The article considers public security as a component of national security. Public security is one of the priorities of state policy in the field of national security. Successful public safety is the implementation of a set of measures in the field of landscaping: installation of traffic lights in appropriate public places, construction of underpasses, construction of indoor stops for citizens waiting for the arrival of public transport, etc. A well-thought-out system of planning and construction of settlements or public places, maintaining them in good condition, which promotes work and recreation of citizens, reduces the degree of threat to public safety from the occurrence of unexpected and dangerous situations. And neglect of public amenities can lead to favorable conditions for those who commit offenses and encroach on public safety. A special place is occupied by local governments, they are the closest power to the population, have the necessary powers and resources to attract citizens to maintain public order, increase their social activity in creating decent living conditions in a given area. The state defines local self-government as an independent level of government to which the people are entitled. First of all, it presupposes the organizational separation and independence of local self-government from state power, its independence in resolving issues of local importance, but independence within its own powers, as provided by the constitution. The main powers of local governments to ensure public safety and public order include: monitoring compliance with the law in the territory; application of measures of state coercion (usually, it is a question of bringing to administrative responsibility for the offenses connected with local government); protection of public order, carried out mainly by the police; ensuring the safety of citizens. Accordingly, local governments may be endowed with additional powers in the field of public order and protection of citizens’ rights. Protecting the rights of citizens is an important component of ensuring security both at the individual level and at the level of the entire state. The sense of security that is transmitted inside and outside the country can be considered part of the attractiveness of the image of the country abroad.

The scope of this article is to show selected problems concerning constitutional regulations of financial autonomy of self-government units in Poland, in the light of the legislator’s freedom to determine their incomes by bills. It appears that in the light of the current regulations, the freedom of the parliament is too great, which significantly limits the financial independence of local government units. The article will present proposals for changes to Polish constitutional regulations in this area in order to increase the self-government financial autonomy, with reference to the solutions in force in selected European countries. It is necessary to increase the influence of self-government about bills concerning their incomes and expenses, so it should be a constitutional obligation to consult such projects on the forum of the Joint Government and Self-Government Commission. The postulate of transforming the Senate into a Self-Government Chamber is also worth considering.
Celem artykułu jest przedstawienie wybranych problemów związanych z konstytucyjną regulacją samodzielności finansowej jednostek samorządu terytorialnego w Polsce, w kontekście swobody ustawodawcy w dziedzinie określania dochodów JST. Wydaje się, że w świetle aktualnych regulacji wspomniana swoboda ustawodawcy jest zbyt duża, co powoduje znaczne ograniczenie samodzielności finansowej JST. W artykule przedstawione zostaną propozycje zmian polskich unormowań konstytucyjnych w tej dziedzinie w celu zwiększenia wspomnianej samodzielności, w nawiązaniu do rozwiązań obowiązujących w wybranych państwach europejskich. Przede wszystkim konieczne jest zwiększenie wpływu organów samorządu terytorialnego na przebieg procedury ustawodawczej w przypadku projektów ustaw dotyczących dochodów i wydatków tych jednostek. Najbardziej wskazane byłoby wpisanie do ustawy zasadniczej obowiązku konsultowania takich projektów na forum Komisji Wspólnej Rządu i Samorządu Terytorialnego. Godny rozważenia jest też postulat przekształcenia Senatu w Izbę Samorządową.

The right for electing the representatives of authority bodies is one of the fundamentals of democracy. This right entitles citizens for active public participation through expressing their support (votes) for candidates, which will respectively represent their voters in certain institutions. Polish electoral law, which regulates the local self–government elections is very controversial. The existing legal rules were changed many times since 2011. Among the subjects being discussed one can mention electoral campaigns, candidate registration rules and organization of elections. Frequent changes in the electoral law result in misunderstandings and unwillingness to participate in elections. Their effect is low voter turnout and a large number of invalid votes. To sum up considerations over a political model of large cities, it is worth to indicate that during the last 25 years of operation of Polish local government none of political models of big cities was adopted.

