Opis:
The article examines the legal consequences of Protocol (No 30) on the application of the Charter of Fundamental Rights of the European Union to Poland and to the United Kingdom. The author notes that the Charter does not merely confirm the fundamental rights previously recognized in EU law, but also introduces new ones. In the light of this statement it is proposed, that – according to article 1(1) of the Protocol – the Charter does not extend the ability of given courts to examine the compliance of laws and practices of Poland and the UK with the Charter, as far as it introduces these new rights. Article 1(2) of the Protocol excludes the possibility of litigation based on provisions of title IV of the Charter. Article 2 of the Protocol aims at preventing the EU from imposing changes of national laws and practices in certain areas. In the light of provisions of the Charter (particularly article 52(6)) it is however doubtful, whether article 2 constitutes any genuine modification of legal obligations. Finally, the author notes, that according to the predominant view it would be theoretically possible for the Court of Justice of the EU to diminish or even deprive the Protocol of actual practical consequences by making use of general principles of EU law. This however might be regarded as a circumvention of primary EU law and as such deserves negative opinion.

Opis:
In the article below the authors analyse the political, social and legal revaluations of human rights relating to non-heteronormative men in Germany, from the rise of the German Empire (Zweites Reich) till contemporary times. What is important is not only a change in the mentality of the German society throughout the last hundred years, but also the fact that the legal system of the Federal Republic of Germany (Deutsche Bundesrepublik, BRD) was using a provision that had been created during the Nazi dictatorship and applied it to its own citizens. The authors of this article demonstrate that the social changes in the BRD in the second half of the 20th century were much faster than the amendment of the legal system; what is more, the BRD has not faced its Nazi past, failing to atone to homosexual men who had been persecuted on the basis of a Nazi legal provision, inherited and applied by a democratic state.

Opis:
The article “Status of women in the Republic of Turkey” examines the issueof an ambiguous predicament of feminine part of the society in one of the European Union’s candidate countries. The objective of the article is to attempt to answer the following question: what are the reasons of social acceptance for violating women’s rights in Turkey? In order to examine the issue, this paper describes and compares legal status (past and present) concerning Turkish women and the instances of abusing their rights. Big contrast shown between them raises other questions. In the end all reflections lead to conclusion that patriarchal heritage and Kemalism’s inadvertences are the two main reasons responsible for current predicament of Turkish women. The whole article refers to the efforts of Turkey to become an EU member, as it plays a significant role there in the process of law modernisation.

Human rights are one of the main European policy horizons, and also the basic pillar of the social and moral order in contemporary world. This does not change the fact that specific and complex narrative of human rights provokes important controversies, as well as open criticism. In the present article we indicate the main thrust of these doubts and objections. Three distinguished fi gures of this criticism we describe as cultural, epistemological and political. Each of them has its numerous representatives, but we introduce only few of them. They are Charles Taylor, Richard Rorty and Pierre Manent. What strikes us in this debate is the fact that it focuses most of the major dilemmas associated with the European integration project. The disagreements about human rights refl ects indeed the debate over the future shape of Europe.

The amendment of the above mentioned Act results from the implementation of the provisions of five directives of the European Communities into the Polish legal order. Nevertheless, the author points out that the proposed amendment goes beyond the limits specified by EU law, reducing both the autonomy of private entities and constitutional freedom of contracts. He refers to the defective wording of the provisions specifying the substantive scope of the Act, at the same time supporting the proposal for the extension of the scope of claims that can be brought by persons harmed by unequal treatment and provisions modifying the rules for application of statute of limitation of claims.

Opis:
This article deals with the legal processing of a serious problem regarding societal security, human rights and the rights of minors, i.e. child abduction. The procedure of the returning of an abducted child is one of the most challenging types of court proceedings. Courts decide within the statutory time limit of six weeks after filing the petition. There is a foreign element in the proceedings, embodied either by the parties to the proceedings or by the necessity of clarifying the child’s habitual residence. Translators or interpreters are recruited to guarantee the parties’ right to act in their mother tongues. The court, as a rule, executes and orders expert evidence within a short period of time, for example to determine the circumstances that rule out the return of the minor to his/her country. As a rule, hearings take place all day or several days in a row. Courts apply international treaties and EU law when making decisions. The difficulty of bringing proceedings is additionally increased by frequent requests from the court hearing the authorities of the Member State of the habitual residence of the minor. The return of the child is usually accompanied by tensions between the parties, emotions and stress.

Opis:
The modern definition and catalogue of human rights were formalized after the World War II. One of the legal documents is Universal Declaration of Human Rights of 1948 which states that all people are free and equal under the law, dignity and rights regardless a race, color, sex, language, religion, political and other views, nationality, social status and so on. All economic, social and cultural rights are also protected. An economic growth and common globalization require legal regulations on observations of human rights in business relations. Since 2001 European Union has been creating such regulations, admittedly not mandatory, but establishing corporate social responsibility (CSR). It means that an entrepreneur should consider in his economic strategy environmental and social aspects although accepting all those methods is entirely voluntarily. On February 6th, 2013, European Parliament accepted two resolutions on CSR: 1) Accountable, transparent and responsible business behavior and sustainable growth (2012/2098 (INI)); 2) Promoting society’s interests and a route to sustainable and inclusive recovery (2012/2097 (INI)). Resolutions include a new definition introduced by Commission, understood as “corporate responsibility for its influence on society”. The aims of both resolutions is to create mechanisms allowing to workout common values for enterprises owners, interested third parties and society and recognize, prevent and mitigate negative effects of destructing activity of enterprise. The involvement of small and medium-sized enterprises (MSP) sector in corporate social responsibility adjusting the methods of CSR to company size and character of activity is postulated. It is also seen that human rights in third countries, in which union companies have their shares and from which providers within chain of supplies originally come, need to be protected.

