The paper sets out to deconstruct two concepts featuring in the title. Firstly, a novel definition of the welfare state based on economic ownership is presented, used then throughout the paper to examine the facts behind the widespread view of the welfare state finding itself in a crisis. Upon scrutiny, it turns out that empirical evidence to support the thesis under investigation is weak at best; neither globalisation nor Europeanization bring about any significant quantitative or qualitative worsening of welfare parameters. In addition, it is imperative not to put all the welfare states into one bag, as they in fact represent a plethora of diverse social-protection regimes.

The article identifies the special significance of state reserves for purposes of ensuring the national security of Ukraine. Established the main purpose of state reserves as a set of strategic reserves of the state to overcome the effects of risk factors. A review and analysis of recent domestic publications on this topic was done. The main definitions of state reserves are found. Established that the existing definitions of state reserves have, mainly, the material and economic plane of understanding. The author’s definition of state reserves was derived and proposed. It was noted that the definition should also contain an institutional and organizational component. The main structural components of state reserve are considered, among which the mobilization reserve, reserves to meet the strategic needs of the country and reserves to perform priority work during emergency response are identified. The peculiarity of the process of state reserve management is studied, where such classical components as normative-legal, institutional and organizational are singled out. A number of normative legal acts were analyzed, which regulate the basic principles of formation, use and disposal of state reserve of Ukraine, as well as the principles of activity of the State Reserve. Established that the institutional component of state reserve management process is embodied in the State Reserve, which is the central body of executive power. The relevance of the thesis that activity of the State Reserve as an active subject of economic processes is one of the main elements of state reserves management is also proved. The content of the process of managing the state reserve is revealed through the need to stabilize the socio-economic situation both in conditions of uncertainty and the consequences of emergencies, and in the normal functioning of the state economy. The essence of process of state reserve management is defined as the rational use of material and technical values that form the strategic reserve of state, in order to regulate economic development in normal socio-economic conditions or quickly overcome the negative consequences of man-made or natural emergencies as well as the consequences of martial law.

The article considers the history and development of the inauguration ceremonies of US presidents. Their role in legitimizing power and their influence on creating the image of the state is evaluated. The very specificity of the inauguration as a social phenomenon makes this ceremonial action a kind of illustration of the cultural condition, mores and tastes of society, national characteristics, becoming a symbolic characteristic of hierarchical differences. Its norms reflect not only ideology, but also the social psychology of society, without an adequate interpretation of which it is impossible to correctly understand the behavior of statesmen in specific situations related to their social status. State civil and military ceremonies, being, as a rule, striking events in the life of the state, have symbolic meaning. They establish a balance between their immediate participants and the highest environment, testify to the stability/instability within the ruling elite. Modern ceremonials of the inauguration of world presidents are politics, prestige, and the image of the government in power.

The changes that have taken place in Poland since 1989 reveal real problems whose solution depends on civic awareness, i.e. on understanding what a democratic legal state is and what role human rights play in it. Given the threats posed by various populisms, also the manipulation of the concepts of: nation, homeland, citizen, patriot, common good, etc., society may not notice how the normative state is turning into a prerogative state. An important role is played by knowledge and understanding of the provisions of the Constitution of the Republic of Poland of 2 April 1997, not only by lawyers, but by the whole of society and, perhaps above all, by the various levels of power, both legislative, executive and judicial. This also applies to local authorities, economic and social entities. Universal civic education and the everyday practice of democracy and human rights are essential. Over the past thirty-five years, there has been a slow change in the mentality of Poles, especially among the younger generation. People born in European Poland support a civil state in which human rights are respected. Paradoxically, the last eight years of PiS rule have contributed to an awareness of the role of law, including human rights, and a willingness to learn about the Constitution of the Republic of Poland. It is also important that the language of a democratic rule of law is back on track.

The article addresses the theoretical issues of the protection of the state interests in the Ukrainian law. The protection of the state interests, being an objective necessity from the perspective of the development of the state and the civil society, requires legal measures to be applied by the state. The core aspect in the analysis of the process of the protection of the state interests by such measures is the theoretical understanding of the state interests concept, including their definition and the requisite qualifications. Based on the approaches of the domestic as well as of the international law on human rights the state interests are proposed to be viewed as objective interests, public in nature, comprising the underlying general social needs, acknowledged by the state. The state interest include, further, the appropriate legal means by which such interests are capable of being protected. Such measures should be relevant to the respective state interests as well as to the specific social relationships in which such measures are to be applied.

