The article considers public security as a component of national security. Public security is one of the priorities of state policy in the field of national security. Successful public safety is the implementation of a set of measures in the field of landscaping: installation of traffic lights in appropriate public places, construction of underpasses, construction of indoor stops for citizens waiting for the arrival of public transport, etc. A well-thought-out system of planning and construction of settlements or public places, maintaining them in good condition, which promotes work and recreation of citizens, reduces the degree of threat to public safety from the occurrence of unexpected and dangerous situations. And neglect of public amenities can lead to favorable conditions for those who commit offenses and encroach on public safety. A special place is occupied by local governments, they are the closest power to the population, have the necessary powers and resources to attract citizens to maintain public order, increase their social activity in creating decent living conditions in a given area. The state defines local self-government as an independent level of government to which the people are entitled. First of all, it presupposes the organizational separation and independence of local self-government from state power, its independence in resolving issues of local importance, but independence within its own powers, as provided by the constitution. The main powers of local governments to ensure public safety and public order include: monitoring compliance with the law in the territory; application of measures of state coercion (usually, it is a question of bringing to administrative responsibility for the offenses connected with local government); protection of public order, carried out mainly by the police; ensuring the safety of citizens. Accordingly, local governments may be endowed with additional powers in the field of public order and protection of citizens’ rights. Protecting the rights of citizens is an important component of ensuring security both at the individual level and at the level of the entire state. The sense of security that is transmitted inside and outside the country can be considered part of the attractiveness of the image of the country abroad.

The right for electing the representatives of authority bodies is one of the fundamentals of democracy. This right entitles citizens for active public participation through expressing their support (votes) for candidates, which will respectively represent their voters in certain institutions. Polish electoral law, which regulates the local self–government elections is very controversial. The existing legal rules were changed many times since 2011. Among the subjects being discussed one can mention electoral campaigns, candidate registration rules and organization of elections. Frequent changes in the electoral law result in misunderstandings and unwillingness to participate in elections. Their effect is low voter turnout and a large number of invalid votes. To sum up considerations over a political model of large cities, it is worth to indicate that during the last 25 years of operation of Polish local government none of political models of big cities was adopted.

After the collapse of the Union of Soviet Socialist Republics (USSR), Kazakhstan’s policymakers recognized that the existing model of state governance had proved ineffective and needed to be changed. One of the necessary solutions was to carry out decentralization. The primary purpose of the following article is to outline the barriers that Kazakhstan needs to remove if it is serious about building local self-government independence. Confronting these with the President’s vision of the transformation of local self-government led to the following research questions: What organizational and legal issues remain unresolved or constitute a barrier to the construction of independent local government structures in the Republic of Kazakhstan after the collapse of the Soviet Union?; to what extent do the changes proposed by President Kasym Tokayev meet the real challenges in the context of expanding the autonomy of local power structures? Answering the questions posed was possible by analyzing legal acts and finding literature and press materials.

The following paper employs a normative approach and focuses on the problem of the current state of the local self-government in the South Caucasus countries: Georgia, Armenia, and Azerbaijan. Since all these countries are members of the Council of Europe, a reference point for decentralisation is the European Charter of Local Self-Government. The paper's main thesis is that despite showing some similarities, the countries have introduced different models of decentralisation that do not fully meet the Council of Europe’s criteria. Such variation is in line with the different political systems of these states and their level of democratisation. The more democratic the state is, the stronger the decentralisation it has adopted. Thus, decentralisation in Georgia follows the European model of public policy, while Azerbaijan is preserving the former Soviet model of weak self-government, with central authorities playing the leading role in public services. The current changes in Armenia’s model resemble the Georgian track of reforms. The findings of this paper may be applicable both in further theoretical research and in implementing reforms of local self-government in various post-Soviet states.

