Church law
cultural trends
Opis:
Changes made over the centuries in ecclesiastical law are usually forced through the changing world, through cultural trends. A church living in a society is somewhat doomed to the review of its law and its updating. The critical point is the changing moral and social norms in societies that are very often against the norms of church law. Nevertheless, from the very beginning of the Churchʼs existence, he has the main goal: Salus animarum suprema lex, Jesus Christ is the only Savior of all mankind and the highest law is the salvation of man. The world is moving forward and changing its laws and the Church goes ahead without changing her main goal, but takes into account the existing conditions, hence we see changes in church law. Changes in church law, however, must be perceived as a response to the needs of time, but they are never changes that would in any way affect the implementation of the Church’s salvific mission.

Opis:
The problem addressed in the article is the question of the credibility of the Church based on benevolence in the light of the work of Marian Rusecki. The present issue was addressed and resolved in three stages. In the first stage – invoking the Ecclesia-forming activity of Jesus – the benevolence-based aspects related to the genesis of the Church were pointed out. In the second stage, the benevolent identity of the Ecclesia was presented, for which well-being is an essential part of its life and mission. At the final stage, the matter of recognizing the benevolence-based credibility of the Church was addressed, taking into account Rusecki’s personalistic and sign-based concept of the Church and the signs of its credibility. Elements that are helpful in recognizing the benevolence-based credibility of the Church were also identified. The Church’s benevolence – which is rooted in the life and work of Jesus – is clear in its connection to the entirety of human life. Goodness is the overriding value that man needs in life, especially in illness, suffering or misfortune. The Ecclesia is a clear and credible sign of God’s goodness when, aware of the salvific goods which it has received from Christ, it bestows them on human beings, remaining particularly sensitive to human injustice and evil, and takes the side of the disadvantaged and the suffering, providing them with concrete help, both spiritual and material.

Opis:
Radio is a very powerful mass communication medium. In radio broadcasting, one can hear the echo of Christ’s words to his apostles in the missionary discourse: “You received without charge, give without charge…What you hear in whispers, proclaim from the house tops” (Mt 10,8b.27). Although the Church uses radio as a means to transmit the Good News of salvation, and we as human beings receive radio transmissions as a part of our daily life, we barely stop to think and reflect upon the underlying aspects of radio as a means of communication. In this paper, the Author endeavours to give a historical overview of what makes radio an important medium for evangelisation according to four key documents of the Church, while also studying the underlying theological positions found in these documents. These documents enable us to study radio as a broadcasting medium, highlighting the possible reactions of the Church to radio and how the Church changed its stance on radio over the years. The reason for focussing specifically on radio is for two particular reasons: from the very beginning, the Church has considered radio as a means for evangelising the masses. Notwithstanding this, what is going to be discussing in the paper can be equally applied to Television as a mass communication medium. Secondly, the Church took an active role in radio broadcasting by asking Guglielmo Marconi himself to construct the Vatican Radio in 1931. The documents of the Church also offer us a theology of radio as a mass communication medium, with unity, progress and evangelisation being the fundamental aspects. Church documents posit that not everything should be broadcasted over radio but only messages which bring about peace and unity.

Opis:
Throughout the ages the Church has taken care of marriage peculiarly. Its concern has taken many forms where the legal one was the most evident. Therefore there is a system of conjugal law which is subordinated to the aim of the Church. It concludes in a principle that there can not be any valid conjugal contract which is not a sacrament in the same time. The article presents the conditions which have to be met to celebrate marriage validly.

The “tradition” of the Church always amazes us with its wealth and the characteristics of its documents. Also the liturgical tradition contributes in this in the important way. It is important to find the appropriate tools to learn about the same documents. In this way the great work done by the three scholars of liturgy is an example and reminder. Looking through all of the text reveals the infinity of elements which doubtless can be a great help per philolgiam ad theologia or ad culturam!

The article presents the Church’s origins from Christ as the basis of her uniqueness. Christ wanted to found the Church and gave her a particular structure and permanent actualization of the Ecclesia in history. Thus, the Ecclesia totally belongs to Christ, both in her origin and in her permanent actualization and in carrying out of the salvific mission. The origins from Christ are also an essential element of the Church’s credibility.

Opis:
In Bergoglio’s thinking, to build on fraternity in order to create a culture of encounter and justice means to move together towards unity, which helps to be committed “to allow people to serve as a body despite differences of viewpoint, physical separation and human ego”.[1] This attitude and these commitments will prevent us from falling into uniformity while respecting the values and richness of plurality. In fact, in today’s world, while we are more and more interconnected we experience a deep sense of division, especially at the social and economic level. Our societies and communities are more and more fragmented and this creates dangerous polarizations, as it is seen in politics and social life. Fraternity will help to foster dialogue at all levels and this will enable people “to generate a shared horizon toward which we can all move forward together”.[2] This does not mean, in Pope Francis’ understanding, denying tensions and differences. It rather calls for the engagement of everyone and all communities to work for a wider unity where all differences remain and coexist while working together. This reading of the present reality can help us react to the pandemic as a people, as a whole humanity with its differences and riches. But we need the courage “to restore an ethics of fraternity and solidarity, regenerating the bonds of trust and belonging. For what it saves is not an idea but an encounter.”   [1] Ibid., p. 68. [2] Ibid., p. 76.

The road to statutory regulation of legal personality of the Catholic Church in Poland "of the people" was extremely tortuous and had its turbulent history. In my analysis, I present how it came to pass the so-called "May's laws" and type this process in the whole relation between state – church, in the decade of eighties of the twentieth century. As I prove in my analysis, the way of conducting the work on the statutory regulation of the legal personality of the Catholic Church depended directly on the condition of the mutual relations and especially of the current, in a given period of time, concept of the religious policy of authorities, which in the last decade of the existance of the PRL had variable and dual character.