De facto states are entities that resemble normal states, except for one difference: they lack international recognition or enjoy it only to a limited extent. Scott Pegg initiated a scholarly inquiry on these entities in 1998 when he published his seminal book, International Society and the De Facto State. Counting about twenty years after the birth of de facto state studies, scholars have started publishing their reflections on the problems that these studies face and directions for future research. I follow this reflective trend in my essay, drawing on my nearly two-decade-long experience of researching de facto states. More precisely, I discuss four problems of de facto state studies and suggest how they can be solved. These problems are as follows: 1. no consensus on a definition of a de facto state, 2. imperfect existing definitions, 3. insufficient engagement with the non-Western literature, and 4. indifference to other concepts and frameworks when studying de facto states.

Opis:
Ibn Khaldun is a Muslim thinker who lived in North Africa in the Middle Ages. The places where he lived were in a geography where tribal management systems were dominant and political turmoil and wars were never lacking. It is possible to see the traces of the geography and era in which Ibn Khaldun lived in the shaping of his political views. At that time, due to the fact that the tribes were constantly at war with each other, the administrations changed hands frequently, some states were destroyed and some new ones were established in their place. These observations led Ibn Khaldun to liken the life of states to human life. According to him, every state is born, develops and dies just like people. The destruction of states is an inevitable end. Ibn Khaldun has been criticized by some thinkers because of these views. In fact, his book Mukaddime was banned in the Ottoman Empire for a while on the grounds that it led the people to pessimism. This study was created by examining the original works of Ibn Khaldun with the exploratory method and interpreting his views.

The article is devoted to study of directions of improving the state regulation of the financial sphere in Ukraine. It is determined that the state regulation of the financial sphere should be carried out in the directions of ensuring the efficiency of budget funds use and providing the relationship between the authorities that carry out the state financial control. The article considers the problems in ensuring the effective state regulation of the financial sphere as a component of the mechanism of public administration and control. We have proved the importance of the state regulation of the financial sector in the current conditions of unstable and declining market economy that Ukraine is experiencing. It was noted that the issue of effective state regulation and control over the implementation of management decisions is thoroughly studied by scientists and practitioners. In practice, under the influence of these studies, more effective mechanisms and tools of the state control for the receipt and use of budget funds are being developed. The article analyzes the latest studies of domestic and foreign authors related to the issues of state regulation and management of the financial sphere The article examines the need for an active regulatory role of the state in the use and circulation of budget funds. Analyzing the state regulation of the financial sphere, it should be noted that it is an integral part of public administration of the economy as a whole. The article analyzes the advantages and disadvantages of the system of state regulation of the financial sphere in the country. There is a need for continuous improvement and increase of efficiency of state regulation and control over the circulation of budget funds.

The article examines the essence of the concept of a “service-oriented state” in the context of digitalization in Western Europe and identifies the peculiarities of its implementation in Ukraine. The concept of a service-oriented state involves a change in the approach to public sector management and transformation of the principles of relations between public authorities and citizens. The service approach in public administration primarily involves the introduction of information management technologies aimed at improving the quality of public services, enhancing social protection of the population and, ultimately, creating effective social security. The priority task of the state is to create conditions for self-realization of individuals, ensure their individual freedom and rights, and provide public services that would meet the needs of citizens. Modern digital technologies are significantly changing our lives, namely the way we produce products and services, methods and forms of education, and affect the social structure of society, the economy, politics, and the development of socio-cultural institutions. Ukraine’s priority task is to create a service-oriented state in which digital technologies would create conditions for self-realization of individuals, their individual freedom and rights, provision of quality public services, and effective social security.

The aim of this paper is to analyze the specific character of the so-called Islamic State. For the purposes of the study it is based on two assumptions. Firstly, the rise of the so-called Islamic State was determined by a number of regional and international conditions, in particular the destabilization of the Middle Eastern order, the events of the Arab Spring, operations of the United States in the region, globalization processes, and technological development. Secondly, the specific nature of the so-called Islamic State, reflected in the use of violence and intimidation, noncompliance with the principles of international law, and challenging the international order exclude the possibility of the entity in question being considered as a person of international law. To begin, with view to attain the research objective stated above and under consideration of the research hypotheses adopted herein, this paper examines the root causes behind the rise of the so-called Islamic State at the regional and international level. Subsequently, it defines the specific nature of the entity in question, taking into account its territory, internal structure, principles of operation, and personality.
Celem poznawczym artykułu jest analiza specyfiki tzw. Państwa Islamskiego. Dla potrzeb podjętego problemu przyjęto dwa założenia. Po pierwsze, na powstanie tzw. Państwa Islamskiego wpłynął szereg uwarunkowań o charakterze regionalnym i międzynarodowym, m.in.: destabilizacja porządku na Bliskim Wschodzie na skutek wydarzeń Arabskiej Wiosny Ludów, działania Stanów Zjednoczonych w regionie, procesy globalizacji i rozwój technologii. Po drugie, specyfika tzw. Państwa Islamskiego – określana m.in. przez: stosowanie przemocy, zastraszanie ludności, nieprzestrzeganie zasad prawa międzynarodowego oraz kontestowanie porządku międzynarodowego – nie pozwala uznać go za podmiot prawa międzynarodowego. W ramach artykułu wskazane zostaną, po pierwsze, najważniejsze uwarunkowania powstania tzw. Państwa Islamskiego na poziomie regionalnym i międzynarodowym. Po drugie, określona zostanie specyfika badanego podmiotu z uwzględnieniem zasięgu przestrzennego, struktury wewnętrznej i zasad funkcjonowania oraz podmiotowości.

