The article presents the works of Codification Commission in the Second Republic of Poland on the specific section of the penal code. It considers the discussion on the reports of Juliusz Makarewicz and Stefan Glaser on offences against the so‑ called morality. The article not only emphasizes the views of the most prominent lawyers of the interwar period on the issues of sexual freedom, but also underlines the ideological differences regarding this matter. It also points out to a universal contribution of contemporary codification works to the understanding of the degree of state interference with the sexual freedom of an individual. Most of the opinions and legislative solutions of that time has remained unchanged up to this day, which only emphasizes a universal value of the presented discussion.

Opis:
The centenary of Poland’s regaining independence is conducive to reflections on the achievements of the last 100 years, including the legal achievements of the interwar period. The Codification Commission, which celebrated its 100th anniversary in 2019, played an important role in the creation of the law of the Second Republic of Poland. Professors at the Jagiellonian University, including F.K. Fierich, the first President of the Commission in 1919—1928; F. Zoll, S. Gołąb, T. Dziurzyński, W.L. Jaworski, S. Wróblewski, M. Rostworowski, A. Górski, E. Krzymuski, took an active part in its work. The work of the commission on the Polish nature conservation law of 1934 was inspired by professor at Jagiellonian University, W. Szafer. The influence of Cracow scholars on the shape of law was also exercised through participation in the works on the Constitution of 17 March 1921, participation in debates and discussions on the shape of various legal solutions in the field of, among others, the system of academic schools and the training of lawyers, shaping borders, creating acts of executive authorities by virtue of their functions as prime minister and ministers (among others, A. Benis, M. Bobrzyński, S. Estreicher, K.W. Kumaniecki, S. Kutrzeba, J. Nowak, W. Wróblewski).

Opis:
Developing a system of appeals in court proceedings, both in criminal and civil cases, is a matter of particular interest for legal reformers, especially in times of political breakthroughs. Admission of a full appeal, its limitation, or lack stems from the structure of the judiciary. Among priority tasks of the Codification Commission of the Second Republic of Poland was designing a system of appeals that would serve best the re-established Polish state. This article highlights the commission’s deliberations during work on the first Polish code of penal proceedings and during its far-reaching amendments. It discusses the standpoints of opponents and supporters of maintaining appeals from district court rulings decided by a judicial panel. Those problems have not lost their relevance. Until this day changes in a criminal lawsuit primarily attempt to streamline and accelerate penal proceedings. Under changing conditions, the search continues for the correct and adequate proportions between the protection of the defendant’s rights and the value of discovering the truth, the need for protecting public safety, fighting increasing crime, and protecting the victim’s interests.
