    The subject of this article is identification of the structure of key issues related to the assessment of effectiveness of public procurement. These issues are generally discussed in two dimensions: (1) as a narrower question of the appropriate choice of evaluation criteria in individual orders, and (2) as a broader problem of assessing the effectiveness of the entire public procurement institutional systems. When it comes to evaluation criteria in individual orders, the subject of discussions are primarily two issues: (1.1) selection and proper definition of economic effectiveness criteria, and (1.2) the admissibility of non-economic criteria. The effectiveness of procurement systems as a whole may be assessed: (2.1) in a comparative manner, as one of alternative ways of delivery of public services, and (2.2) separately, for each individual system, related to its internal goals, functional and structural criteria.

    Opis:
    In the work there is a multi-criteria model of order size of materials used in production presented. It was assumed that the consumption size of each material is a random variable of known probability distribution. In the model with the purchase cost of materials ordered limited there were three criteria: order size, probability of lack of materials in the production process, deviations of order size from the consumption size in the past periods. It was shown on an example how to use the model for determining the order sizes for polyurethane adhesive and wood in one of the hard-coal mines.

    Opis:
    This article presents issues related to abnormally low tender price in terms of public procurement effectiveness. The problem tackled in this article concerns lack of a legal definition of the term 'abnormally low tender price', the difference between the 'abnormally low tender price' as understood in the Public Procurement Law and the 'dumping price' as understood in the Unfair Trade Practices Act. Another issue discussed in this article regards practical possibilities to reject an offer with an abnormally low tender price as a sign of an activity aiming to ensure the security of the executed investments and to increase the effectiveness of public spending.

    W interesie społecznym jest, aby jednostki sektora finansów publicznych ciągle poprawiały i podnosiły efektywność realizowanych zadań publicznych. Problematyka zamówień publicznych może być rozważana i badana w rozmaitych aspektach. Jednym z nich jest wpływ możliwości tworzenia konsorcjów w trybie przewidzianym przez Ustawę o zamówieniach publicznych na aktywizację sektora MŚP w obszarze rynku tychże zamówień. Celem artykułu jest przedstawienie miejsca konsorcjum w systemie zamówień publicznych.
    It is for the public interest that entities of the public finance sector constantly improve and raise the efficiency of public tasks performed. The issue of the public procurement may be considered and studied in various aspects. One of them is the impact of the possibility of the consortia formation according to the Act on Public Procurement towards SMEs elicitation within the market those procurements. The purpose of this article is to present the place of a consortium in the public procurement system.

    Podstawowym celem artykułu jest próba oceny roli klauzuli społecznej jako instrumentu rozwoju i wsparcia ekonomii społecznej. W artykule wykazano, że klauzule społeczne w zamówieniach publicznych mogą być ważnym i użytecznym narzędziem – odpowiednio wykorzystane stają się szansą dla wielu przedsiębiorstw społecznych. W celu dokonania oceny efektywności klauzul społecznych wykorzystano metodę analizy literatury przedmiotu oraz obowiązującego ustawodawstwa z zakresu zamówień publicznych – zwłaszcza istniejących rozwiązań prawnych dotyczących klauzul społecznych w obszarze ekonomii społecznej.
    The primary objective of this paper is an attempt to evaluate the role of the social clause as a tool for development and support of social economy. The article shows that the social clauses can be extremely important and useful tool in public procurement – used appropriately they become an opportunity for many social enterprises. The method used in assessment of the effectiveness of the clauses is the analysis of literature and existing legislation in the field of public procurement – in particular the existing legal solutions regarding the use of social clauses in the area of social economy.

    Wykorzystywanie narzędzi informatycznych przy czynnościach związanych z planowaniem i ogólnym zarządzaniem zamówieniami publicznymi podnosi skuteczność zamówień publicznych. Mogą być one realizowane skutecznie pod warunkiem, że proces przeprowadzania zamówień w danej jednostce będzie zaplanowany optymalnie dla jej potrzeb, pracownicy będą posiadali odpowiednie kompetencje i uprawnienia adekwatne do zakresu realizowanych przez nich zadań, a przy ich realizacji będą korzystali z systemów informatycznych dostosowanych do potrzeb jednostki. Urzędy centralne powinny rozważyć wypracowanie wspólnych procedur udzielania zamówień i narzędzi informatycznych dla podległych jednostek, które realizują te same zadania.
    Using IT tools with activities related to the planning and overall management of the procurement process in public administration increases the efficiency of public procurement. Central government offices should consider developing joint procurement procedures and IT tools for subordinate offices.

    The paper presents the issues the public sector demand for rail freight services in Poland. Tenders have been characterized in terms of: the type of load, the size of the re-quests in the volume of transport work and the results of tender procedures. The article contains an analysis of the share of the transport volume purchased in auctions. As a result, it was found that it may play important role in shaping the behavior of market actors on highly concentrated freight transport market.

    The paper presents a conversion process of public contracts notices from XML files to RDF triples. The linked data approach has several advantages over classical databases: navigation between data, and enrichment of possessed datasets by linking to external information. It allows new application areas for enterprise like semantic search for offers and precise matching of tenders to interested contractors. Specific vocabulary has also been developed to make integration possible.