Рассмотрены особенности зарубежных моделей социального государства, вызванными модернизационными процессами. Предложена современная политическая концепция модели государства всеобщего благоденствия. Определены основные тенденции в развитии социального государства в условиях современных вызовов глобализации. На основе анализа процессов формирования государства всеобщего благосостояния Украины определены параметры дальнейшего образца государства благосостояния.

The practice of placing in the constitution provisions relating to state symbols (emblem, flag, anthem) is satisfactory. Often accompany such regulation standards, the task is to indicate the center of which is the state capital. The desirability of such regulations is questionable, hence the question whether it is a common practice. The analysis covers the EU Member States. It is a inhomogeneous group, which should be considered as an advantage, because it allows to review the solutions. The aim is to answer the question of whether the EU countries there is a widespread practice of the constitutional establishment of the state capital, whether it is the dominant model, is it possible there are different solutions in this area, when such adjustments are redundant, whether such cases allow conclusions that can be application in practice of Polish political system.
Praktyka umieszczania w konstytucji przepisów dotyczących symboli państwowych (godło, flaga, hymn) nie budzi zastrzeżeń. Nierzadko takim regulacjom towarzyszą normy, których zadaniem jest wskazanie ośrodka będącego stolicą państwa. Celowość takich unormowań budzi wątpliwości, stąd pytanie, czy jest to praktyka powszechna. Przeprowadzona analiza obejmuje państwa członkowskie Unii Europejskiej. Jest to grupa niejednorodna, co należy uznać za zaletę, gdyż pozwala dokonać przeglądu stosowanych rozwiązań. Celem jest odpowiedź na pytania, czy w państwach UE istnieje powszechna praktyka konstytucyjnego ustanawiania stolicy państwa, czy jest to model dominujący, czy możliwe są odmienne rozwiązania w tym zakresie, w jakich przypadkach takie regulacje są zbędne, czy przypadki takie pozwalają na wyciągnięcie wniosków mogących mieć zastosowanie w polskiej praktyce ustrojowej.

The Polish State, with due regard to the time constraints on its continuity, is perceived from the perspective of more than a thousand years. Simultaneously, as an organised entity with its own values, it has been a mental problem for Poles since the turn of the 15th and 16th centuries and is continued until now. Thus, the reflections here have been restricted to the mentioned period because it is then that the main drawbacks of the Polish State began to occur. They include a description of these major flaws as we understand them and their effects. We often express the belief that our state disappeared from the map of Europe mainly due to the actions of our aggressive and finally partitioning neighbours. However, in doing so, we distance ourselves from the mistakes in managing the state made by the generations of our ancestors. This article analyses and exemplifies a deeper, critical academic reflection on these errors committed internally during the mentioned period and visible until today.

Konstytucja Republiki Estonii wyróżnia dwa rodzaje stanów nadzwyczajnych: stan wyjątkowy i stan wojenny. Zostały one skąpo unormowane na poziomie ustawy zasadniczej pozostawiając kwestie szczegółowe do regulacji ustawowej. Decyzja o wprowadzeniu stanu nadzwyczajnego wymaga współpracy parlamentu z organami władzy wykonawczej tj. prezydentem i rządem. Zagrożenie dla zdrowia i życia obywateli związane z pandemią koronawirusa nie stanowi okoliczności uzasadniającej zarządzenie stanu wyjątkowego ani tym bardziej stanu wojennego przewidzianych w §§128–129 ustawy zasadniczej. Tym samym w marcu 2020 r. władze estońskie zdecydowały o zastosowaniu mechanizmu przewidzianego w §87 Konstytucji.
There are two types of emergency states distinguished by the Constitution of the Republic of Estonia: state of emergency and state of war. They have been sparsely regulated at the level of the Constitution, leaving detailed issues to statutory regulation. The decision in this regard requires the cooperation of parliament with the authorities of executive power, i.e. the president and the government. The threat to the health and lives of citizens posed by a coronavirus pandemic is not a circumstance justifying the imposition of a state of emergency, let alone a state of war as stipulated in §§128–129 of the Constitution. Thus, the Estonian authorities in March 2020 decided to apply the mechanism of §87 section 8 of the Constitution.
