The author claims that there are no legal obstacles for a Deputy to incidentally fulfill his duties out-of-parliament by using, for this purpose, vehicles such as a bus. However, that sort of activity hast to stay within the limits of exercising a parliamentary mandate and, thus, stay within the scope of functioning of a Deputy’s office. As the Marshal’s of the Sejm Order No. 8 states, an enumeration of probable expenses which may be covered in lump sum to cover costs related to the functioning of a Deputy’s office, is only of an exemplary character. Such sort of costs might be covered from the above-mentioned source only when they concern “Deputy’s transport”. The author underlines that a Deputy does not have an obligation to use a bus which is a property of Deputy’s office. The Deputy may also use a vehicle provided for use by volunteers or by a non-governmental organization. That kind of activity ought to stay within limits of exercising of the mandate of a Deputy and ought not to be used for the purposes of sponsorship.

Opis:
Article 184 para. 1 of the Standing Orders of the Sejm obligates the Marshal of the Sejm to give the floor regardless of the orders of the day for the sitting or in respect of the debate to claim rectification. Only the Deputies to the Sejm are entitled to make rectifications. Rectifications can only refer to “statements that has been misunderstood or imprecisely quoted,” and notice of intention to use the remedy of rectification under this procedure is a direct response to the statement of another Deputy or any other participant in the sitting of the Sejm. For assessing the admissibility of rectification request it does not matter whether the author of the rectified statements directly mentioned the specific individuals whose statements he/she quotes giving their names. Presented rectification is not subject to debate or vote. A rectification should take the form of indicative sentence. In a situation where the Deputy’s statement does not satisfy the requirements relating to rectification, the Marshal of the Sejm has the right, and even the obligation, to reproach the Deputy, and to discontinue his/her speech.

A Deputy who enters into the mandate contracts or service contracts with natural persons using the financial resources designated for funding of a parliamentary office is not an entrepreneur within the meaning of the Act on Freedom of Economic Activity or legally established “other organizational unit”. The Deputy is a party in civil law relations as a natural person. In conclusion, law on minimum wage does not apply in this case.

The author indicates that according to the provisions of the Act on the Exercise of the Mandate of a Deputy or Senator, only Deputies and Senators may form parliamentary groupings. The possibility of participation of other persons in sittings of a grouping, including taking the floor in the discussion may be included in the grouping’s internal regulations (statutes). Members of the European Parliament elected in the Republic of Poland may not be members of parliamentary groupings and bilateral groupings.

In the opinion it was stated that although examining identity documents is associated with a temporary restriction of freedom of a Deputy by an authorized body, it does not constitute a violation of the privilege of parliamentary inviolability. Undertaking Deputy’s activities related to the exercise of the mandate in a border zone, does not require an appropriate consent. The privilege of inviolability does not absolve the Deputy from the obligation to respect the law. As a rule, a Border Guard officer cannot detain the Deputy during performing activities falling within the scope of the parliamentary mandate in the border zone. Deputies may be detained only in the event of joint fulfillment of requirements provided in the Article 105 para. 5 of the Constitution.

Opis:
The concept of “a non-state economic entity”, referred to in Article 20 of the Act on the Exercise of the Mandate of a Deputy or Senator, causes difficulties with interpretation. A broad interpretation of that article, indicating that the category of entities to which the intervention may be addressed includes private-law entities, raises serious doubts in the context of the provisions of the Constitution. Moreover, it is not possible to enforce an obligation (imposed on a private entity) to response to the intervention undertaken in relation to it, and the impact of a Deputy on the issue underlying the intervention depends solely on the “power of authority” of the representative mandate.

Interpellation is one of the fundamental mechanisms ensuring parliamentary oversight of the government. An obligation to respond to interpellations is enshrined in the constitution. Information about non-response to interpellations are placed in the Information System of the Sejm. The body entrusted to supervise the execution by the government administration of the relevant obligations specified in the Act on the Exercise of the Mandate of a Deputy or Senator is the Marshal of the Sejm. The predominant form of responsibility of a minister for failure to comply with the obligation to reply to an interpellation is a political responsibility, including in particular the opportunity to submit a motion of no confidence in him/her by the Sejm. Due to the constitutional nature of the obligation to give response to an interpellation, any failure to meet that obligation may also be a prerequisite for initiation of the proceedings to hold the minister constitutionally responsible.

The obligation to submit to the Marshal of the Sejm certain information relates to data on every person who actually performs a specific job for a Deputy, irre‑ spective of its formal classification as a parliamentary office worker or a parliamentary assistant. The duty arises from Article 23 para. 4a of the Act on Exercise of the Mandate of a Deputy and Senator. If the mandatary defaulted on its obligations, the Deputy still has to perform an obligation stemming from Article 23 paragraph 4a of the Act on Exercise of the Mandate of a Deputy and Senator. Consequently, regardless of the time elapsed since the contract was concluded, the Deputy should fulfill this obligation and submit the information about a co-worker to the Marshal of the Sejm.

In the author’s opinion, it is necessary to separate the sphere of exercising a Deputy’s mandate and the sphere of election campaigning. The key to determining to which of these spheres the publication of a brochure summarising the term of office of the Sejm belongs is the presence of contents of an evaluative nature in the brochure, which should be qualified as an element supporting its classification as canvassing. Regarding the distribution of gadgets, the author states that what is relevant is not the inclusion of data regarding the Deputy on the gadgets themselves, but the circumstances in which the gadgets are distributed, which may speak in favour of considering them as a form of canvassing.
