The aim of this paper is to discuss blended projects, i.e. project which combine public‑private partnership with EU funds. The author addresses the main challenges and gives some recommendations for the next EU financial perspective. The first section provides an overview of financial instruments suitable for blended projects. The second section of the article covers various types of such projects. Next, the author discusses projects which were completed in Poland between 2007 and 2013. Special attention is given to the Polish and European Union regulations designed to support the development of blended project model. The final section assesses barriers for the development of blended projects and highlights their importance in the context of 2014–2020 financial perspective.

The aim of this article is to suggest an explanatory set of factors to the popularity of gated housing in the Polish context. The explanation focuses on the divide between the public and the private sphere and encompasses economic, cultural and institutional explanations to the gating phenomenon. The empirical material consists of interviews, discourse analysis, a questionnaire, official reports and data, and legal regulation analysis. The Polish example display that both the remnants from the past and the contemporary ideals can be derived from the public-private divide. This divide has played a central role in the negotiations on urban space, the role of housing, and the identities and activities connected to housing and spatial issues since 1989. It is argued that the introduction of market economy followed by socioeconomic inequalities, has resulted in specific forms of creative strategies for individual actions among Poles and to the popularity of gated housing.

The paper analyzes the changing public-private dynamics in higher education in Poland in 1990-2016 and beyond, focusing on the processes of internal and external de-privatization of the system. De-privatization of higher education – viewed also as its republicization – is caused by declining demographics and may lead to the demise of the largely demand-absorbing private higher education. Poland is shown as moving against the two powerful global trends related to privatization: private sector growth and increasing reliance on cost-sharing. Data related to funding and provision in 1990-2005 (expansion) and 2006 and beyond (contraction) are analyzed in detail, and policy implications of ongoing and expected changes are discussed.

There is a widespread and increasing interest in public-private partnership (PPP) in Poland as a mean of implementing public investment projects, resulting from the fact that the funds that are available to local governments, or EU funding, are not sufficient to meet all the investment needs. In the paper a comparative analysis of the size and structure of the public-private partnerships in the EU countries, with a particular focus on the Polish market is presented. Possibilities of investments based on public-private partnerships on rural areas are specified. The paper examines the recent trends in the PPP's market and describes how these changes and development may affect the infrastructural improvement on rural areas.

The article looks at public‑private partnership as an instruments of financing research, development and innovation projects (R&D&I) in Poland. The author introduces the case of the National Centre for Research and Development (NCRD), a governmental executive agency set up to fund applied research. The paper begins with presenting the rationale for changes in the structure of R&D&I funding by increasing the private expenditures, as it can result in a more innovative economy. The aim of this article is to introduce non‑budgetary methods of financing public investments. The author bases her insights on professional experience from Poznań City Hall. In the first section the alternative forms of funding and implementation for public services are discussed. Next, the author presents the approach which was adopted by the city of Poznań regarding public‑private partnership projects. The examples of municipal investments implemented in Poznań within the public‑private partnership formula, such as Thermal Recycling Facility for Municipal Waste are given. The author also discusses legal basis, financial schemes and identifies challenges to such investments.

The article reviews judgments of Polish courts on private enforcement of competition law between 1993 and 2012. A quantitative analysis of this jurisprudence shows that very few cases of that type exist at all. Their qualitative characteristics illustrate that: none of them referred to consumers; none of the claims was a 'pure' damage claim; all of these cases focused on partial or general nullity of contracts concluded as a result of an anticompetitive practice; almost all of them concerned an abuse of a dominant position; only one referred to competition-restricting agreements. The relevant jurisprudence largely focused on the binding force of a prior decision of the Polish competition body upon civil courts. Even if the fact that some cases of this type were at all record might suggest that there is a potential for developing private enforcement of antitrust in Poland, nothing like this actually happened. Unfortunately, the Act on Collective Redress (in force since July 2010) has not contributed to a growth in the number of consumers (or any other entities) engaging in court disputes with undertakings restricting competition.
L’article passe en revue les jugements des tribunaux polonais sur l’application privée du droit de la concurrence entre 1993 et 2012. Une analyse quantitative de cette jurisprudence montre que très peu de cas de ce type existent. Leurs caractéristiques qualitatives montrent que : aucun d’entre eux ne concernait les consommateurs ; aucune des revendications ne constituait une demande d’indemnisation dans le sense exacte ; tous ces cas axaient sur la nullité partielle ou générale des contrats conclus à la suite d‘une pratique anticoncurrentielle ; la quasi-totalité d’entre eux concernaient un abus de position dominante ; une seule visait aux accords restreignant la concurrence. La jurisprudence se concentrait surtout sur la force contraignante d’une décision préalable de l’organe polonais de la concurrence prise par des tribunaux civils. Même si le fait que certains cas de ce type-là étaient notés, il pourrait suggérer qu’il existe un potentiel de développement de l’application privée de la concurrence en Pologne – rien que cela ne s’est réellement passé. Malheureusement, la Loi sur les recours collectif (en vigueur depuis juillet 2010) n’a pas contribué à une augmentation du nombre de consommateurs (ou d’autres entités) s’engageant dans des litiges judiciaires avec les entreprises qui restreignent la concurrence.

The aim of the article is to present the method and results obtained by the SURE-Farm project in the process of evaluating the Polish horticulture farming system through the prism of the importance and performance of private and public functions delivered by it. Based on the FoPIASure-Farm method, analysis proceeds with an evaluation of the importance and performance of functions delivered by the farming system. According to the method, four private and four public functions were assessed, while respondents included farmers, state and local authorities, as well as other actors relevant for the development of agriculture. Stakeholder opinions reveal price levels and income as being the most important indicators for the assessment of private functions delivered by the horticulture farming system in Poland, yet assess their performance as lower than average, with a tendency for being poor. Public functions of the farming system, on the contrary, are perceived by stakeholders as less important, yet satisfaction from their delivery is greater compared to private functions.
Celem artykułu jest przedstawienie metody i wyników uzyskanych w ramach projektu SURE-Farm w procesie oceny polskiego systemu ogrodnictwa, przez pryzmat znaczenia i realizacji pełnionych przez niego funkcji dostarczania dóbr prywatnych i publicznych. Wykorzystując metodę FoPIA-Sure-Farm dokonano oceny znaczenia funkcji realizowanych przez system rolniczy oraz próbę oceny efektów wypełnianych funkcji. Zgodnie z metodą oceniono cztery prywatne i cztery publiczne funkcje, a wśród respondentów znaleźli się rolnicy, przedstawiciele władz państwowych i lokalnych, a także inne osoby odgrywające pewne role w rozwoju rolnictwa. Badania opinii interesariuszy ujawniły, że poziom cen i dochody postrzegane są jako najważniejsze wyznaczniki w dostarczaniu dóbr prywatnych przez system rolnictwa ogrodniczego w Polsce. Równocześnie interesariusze oceniali realizację funkcji przez polski system, jako niższą niż przeciętna, z tendencją do oceny niskiej. Należy zaznaczyć, że funkcje publiczne systemu rolniczego było postrzegane przez interesariuszy jako mniej istotne, lecz zadowolenie z uzyskiwanych efektów z ich realizacji było wyższe niż w przypadku funkcji prywatnych.
