Provisions of the Act does not infringe the principle of independence of judges of the Constitutional Tribunal and the individual’s right to have his/her case heard without undue delay. Adoption of the solution according to which the Tribunal decides, as a rule, by a full bench is also consistent with the Constitution of the Republic of Poland. However, the finding that there have indeed been grounds for immediate entry into force of the amendment of the Constitutional Tribunal Act of 22 December 2015., is not obvious. Therefore, the arguments justifying the departure from the introduction of the period of vacatio legis should be clarified in the explanatory memorandum of the Act. In the author’s view, a provision requiring a qualified (2/3) majority for the Tribunal to adjudicate can be considered not to comply with Article 190 para. 5 of the Constitution. The legislature should consider, with a view to the future law, clarifying the content of the concept of particularly glaring cases used in Article 31a para. 1 of the Act. Worth considering is also the change in the order in which motions are heard, as referred to in Article 80 of the Act.

The author claims that the adoption of a new Constitutional Tribunal Bill, which better defines its position in the system of government, does not solve all the problems. He believes that the challenges resulting from Poland’s membership in the EU and the experience of the functioning of the Tribunal require the adoption of the Constitutional Tribunal Bill be dependent on the amendment of the Constitution. Changing the Constitution should be the starting point for the comprehensive regulation of the functioning of the Tribunal by statute. In addition, the author points out those articles of the bill that require clarification, reformulation or raise substantive or legislative doubts.

In this draft position the author points out the conformity of Article 16 para. 3 subparas (1), (3), (4) and (6) of the Act on the removal, storage and transplantation of human bodies, organs and tissue and Article 16 para. 3 subpara. 2 in part containing the phrase “and place”, with Article 47 and Article 51 para. 2, in conjunction with Article 31 para. 3 of the Constitution. According to the author, the proceedings should be discontinued in relation to other issues, due to inadmissibility of issuing a judgment. In justifications, he claims that the provisions referred to by the Human Rights Defender do meet the criterion of necessity within the meaning of the constitutional provision imposing limitations on obtaining, gathering and disclosure of information o citizens by public authorities and, thereby, meet the constitutional standard concerning the right to privacy and its admissible limitations.

Opis:
The authors claim that the new Constitutional Tribunal bill, aimed at resolving many essential problems that have appeared in recent years in relation to the jurisprudence of the Tribunal, deserves a positive assessment. However, some of the proposed solutions raise doubts as to their constitutional basis and systemic consistency. The authors point out that some of the issues cannot be solved by the bill due to constitutional limitations. Therefore, they propose to link the adoption of the bill with a prior change of the provisions of the constitution which govern the functioning of the constitutional court. It is the only way to carry out the changes guaranteeing the appropriate level of adjudicative efficiency of the Tribunal. The authors also point out the need for legislative‑techniques changes in some articles of the bill.

he author of the position of the Sejm on the application of the President of the Council of Ministers concerning the assessed provision of the Act on the Organisation and Procedure before the Constitutional Tribunal states that the provision in question is inconsistent primarily with the principle of efficiency and reliability of the operation of public institutions expressed in the Preamble to the Constitution. The challenged provision determines the minimum number of Constitutional Tribunal judges whose participation is necessary when the Tribunal takes decisions in full session. This provision has been challenged by the applicant to the extent that it prevents the Constitutional Tribunal from adjudicating when a minority of the constitutional composition refuses to adjudicate. The statutory establishment of a relatively high, rigid quorum may block the exercise of the constitutional powers of the Polish constitutional court. The provision under review may result in the fact that citizens and state bodies – due to the inability of the Tribunal to meet in full composition – will in fact be deprived of the constitutional guarantee of the Tribunal’s rendering of a judgment in cases in which adjudication by such a composition is required.

Opinion of the Venice Commission about amendments to the Constitutional Tribunal Act of 2016 was prepared upon the request of the Polish Minister for Foreign Affairs, Witold Waszczykowski. In his request, he identified the constitutional issues to be examined by the Commission. As stated by the Commission itself, the opinion referred to the composition of the Constitutional Tribunal. In its Opinion, the Commission makes an assessment, recommendations and suggestions, at the same time declaring its continuing support. In this respect, it did not go beyond the standard procedure, which does not prejudge the issue of whether it is right in its assessments. The Polish authorities are not legally bound by the findings of the Commission’s Opinion which, however, contains some recommendations and suggestions that deserve response.