After the collapse of the Union of Soviet Socialist Republics (USSR), Kazakhstan’s policymakers recognized that the existing model of state governance had proved ineffective and needed to be changed. One of the necessary solutions was to carry out decentralization. The primary purpose of the following article is to outline the barriers that Kazakhstan needs to remove if it is serious about building local self-government independence. Confronting these with the President’s vision of the transformation of local self-government led to the following research questions: What organizational and legal issues remain unresolved or constitute a barrier to the construction of independent local government structures in the Republic of Kazakhstan after the collapse of the Soviet Union?; to what extent do the changes proposed by President Kasym Tokayev meet the real challenges in the context of expanding the autonomy of local power structures? Answering the questions posed was possible by analyzing legal acts and finding literature and press materials.

The legal order of contemporary democratic states consists of a supervisory institution which cannot be used for political purposes or used in a discretionary manner. Poland, returning to the maps of Europe in 1918, was a country in which territorial self-government functioned, differing in many aspects from the model we encounter today. The differences concerned, among others supervision, which also played an important role in the activities of local government units in the Second Republic of Poland. The purpose of this article will be to show the evolution of supervision over territorial self-government in Poland.
Współczesne państwa demokratyczne w swoim porządku prawnym posiadają instytucję nadzoru, która nie może być wykorzystywana do celów politycznych, bądź stosowana w sposób uznaniowy. Powracająca na mapy Europy w 1918 r. Polska, była państwem, w którym funkcjonował samorząd terytorialny, różniący się w wielu aspektach od modelu, z którym mamy styczność w dzisiejszych czasach. Różnice dotyczyły m.in. nadzoru, który również w II RP pełnił ważną rolę w działalności jednostek samorządu terytorialnego. Celem niniejszego artykułu będzie ukazanie ewolucji nadzoru nad samorządem terytorialnym w Polsce.

Discussion whether to formalize participatory budgeting or not has been solved. Again, this time it has happened without scholars’ engagement. Given this situation, can we say that whoever is satisfied? The amendment of the act that introduced legal form of participatory budgeting as a new tool of public consultation does not meet anyone expectations. The reason to think so is that there is no new and compulsory form of public engagement in financial decisions. Moreover, organizational framework and the huge variety of using participatory budgeting have been turned to uniform pattern. Equally, it is hard to agree that implemented solutions, previously though as a way to increase citizens’ involvement in functioning and scrutiny part of public bodies, have been met.

The following paper employs a normative approach and focuses on the problem of the current state of the local self-government in the South Caucasus countries: Georgia, Armenia, and Azerbaijan. Since all these countries are members of the Council of Europe, a reference point for decentralisation is the European Charter of Local Self-Government. The paper's main thesis is that despite showing some similarities, the countries have introduced different models of decentralisation that do not fully meet the Council of Europe’s criteria. Such variation is in line with the different political systems of these states and their level of democratisation. The more democratic the state is, the stronger the decentralisation it has adopted. Thus, decentralisation in Georgia follows the European model of public policy, while Azerbaijan is preserving the former Soviet model of weak self-government, with central authorities playing the leading role in public services. The current changes in Armenia’s model resemble the Georgian track of reforms. The findings of this paper may be applicable both in further theoretical research and in implementing reforms of local self-government in various post-Soviet states.

Michał Kulesza, Jerzy Regulski, and Jerzy Stępień are three co-authors of polish self-government reform (1990 – 1998). The author of the article searches their roles as experts as well as politicians in shaping self-government system. Final conclusion is as follows: although they were “scientific owners” of the problem, their important part in resolving it was more political (bureaucratic) than professional. The matter of their professional role was generally out of question. Practically, the most difficult task was not the shape of future self-government system but the implementation of it. Key in resolving this problem was the political position of aforementioned co-authors, their participation in bureaucratic power, and openness for lobbying. It is a meaningful lesson for the future reformers, each and every one of them.

