    In this paper the authors present functioning of agricultural market organization system on the example of Agricultural Market Agency’s (AMA). They discuss various policy tools supporting agriculture with particular attention given to activities of AMA, which is an institution supervised by the Ministry of Agriculture and Rural Development and the Ministry of Finance within the scope of the Common Agricultural Policy and related tasks. Since 2004, the agency is an accredited EU Paying Agency distributing financial support and performing controls of manufacturing of agricultural products under the Common Agricultural Policy. The paper presents also the regulation regarding public intervention in the agricultural markets, quotas and aid schemes, marketing, production standards and trade with third countries.

    Opis:
    Quotas for the production of milk are a permanent element of the Common Agricultural Policy. Their legal character and the possibility of their acquisition are the subject of this article. On the one hand, the quotas are to be considered from the administrative law point of view– they are the result of an administrative decision and their distribution is regulated by the code of administrative procedure. On the other hand, the legislator allowed the possibility of the civil law turnover. In Poland the legislator allows permanent and temporary alienation of individual quotes. In the case of permanent alienation, regulations pertaining to the contract of sale are applied; in the case of turning them over for somebody else’s use – those concerning the contract of lease. Taking the above into account, one may observe that quotas for production of milk are of dual nature. In the relations: farmer – the Agricultural Market Agency, there is no doubt they are regulated by administrative law. Yet, in the case of appearing in the turnover they are the qualifications of a certain material worth, which requires the application of civil law.

    The concept of public policy in Polish literature is a relatively new issue. Funds are one (but not only) of the instruments of implementation of public policies in the EU. In the classical meaning of public policy consists of a sequence of separate activities which should include identification ofproblems, the definition of principles and policy objectives, an indication of the instruments and resources needed to achieve set targets and assess their validity. The aim of this paper is to show how European Union funds affect the implementation of EU public policies in Poland and what are the implications.

    This study focuses on the pigmeat market as one of the agricultural markets within the Common Agricultural Policy. The main mechanisms for intervening in the EU related to this market include public intervention and aid for private storage. The purpose of the aid for private storage is temporary blocking of surplus of pigmeat on the market when oversupply causes unfavourable price relations. In contrast to public intervention, the system of aid for private storage does not transfer the ownership of pigmeat to a paying agency. In exchange for the aid for storage the operator undertakes to store the product for the time specified in the agreement and to refrain from placing it on the market. The article deals with the normative provisions for the operators within the system of aid for private storage of pigmeat resulting primarily from the Regulation (EU) No. 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No. 922/72, (EEC) No. 234/79, (EC) No. 1037/2001 and (EC) No. 1234/2007 as well as the Commission Delegated Regulation (EU) 2016/1238 of 18 May 2016 supplementing Regulation (EU) No. 1308/2013 of the European Parliament and of the Council with regard to public intervention and aid for private storage, which entered into force on 1 October 2016 and Commission Implementing Regulation (EU) 2016/1240 of 18 May 2016 laying down rules for the application of Regulation (EU) No. 1308/2013 of the European Parliament and of the Council with regard to public intervention and aid for private storage.
    Przedmiotem rozważań zawartych w artykule są normatywne struktury funkcjonowania podmiotów gospodarczych w mechanizmie dopłat do prywatnego przechowywania na rynku wieprzowiny, wyznaczone przede wszystkim rozporządzeniem Parlamentu Europejskiego i Rady (UE) nr 1308/2013 z dnia 17 grudnia 2013 r. ustanawiającym wspólną organizację rynków produktów rolnych oraz uchylającym rozporządzenia Rady (EWG) nr 922/72, (EWG) nr 234/79, (WE) nr 1037/2001 i (WE) nr 1234/2007, a także obowiązującym od 1 października 2016 r. rozporządzeniem delegowanym KE (UE) 2016/1238 z dnia 18 maja 2016 r. uzupełniającym rozporządzenie Parlamentu Europejskiego i Rady (UE) nr 1308/2013 w odniesieniu do interwencji publicznej i dopłat do prywatnego przechowywania oraz rozporządzeniem wykonawczym KE (UE) 2016/1240 z dnia 18 maja 2016 r. ustalającym zasady stosowania rozporządzenia Parlamentu Europejskiego i Rady (UE) nr 1308/2013 w odniesieniu do interwencji publicznej i dopłat do prywatnego przechowywania.

