The dispute over the Constitutional Tribunal is primarily of a personal nature and concerns two issues: 1) the legality of choosing three people for the position of judge of the Constitutional Tribunal: Mariusz Muszyński, Jaroslaw Wyrembak and Justyn Piskorski; 2) the legality of the appointment of the judge of the Tribunal Julia Przyłębska to the post of the President of the Constitutional Tribunal. This article consists of a descriptive part summarizing the basic facts and arguments brought up by both parties to the dispute in the legal discussion, and a prognosis presenting four alternative scenarios for ending the dispute over the Constitutional Tribunal in 2019–2024 or later.

The author of this draft position points to the conformity of Article 12 para. 1 of the Act of 7 December 2012 amending the Act on Family Benefits and Certain Other Acts (Dziennik Ustaw, item 1548) with the principle of confidence in the state and its laws and the principle of acquired rights, derived from Article 2, Article 32 para. 1 and Article 71 para. 1 of the Constitution There are no sufficient grounds to rebut the presumption of constitutionality of the above‑mentioned provision insofar as the grant of a supplement to the carer’s allowance to persons entitled to that allowance pursuant to the provisions in force until 31 December 2012 is dependent on the fact that disability of the person requiring care occurred no later than he/she has attained 18 years of age or during education in school or college, but no later than by attainment of 25 years of age. The proceedings in relation to the remainder should be discontinued due to the inadmissibility of the judgment.

The position of the Sejm of the Republic of Poland concerns Article 207 § 3 second sentence in conjunction with § 7 of the Code of Civil Procedure (CCP), establishing a procedure for consent by order of the president for bringing further writings preparatory to pleading in the course of the case, and Article 207 § 4 CCP which provides the possibility of an oral hearing of the parties in closed session before the first hearing, if the president call upon the parties to submit additional clarification on the issue, in terms of their compliance with Article 45 para. 1 of the Constitution, which establishes the right to a court hearing. In the author’s view, there should be declared compliance of the above provisions of the Act with the Constitution because in the challenged Article 207 § 4 CCP the lawmaker uses the plural to describe the addressee of the norm, so from this provision it follows an obligation to inform about the meeting and the possibility of participation of both parties, as well as entities acting as a party. Moreover, in support of the declaration of compliance of Article 207 § 3 the author presents the fundamental principles of civil process, such as the concentration of the evidence, judicial consideration of the case without undue delay, and the duty of the court and the parties to smoothly and timely completion of the proceedings. Motion has been made for cancellation of the case due to inadmissibility of the judgment on the basis of Art. 39 para. 1 subpara. 1 of the Constitutional Tribunal Act.

In assessing the constitutionality of the contested Article 215, para. 2 of the Real Estate Management Act, it was stated that it is important to ascertain whether the differentiation of former owners, based on the criterion of deprivation of physical possession of the plot after 5 April 1958, was justified, and therefore whether it has such essential nature that justifies different treatment of similar entities. Pointing to the special status of the right to compensation, as stressed in the jurisprudence of the Constitutional Tribunal, the author claims, however, that claiming the right to compensation cannot be limited by an incidental and historical time criterion, which is the date of entry into force of the Act of 1958, even if the economic reasons argue for that approach. Given the above, it was found that Article 215 para. 2 of the Act, to the extent of the above interpretation, is inconsistent with the provisions of the Constitution.

In the proposed draft position the author points to the incompatibility with Article 45 para. 1 of the Constitution of Article 75 § 4 of the Act – Law on Common Courts System, in so far as it denies the right of appeal to the court against the decision of the Minister of Justice rejecting the request from a judge to be moved to a different place of office. The decision of the Minister, based on his/her own discretion, should be subject to judicial review, as it is taken neither within the scope of administrative supervision over the courts, nor even by means of official superiority, but rather relates to the systemic position of a judge determined by his/her rights and obligations. In the opinion of the author, Article 75 § 1 of the above Act, in so far as it does not specify the conditions for move to another post, is in conformity with Article 47, Article 52 para. 1, Article 65 para. 1 in conjunction with Article 31 para. 3 of the Constitution. This provision contains a mechanism that properly balances the public interest and private interest. On the one hand, it allows the change of place of adjudication established in the appointment document, providing an exception to the principle of stabilization of the office of judge. On the other hand, it guarantees an efficient and fair administration of justice.

The proceedings before the Constitutional Tribunal in this case were initiated by a group of Deputies who questioned the constitutionality of some provisions of the Act of 21 June 2013 amending the Act on the Office of the Minister of National Defence and other acts. The Sejm did not share the arguments of the applicant. The abolishment of the posts of the commanders of the Army, Air Force, Navy and Special Forces (and their corresponding commands) accompanied by the creation of the posts of General Commander of the Branches of the Armed Forces and Operational Commander of the Branches of the Armed Forces is within the regulatory discretion of the legislature. The constitutional position of Chief of General Staff has not weakened, and the changes resulting from the Amending Act do not go beyond the framework set by the relevant constitutional provision. Entrusting to the President of the Republic of the competence to appoint – at the request of the Prime Minister – a person “designated for an appointment as Commander‑in‑Chief of the Armed Forces” has a strong constitutional grounds and ensures efficient procedure for filling the position of Commander‑in‑Chief for a period of war. In addition, the procedure in which the amendment was made did not infringe the principle of proper legislation.

The opinion presents Sejm’s draft position in the proceedings before the Constitutional Tribunal concerning constitutionality of the procedure for the creation of common and military courts (Ref. No. K 27/12). A group of Deputies and the National Council of the Judiciary, initiating the proceedings, challenged the transfer to create and dissolve common and military courts to – respectively – the Minister of Justice and Minister of National Defence. In the Sejm’s view, the procedure for creation common courts does not infringe constitutional standards, but the provision authorising the creation of military courts does not comply with the Constitution due to the lack of necessary guidelines.

