Opis:
The legal effects of the use of artificial intelligence algorithms need to be assessed not only at the level of national law, but also at the level of private international law. The initial point of assessment is to determine the law applicable to legal events related to artificial intelligence. The conflict of laws analysis of artificial intelligence also allows to expand the knowledge about traditional private international law institutions, such as ordre public clause. The paper does not pretend to fully explain the issue of conflict of laws of artificial intelligence. Its aim is to make a preliminary verification of the conflict-of-laws methods based of existing instruments. The study aims to start an academic discussion on artificial intelligence in the context of the conflicts of law. It is important as legal events related to artificial intelligence algorithms are characterized by considerable complexity.

In the Western culture there is a widespread belief that marriage should be contracted only by freely expressed will. Hence, marriages concluded at an early age are considered unacceptable. Entering into marriage by children has a negative impact on their education, physical and mental health, as well as their socioeconomic position. For this reason, such practices are incompatible with human rights. Therefore, European countries are trying to counteract them, which results in taking specific legislative actions. The intensification of these activities is particularly evident in the last decade, which is mainly caused by the increased migration to Europe from countries belonging to other cultural circles. Child marriages, being a phenomenon strongly embedded in culture, have become one of the areas where there are frictions between the majority, which in principle determines the shape of legal regulations, and minorities who, on the one hand, want to live in European countries, but also want to preserve the traditions that are cultivated in their countries of origin. The changes in law considering child marriages are undertaken in realm of substantive law as well as conflict of laws rules. In the second case, the states introduce specific public policy clauses referring to child marriages. The paper aims at describing and evaluating those changes in law, especially from the point of view of private international law.

Opis:
This article addresses the issues related to heredamiento - an agreement as to succession, characteristic of the Catalan legal system (Spain), the centuries-long functioning of which may be an inspiration for other legislators. The paper first attempts to locate this institution in the context of history and terminology. Further, it explains and describes the functioning of heredamiento in the provisions of Catalan law currently in force. The article then discusses the centuries-old location of this institution at the junction of succession law and family law. The paper also presents issues relating to the conflict of laws rules of private international law and the conflict of law rules of interregional law that are characteristic of the Spanish legal system. Therefore, introducing the reader to the institution of heredamiento, the author suggests that the Polish legislator should not cease looking for legal instruments adjusted and adapted to social realities, which would adequately protect the interests of both future decedents and heirs.

Opis:
The article raises issues concerning legal basis for the application of the overriding mandatory rules. In the Polish doctrine there are two opposing concepts in terms of explanation of the legal grounds for application of overriding mandatory rules. Both theories do not have a universal dimension, in the sense that they do not sufficiently explain the basis for the application of domestic as well as foreign overriding mandatory rules, being part of lex causae or coming from a third state. The article presents arguments for and against the possibility of deriving the legal grounds for application of the overriding mandatory rules, with reference to submissions made to that effect in literature. The author makes also an attempt to formulate a concept complementary to the concept of an integrated conflict-of-law rule with the substantive law rule, boiling down to the assumption that the basis for application of overriding mandatory rule is a second degree conflict of laws rule allowing to apply a first degree conflict of laws rule integrated with the substantive rule.

Opis:
The legislation of crimes against sexual integrity was initially aimed at safeguarding specific interests such as the honour of the father, the family, virginity, and the social security of women. Accordingly, the extent of rape victims was for a long time limited only to women (e.g. under Article 100 of the Criminal Code of the Socialist Republic of Slovenia from 1977, the execution of rape was only possible as immission penis in vaginam). In modern society, legislators seek to protect the self-determination of the individual, sexual and physical integrity, and sexual autonomy. This reversal demonstrates that modern criminal law revolves around the essential question of whether sexual intercourse is engaged in through free choice, that is, autonomously. Domestic legislators have been put under the pressure of media campaigns and controversial case law to modernise criminal law accordingly. In the spirit of the reforms, the Republic of Slovenia in 2021 adopted the amendments of Rape and Sexual Assault in the Criminal Code (KZ-1H) consistent with the affirmative consent model (“yes means yes”).

In the years 1644—1655 the Faculty of Law of the Vilnius Academy published several publications of professors working there and promoted doctors of both laws (utriusque iuris). Some of them covered Roman law. The dissertation of Benedict de Soxo, Claves juris, contains numerous Romanistic motifs. The Rector of the Vilnius Academy discussed terms, phrases and principles rooted in Roman law. Also, considerations concerning the sources of law, its interpretation or the teaching of law had their romanistic roots. Aaron Aleksander Olizarowski, professor at the Faculty of Law of the Vilnius Academy, in his work De politica hominum societate, published in Gdańsk in 1651, made numerous references to Roman law. Most of the romanistic themes were included in the first book, De Domo, when discussing issues related to marriage and family. In 1650 Jan Marquarta wrote a dissertation on Roman law entitled De damno injuriae, which was the only dissertation on this legal matter at the Vilnius Academy in the years 1644—1655. Although the work concerned damage and liability for damages, its author additionally presented the historical development of sources of law in ancient Rome. The content and structure of the dissertation testifies to the good romanistic background of its author. The works referring in their content to Roman law, in the initial period of functioning of the Faculty of Law of the Vilnius Academy, testify to its important role in science and teaching at university law studies.

