The Roman Republic struggled with many pathologies. These included usury, excessive profligacy, excesses in food and drink, gambling and political corruption. These phenomena caused far-reaching negative social consequences, so the state tried to eliminate them by means of laws. Their history clearly shows that they were extremely ineffective. They were published with noble intentions of improving customs in a broad sense and stopping the negative phenomenon of the disappearance of the features of the former ethos. They were an expression of the noble but somewhat naive faith presented by the Roman legislator that a problem could be solved by means of a law. This faith was shaken many times, and the reality of the functioning of these regulations proves that the society will always find a way to circumvent regulations that are not adapted to the conditions in which it lives

Marek Licyniusz Krassus w trakcie wyprawy przeciwko imperium Partów poniósł klęskę pod Carrhae, w wyniku której poległ. Wrogowie przejęli wtedy znaki legionowe pokonanej armii. Dążenie do ich odzyskania określiło cele rzymskiej polityki na Wschodzie w następnych latach. Stało się również priorytetem rzymskiej propagandy w czasach Augusta.
Regaining the legion’s standards (insignia) lost by Crassus as a result of his defeat at Carrhae was widely used in the Roman propaganda during the times of Augustus. The event in question had a rich religious significance in addition to its prestige. Referred to in literature as a factor contributing to the emperor’s glory, as the event was also a prerequisite of and a step towards building the Roman reign without borders. After recovering the standards, the success was celebrated not only in the above-mentioned contexts, but also as a military victory that forced the Parthians into surrendering. The occasion was similarly distinguished in numismatics and iconography, and by means of them promoted the connection of the signa with Mars the Avenger, both due to the character of the god’s veneration and origins thereof. Associating the recovered standards with the god could also involve the fulfilment of Caesar’s obligations and one of his promises.

W artykule omówiono książkę Daria Calomino Defacing the Past: Damnation and Desecration in Imperial Rome. Jej autor prześledził zmiany wizerunku rzymskich władców i osób z ich kręgu nanoszone na różne nośniki, w tym zwłaszcza na numizmaty. Zmiany te mogły być rezultatem negatywnego osądu konkretnej postaci z przyczyn ideologicznych bądź politycznych, można je więc połączyć z procesem potępiania pamięci — damnatio memoriae. W drugiej części artykułu zaprezentowano skrótowo historię badań nad tym zjawiskiem, wskazując przy tym jego aktualność i atrakcyjność poznawczą.
In her review of Dario Calomino’s book Defacing the Past, Anna Anzorge-Potrzebowska presents her reflections on the condemnation of memory inspired by this publication. Calomino’s aim has been to trace the changes introduced to the images of Roman rulers across various media. Those changes could (though not always had to) bear marks of a negative judgment of a given figure for ideological or political reasons. Calomino’s focus is on numismatics. His considerations are supplemented by references to analogous modifications of images of people from the emperors’ entourage and extensive use of sources other than numismatic. This approach places Calomino in a stream of research connected with the condemnation of memory. The way this author conducts the narrative also highlights such issues as the memory culture, the policy of historical memory in the Roman empire. The reviewer deliberately indicates here the area of the empire because Calomino’s book is not devoted exclusively to the Roman perspective.

The main purpose of this study is to determine which conflict of law rules constitute the basis for the search for the law applicable to private-law compensation claims provided for in Article 82 of the GDPR, and whether it is possible to apply the Rome II Regulation on the law applicable to non-contractual obligations in this regard. The authors first set out the main features of the claim, with particular emphasis on those areas where discrepancies may arise at the level of national law. They then qualify the claim as a tortious one, which leads them to pose a question about the applicability of the Rome II Regulation in this case. Special attention is given to the relationship between privacy and personal data protection. The authors argue that these two spheres have become gradually separated from each other and finally, under GDPR, claims for damages for a breach of personal data protection being independent of claims for an infringement of personal rights. Consequently, they assume that the law applicable to a claim under Article 82 of the GDPR should be indicated on the basis of the Rome II Regulation, despite the doubts arising from the exclusion provided for in Article 1.2.g Rome II. If approach is accepted, it will have significant consequences for the harmonisation of the application of the GDPR in the EU Member States, and for achieving the harmonisation of decisions at the level of national law.

The subject of this review is a study by Anna Tatarkiewicz devoted to the woman becoming mother in Ancient Rome. It delves into such aspects of lives and functioning of women in Ancient Rome as: the birth of a baby girl, her later wedding, pregnancy period, biologically giving birth, and dies lustricus, that is, acknowledging the social fact of childbirth by law, which equalled a mother being born symbolically.

Opis:
Disputes arising from international data breaches can be complex. Despite the introduction of new, unified EU regulation on the protection of personal data (GDPR), the European Union failed to amend the Rome II Regulation on the applicable law to non-contractual liability and to extend its scope to the infringements of privacy. GDPR only contains provisions on international civil procedure. However, there are no supplementing conflict-of-law rules. In order to determine the applicable law national courts have to apply divergent and dispersed national codifications of private international law. The aim of this study is to propose an optimal conflict-of-law model for determining the applicable law in case of infringement of the GDPR’s privacy regime.

Celem artykułu jest prześledzenie okoliczności przejęcia władzy przez Hadriana po śmierci Trajana. Tekst opiera się na analizie materiału numizmatycznego pochodzącego przede wszystkim z pierwszych lat rządów cesarza Hadriana. Treści emitowane przez mennicę cesarską jednoznacznie wskazują na potrzebę usankcjonowania władzy nowego princepsa. W artykule przedstawiono ponadto tło wydarzeń politycznych tego okresu, a także postaci w największym stopniu mające udział we władzy, zarówno zwolenników, jak i oponentów cesarza.
The aim of this article is to examine the circumstances of Hadrian’s assumption of power after the death of Trajan. Wojciech Wierzbicki has analysed the numismatic material of the emperor Hadrian dating mainly from the first years of his reign. These contents, the issue of the imperial mint, clearly indicate the desire and need to legitimate the power of the new princeps. Wierzbicki also presents the background to the political events of the period as well as the most important figures involved in sharing power, both supporters and opponents of the emperor.