    Głównym celem pracy jest ocena wpływu płatności bezpośrednich na dochody gospodarstw rolnych po akcesji do Unii Europejskiej. Podstawową metodą wykorzystaną w pracy jest metoda porównań. Analizowano dochody i wielkość wsparcia bezpośredniego w gospodarstwach rolnych według wielkości ekonomicznej (klasyfikacja ES6) oraz typów rolniczych (klasyfikacja TF8). Zmiany dotyczące wielkości dochodów w latach 2004-2018 analizowano wykorzystując wskaźnik średniego tempa zmian. Z przeprowadzonych badań wynika, że średnie tempo wzrostu dochodów w latach 2004-2018 dla gospodarstw ogółem wynosiło 4,75%. Wzrost dochodów był zróżnicowany w zależności od wielkości ekonomicznej i typu rolniczego. Największy wzrost dochodów był w gospodarstwach mlecznych. W tych gospodarstwach dochody wzrastały średnio w roku o 10,68%. Z kolei w gospodarstwach trzodowych wystąpił spadek dochodów o 6,15%. Zastanawiający jest spadek dochodów w gospodarstwach bardzo dużych o średniej powierzchni w roku 2018 około 1000 ha. W latach 2004-2018 dochody gospodarstw bardzo dużych spadały średnio w roku o 0,51%. Po akcesji do Unii Europejskiej głównym źródłem dochodów były płatności bezpośrednie. Ich udział wzrósł z 15% w 2004 roku do 77,8% w 2018 roku.
    The main purpose of the work is to assess the impact of direct payments on farm income after accession to the European Union. The basic method used in the work is the comparison method. Income and the amount of direct support in farms were analyzed according to the economic size (ES6 classification) and types of farming (TF8 classification). Changes in the amount of income in 2004-2018 were analyzed using the average rate of change indicator. The conducted research shows that the average income growth rate in 2004-2018 for farms in total was 4.75%. The increase in income varied depending on the economic size and type of farming. The greatest increase in income was recorded in dairy farms. In these farms, income increased on average by 10.68% per year. On the other hand, on pig farms there was a decrease in income by 6.15%. The decrease in income on very large farms with an average area of around 1000 ha in 2018 is surprising. In 2004-2018, the income of very large farms decreased on average by 0.51% per year. After accession to the European Union, direct payments were the main source of income. Their share increased from 15% in 2004 to 77.8% in 2018.

    Przedmiotem artykułu są sprzeczności w ewolucji Wspólnej Polityki Rolnej. Celem rozważań jest określenie tych sprzeczności i pokazanie ich negatywnych konsekwencji. Autor wychodzi od osobliwości popytu na produkty rolne, omawia znaczenie Wspólnej Polityki Rolnej i prezentuje sześć kolejnych faz jej rozwoju. W konkluzji dokonuje syntezy sprzeczności ewolucji WPR i ich negatywnych konsekwencji. Formułuje pytanie, czy możliwe byłoby poddanie działalności handlowej w rolnictwie, podobnie jak w innych sektorach gospodarki, wolnej konkurencji między grupą państw lub globalnie, przy założeniu, że byłaby ona wzajemna i podlegała tym samym standardom jakości i bezpieczeństwa żywności.
    The subject of this article is contradictions in the evolution of the Common Agricultural Policy. The considerations aim to identify these contradictions and their negative consequences. Starting from the peculiarities of the demand for agricultural produce, the author discusses the importance of the Common Agricultural Policy and presents six successive phases of its development. He concludes with a synthesis of the contradictions of the CAP evolution and their negative consequences. He also raises a question as to whether it would be possible to subject commercial activity in agriculture, like in other sectors of the economy, to free competition among a group of states or globally, on the assumption that such competition would be reciprocal and subject to the same standards of quality and food safety.