This paper presents changes that have occurred at the local level in Poland and new German federal states during the process of the post-communist system transformation. The stages of rebuilding the local self-government and its structures are analyzed. The experiences of Poland and Eastern Germany – two states where the system transformation took different courses – were compared. At the same time, both countries have different constitutional orders of the unitary state and federal state, and this context are interesting fields for a comparative analysis. This paper also confronts the two methods of institution building – the importing of well-established institutions and developing them in the evolutionary way, where in both cases path a dependency can be well observed. In Germany this is considered a special case (Sonderfall) of institutional transformation, in which the key role was played by the transference of institutions, personnel and financial means. This was also done much quicker and in a more structured and comprehensive way than in Poland. In the case of Poland, the creation of local self-government structures or shaping the political actors was a grassroots and evolutionary process. This article points out the most important factors that had a crucial significance in the course and results of the transformation and explains different ways of developing the system of democratic local self-government.

Artykuł przedstawia kształtowanie konstytucyjnych postanowień dotyczących samorządu terytorialnego i omawia zjawisko rozszerzania zakresu konstytucjonalizacji tego zagadnienia ustrojowego. Wskazuje etapy tego rozszerzania: 1) wprowadzenie do unormowań konstytu-cyjnych zasady udziału samorządu terytorialnego w sprawowaniu władzy (1989), 2) ukształ-towanie konstytucyjnych podstaw dla utworzenia samorządu terytorialnego w postaci wpro-wadzenia do konstytucji rozdziału regulującego samorząd terytorialny (1990), 3) rozszerzenie zakresu konstytucyjnej regulacji materii dotyczącej samorządu terytorialnego o zakres wy-konywanych zadań (październik 1992 r.), 4) uchwalenie obowiązującej konstytucji z 1997 r., której rozdział reguluje konstytucyjne podstawy funkcjonowania samorządu terytorialnego.
The article describes the process of shaping constitutional provisions concerning lo-cal selg-government and presents a phenomenon of increasing constitutionalisaton of this element of state policy. Author indicates four stages of this process: 1) establish-ing a principle of local self-government participation into system of public authority (1989), 2) establishing a constitutional chapter regarding structure of local self-govern-ment (1990), 3) complementing this regulation with provisions concerning self-govern-mental tasks (1992), 4) adopting the Constitution 1997, in which a chapter concerning local self-government.

Local self-government constitutes a part of executive power in the state, with the state’s law underlying its functioning. Local government remains under the state’s supervision, representing a form of the political system within the decentralized public administration. 2018 marks 20 years of the functioning of local self-government based on a three-tier structure. The aim of the paper is an attempt at finding the answer to the question whether or not the organizational solutions adopted by the legislator and established in practice need to undergo reforms and if so, to what extent? The question thus formulated relates directly to the argument that the organization of local government system is not sound while the criteria assumed in the territorial breakdown of the local government organization do not correspond to the conditions in which those units operate, and therefore what appears necessary is for the system to be reorganized and the number of units at individual tiers to be reduced. The paper presents selected problems of the local administration in the context of a systemic organization and suggest possible (or necessary) changes which, in the author’s view, should become a subject of discussion (and in practice are such) between local selfgovernment and government administration.

The article presents a theoretical and legal analysis of local democracy. The top place in democratic transformations in local democracy; is an effective system of local self-government that is impossible without working mechanisms to implement legislation in the field of local democracy at both national and local levels. The author points out that the importance of local democracy is determined by its essence and role. After all, the local level is the closest to the population, needs, and problems. The creation of appropriate living conditions should be determined locally. It is determined that the term «local area» means a reasonably extensive range of phenomena and processes. In defining this term in scientific doctrine, emphasis is placed on a particular phenomenon or process. The predominance of local democracy is understood as a national model of democracy, as the participation of citizens in governance, as a form of self-organization of citizens and as a democratic system at the municipal level. Based on the analysis of scientific points of view, conclusions are made about the peculiarities of local democracy. The main characteristics of local democracy are an organization of the life of the territorial community on the principles of equality, participation, public dialogue; involvement of citizens in community affairs, dissemination of practices of local initiatives, referendums; self-organization of the population. The local democracy is the development of the people, the broad involvement of local people in participation in matters of meaning. Effective local democracy is a prerequisite for sustainable and equitable economic and social development, good governance, and the promotion of democratic values. The proper functioning of democratic institutions and processes at the local level is a determining and vital factor. Active citizenship at the local level lays the foundation for a stable and robust democracy at the national level because the policy at the national level uses practices and methods at the local level. In contrast, experience at the local level is the basis for national policy and reform.