    The subject of this report is effectiveness in the process of management of public funds. The analysis covers the process of purchasing of specialist medical equipment by entities providing therapeutic services. The report takes into account introduction into the issue of public procurement transactions and a short description of the market of medical equipment with reference to associated legal acts. In accordance with the thesis of this report, the level of effectiveness in carrying out of public procurement contracts depends on the purchasing process that should be consistent with and adequate to the ordered product, and results from appropriate making use of all institutions provided by the Public Procurement Law and also from rational decisions made by the ordering institution in the public procurement awarding procedure. Expedient and economical expenditure of public funds, aimed at achieving the maximum utility (best effects and profits for the user), has a direct effect upon country's economy and influences its economic processes. Application of the Public Procurement Law must be associated with rational actions made by the ordering institution during the procedure, making use of all available institutions specified in the Law, and with abidance by the requirements of the purchasing process which should be adapted to the subject of the order. This report presents a purchasing process model for medical equipment and provides examples of incorrect actions by ordering institutions, with results of public procurement awarding procedures regarding specialist medical equipment purchases in the years 2009-2010. Taking into account the data collected in the sector of specialist medical equipment, only the purchasing process, which combines in itself the financial, organizational, ethical, legal and clinical aspects, may be regarded as effective, making use of the purchasing model which is appropriate for a given equipment. Provisions of legal acts are not the goal in itself but must be coordinated with the rational decisions of the orderer so that equal and fair competition between potential contractors may be achieved.

    Klauzule społeczne stanowią wyjątek od ogólnych zasad zamówień publicznych - umożliwiają stosowanie dodatkowych kryteriów wyboru wykonawcy z uwagi na istotne cele społeczne. Artykuł wyjaśnia, jakie są podstawy stosowania klauzul społecznych, na czym one polegają, opisuje polskie rozwiązania w tym zakresie oraz dotychczasowe doświadczenia we wdrażaniu tych rozwiązań. Identyfikuje także bariery w upowszechnianiu stosowania klauzul społecznych w Polsce. Ponadto wskazuje, jakim celom może służyć stosowanie klauzul społecznych i jak je można wykorzystać jako instrument rozwoju przedsiębiorczości społecznej. Określa wreszcie kluczowe warunki, które są niezbędne do tego, aby był to instrument skuteczny. (abstrakt oryginalny)
    The social provisions are an exception from comprehensive procedures in public tenders - they enable the use of extra criteria in selection of contractor, considering crucial social objectives. Those objectives include first of all increase and maintain the level of employment of people who meet difficulties in finding job as well as creating employees-friendly work environment. The article explains the fundaments of the use of social provisions, how they work, describes Polish practice in their use and hitherto experience in the introduction. It also indentifies the barriers dissemination of social provisions and how they can be used as an instrument of social entrepreneurship development. Finally it specifies key conditions necessary to make those instruments effective. (original abstract)

    Klauzule społeczne w zamówieniach publicznych to instrument, dzięki któremu zamawiający może w prowadzonym przez siebie postępowaniu o udzielenie zamówienia publicznego uwzględnić dodatkowe cele społeczne, obejmujące przede wszystkim zatrudnienie i warunki pracy pracowników zaangażowanych w wykonanie zamówienia. W pierwszej części artykułu przedstawiono defi nicję klauzul społecznych w zamówieniach publicznych. Druga i trzecia część zostały poświęcone unijnym i polskim przepisom prawnym w zakresie klauzul społecznych w zamówieniach publicznych, a także zamówieniom zastrzeżonym. Następnie wskazano na sposób, w jaki klauzule społeczne powinny być formułowane w postępowaniu o udzielenie zamówienia publicznego. Ponadto w artykule, w jego ostatniej części, podjęto próbę oceny wpływu klauzul społecznych na podmioty ekonomii społecznej, podkreślając przede wszystkim fakt, że odpowiednio sformułowane w dokumentacji przetargowej klauzule społeczne są szansą dla przedsiębiorstw zatrudniających osoby mające problemy z integracją społeczną i zawodową. Wskazano także bariery dotyczące stosowania klauzul społecznych - zarówno od strony zamawiających, jak i podmiotów ekonomii społecznej. (abstrakt oryginalny)
    The social clauses in public procurement are the instrument through which the contracting authority may include in the public award procedures additional social goals focusing on the employment and working conditions of employees engaged in the performance of public contracts. In the first part of article has been presented the definition of social clauses in public procurement. Second and third parts have been devoted to the presentation of the EU and Polish legal framework for social clauses in public procurement and additionally also the reserved public procurement. Then in the article has been pointed the way in which social clauses should be formulated in the public procurement award procedures. Furthermore, the article in its fi nal part, attempts to assess the impact of social clauses for the social economy entities by showing fi rst of all that the social clauses properly formed in the tender documents are a chance for enterprises employing people who have problems with social and professional integration. Addition the barriers to the use of social clauses from both the side of contracting authorities as well as social economy entities have been also identified. (original abstract)

    The use of CSR instruments in the public procurement sector has dramatically increased in the recent years. Nevertheless, a certain level of ambiguity raised questions on their juridical nature and actual impact. This study tries to answer these questions by focusing on two recently implemented measures aimed at making investments delivered through public procurement sustainable from an anti-corruptive perspective: integrity pacts and the legality rating for enterprises. Their impact, possible problems of legitimacy and relation with CSR have been analysed through a review of Italian and European Jurisprudence, legislation, literature and official data.
    Niniejszy artykuł koncentruje się na dwóch ostatnio wdrożonych instrumentach, których celem jest zapewnienie zrównoważenia inwestycji realizowanych w ramach zamówień publicznych w perspektywie antykorupcyjnej: pakty uczciwości oraz ocena legalności dla przedsiębiorstw. Duży nacisk kładzie się na korzyści zsynchronizowanego podejścia w realizacji celów społecznie zrównoważonych, realizując aktywny wkład podmiotów prywatnych poprzez zachęcanie do polityk CSR i narzędzi kontraktowych. W tym kontekście zwrócono uwagę na kluczową rolę zamówień publicznych w realizacji zrównoważonej polityki pod względem społecznym. Przeglądowi poddano orzecznictwo włoskie i europejskie, ustawodawstwo oraz literaturę wraz z niektórymi oficjalnymi danymi.
