    The aim of the study is to discuss the protection of the rights of persons with disabilities un¬der the system of law of the Council of Europe. In particular, the focus is on the rights of per¬sons with disabilities to independence, social integration, and participation in the life of the community under the European Social Charter (ESC). This paper covers both an analysis of the Charter, with special attention paid to Article 15, and an examination of the decisions of the European Committee of Social Rights (ECSR) with respect to this provision. Besides the regulation of these rights at the European level, this paper also discusses different examples of state regulations’ conformity or non-conformity with Article 15 ESC.

    Both the 1961 European Social Charter and its revised version of 1996 constitute international social and economic rights treaties ratified by the Member States of the Council of Europe. Together with the European Treaty for the Protection of Human Rights and Fundamental Freedoms, they are the cornerstones of the contractual system for the protection of human rights in the member countries of the Council of Europe. Moreover, these contracts have contributed significantly to the development of European human rights standards in the areas of personal management, labour law and social security law. Nevertheless, it receives minimal attention from legal theorists. This leads to problems in its interpretation in practice. Through scientific and doctrinal interpretation, authors examine the various provisions of the European Social Charter. They seek answers to practical application problems through scientific literature as well as the case-law of the European Court of Justice. The aim and result of the authors’ work is to examine individual documents, to compare them and analyse the differences. The aim of the authors' work is also to evaluate the impact of the case law of the European Court of Justice in connection with the implementation of the Charter into the legal order as well as application practice. The benefit of this article is also the analysis of the impact of the Charter on the rights of working women.

    The article examines the conformity of the situation in Poland with the European Social Charter, which is the subject of the “conclusions” formulated by the European Committee of Social Rights. This conclusions concerns the review of conformity and of non-conformity of Polish law and practice with the various provisions of the Charter on the basis of reports submitted by Poland.

    W maju 2012 r. Europejski Komitet Praw Socjalnych opublikował coroczne sprawozdanie, w którym przeanalizował przestrzeganie praw dzieci i osób młodych, prawa do ochrony macierzyństwa, prawa ochrony rodziny, praw mniejszości narodowych oraz praw pracowników migrujących i ich rodzin, a także prawa do zamieszkania. Europejski Komitet Praw Socjalnych przyjął w 2011 r. 950 wniosków; 258 z nich dotyczyło łamania Europejskiej karty społecznej. Pomimo wielu przykładów łamania praw ujętych w Karcie, eksperci Rady Europy zwrócili uwagę na wiele pozytywnych zmian zarówno w zakresie regulacji prawnych, jak i stosowanych przez państwa członkowskie praktyk, których celem jest przestrzeganie zapisów Europejskiej karty społecznej.
    In May 2012 The European Committee of Social Rights has published its “Activity Report 2011” which looked at the rights of children and young people, the right to maternity protection, rights related to the protection of the family, the rights of minorities, the rights of migrant workers, their families and the right to housing. In 2011 the ECSR adopted 950 conclusions. 258 findings were related to violations of the European Social Charter. Despite many examples of violations of the rights recognized in the Charter, the experts of the Council of Europe have taken many positive developments, also many Member States have changed their legislation and practice to bring the situation into conformity with the European Social Charter.

    W artykule scharakteryzowano prawa człowieka II generacji. Dokonano również analizy zakresu przedmiotowego wybranych praw pracowniczych uregulowanych w Europejskiej Karcie Społecznej oraz stopnia ich realizacji przez Polskę. Badanie objęło artykuł 1 (prawo do pracy), artykuł 2 (prawo do sprawiedliwych warunków pracy), artykuł 3 (prawo do bezpiecznych i higienicznych warunków pracy), artykuł 4 (prawo do godziwego wynagrodzenia) oraz artykuł 12 (prawo do zabezpieczenia społecznego). Ocena realizacji wyżej wymienionych przepisów Karty oparta została na konkluzjach Europejskiego Komitetu Praw Społecznych z sześciu cykli kontrolnych, począwszy od 1997 r., gdy Polska ratyfikowała Kartę, do 2014 lub 2016 r., w zależności od rozkładu cykli dla poszczególnych artykułów Karty. Badanie miało pomóc sformułować odpowiedź na pytanie, w jakim stopniu Polska wypełnia postanowienia wynikające z Karty. Przyjęto założenia teoretyczne (wywodzące się z instytucjonalizmu), iż normy uregulowane w Europejskiej Karcie Społecznej obowiązują w społeczeństwie i kształtują relacje między państwem a jednostkami.
    The article characterises human rights of the second generation; with a subsequent analysis of the material scope of selected employee rights as regulated in the European Social Charter and the degree of their implementation on the part of Poland. The study covered Article 1 (the right to work), Article 2 (the right to decent working conditions), Article 3 (the right to safe and hygienic working conditions), Article 4 (the right to a fair wage), and Article 12 (the right to social security). Evaluation of the implementation of the above-mentioned Charter provisions was based on the conclusions of the European Committee of Social Rights in six control cycles, starting from 1997, when Poland ratified the Charter, and up until the years 2014 or 2016, depending on the control cycle distribution for the individual articles of the Charter. The survey tried to answer the question as to what extent Poland complies with Charter provisions. Theoretical assumptions were adopted, ones derived from institutionalism, that the norms regulated in the European Social Charter constitute binding principles in society and that these shape the relations between the state and individuals.