The author of this draft position points to the conformity of Article 12 para. 1 of the Act of 7 December 2012 amending the Act on Family Benefits and Certain Other Acts (Dziennik Ustaw, item 1548) with the principle of confidence in the state and its laws and the principle of acquired rights, derived from Article 2, Article 32 para. 1 and Article 71 para. 1 of the Constitution There are no sufficient grounds to rebut the presumption of constitutionality of the above‑mentioned provision insofar as the grant of a supplement to the carer’s allowance to persons entitled to that allowance pursuant to the provisions in force until 31 December 2012 is dependent on the fact that disability of the person requiring care occurred no later than he/she has attained 18 years of age or during education in school or college, but no later than by attainment of 25 years of age. The proceedings in relation to the remainder should be discontinued due to the inadmissibility of the judgment.

In the article, the issue of the relationship between the Polish Constitution and European Union law is analysed from the perspective of its shaping in the adjudication of the Constitutional Tribunal. Firstly, the constitutional regulations that define the relationship between the Constitution and EU law will be analysed. This part of the article also includes the issues relating to the legal basis of the most commonly used instrument that shapes this relationship – the EU-friendly interpretation of the Constitution. Secondly, the contexts in which the Constitutional Tribunal refers to EU law are examined. The case study that is undertaken focuses on the instruments that prevent conflicts between EU law and the Constitution, inter alia legislative and interpretative instruments. The application of these methods in recent controversial judgments Ref. no. P 20/07 and Ref. no. K 3/21 concerning the relationship between the Polish Constitution and the EU law will be analysed.
W niniejszym artykule kwestia relacji między polską Konstytucją a prawem Unii Europejskiej jest analizowana z perspektywy ewolucji jej kształtowania w orzecznictwie Trybunału Konstytucyjnego. W pierwszej kolejności przedmiotem analizy są przepisy konstytucyjne definiujące relację między Konstytucją i prawem UE. Ta część artykułu zawiera również rozważania na temat podstaw prawnych najpowszechniej wykorzystywanego instrumentu kształtującego tę relację – prounijnej wykładni Konstytucji. W kolejnych częściach artykułu badane są przypadki, w których Trybunał Konstytucyjny w swoim orzecznictwie odwołuje się do systemu prawa unijnego. Przeprowadzona analiza koncentruje się na instrumentach, które zapobiegają konfliktom między prawem UE i Konstytucją, w tym instrumentom wymuszającym aktywność legislacyjną oraz instrumentom interpretacyjnym. Przedmiotem analizy w artykule jest również ustosunkowanie się do ww. metod w ostatnich kontrowersyjnych orzeczeniach TK o sygn. akt P 20/07 oraz sygn. akt K 3/21 dotyczących relacji między polską Konstytucją i prawem Unii Europejskiej, które zasadniczo zrywają z dotychczasową tendencją orzeczniczą w tym zakresie.

This article examines the process of the judicial Europeanization of the Polish Constitution. In Poland the judicial method of Europeanizing the Constitution is currently the primary way of adjusting constitutional norms to requirements resulting from EU law. The phenomenon of re-interpretation of constitutional provisions in light of the new and changing realities is a characteristic feature of contemporary constitutionalism. It has been a long time since most national constitutions have undergone significant textual changes. In Poland, the scope of judicial Europeanization of the Constitution is connected, to a great extent, with the inflexible procedure required for constitutional amendments. In this situation, these so-called “silent changes” of constitutional norms are the easiest and fastest way of reacting to requirements stemming from Poland’s EU membership. In the Polish case not only have the norms regarding the political system of the state changed, but also constitutional standards relating to the protection of fundamental rights and freedoms have undergone the process of the Europeanization. To some extent, these changes relate to procedural norms as well.

In assessing the constitutionality of the contested Article 215, para. 2 of the Real Estate Management Act, it was stated that it is important to ascertain whether the differentiation of former owners, based on the criterion of deprivation of physical possession of the plot after 5 April 1958, was justified, and therefore whether it has such essential nature that justifies different treatment of similar entities. Pointing to the special status of the right to compensation, as stressed in the jurisprudence of the Constitutional Tribunal, the author claims, however, that claiming the right to compensation cannot be limited by an incidental and historical time criterion, which is the date of entry into force of the Act of 1958, even if the economic reasons argue for that approach. Given the above, it was found that Article 215 para. 2 of the Act, to the extent of the above interpretation, is inconsistent with the provisions of the Constitution.