The paper examines the fundamental issues regarding the interests in private international law. The goal of the present investigation is to attempt an answer to the question whose interests does the conflict-of-laws rules (narrowly understood) protect. This question is discussed in particular in reference to the theory created in the German doctrine by G. Kegel and developed by his follower K. Schurig. The paper systematizes the conflict-of-laws interests, giving the Polish law examples of the solutions that incorporate them. To be conscious that these interests exist and how they are allocated is necessary, both when drafting and enacting private international law legislation, as well as at the time of its application.

The question of which law should govern the third-party effects of assignments of claims was considered during the preparation of the Rome I Regulation. The European Commission’s proposal for the Rome I Regulation admitted the law of the assignor’s habitual residence as the law that should apply to the proprietary effects of assignments of claims. Finally, EU Regulation on the law applicable to contractual obligations did not include the issue of the third-party effects of the assignment. However, Article 27(2) of the Rome I Regulation required the European Commission to present a report on the question of the effectiveness of assignments of claims against third parties accompanied, if appropriate, by a proposal to amend the Rome I Regulation. Proposal for a Regulation on the law applicable to the third-party effects of assignments of claims (COM(2018) 96 final) is a response to this request. This paper analyses current draft of the new EU Regulation, the rules on determination of the third-party effects of assignments of claims (law of the assignor’s habitual residence and law of the assigned claim) and "super conflict rules" in specific cases. The author argues that the law of the assignor’s habitual residence remains the appropriate conflict rule for proprietary effects of assignments of claims.

The question of the law applicable to the third-party effects of assignments of claims is widely discussed in the doctrinal debates. In common opinion, the existing European conflict-of-laws regulations do not provide for a rule governing this issue. In the case BGL BNP Paribas SA v. TeamBank AG Nürnberg (C‑548/18), the Court of Justice of the European Union confirmed this gape of the Rome I Regulation.The gloss presents the justification of the European Union Court’s judgment, the reasons for the lack of the uniform conflict-of-laws regulation, and the consequences of this state. It also analyses briefly the European Commission’s proposal for the EU Regulation concerning the law applicable to the third-party effects of assignments of claims (COM(2018) 96 final), as a response to this situation. Finally, it examines the appropriate conflict-of-laws rules for proprietary effects of assignments of claims (the law of the assignor’s habitual residence and the law of the assigned claim).

The article confronts the unilateral and multilateral methods in private international law. The author first identifies the basic differences between the two. She then moves to describe the instruments and concepts resulting from the unilateral method: the theories of the Statutists in the period between 12th to 19th centuries, the solutions offered by the so called new American school, the method of recognition of private situations crystallized in a foreign legal system,  the rules governing the spatial scope of the EU provisions, including the regulations and the directives, and finally the paradigm of the overriding mandatory rules. The second part of the paper provides a comment to the Nikiforidis case. The author makes a number of critical remarks with respect to the restrictive and rigid interpretation of Article 9(3) adopted by the CJEU. The argument is made that the more flexible and functional approach proposed by the Attorney General Maciej Szpunar in his Opinion should be preferred. Finally, the author makes her own proposition regarding the Nikiforidis case. She advocates a unilateral methodology that rejects the distinction between the overriding mandatory rules of the legis fori, legis causae and these of a third country.

The article pertains to the matter of jurisdiction and the law applicable to relations between parents and children in Polish-Ukrainian relations. In recent years, in particular since the beginning of Russia’s military aggression against Ukraine, large waves of Ukrainian immigrants have come to Poland. The structure of the migration, with the domination of women and children, oblige Polish courts and other authorities to deal with the issues of parental responsibility, contacts with children, custody and maintenance in the cross-border context. In this situation, the bilateral Agreement between the Republic of Poland and Ukraine on legal assistance and legal relations in civil and criminal matters, signed in Kiev on 24 May 1993, acquires a new significance. It contains both the procedural rules (on jurisdiction, international legal aid, service of documents, as well as the recognition and enforcement of judgments) and confl ict of law provisions in the field of broadly understood civil matters, including relations between parents and children. The author undertakes a critical analysis of the provisions of Polish-Ukrainian Agreement as with respect to filiation (children’s origin), parental responsibility and child maintenance. The anachronism of its solutions and the need for its termination is emphasized.
