Opis:
The article pertains to the matter of jurisdiction and the law applicable to relations between parents and children in Polish-Ukrainian relations. In recent years, in particular since the beginning of Russia’s military aggression against Ukraine, large waves of Ukrainian immigrants have come to Poland. The structure of the migration, with the domination of women and children, oblige Polish courts and other authorities to deal with the issues of parental responsibility, contacts with children, custody and maintenance in the cross-border context. In this situation, the bilateral Agreement between the Republic of Poland and Ukraine on legal assistance and legal relations in civil and criminal matters, signed in Kiev on 24 May 1993, acquires a new significance. It contains both the procedural rules (on jurisdiction, international legal aid, service of documents, as well as the recognition and enforcement of judgments) and confl ict of law provisions in the field of broadly understood civil matters, including relations between parents and children. The author undertakes a critical analysis of the provisions of Polish-Ukrainian Agreement as with respect to filiation (children’s origin), parental responsibility and child maintenance. The anachronism of its solutions and the need for its termination is emphasized.

The article deals with the new Uruguayan act on private international law, i.e. the General Act on Private International Law n° 19.920 of the 17th of November 2020. The authors aim to analyse and assess its solutions, especially in the areas of matrimonial property relations, succession and legal entities, taking into account historical and comparative perspectives. The study presents the origins of the Act, its structure, main characteristics and ideas, and essential novelties introduced thereby. As for matrimonial property relations and succession, the authors focus on the question of the applicable law, while as for legal entities, also on the notion of the recognition of their legal personality. Within the comparative remarks, new Uruguayan provisions are explained against the background of Argentinian, Brazilian, Chilean, Colombian, Cuban, Dominican, Panamanian, Paraguayan, Peruvian and Venezuelan rules, as well as international multilateral conventions and European Union regulations.

Opis:
Evgeny B. Pashukanis (1891—1937) is noted as the most influential theorist of law in Soviet Russia. In his book The General Theory of law and Marxism, issued in 1924, 1925 and 1927, he defined law as a form expressing the real relation between people in process of production and exchange of goods: the form that reaches its highest level as the rule of law (Rechtsstaat), when it becomes a mirage, concealing the real and deep conflict of interests. Pashukanis was convinced that in communism any form of law would disappear because there would be no class conflict of interests. He also repeated the prophesy of Marx that capitalism would disappear, as expressed in The Communist Manifesto. That the prophesy is false and that history is not a science in the same way as physics was showed and criticised by Karl Raimund Popper. The reduction of rule of law to the expression of class interest only is false as well, because many legal regulations are not connected to economic interests. The thesis whereby law occurs only in bourgeois society surely led people ruling in Soviet Russia to contempt of any law, taking into account the fact that Pashukanis’s book was popular and used in education. Interestingly enough, the book was printed in Polish in 1985, with the commentary that provides a very instructive and important theory of law.