    Celem artykułu była prezentacja i analiza najważniejszych postanowień regulacji traktatowych Rady Europy w zakresie problematyki praw osób z niepełnosprawnościami. W bogatym dorobku normatywnym Rady nie znajdujemy szczegółowej konwencji na ten temat, ale problematyka ochrony praw takich osób została uregulowana w innych konwencjach tej organizacji. Najważniejsze znaczenie w tym zakresie mają postanowienia Europejskiej Karty Społecznej i Zrewidowanej Europejskiej Karty Społecznej. W związku z tym autorzy zaprezentowali treść i interpretację art. 15 obu Kart oraz stanowisko Europejskiego Komitetu Praw Społecznych w tych sprawach. Autorzy zwrócili również uwagę na najważniejsze postanowienia Konwencji o ochronie praw człowieka i podstawowych wolności, dotyczące zwłaszcza zakazu dyskryminacji, oraz na wybrane, najbardziej reprezentatywne orzecznictwo Europejskiego Trybunału Praw Człowieka.
    The aim of this article is to present and analyze the most important provisions contained in the conventions of the Council of Europe with regard to rights of persons with disabilities. The abundant normative acquis of the Council does not offer a specific convention devoted this subject, but the issue of protecting the rights of persons with disabilities is governed by provisions of its various other conventions. The stipulations of the European Social Charter and the Revised European Social Charter are of crucial importance in this respect. With this in mind, the authors present the content and interpretation of Article 15 of both Charters and the position of the European Committee of Social Rights on this matter. The authors also point to the most important provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms – in particular with reference to the prohibition of discrimination – and to the relevant case law of the European Court of Human Rights.

    The article presents the competences of the European Committee of Social Rights in monitoring States’ compliance with the European Social Charter. The Council of Europe’s treaty acquis in the field of the protection of human rights and fundamental freedoms is rich and extensive, and the system of monitoring States’ compliance which it has established may be regarded as a reference model for other international organisations. The system of supervising compliance within the European Social Charter is analysed with an emphasis on its main institution – the European Committee of Social Rights – considered to be a particular treaty body. While ruling on the conformity of the situation in States with the European Social Charter, the Committee employs both the classical instruments of control, that is national reports submitted by States, as well as specific instruments of control, that is collective complaints. In reviewing collective complaints, the European Committee of Social Rights undertakes actions which justify the stance of the Committee being equipped with quasi-judicial competences. Arguments to support this thesis have been offered.
    Artykuł prezentuje problematykę kompetencji kontrolnych Europejskiego Komitetu Praw Społecznych jako organu traktatowego w systemie Europejskiej Karty Społecznej Rady Europy. Dorobek traktatowy Rady Europy w dziedzinie ochrony praw człowieka i podstawowych wolności jest bardzo bogaty, a stworzony przez tę organizację system kontrolny może być traktowany jako wzorcowy dla innych organizacji międzynarodowych. Przedmiotem rozważań autora jest system kontrolny Europejskiej Karty Społecznej, którego najważniejszą instytucją jest Europejski Komitet Praw Społecznych jako szczególny organ traktatowy. Komitet wykorzystuje zarówno klasyczne instrumenty kontrolne, jakimi są sprawozdania państw, jak i szczególny instrument kontrolny, jakim są skargi zbiorowe. W procesie rozpatrywania skarg zbiorowych Europejski Komitet Praw Społecznych, jako organ niesądowy, podejmuje i realizuje działania, które uzasadniają określenie jego funkcji kontrolnych jako funkcji quasi-sądowych. Autor prezentuje argumenty na poparcia tej tezy.
