby pogłębienia wiedzy na ten temat, do publikacji podanych w załączonej do tekstu bibliografii.
    This contribution seeks to present the modus operandi of the Apostolic Penitentiary, the Tribunal of the Roman Curia that is responsible for everything relating to the internal forum and the granting of indulgences. To do this, reference is made first of all to the notion of the internal forum so as to then illustrate the responsibilities attributed to the Apostolic Penitentiary by the recent apostolic constitution Praedicate Evangelium of Pope Francis. Attention is then paid in particular to the delicts reserved to the Holy See and the way a confessor should behave towards a penitent who has incurred excommunication. Lastly, a reference is also made to the other responsibilities of the Apostolic Penitentiary relating to dispensation from irregularities and the granting of other graces, with references to the works indicated in the bibliography provided for further reading.
    Il contributo intende presentare il modus operandi della Penitenzieria Apostolica, il Tribunale della Curia Romana competente su tutto quanto riguarda il foro interno e la concessione delle indulgenze. Per fare ciò, si richiamerà anzitutto la nozione di foro interno, per illustrare poi le competenze attribuite alla Penitenzieria dalla recente costituzione apostolica Praedicate Evangelium di Papa Francesco. Ci si soffermerà, in particolare, sui sei delitti riservati alla Santa Sede e sul modo di comportarsi del confessore di fronte a un penitente che è incorso nella scomunica. Infine, si farà un cenno anche alle altre competenze della Penitenzieria riguardo la dispensa dalle irregolarità e alla concessione di altre grazie, rimandando alle opere indicate nella bibliografia per ulteriori approfondimenti.
