In September 1819, Prussian War Minister Hermann von Boyen received a letter regarding the situation in the Kingdom of Poland. It was written by General Ludwig Gustav von Thile I, who conducted a factual analysis of the key elements of Poland’s military potential. The letter constitutes crucial evidence of the distrust that marked Polish-Prussian relations marked by distrust after 1815. The text studies Berlin’s perception of the Polish lands from a political and military perspective. It also confirms that foreign countries perceived the negative aspects of the policy pursued by Grand Duke Constantine.

From the start of his reign, Władysław Jagiełło he strove to normalize relations with the Silesian dukes, vassals of the Czech Crown, and neighbors of the Kingdom of Poland. These plans were initially disrupted by the war with Władysław Opolczyk and his nephews (1391–1396), but after it ended, relations were correct for the next two decades. Jagiełło’s wise policy towards the Silesian dukes also included his matrimonial policy, arranging marriages with representatives of the Giedyminowicz family. In the mid‑1420s, all the bordering Upper Silesian principalities were ruled by relatives of the Polish king. Despite this, the dukes of Upper Silesia remained faithful to their Czech rulers. When the Hussite Revolution broke out in Bohemia in 1419, the Silesian dukes supported Sigismund of Luxemburg, the successor of Wenceslas IV. At the same time, however, they tried to maintain proper relations with the Polish King Władysław Jagiełło, permitting – like the princes of Racibórz, Cieszyn, and Oświęcim – the Hussite legations to pass through their territories on the way to Poland and Lithuania with the offer of the crown of St. Wenceslas. The situation changed when, in September 1421 in Racibórz, Jan II Żelazny (who was married to Jagiełło’s niece Helena) imprisoned the Hussite legation sent by the Czech parliament. Despite pleas and threats from the Polish and Lithuanian sides demanding their release, the Duke of Racibórz, under great pressure, handed over the envoys to King Zygmunt. Consequently, the Silesian dukes, fearing for their principalities (at the hands of the Hussites and Poland), became closely associated with Sigismund of Luxemburg and became his allies in the conflict with Jagiełło and Witold. The culmination of these activities was that the Silesian dukes, at the beginning of 1423, joined a pact against Poland, the aim of which was its partition. However, when Sigismund of Luxemburg abruptly changed his policy and, in March 1423 in Kieżmark, concluded a treaty of friendship with King Jagiełło, the Silesian dukes realized that they had made a mistake by trusting their ruler excessively and adopting anti‑Polish rhetoric. So they took rapid steps to restore the former correct relations, apologizing to King Jagiełło and the Kingdom of Poland for their actions, a move that proved successful.

One tragic consequence of it was the increase in the number of children without parental protection, juvenile beggars, tramps, young criminals and prostitutes. During the last thirty years of the 19th century it became a priority in the Kingdom of Poland to pay attention to the education and protection of children and teenagers from the poorest families. Numerous innovative and educational concepts were formulated at that time; some of them were used in centres for socially maladjusted young people, for instance in Studzieniec, Mariańska Wilderness or Struga, in centres for young prostitutes. The activity of educational centres and societies which organised the protection of children (for example, The National Society for the Prevention of Cruelty to Children) was given as an example.

