Opis:
This article examines the process of the judicial Europeanization of the Polish Constitution. In Poland the judicial method of Europeanizing the Constitution is currently the primary way of adjusting constitutional norms to requirements resulting from EU law. The phenomenon of re-interpretation of constitutional provisions in light of the new and changing realities is a characteristic feature of contemporary constitutionalism. It has been a long time since most national constitutions have undergone significant textual changes. In Poland, the scope of judicial Europeanization of the Constitution is connected, to a great extent, with the inflexible procedure required for constitutional amendments. In this situation, these so-called “silent changes” of constitutional norms are the easiest and fastest way of reacting to requirements stemming from Poland’s EU membership. In the Polish case not only have the norms regarding the political system of the state changed, but also constitutional standards relating to the protection of fundamental rights and freedoms have undergone the process of the Europeanization. To some extent, these changes relate to procedural norms as well.

Opis:
The discussion on the model of constitutional review of law in Poland gained a new dimension after 2016 in connection with the ongoing constitutional crisis. First of all, there is a question of whether, irrespective of the competences of the Constitutional Tribunal, on the grounds of the binding constitutional provisions, also courts may review the constitutionality of statutory provisions in the process of their application. Although after 1997 the principle became established that the Constitutional Tribunal had exclusive competence to review the constitutionality of acts in Poland, a clear change in this respect is now visible both in doctrine and jurisprudence. The majority of doctrinal representatives justify the admissibility of dispersed judicial review by the inability of the Constitutional Tribunal to perform its basic function, treating it as something exceptional, incidental, determined by the doctrine of necessity. The aim of this paper is to present the debate on the admissibility of dispersed judicial review on the grounds of the Polish Constitution, as well as to indicate the possible directions of its development.

Opis:
One of the politically momentous and legally precedential constitutional problems of recent years which had to be faced by the Polish constitutional court has been the dispute whether it is possible to exclude the applicable statute defining the organization and procedure of the CT proceedings as a basis for adjudication. An analysis of the judgment of the Tribunal addressing that issue proves that the Polish constitutional court excluded the possibility that the same regulation could serve simultaneously as the object of control and the basis for control proceedings. This results from the essence of constitutional control of the law which in such arrangement of its key elements would simply repeal itself, i.e. would lead to its own invalidation.Subordination of constitutional judges exclusively to the Constitution extends to all actions they perform in serving their office and other consubstantial manifestations of exercising the power to judge. This is a derivative of jurisprudential responsibilities of the Tribunal, which include both passing a final judgment as to compliance of challenged statutes, as well as other acts of application of law.Art. 195 (1) in fine of the Polish Constitution lays down a competence norm for a CT judge to refuse, in specific circumstances, to abide by the CT Act. One of the analytical assumptions is recognition of the finality of CT judgments. The possibility to exclude a provision of the CT Act is an action in the area of application of law.Determination of the legal framework for passing judgments has nothing in common with constitutional control of challenged statutes. Those actions derive from totally different orders and their goals are differe.

Opis:
The paper examines the conflict over the control of the integration of Poland’s Constitutional Tribunal (CT) that evolved into a constitutional crisis in October 2015 - and has extended for more than two years. It identifies issues that help understand how the Polish Democracy does not impede the erosion of constitutional democracy as the conflict has undermined the CT and the function of judicial review (JR). The article examines issues of legitimacy that emerge from the crisis; it also examines the extent to which the institutional settings condition the operation of the JR function; in particular, it looks at the role of executive actors (the Government and the President), and the role of the political/parliamentary party in bridging the separation of powers.

Opis:
Recent years have gone down in the history of the Polish constitutional thought with an unprecedented dispute concerning the underlying principles for the activity and statutory position of the Constitutional Tribunal (‘CT’) . Under the dynamics of political events following the 2015 parliamentary elections the initial doubts whether some of the CT judges were appointed correctly turned into the deepest constitutional crisis in the modern history of Poland which ultimately led to decomposition of the entire state system of constitutional control. Finding all of the underlying causes of that crisis would require multifaceted analyses carried out by experts representing various scientific disciplines. Such an undertaking goes far beyond the boundaries of this study. The aim of this sketch is to reconstruct one of the episodes of the so-called Constitutional Tribunal Crisis which is a direct outcome of the appointment of CT judges by the Sejm (Parliament) to replace judges whose terms did not yet expire . This issue is of key importance for the current discussions on the nature and consequences of CT judgments . The presence of unauthorized persons in CT adjudicating panels became also an important symbolic turning point in the systemic transformation of the Polish constitutional court at the beginning of 2017 .

Opis:
In the light of Article 184 of the 1997 Constitution administrative courts verify the lawfulness of administrative decisions and some other acts of public administration. Furthermore, administrative courts may review the lawfulness, including the compliance with the Constitution, of the so called “enactments of local law” (referred to in Articles 87(2) and 94 of the Constitution). Pursuant to Article 8(2) of the Constitution “The provisions of the Constitution shall apply directly, unless the Constitution provides otherwise”. This constitutional competence is addressed, inter alia, to courts. In practice, administrative courts apply Constitution in three ways: 1) pro-constitutional interpretation of laws, 2) referring the so called questions of law to the Constitutional Tribunal, 3) ruling in a case directly on the basis of a constitutional provision. The provision applied by administrative courts in most cases is Article 2 of the Constitution, which stipulates that “The Republic of Poland shall be a democratic state governed by the rule of law (…)”. The Article is focused on most important cases in which the rule of law principle was applied. Administrative courts, as well as other courts and the Constitutional Tribunal, consider the rule of law principle to be the source of several detailed principles, e.g. the certainty of law, the lex retro non agit principle, the loyalty of the State towards citizens, the citizens’ trust in the State and the law, the principle of proportionality. Each of these principles was referred to in the large number of administrative courts’ judgments as the basis of a ruling. This proves that the Constitution, in particular the rule of law principle, is one of the instruments utilized by administrative courts’ judges in their everyday work.