The opinion presents Sejm’s draft position in the proceedings before the Constitutional Tribunal concerning constitutionality of the procedure for the creation of common and military courts (Ref. No. K 27/12). A group of Deputies and the National Council of the Judiciary, initiating the proceedings, challenged the transfer to create and dissolve common and military courts to – respectively – the Minister of Justice and Minister of National Defence. In the Sejm’s view, the procedure for creation common courts does not infringe constitutional standards, but the provision authorising the creation of military courts does not comply with the Constitution due to the lack of necessary guidelines.

The subject of this article is the institution of the constitutional complaint, which is analysed in connection with European integration. It should be noted that Poland’s membership of the European Union has had a great influence, not only on the system of national law, but also on the jurisprudence of the Polish Constitutional Tribunal; therefore considerations are carried out here mainly in relation to the Constitutional Tribunal.            In examining the issue of the constitutional complaint, the following assumptions may be stated. First, the constitutional-complaint procedure, is in fact, the examination of the compliance of legal norms with the Constitution, any deviation being related to the entities initiating proceedings before the Constitutional Tribunal, Article 191(1)(6), of the Constitution[1], and to the material scope of the complaint, as determined in Article 79 of the Constitution. Second, there is no doubt that the constitutional complaint can become an important legal instrument shaping the jurisprudence of the Polish Constitutional Tribunal, which has to face constitutional issues related to European integration[2]. Following the example of the practice of other Member States, e.g. Germany, the Tribunal may use the institution of the constitutional complaint as a means of controlling the compliance of the secondary law of the European Union with the Constitution of the Republic of Poland.   [1] The Constitution of the Republic of Poland, Journal of 2 April 1997, Journal of Law 1997, No. 78, item 483, as amended. The position of the Sejm of the Republic of Poland concerns Article 207 § 3 second sentence in conjunction with § 7 of the Code of Civil Procedure (CCP), establishing a procedure for consent by order of the president for bringing further writings preparatory to pleading in the course of the case, and Article 207 § 4 CCP which provides the possibility of an oral hearing of the parties in closed session before the first hearing, if the president call upon the parties to submit additional clarification on the issue, in terms of their compliance with Article 45 para. 1 of the Constitution, which establishes the right to a court hearing. In the author’s view, there should be declared compliance of the above provisions of the Act with the Constitution because in the challenged Article 207 § 4 CCP the lawmaker uses the plural to describe the addressee of the norm, so from this provision it follows an obligation to inform about the meeting and the possibility of participation of both parties, as well as entities acting as a party. Moreover, in support of the declaration of compliance of Article 207 § 3 the author presents the fundamental principles of civil process, such as the concentration of the evidence, judicial consideration of the case without undue delay, and the duty of the court and the parties to smoothly and timely completion of the proceedings. Motion has been made for cancellation of the case due to inadmissibility of the judgment on the basis of Art. 39 para. 1 subpara. 1 of the Constitutional Tribunal Act.

The proceedings before the Constitutional Tribunal in this case were initiated by a group of Deputies who questioned the constitutionality of some provisions of the Act of 21 June 2013 amending the Act on the Office of the Minister of National Defence and other acts. The Sejm did not share the arguments of the applicant. The abolishment of the posts of the commanders of the Army, Air Force, Navy and Special Forces (and their corresponding commands) accompanied by the creation of the posts of General Commander of the Branches of the Armed Forces and Operational Commander of the Branches of the Armed Forces is within the regulatory discretion of the legislature. The constitutional position of Chief of General Staff has not weakened, and the changes resulting from the Amending Act do not go beyond the framework set by the relevant constitutional provision. Entrusting to the President of the Republic of the competence to appoint – at the request of the Prime Minister – a person “designated for an appointment as Commander‑in‑Chief of the Armed Forces” has a strong constitutional grounds and ensures efficient procedure for filling the position of Commander‑in‑Chief for a period of war. In addition, the procedure in which the amendment was made did not infringe the principle of proper legislation.

The content of this principle is indeterminate, and the test of the specificity of legal provisions, which is a tool for assessing compliance with the principle in question, leaves a significant interpretative margin to the Constitutional Tribunal. The Tribunal’s ruling on the incompatibility of legislation with the principle of the specificity of legal provisions should be a measure of last resort, applied when other interpretative methods are insufficient. This is not the case in the case in question.