    Celem rozważań była próba określenia kształtu prawnego zakładania, uznawania i funkcjonowania organizacji producentów rolnych (ze szczególnym uwzględnieniem zmian regulacji prawnych z 2019 i 2020 r.) oraz ich oceny w kontekście obecnych wyzwań dotyczących gospodarstw i rynków rolnych. Starano się także ustalić, które regulacje prawne stanowią barierę w zakresie zakładania i rozwoju organizacji producentów rolnych oraz wskazać propozycje ich zmiany. Rozważania skoncentrowano przede wszystkim na regulacjach unijnych dotyczących organizacji producentów rolnych (w tym zwłaszcza na rozporządzeniu Parlamentu Europejskiego i Rady (UE) nr 1308/2013 z 17 grudnia 2013 r. ustanawiających wspólną organizację rynków produktów rolnych) oraz znowelizowanych w 2019 i 2020 r. polskich przepisach. Poruszono zagadnienie europejskiego Zielonego Ładu i strategii na rzecz bioróżnorodności 2030 oraz „od pola do stołu” opublikowanych w maju 2020 r. przez Komisję Europejską. Do realizacji założeń wynikających z tych unijnych dokumentów mogą przyczynić się właśnie organizacje producentów rolnych, są one również ważne w aspekcie rozwoju gospodarstw i rynków rolnych. W dalszej części rozważań wskazano różnice i podobieństwa pomiędzy organizacjami a grupami producentów rolnych. W konkluzji stwierdzono m.in., że czynnikiem stanowiącym barierę w zakresie uznawania organizacji jest prawdopodobnie m.in. wysoka liczba producentów rolnych konieczna do rejestracji, jak i ilość dostarczanych produktów rolnych. Pozytywnie oceniono zmiany regulacji prawnych, które weszły w życie w maju 2020 r. Pozwalają one na korzystanie także przez organizacje producentów rolnych ze środków unijnych z działania „Tworzenie grup producentów i organizacji producentów” objętego Programem Rozwoju Obszarów Wiejskich na lata 2014-2020. Na koniec zaproponowano uchwalenie odrębnej ustawy o organizacjach producentów rolnych, regulującej zasady zakładania i funkcjonowania omawianych podmiotów.
    The article aims, firstly, to define the legal framework of the way agricultural producer groups are established, recognized and how they operate (with particular attention given to amendments to legal regulations of 2019 and 2020) and to assess them in the context of current challenges that farms and agricultural markets are facing, and secondly, determining which legal regulations constitute a barrier to the establishment and development of agricultural producer organizations and indication of proposals fortheir amendment. The considerations focusprimarily on EU regulations on agricultural producer organisations (including, in particular, Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007) and the Polish regulations amended in 2019 and 2020. The issue of the European Green Deal and the 2030 biodiversity strategy and “farm to fork” published in May 2020 by the European Commission is discussed. It is agricultural producer organisations that can contribute to the implementation of the assumptions included in those EU documents and they are important in terms of the development of farms and agricultural markets. Further on, the publication points out to the differences and similarities between organisations and groups of agricultural producers. In the conclusion, the author states, inter alia, that the factors hindering the recognition of the organisations include a high number of agricultural producers necessary for registration and the amount of supplied agricultural products. She positively assesses the amendments to the legal regulations that entered into force in May 2020. They allow agricultural producer organisations to use EU funds under the measure “Creation of producer groups and producer organisations” covered by the Rural Development Program for 2014-2020. Finally, she proposes adopting a separate act on agricultural producer organisations, regulating the principles of establishing and functioning of the entities in questions.

    The article presents basic rules regarding to the evolution of legal mechanisms affecting the competitiveness of agriculture in Europe. Market mechanisms such as agricultural intervention, private storage subsidies or emergency aid measures have been analyzed. Author also pointed out the mechanisms whoch influence the profitability of agriculture, the level of unemployment, or the possibility of creating groups of agricultural producers. A possible framework was also defined for making analysis of the need to participate in the definition of European agricultural policy after 2020. It was pointed out that competitiveness and selection of legal mechanisms which can improve it, still would be one of the more important in this process.