The legal order of contemporary democratic states consists of a supervisory institution which cannot be used for political purposes or used in a discretionary manner. Poland, returning to the maps of Europe in 1918, was a country in which territorial self-government functioned, differing in many aspects from the model we encounter today. The differences concerned, among others supervision, which also played an important role in the activities of local government units in the Second Republic of Poland. The purpose of this article will be to show the evolution of supervision over territorial self-government in Poland.
Współczesne państwa demokratyczne w swoim porządku prawnym posiadają instytucję nadzoru, która nie może być wykorzystywana do celów politycznych, bądź stosowana w sposób uznaniowy. Powracająca na mapy Europy w 1918 r. Polska, była państwem, w którym funkcjonował samorząd terytorialny, różniący się w wielu aspektach od modelu, z którym mamy styczność w dzisiejszych czasach. Różnice dotyczyły m.in. nadzoru, który również w II RP pełnił ważną rolę w działalności jednostek samorządu terytorialnego. Celem niniejszego artykułu będzie ukazanie ewolucji nadzoru nad samorządem terytorialnym w Polsce.

Artykuł jest studium przypadku, przedstawiającym współpracę międzynarodową Olecka, które jest stolicą Mazur Garbatych, jako jednej z ponad sześciuset istniejących w Polsce gmin miejsko- -wiejskich. Ukazano w nim sięgające czasów komunistycznej Polski początki tej współpracy, wyrażającej się kooperacją z francuską gminą Marly. Główna część tekstu stanowi omówienie ewolucji i ocenę współczesnej współpracy międzynarodowej Olecka, na którą składają się relacje z partnerami białoruskimi (Szczuczyn), litewskimi (Wilkowyszki, Kozłowa Ruda), ukraińskimi (Drohobycz), rosyjskimi (Gusiew), austriackimi (Guessing) i estońskimi (Johvi). Cechą charakterystyczną aktywności międzynarodowej Olecka jest ścisłe powiązanie z jego położeniem geograficznym i pochodzeniem olecczan. To one determinują w przeważającym stopniu, z kim i na jakich zasadach miasto współpracuje, w bardzo znaczącym stopniu wykorzystując fundusze Unii Europejskiej. Ta aktywność stolicy Mazur Garbatych została dostrzeżona na arenie międzynarodowej. W roku 2014 Olecko zostało uhonorowane prestiżową nagrodą i tytułem Europejskiego Miasta Sportu.
The article is a case study which depicts the international cooperation of Olecko, which is the capital of Mazury Garbate and one of over six hundred urban-rural boroughs in Poland. It shows the beginnings of this activity, dating back to the communist times in Poland, expressed through cooperation with the French municipality of Marly. The main part of the text, however, discusses the evolution and evaluation of contemporary international cooperation of Olecko, which consists in developing relations with Belarusian (Szczuczyn), Lithuanian (Wilkowyszki, Kozlov Ore), Ukrainian (Drohobych), Russian (Gusev), Austrian (Guessing), and Estonian (Johvi) partners. A characteristic feature of Olecko’s international activity is closely linked with its geographical position and the origin of its inhabitants. These factors largely determine with whom and on what terms the city cooperates with, using a significant amount of EU funding. This international activity of the capital of Mazury Garbate has been internationally recognized. In 2014, Olecko was awarded the prestigious prize and the European City of Sport title.