In this article, I will focus on the evolution of the systems of elections to the commune councils in Poland. Between 1990 – 2014, seven elections to the commune councils were organized in Poland, conducted on the basis of four different voting systems. The most important alterations in the ordinations between 1990 and 2011 included: changing the category of entities qualifying for majority election system, modification of the dimension of the constituencies, changing the mode of distribution of seats, introducing electoral threshold, diminishing the number of councilors, implementing the procedure of “grouping list”. Analysis of changes in the electoral regulations leads to the conclusion that the elections to municipal councils have been politicized.

This paper presents changes that have occurred at the local level in Poland and new German federal states during the process of the post-communist system transformation. The stages of rebuilding the local self-government and its structures are analyzed. The experiences of Poland and Eastern Germany – two states where the system transformation took different courses – were compared. At the same time, both countries have different constitutional orders of the unitary state and federal state, and this context are interesting fields for a comparative analysis. This paper also confronts the two methods of institution building – the importing of well-established institutions and developing them in the evolutionary way, where in both cases path a dependency can be well observed. In Germany this is considered a special case (Sonderfall) of institutional transformation, in which the key role was played by the transference of institutions, personnel and financial means. This was also done much quicker and in a more structured and comprehensive way than in Poland. In the case of Poland, the creation of local self-government structures or shaping the political actors was a grassroots and evolutionary process. This article points out the most important factors that had a crucial significance in the course and results of the transformation and explains different ways of developing the system of democratic local self-government.

The article presents issues related to road traffic organization in the territorial self-government units. The author analyzes such categories as: public roads, road traffic organization, the competences of local government. Considerations include an analysis of the practices to determine the rules of the road traffic, the fundamental principles of establishing and obeying the local law and the relationships between the self-government bodies: the Executive (Mayor, president) and the Legislature of the municipality (Municipal Council). The foundation of the statements made are the most important acts of law, comments of specialists and attitudes of the Supreme Court and administrative courts. Artykuł przedstawia kształtowanie konstytucyjnych postanowień dotyczących samorządu terytorialnego i omawia zjawisko rozszerzania zakresu konstytucjonalizacji tego zagadnienia ustrojowego. Wskazuje etapy tego rozszerzania: 1) wprowadzenie do unormowań konstytu-cyjnych zasady udziału samorządu terytorialnego w sprawowaniu władzy (1989), 2) ukształ-towanie konstytucyjnych podstaw dla utworzenia samorządu terytorialnego w postaci wpro-wadzenia do konstytucji rozdziału regulującego samorząd terytorialny (1990), 3) rozszerzenie zakresu konstytucyjnej regulacji materii dotyczącej samorządu terytorialnego o zakres wy-konywanych zadań (październik 1992 r.), 4) uchwalenie obowiązującej konstytucji z 1997 r., której rozdział reguluje konstytucyjne podstawy funkcjonowania samorządu terytorialnego.
The article describes the process of shaping constitutional provisions concerning lo-cal selg-government and presents a phenomenon of increasing constitutionalisaton of this element of state policy. Author indicates four stages of this process: 1) establish-ing a principle of local self-government participation into system of public authority (1989), 2) establishing a constitutional chapter regarding structure of local self-govern-ment (1990), 3) complementing this regulation with provisions concerning self-govern-mental tasks (1992), 4) adopting the Constitution 1997, in which a chapter concerning local self-government.

The notion of region is particularly vague, as this issue is referred to by studies from various disciplines. It has long been one of the subjects of interest of the Council of Europe which perceives local and regional administration as one of the fundamental ingredients of modern European democracy. The European Charter of Local Self- -Government is the main document that regulates these matters in the Council of Europe law system. It is accompanied by a number of other documents, including The European Charter of Regional Self-Government. The article provides an analysis of these normative deeds within the realm of Union law. When the Single European Act entered into force, regions have become an important part of Union policy. Committee of the Regions set up in 1994, whose operation is related to the principle of subsidiarity and programming of the idea of the Europe of Regions, is the most important body concerned with regional issues.
