Opis:
Since it assumed competences in the area of security and defence, the EU has become a complete regional organization in the sense of the Chapter VIII of the UN Charter. This article explains the current situation, following the recognition of the EU’s special status by the United Nations and the entry into force of the Treaty of Lisbon. The future implementation of the mutual defence clause can improve the relevance of the European role as a security actor in the global framework of the UN and add a new task to its traditional peace-keeping, crisis management, and conflict prevention operations. In addition, the EU is an important political actor in the implementation of UN Security Council (UNSC) resolutions, especially those concerning the sanctions against individuals considered as belonging to terrorist organizations. By refusing the implementation of a UNSC resolution that fails to protect human rights, the EU can contribute to the evolution of the UN Charter legal order and be a political force to be reckoned with in the Security Council. The EU orientation, as reflected in its values, including respect for international law, can both reinforce the legitimacy of some UNSC resolutions and improve the credibility and specificity of the EU as an international actor.

The United Nations Convention on Contracts for the International Sale of Goods (the so-called Vienna Convention, CISG) is considered one of the most important and influential private law acts of the past decades. The most compelling evidence of the impact of the CISG is the European private law. It is especially evident in case of consumer sales law of the European Union. The Consumer Sales Directive (99/44) and, to some extent, even the Directive on Consumer Rights (2011/83/EC) were based on principles and institutions derived from the CISG. The most important influences are of course the objective liability of a debtor and the institution of conformity of the goods; however, even the basic terms (such as “conformity of goods” and “non-conformity of goods”) are defined per analogiam. And even though European legislator did not borrow from the CISG its’ concept of the fundamental breach of contract, the further cases of CISG’s impact are seen in cases of Nachfrist and remedies available to the parties of a contract. Since European consumer sales law is one of the most important spheres of EU interests and influences national civil law systems, CISG may easily be described as the model and backbone of future private law harmonization.

Opis:
The International Court of Justice (ICJ) is a principal judicial organ of the United Nations. The main task of ICJ is to settle disputes submitted to it by the states and is also entitled to give advisory opinions which are given on the motion of some United Nations organs and specialized agencies. The expression that ICJ is a “principal judicial organ of the United Nations” doesn’t mean that it is the only one judicial organ within the framework of the United Nations. The United Nations Administrative Tribunal (UNAT) was established by the legal force of the General Assembly resolution 351 A(IV) of 9 December 1949 r. The main purpose of the UNAT was to decide legal employment disputes between United Nations staff and the Organization. In 1955 the Statute of UNAT was amended and the Committee on Application for Review of Administrative Tribunal Judgement was competent to seek advisory opinion form ICJ and this opinion was binding. However Committee only in three cases requested the ICJ to give advisory opinion. Those opinions concerned inter alia the competence of ICJ to respond to the question, the right of Committee to submit such motion, the principle of equality of arms. In spite of that since of the 1st of July 2009 the new system of administration of internal justice was established – the United Nations Dispute Tribunal and the United Nations Appeal Tribunal, which consider the appeals against judgments rendered by the United Nations Dispute Tribunal, the issues discussed in advisory opinions of ICJ on the matters of appealing against a judicial decision of UNAT are still highly topical, especially in the context of the maintained in force competence of ICJ to review judgement of The Administrative Tribunal of the International Labour Organisation.