Artykuł dotyczy ograniczenia uprawnień duchownych katolickich w pracach kodyfikacyjnych w Królestwie Kongresowym. Zgodnie z prawem kanonicznym, które w znacznym zakresie było respektowane przez sądy Rzeczypospolitej Obojga Narodów, zakonnicy i zakonnice mieli poważnie ograniczone uprawnienia w zakresie prawa spadkowego (co do możliwości spadkobrania czy sporządzenia testamentu). Wobec w pełni wyznaniowego charakteru prawa małżeńskiego osoby zobowiązane do celibatu nie mogły też rzecz jasna zawrzeć małżeństwa. Reguły te pozostały w znacznym stopniu w mocy po zaprowadzeniu na dawne ziemie koronne praw pruskich i austro-galicyjskich. Z kolei Kodeks Napoleona, któremu nadano moc obowiązującą w Księstwie Warszawskim, nie znał ograniczeń duchownych ani w zakresie prawa spadkowego, ani co do możliwości zawierania małżeństw. Po przejęciu kontroli nad centralnymi ziemiami polskimi przez Aleksandra I oczywistą była potrzeba reformy prawa cywilnego. Jej zakres i zasady jednak budziły kontrowersje. Poza dyskusją pozostawało wyłączenie możliwości zawierania małżeństw przez duchownych katolickich, lecz zakres ewentualnego ograniczenia zdolności prawnej oraz zdolności do czynności prawnych zakonników i zakonnic był przedmiotem sporów. Tarcia w powołanej po obradach Sejmu w 1820 r. deputacji prawodawczej były tak wielkie, że konieczne okazało się rozstrzygnięcie tej kwestii przez samego cara. Opinia monarchy wychyliła się wówczas w stronę klerykalną, czego skutkiem było ograniczenie praw cywilnych zakonników i zakonnic przez art. 10 Kodeksu Cywilnego Królestwa Polskiego. Pełniejszy niż dotychczas opis tych kontrowersji był możliwy dzięki uwzględnieniu niewykorzystywanych dotychczas przez polskich badaczy materiałów przechowywanych w jednym z moskiewskich archiwów.
The article focuses on the limitations of the legal capacity of the clergy in the codification work during the era of the Congress Kingdom of Poland. According to canon law, which was largely respected by the courts of the Polish-Lithuanian Commonwealth, the rights of monks and nuns were severely limited in matters related to succession (in particular, as far as inheritance or wills are concerned). Moreover, in light of the fully religious nature of marriage law, persons obliged to celibacy could not, as a matter of course, enter into a marital relationship. Austrian and Prussian lawmakers respected many of the ecclesiastical rules which regulated the status of the clergy. On the other hand, the Napoleonic Code did not place any limitations on the clergy in the realm of inheritance or marriage law. In 1807, the Duchy of Warsaw was established from the Polish lands seized by Prussia where Landrecht of 1794 was in force. In 1809, some lands occupied by Austria were incorporated into the Duchy of Warsaw. The civil code of Western Galicia (a precursor of Allgemeines Bürgerliches Gesetzbuch) was binding within these territories. Soon afterwards, the Napoleonic Code was introduced into both parts of the Duchy. During the Congress of Vienna it was decided that a major part of the Duchy would be transformed into the Kingdom of Poland under Russian control. It was obvious that Emperor Alexander I would reform the secular Napoleonic law of the Kingdom of Poland. While the prohibition of concluding marriages by the Catholic clergy was not questioned, the scope of potential limitations of the legal capacity of monks and nuns was the subject of much debate. The members of the Codification Commission could not come to an agreement whether to change or preserve the French regulations. Finally, Alexander I ordered to introduce them into the Civil Code of the Kingdom of Poland. The article gives a fresh view on the debate as it is based on the analysis of recently discovered materials from one of the Moscow archives.

The discussion article provides an analysis of a book recently published by Wojciech Krawczuk entitled Records and Regesta of the German Expedition of the Royal Swedish Chancery of King Sigismund III of the Years 1597–1600. The book contains a source edition of the minutes of the royal chancery of Sigismund III Vasa, King of Poland, Grand Duke of Lithuania (1587–1632), and King of Sweden (he retained power in 1592–1599), written around 1600, which has been supplemented by extensive regesta prepared by the editor. This discussion article evaluates this form of providing access to the contents of primary sources against the background of similar source editions consisting of records created by other royal chanceries, namely the chancery of the Kingdom of Poland, the chancery of the Grand Duchy of Lithuania and the chancery of the dukes of Mazovia. It is noteworthy that increasingly more archival materials are made available online through the websites of various archives and other institutions that preserve historical documents. In view of the growing trend to digitalize primary sources and make them available online, the idea of publishing complete source editions including full source texts, which began at the beginning of the twentieth century, seems unjustified nowadays. Currently, the solution proposed by Wojciech Krawczuk, based on the publication of regesta, appears to be the most favourable. Perhaps it would be appropriate to link the published regesta even more closely to the digitized archival materials by providing each one of them with a link or QR code that would refer to the website hosting the relevant digitalized source. The content of the documents included in the reviewed book differs significantly from the content of the records created by the chanceries of the Kingdom of Poland and the Grand Duchy of Lithuania. Swedish documents are dominated by current affairs, primarily concerning military and diplomatic issues, and include much fewer normative acts, such as appointments to offices and bestowals of landed property.