Opis:
In this article author compares LGBT’s human rights standards in Poland, Germany, Ukraine, Russia and some Middle Eastern states. Members of the LGBT community have not equal rights in Europe, even in a European Union member states, which have to respect rights of any minority. In a case of Germany society sooner tend to accept LGBT people than this was reflected in a law system. It is interesting, that Poland has been decriminalizing homosexual activity in 1932, but this does not changed social atitudes, even now in this country LGBT sa socially excluded in many ways. Situation in post-Soviet states in even worse – in both Ukraine and Russia societies permits LGBT’s persons exclusion from the social and political sphere.
W niniejszym artykule autor dokonał analizy porównawczej realizacji europejskich standardów praw człowieka wobec osób LGBT na przykładzie Polski, Niemiec, Ukrainy i Rosji.

This article attempts to discover the key elements of the democratic principle, as described by the judges sitting in Luxembourg and Strasbourg, whose case law reveals the underlying idea of democracy at the supranational level. Until recently the debate on democracy was limited to the national level. But things are changing, and this article shows the gradual emergence of a process led by supranational courts, in which the application of the democratic principle finds multiple grades and variations. In this way the supranational/international courts have opened a new chapter in the process of constitutionalization of international law.

Belarus and began to approach closer to Russia, which cooled relations with Warsaw. In 2008, Sweden and Poland began to lay the foundations of the EU’s eastern pol-icy, hereinafter referred to as the Eastern Partnership. However, the violent actions of the regime of Alexander Lukashenko after the undemocratic presi-dential elections on 19 December 2010, resulted in further isolation of the Bela-rusian authorities. Violation of human rights is one of the main obstacles in the way of Belarus to establishing good relations with the European Union. Polish Politics and the European Union towards Belarus can be described as „democ-ratic crusade” of Western civilization.

Most worldwide monetary, financial, trade and environmental agreements fail to protect international public goods (like prevention of climate change, transnational rule of law for the benefit of citizens) effectively and do not even mention human rights and consumer welfare. This contribution argues that the prevailing “Westphalian conceptions” of international economic law (IEL) as “international law among states”, “global administrative law”, multilevel economic regulation and international “conflicts law” must be “civilized” and “constitutionalized” by limiting multilevel governance through legal and judicial protection of cosmopolitan rights empowering citizens – as “democratic owners of IEL” – to hold their government agents more accountable for their obvious “governance failures”. Sections 1 to 10 discuss ten areas of IEL where the need for stronger protection of human rights is increasingly recognized. Sections 11 and 12 infer from the citizen-driven transformations of international investment law and European common market law that “market failures”, “governance failures” and related abuses of public and private power in international economic relations can be limited by empowering citizens and “courts of justice” to protect transnational rule of law for the benefit of citizens. The article criticizes the EU institutions for their nondemocratic assertion of “freedoms to violate international law” to the detriment of EU citizens, and discusses the links between the current financial and economic growth crises in the European Monetary Union and the persistent violations by most EU countries of their agreed fiscal and debt legal disciplines. If the main objective of law is to “institutionalize public reason” protecting citizens and their human rights, IEL requires far-reaching cosmopolitan reforms in the 21st century.

On the basis of the Treaty of Nice, the European Union institutions have obtained a crucial right to inspection rule of law in its Member States, encompassing the areas of law being within their exclusive competence. The main aim of the study is to analyze the legitimacy of this extensive intrusion European Union in particular from the point of view of the objectives of this organization. The author indicates that the area in which the European Union has a real interest are the elections to the national authorities that participate in the European Union legislative procedure. Election of this authorities in undemocratic procedure weakens – already undermined – legitimacy of the European Union. The author postulates thereby limiting the scope of this control.

The findings are not limited to supporting the predominant interpretations of scholars and experts, but aim at exploring the usefulness of text mining techniques in the interpretation of EU documents. Furthermore, the conclusions drawn from the lexical analysis are discussed in the light of complex systems theory, which may be beneficial for the proper understanding of the concept of resilience (mainly its multidimensional nature) and its subsequent operationalization. The last part of the paper includes an in-depth analysis of the EU rhetoric on the UN fora (period: 2014–2019) regarding the concept of resilience, in particular its linkages with human rights.

Opis:
The present contribution looks at the protection of fundamental rights under EU law, paying special attention to the Charter of Fundamental Rights of the European Union (the Charter) which, since the entry into force of the Treaty of Lisbon, enjoys “the same legal value as the Treaties”. First, by looking at the recent case law of the European Court of Justice, it explores the scope of application of the Charter. Second, it examines the conditions that the limitations on the exercise of the rights and freedoms recognised by the Charter must fulfil in order to be valid. Third, it looks at the interaction between, on the one hand, the Charter and the European Convention for the Protection of Human Rights and Fundamental Freedoms and between, on the other hand, the Charter and the constitutional traditions common to the Member States. Finally, a brief conclusion contains some remarks as to the requirements private applicants must fulfil in order to build strategic human rights cases successfully.