The article provides a scientific analysis of the financial independence of territorial communities, which is aimed at strengthening the implementation of decentralization measures in Ukraine. Indicated that problems of financial support of the local government powers are the focus of Ukrainian scientists, experts in local budget management and finance. Independence in the aspect of local self-government should be considered within the norms established by the Constitution of Ukraine, the European Charter of Local Self-Government, and other legislative acts. Performed theoretical and applied identification of the “financial independence of the territorial community”. Analyzed the key provisions of the Ukrainian legislation on financial support of territorial communities, which were transformed in the process of decentralization during 2014–2020. Highlighted the state policy components of ensuring the financial independence of territorial communities, based on the principles of the European Charter of Local Self-Government. Measures of state policy to ensure the financial independence of territorial communities can be systematized into two groups: 1) direct participation of the state in the formation of financial resources of communities and territories; 2) indirect participation of the state in the formation of financial resources of communities and territories and their disposal. Noted that consolidation of revenue sources in local budgets of Ukraine is characterized by instability. Summarized the results of the sociological study of the financial support of territorial communities in terms of their financial independence. Emphasized the lack of legal opportunity for local governments to independently keep records of personal income tax and other national taxes in terms of their payers. Proposed the measures to improve the administration of taxes, which are a source of revenue to local budgets: organization of a digital information network on the payment of taxes and other mandatory payments by individuals and ensuring access to it by local government officials; establishing interaction of territorial bodies of the State Tax Service of Ukraine with local self- -government bodies on issues of control over the correctness and timeliness of tax payments and other obligatory payments by individuals and legal entities, etc.

Local self-government in the Republic of Belarus is an institution of constitutional law. It declares functioning of institutions of direct and indirect democracy. The aim of following paper is to describe legal aspects of institutions of direct democracy in the system of local self-government in Belarus including local referendum, local assembly and territorial social self-government. It discusses also problems in implementation of direct democracy mechanisms, relating this with the specificity of nondemocratic political regime in contemporary Belarus.

Presented article shows current problems regarding the lack of compliance by public authorities of the fundamental principles and values defining the democratic systemic order.Failure to obey the constitutional rules of social life, circumventing the law, and even breaking them, weakening civic institutions, inevitably threats the security of the democratic systemic worked by Poland after 1989.In this context, the right to selfgovernment ceases to be one of the most important, elementary values allowing the fullfilling of the principle of a democratic state of law.
В данной статье представлены актуальные проблемы несоблюдения органами го- сударственной власти основополагающих принципов и ценностей, определяющих демократический системный порядок. Несоблюдение конституционных правил общественной жизни, обход законов и даже нарушение их, ослабление граждан- ских институтов неизбежно ставит под угрозу безопасность демократического системного строя, сложившегося в Польше после 1989 года. В этом контексте право на самоуправление перестаёт быть одной из важнейших элементарных ценностей, позволяющих реализовать принцип демократического правового государства.

The notion of region is particularly vague, as this issue is referred to by studies from various disciplines. It has long been one of the subjects of interest of the Council of Europe which perceives local and regional administration as one of the fundamental ingredients of modern European democracy. The European Charter of Local Self- -Government is the main document that regulates these matters in the Council of Europe law system. It is accompanied by a number of other documents, including The European Charter of Regional Self-Government. The article provides an analysis of these normative deeds within the realm of Union law. When the Single European Act entered into force, regions have become an important part of Union policy. Committee of the Regions set up in 1994, whose operation is related to the principle of subsidiarity and programming of the idea of the Europe of Regions, is the most important body concerned with regional issues.

Opis:
Development of local self-government institutions, positive dynamics of local development through the level of public capacity. Demographic capacity is part of the overall capacity of the local community. Demographic capacity is seen here as the ability of a local community to demonstrate a positive level of demonstration - one that allows communities to function smoothly, to have a resource program that provides a quality level of services to live in communities. The article presents an analysis of the current state of demographic processes in Ukraine and European countries. Insufficient demographic capacity in Ukrainian territorial communities is a consequence, first of all, of negative transformational societies, state institutions and local self-government institutions. Restoration of the demographic balance in Ukrainian communities depends on the nation of positive changes in the socio-economic and political spheres. Take care of your health, feel positive, give birth to children more than residents of those communities that have managed to achieve such positive changes and improve living standards. Theoretical and methodological basic research is the scientific works of foreign and domestic scientists on selected issues. Dialectical, systemic and structural methods of analysis and generalization are applied. The main goal of the article is to analyze and systematize the theoretical and methodological approaches to defining the concept of demographic capacity of the community. The task of the article is to study the trends and patterns of the current situation and identify opportunities and mechanisms to ensure demographic capacity.