The article presents the legal underpinnings of the operation of municipal credit societies in the Kingdom of Poland, which were institutions providing municipal mortgage loans. This is presented using the example of the Lublin Land Credit Society, and the author draws general conclusions about the model of mortgage loan offered by loan societies. At that time, the credit society was the most popular organisational model used with mortgage loans, not only in towns (municipal credit societies) but also in the countryside (land credit societies). Furthermore, when seeking the origins of mortgage banking, the author presents other institutions granting long-term loans in the Polish territories, apart from credit societies. This analysis, with its legal and historical perspective, is considered by the author to be a contribution to discussion on mortgage loan and the place of contemporary mortgage banking in Poland.

Lack of a universal pension system in the Kingdom of Poland in the late 19th and the early 20th centuries was one of the factors contributing to the difficult situation of the elderly from non-elite social strata, particularly in the face of insufficient support of the families. The homeless, who often also suffered from diseases, were crippled and begged, found themselves in a particularly difficult situation, men and women alike. Organising institutional social protection and medical care for this group required instant action. The priority was to establish homes for old people and various types of residential homes. This was primarily handled by charities for which medical care and welfare of the elderly were among the most important areas of activity. Old people’s homes were also established by religious communities and individualsas well as institutions operating on a self-help basis.

The lifetime of the Kingdom of Poland – a state connected with the Russian Empire by a union – has not been unequivocally assessed in Polish historiography. On the one hand, the Kingdom had its own army, administration and a very liberal constitution, and had quickly achieved economic prosperity. On the other hand, within a few years of its creation, there occurred the fi rst violations of the Constitution and the persecutions of those who opposed these infringements. A significant event was the revolt of the Cadets of 29 November 1830, which turned into a uprising, today referred to as the November Uprising. This article is the analysis of the legal aspects of the Polish-Russian union created in 1815. It is then compared with the Union of Lublin and the drafts of planned unions between the Polish-Lithuanian Commonwealth and the Tsardom of Russia in the 16th and 17th centuries. The circumstances which led to the creation of the Kingdom of Poland and its union with the Russian Empire, as well as the earlier attempts to create one state of the Polish-Lithuanian Commonwealth and the Russian Empire, as well as the principles of a union of the Crown of the Kingdom of Poland and the Grand Duchy of Lithuania are presented. The principles upon which these unions were to be based are subsequently compared and analysed. A particular emphasis has been placed on the issues related to the international legal status of the Kingdom of Poland. In this context questions such as: the treaty-making power and jus legationis have also been asked. Another important issue discussed in the paper is also the role of the king in matters concerning foreign policy and a possible role of Russia in these matters. The results of this analysis allow to formulate a more objective assessment of the period of the Kingdom of Poland, focusing on its legal status and position, and in particular on the relation with the Russian Empire.