Establishing an Italian American Archive of the Visual Arts of the late 1950s and early 1960sThis paper examines the role Rome played in the 1950s as an important outpost for the development of a distinct art scene, where the American and the Italian experience had the opportunity to blend with the artists gathering and sharing innovative ideas. It is a part of an ongoing research and it presents and sums up the early stage of the project which focuses mostly on archival sources and interviews with the central figures of this period. This paper, in particular, follows some of the members of this tran-Atlantic community, focusing in particular on the art galleries that fostered an international dialogue. Above all, this paper addresses the fundamental questions concerning whether this period could be considered as an “archive” of Italian and American art. It aims at demonstrating that, though not altogether free from contradictions and misconceptions, the period under study was very fertile in terms of the results of cross-cultural experience.

The claims are rights in personam but the assignment of claims has a hybrid nature. Abolishing the “nomina ossibus inhaerent” rule has increased commercial significance of the assignment of claims. However, the contemporary legal situationleaves parties with great legal uncertainty, as to the question under which circumstances does the cross - borders assignment is valid. A recent judgment of the CJEU of 9 October 2019 (C - 548/18) in case BGL BNP Paribas SA v. TeamBank AG Nürnberg has augmented this uncertainty. The Luxemburg Court ruled that: “Article 14 of the Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 (‘Rome I’) must be interpreted as not designating, directly or by analogy, the applicable law concerning the third-party effects of the assignment of a claim in the event of multiple assignments of the claim by the same creditor to successive assignees”. In this situation, one would highly welcome an attempt to establish a new set of conflict of laws rules relating to the law applicable to third - parties effects of the assignment of claims. This attempt has recently been made by the European Commission in its Report “on the question of the effectiveness of an assignment or subrogation of a claim against third parties and the priority of the assigned or subrogated claim over the right of another person”, dated 29 September 2016. In the present article, the author reviews the most important propositions formulated in the conflicts’ doctrine through the “lens” of the international insolvency law. Multiply provisions of the Regulation (EU) 2015/848 of 20 May 2015 on insolvency proceedings (recast) - despite many judgments of the CJEU in this area - also lack certainty. Insolvency is a foreseeable risk, but without clear rules concerning the third parties’ effects of the assignment of claims, it may become unenforceable for the creditors of the assignor.

In this article, Barbara Trygar analyses Giovanni Battista Piranesi’s The Veduta dell’Anfiteatro Flavio drawing detto il Colosseo. The Colosseum is one of world’s greatest buildings and for centuries it has inspired artists all over the world. This symbolic place reminds man about the drama of life: the fight between “to be” and “not to be” and the struggle for the values of freedom, truth, and the good. The drawing (engraving) by the Italian printmaker is a provoking reflection on the axiological and metaphysical dimensions of human life.

The question of which law should govern the third-party effects of assignments of claims was considered during the preparation of the Rome I Regulation. The European Commission’s proposal for the Rome I Regulation admitted the law of the assignor’s habitual residence as the law that should apply to the proprietary effects of assignments of claims. Finally, EU Regulation on the law applicable to contractual obligations did not include the issue of the third-party effects of the assignment. However, Article 27(2) of the Rome I Regulation required the European Commission to present a report on the question of the effectiveness of assignments of claims against third parties accompanied, if appropriate, by a proposal to amend the Rome I Regulation. Proposal for a Regulation on the law applicable to the third-party effects of assignments of claims (COM(2018) 96 final) is a response to this request. This paper analyses current draft of the new EU Regulation, the rules on determination of the third-party effects of assignments of claims (law of the assignor’s habitual residence and law of the assigned claim) and "super conflict rules" in specific cases. The author argues that the law of the assignor’s habitual residence remains the appropriate conflict rule for proprietary effects of assignments of claims.

W artykule zaprezentowano i omówiono indywidualne formy percepcji szeroko pojętej świętości uwidaczniającej się w diariuszach peregrynanckich spisanych przez dwóch franciszkanów reformatów: Remigiusza Zawadzkiego oraz Stanisława Kleczewskiego. Obu zakonników pełniąc obowiązki delegatów - odpowiednio: prowincji wielkopolskiej i kustodii ruskiej - udało się w podróż na kapitułę generalną Zakonu Braci Mniejszych. Trwająca niemal przez pół roku wyprawa, zakończona dotarciem do Rzymu w maju 1750 roku, oprócz wymiaru formalnego dostarczyła obu duchownym bezpośrednich okazji do odwiedzenia wielu założeń klasztornych, kościołów, bazylik, katedr oraz przede wszystkim miejsc kultu świętych. Pod tym względem wojaż do Wiecznego Miasta był dlaR. Zawadzkiego i S. Kleczewskiego nie tylko wyjątkowym i cennym doświadczeniem życiowym, lecz stanowił świadectwo pogłębiania wiary oraz poszukiwania kontaktu z Bogiem i dziedzictwemśw. Franciszka. Zarówno S. Kleczewski, jak i R. Zawadzki w zapiskach z wyprawy odnotowali wiele cennych wiadomości na temat przebytej drogi do Rzymu, pobytu w europejskich miastach i przebiegu obrad kapituły generalnej.