The author points out that the bill provides a comprehensive framework for the organization of, and proceedings before, the Constitutional Tribunal without missing any essential elements. He is in favour of the provisions aimed at eliminating loopholes and inconsistencies in the existing Constitutional Tribunal Act and the introduction of new regulations designed to prevent undue delay in proceedings before the Tribunal. However, in his view, some provisions of the bill raise doubts relating to their essence and legislative‑technique requirements and, therefore need to be rework in the course of parliamentary work on the bill. The author propose the wording of provisions complementing and clarifying the text of the bill.

The position of the Sejm refers to application of the Marshal of the Sejm initiating proceedings before the Constitutional Tribunal. The position of the Sejm it was stated that the questioned provision of the Act – Electoral Code, in so far as it limits the competence of the Marshal of the Sejm to change the date of presidential elections after an occurrence of unpredictable, extraordinary circumstances hindering or preventing the holding of elections on the originally scheduled date, is unconstitutional. According to the applicant, the challenged provision violates the Constitution because it introduces additional, non-constitutional deadlines binding the Marshal of the Sejm in ordering elections to the office of the President of the Republic of Poland. It also excludes the constitutional competence of the Marshal of the Sejm to change the date of these elections and limits the possibility of ordering presidential elections by indicating a statutory holiday.

In the presented project of a position, the author claims that indicated provisions of the Civil Code, in part which enabled acquisition of a land servitude of similar nature to a transmission servitude through usucaption, before articles 3051–3054 of the Civil Code entered into force, in situation when an administrative decision restricting rights of the owner of the land is non-compatible with provisions of the Constitution. Constitutional protection of the right of ownership requires every restriction of that right to fulfill certain obligations. From a constitutional standpoint, an institution of land servitude is a restriction of the right of ownership. In analyzed case the basis for the restriction provided in an act is of primary importance. The author does not agree with the Supreme Court that the analyzed provisions regulate land servitude. In her opinion, the provisions cannot serve as a basis for a land servitude as an autonomous right (a transmission servitude), and in consequence cannot serve as a basis for a restriction of constitutional right of ownership. According to the author, the analyzed regulation also does not fulfill the criterion of necessity.

When examining the constitutionality of the contested Article 62 para. 1 and Article 63 para. 1 of the Preventing Drug Addiction Act, the author assumed that those provisions do not directly interfere with the freedom of religious practice. Therefore, such provisions to the extent that they relate to cannabis other than fiber hemp, are not incompatible with Article 53 para. 1 and para. 2 of the Constitution. It was also considered that the contested provisions do not apply to the medical use of narcotic drugs and can not be assessed in the context of Article 68 of the Constitution. Moreover, it was noted that the objectives of the prohibitions set forth in the challenged provisions can be considered justified by the guarantee of healthcare derived from the Constitution, indicating the usefulness of the contested regulation because of the general requirements of prevention and the duty of adequate protection of constitutional values. It is also claimed that restriction of access to medicinal products cannot be regarded as inconsistent with the prohibition of degrading treatment, which means that the above mentioned provisions are in conformity with Article 40 of the Constitution.

In the proposed draft position the author claims that Article 32 para. 1 of the Act on Foreign Service, in so far as it deprives the members of foreign service employed as auxiliary staff of the right to a separate remuneration or time off in exchange for work performed beyond normal working hours, is incompatible with the constitutional principle of equal protection of property rights and the principle of proportionality. He points out that covering of those employed in non-clerical positions under the special regime of increased availability to perform work is justified within in the scope of regulatory discretion of the legislator. However, it requires the introduction of a proper mechanism to compensate for the work performed. Moreover, according to the author, proceedings in relation to the remaining scope of examination of constitutionality of Article 32 para. 1 of the above-mentioned Act should be discontinued due to the inadmissibility of rendering the judgment.

In this draft position the author points out the conformity of Article 16 para. 3 subparas (1), (3), (4) and (6) of the Act on the removal, storage and transplantation of human bodies, organs and tissue and Article 16 para. 3 subpara. 2 in part containing the phrase “and place”, with Article 47 and Article 51 para. 2, in conjunction with Article 31 para. 3 of the Constitution. According to the author, the proceedings should be discontinued in relation to other issues, due to inadmissibility of issuing a judgment. In justifications, he claims that the provisions referred to by the Human Rights Defender do meet the criterion of necessity within the meaning of the constitutional provision imposing limitations on obtaining, gathering and disclosure of information o citizens by public authorities and, thereby, meet the constitutional standard concerning the right to privacy and its admissible limitations.

In the proposed draft position the author points to the incompatibility with the Constitution of Article 51 para. 1 subpara. 3 of the Act on Court Bailiffs and Enforcement insofar as it does not provide for a separate fixed fee rates for emptying the dwelling of the things or people in a situation in which the debtor, after being given notice by a bailiff, has voluntarily performed the obligation within the prescribed time period. The author points out that the definitive reason for finding the unconstitutionality of the provision in question is an internal inconsistency of the mechanism for determining the amount of an enforcement fee, the results of which are contrary to the basic principles of law and the structure of such proceedings as provided for in the Code of Penal Procedure, and at the same time violates the rights of the debtor, discouraging him, in fact, from voluntary performance of the obligation. In the author’s view, proceedings should be discontinued in relation to Article 51 para. 2 of the Act on Court Bailiffs and Enforcement, the remaining scope of the question of law should be left unexamined.