In the years 2020–2021, Łódź and other surrounding cities will celebrate the 200th anniversary of the decisions made by the authorities of the Kingdom of Poland, aimed at the industrialization of this part of Polish territory. Some of these urban centers, such as Lodz, have been successful, while most of them have not been able to develop industrially. Witold Kula, an excellent researcher of socio-economic history, wrote about these issues. So far this work has not been published and thanks to the help of prof. Marcin Kula, the author’s son, was published in a journal. Kula decided to analyze the economic and social condition of the cities located within the Łódźand Łęczyca poviats (according to the administrative status of 1921). Therefore, he was interested in the area subjected to industrialization and protection policy by the authorities of the Kingdom of Poland under the Act of Governor Józef Zajączek of 1820. The author was looking for an answer to the fundamental question which of the cities located in this area were also in the legal sense and in economic terms, and which and from an economic point of view, they did not differ from the status of a village? The conclusions and reflections contained in the work cover a long chronological period, starting from 1807 and ending with 1869, i.e. from the moment of placing Polish cities under the administration of a modern bureaucratic national magistracy, to the year in which the tsarist decree was issued to rename some settlements. cities in the governorates of the Kingdom of Poland. The subject of this work were 13 cities, namely: Grabów, Kazimierz (Łęczycki), Łęczyca, Łódź, Parzęczew, Piątek, Rzgów, Tuszyn and Zgierz, and the cities elevated to the rank of cities during the Congress Kingdom: Ozorków (1816), Aleksandrów and Poddębice (1822), Konstantynów (1830). After the reform of 1869–1870, only four of them remained towns: Łęczyca, Łódź, Ozorków and Zgierz. In implementing the theme, W. Kula assumed the following stages: “1. Overview of the basic and existing definitions of the term «city»; 2. on this basis, determining the basic economic and demographic characteristics of the city, and thus the qualification criteria of the city; 3. establishing the facts corresponding to the successful qualification criteria in individual cities in a particular period of time”. The author did not intend to issue “a firm sentence on each of the examined cities, granting or denying it the right to the” title “of the city in the economic sense. More important for him was to “establish the actual state of affairs corresponding to individual criteria, the state which, using these criteria, will sometimes lead us to various conclusions”. The work of W. Kula was based on a variety of source material, primarily the resources of the then pre-war archives, which were partially lost as a result of the tragic consequences of the Second World War. Hence, this monograph is also extremely important because it provides contemporary researchers with invaluable source material for further analyzes of the history of the cities of the Łódź region. More than a hundred tables included in the work by W. Kula with various and valuable statistical data will help in this. The monograph published in print consists of an extensive part called Introduction, divided into two chapters, the first of which is entitled Issue, and the second - Sources and studies, and two parts. The first part is entitled The economic content of the term “city” and is also divided into the following two chapters: Existing definitions of the term “city” and Eligibility criteria for urban settlements. On the other hand, the second, entitled Socio-economic character of cities in the Łęczyca and Łódź poviats, is the main part of the monograph with a source analysis of 13 cities and towns under consideration. It opens with Introductory remarks, followed by an alphabetical list of the aforementioned urban centers in terms of economic and social aspects in the following 13 sections. The work is supplemented by a bibliographic list and a list of abbreviations. The editors of the journal made only minor interference in the work by correcting typos and the so-called Czech errors, as well as by modernizing the spelling and the scientific apparatus of the monograph (in the notation of footnotes and bibliographic items), e.g. by supplementing some items, introducing currently used abbreviations, etc. Moreover, the bibliographic list that opened the work in the manuscript was moved to its end. However, no linguistic and stylistic corrections were made to reflect the character of the writing style and the way of expressing thoughts as accurately as possible by W. Kula, then a young adept of the historical guild.

Artykuł przedstawia problematykę przepraw mostowych łączących Królestwo Polskie z Cesarstwem Rosyjskim do połowy XIX wieku w trzech głównych punktach: w Aleksocie, w Terespolu oraz Żółtkach. Analizie poddano odmienne uwarunkowania funkcjonowania tych przepraw mostowych, w tym o charakterze chronologicznym, oraz zwrócono uwagę na prawidłowość w ich zarządzie. Powtarzającym się zjawiskiem okazywało się bowiem sukcesywne dążenie władz rosyjskich, szczególnie od okresu Wiosny Ludów, do przejęcia mostów granicznych z rąk polskich i podporządkowania ich imperialnej władzy wojskowej bądź cywilnej.
This article deals with the issues of borde bridges connecting till the mid of 19th century Kingdom of Poland and tzarist Russian Empire in three main points: Aleksota, Terespol and Źółtki towns. The different aspects of functioning of these bridges were analyzed, including a chronological view of the phenomenon; as well one drew attention to visible and clear tendency in their management. A repeated idea tended to occcur as - especially since the period of “Spring of Nations” - one could observe among Russian authorities kind of steady desire to take full controll over Polish- Russian border bridges from Polish hands and make them subject to the imperial rule of military or civilian origin only.

Artykuł analizuje drogowe ustawodawstwo porządkowe w Królestwie Polskim okresu 1815-1830. Przedstawiono tu generalny opis zasad charakterystyki, ochrony i kontroli polskiego systemu drogowego omawianego czasu. Deskrypcja ta dotyczy ogólnego zarysu prawnego w zakresie generalnych przepisów porządkowych na drogach oraz wielu zagadnień szczegółowych. Wśród tych ostatnich można wymienić: ubiór służby kontrolnej, zasady ruchu zwierząt i ludzi, kwestie wyszynku dla entreprenerów drogowych.
The article analyzes law enforcement legislation in force on the roads of Kingdom of Poland in the period between 1815 and 1830. The general description of these regulations was mostly concerning characterics, protection and control processes of Polish road system of that time. Aditionally the research was focusing on the outline of law in terms of general police of road regulations as well as a number of specific issues. Among the latter are: inspection staff clothing, rules related to animal and human traffic; liquor licenses for road entrepreneurs.