    Pending the entry into force of the Common Agricultural Organization of Agricultural Markets in 2007, there were twenty one coexisting industry market organizations as defined in the relevant basic EU regulations. Merging in one legal act the provisions of several dozen other EU regulations and looking at the single European market in a holistic and not sectoral way, illustrates the current way of running the Common Agricultural Policy, which seeks to comprehensively address the problems of the European agricultural market. From 1st September 2017, there has been a National Support Center for Agriculture, which took over the tasks of two liquidated agencies: the Agricultural Property Agency and the Agricultural Market Agency. Adaptation of the Polish legislation within the framework of agricultural policy will have to take into account the changes taking place in the Common Agricultural Policy in the future. From 1st October 2017, the sugar-producing quota system which existed for the last 50 years, setting the limits for individual Member States of the European Union, was terminated. This was the last system of agricultural quotas within the European Union. Following the harmonization of the Polish legislation with European standards, we are aware of the fact that the EU law is constantly facing changes.

    Opis:
    The study analyses changes taking place in the rural population’s economic activity during the functioning of Poland within the EU structures. The subject of research work was the processes of transformation in employment and unemployment of the total rural population and by: associations with farms, sectors, type of employment. Analysis has been based on general statistical data, results of the IAFE-NRI field studies and the literature. Due to a need to reduce the number of the employed in the agricultural sector from the perspective of reducing economic distance between the countryside and cities, as well as between Polish and EU agriculture, much room in the paper has been dedicated to the diversification of the rural population’s professional activity. The CAP in creating jobs in rural areas and in deagrarianising employment. It has been demonstrated that during the analysed period a relatively constant level of the rural population’ professional activity was accompanied by the increased employment level and decreased unemployment level. This process was going hand in hand with the diversification of employment. Consequently, employment in agriculture was less than 10% of the total population employed and 22% of the rural population. The creation of jobs is not a treaty objective of the CAP, it is activities in this regard which constituted an integral part of the rural development programmes financed under the CAP. From analysing of the ways and effects of their impact it results that those initiatives contributed to the growth of non-agricultural employment.
    Opracowanie zawiera analizę zmian zachodzących w aktywności ekonomicznej mieszkańców wsi w okresie funkcjonowania Polski w strukturach Unii Europejskiej (UE). W odniesieniu do sytuacji na rynku pracy przedmiot dociekań stanowiły procesy przeobrażeń w zatrudnieniu i bezrobociu ogółu ludności wiejskiej oraz według: związku z gospodarstwem rolnym, sektorów (rolnictwo – działy nierolnicze) charakteru zatrudnienia (najemnie – na własny rachunek). Tendencje w aktywności ekonomicznej mieszkańców polskiej wsi zostały skonfrontowane ze zmianami zachodzącymi w tej płaszczyźnie wśród ludności miejskiej oraz w innych krajach UE. Podstawę analizy stanowiły dane statystyki powszechnej (GUS i Eurostat) i wyniki badań terenowych IERiGŻ-PIB oraz literatura przedmiotu. Ze względu na konieczność spadku liczby pracujących w sektorze rolniczym z perspektywy zmniejszania dystansu ekonomicznego między wsią i miastem oraz polskim i unijnym rolnictwem, w pracy dużo miejsca poświęcono problematyce dywersyfikacji aktywności zawodowej ludności rolniczej. Podjęto również próbę określenie roli Wspólnej Polityki Rolnej (WPR) w kreowaniu miejsc pracy na obszarach wiejskich i dezagraryzacji zatrudnienia. Wykazano, że w okresie objętym analizą względnie stałemu poziomowi aktywności zawodowej ludności wiejskiej towarzyszył wzrost zatrudnienia i spadek bezrobocia. Z tym procesem szła w parze dywersyfikacja zatrudnienia. W konsekwencji zatrudnienie w rolnictwie miało niespełna 10% ogółu pracujących w polskiej gospodarce i 22% mieszkańców wsi. Pozostali pracowali głównie w usługach w miastach. Kreowanie miejsc pracy nie jest traktatowym celem WPR, to działania w tym zakresie stanowiły integralną część programów na rzecz rozwoju obszarów wiejskich finansowanych w ramach WPR. Z analizy sposobów i efektów ich oddziaływania wynika, że inicjatywy te przyczyniały się do wzrostu nierolniczego zatrudnienia.
