    The authors of this article undertake a general discussion of the legal protection of Japan’s cultural heritage. They begin their reflection with the issue of comparative legal studies, treating it as a determinant of the direction and scope of legal analysis of the cultural property protection in Japan. However, their main focus are three issues. These are: the history of legal protection of the cultural heritage against the background of the formation of modern Japanese law, the subject of protection and its categories according to the Japanese Act of 30 May 1950 on the Protection of Cultural Property, and the empirically significant aspect of conservation theory concerning the issue of the authenticity of a historic substance in relation to Japan. The authors end their analysis of the legal history of the protection of Japan’s cultural heritage with a discussion of the 1950 Law, which (amended) still remains in force. The curious practice of monuments conservation in Japan related to the understanding of the authenticity of a historic substance by the Japanese is addressed by the authors in the last part of the article.

    The aim of the article is to present the functioning of the International Committee on the Blue Shield in the system of protection of cultural property in the conditions of war and natural disasters. The author has analyzed the problem through the prism of the international legal status of protection of cultural goods and the practical activities of the International Committee of the Blue Shield in the world and in Poland. The protection of cultural property in the context of military threats and natural disasters is an important element of the state’s cultural policy and of the international community’s activities carried out under international law. In spite of over one hundred years of improvement of the law of cultural heritage protection, numerous cultural objects have been destroyed. The ineffectiveness of state protection has contributed to the protection of international NGOs. One of them is the International Board of the Blue Shield, which brings together national committees dedicated to the preparation of the protection of cultural property during conflicts and natural disasters. Non-governmental organizations provide greater opportunities for the protection of cultural goods in a variety of threats.
    Artykuł jest analizą funkcjonowania Międzynarodowego Komitetu Błękitnej Tarczy w systemie ochrony dóbr kultury w warunkach wojny i klęsk żywiołowych, na tle międzynarodowego systemu ochrony dóbr kultury. Autorka dokonała analizy problemu poprzez pryzmat międzynarodowego stanu prawnego ochrony dóbr kultury oraz praktycznych działań Międzynarodowego Komitetu Błękitnej Tarczy na świecie i w Polsce. Ochrona dóbr kultury w warunkach zagrożeń wojennych i klęsk żywiołowych jest ważnym elementem polityki kulturalnej państwa oraz działań wspólnoty międzynarodowej realizowanym na podstawie prawa międzynarodowego. Mimo ponad stuletniego doskonalenia prawa ochrony dziedzictwa kultury w dalszym ciągu dochodzi do licznych zniszczeń obiektów kultury. Nieskuteczność ochrony realizowanej przez państwa spowodowała włączenie się w proces ochrony międzynarodowych organizacji pozarządowych. Jedną z nich jest Międzynarodowy Komitet Błękitnej Tarczy, który skupia komitety krajowe działające na rzecz przygotowania ochrony dóbr kultury w okresie konfliktów i klęsk żywiołowych. Działania organizacji pozarządowych stwarzają szersze możliwości ochrony dóbr kultury w warunkach różnorodnych zagrożeń.

    Nowadays the issue of regional education is a very contemporary and necessary problem, seen as a future factor in cultural heritage, which can be treated as a contribution to preserving the continuity of traditional values. A look at how heritage can be protected using local perspectives in a globalized world through educational activities is also postulated by UNESCO’s global doctrines. In order to include this idea within the school education system, a certain transformation of the pedagogical reality must take place, which is a long-term process. That is why such projects are often carried out through non-formal education. Using the example of the project ‘Journey through Wooden Podlasie’, this study addresses the problem of protecting the cultural landscape and intangible heritage of Podlasie through education from an early age. Analysis of material collected, as well as the author’s own observations from the various projects carried out in the form of regional education, confirm the theory that there is a great need to implement programs of active heritage protection from scratch. Drawing inspiration from the past can be of great practical importance for future generations, and can serve to encourage children to be active participants in their environment.

    Opis:
    In her article, the author points out that contemporary armed conflicts are often of a non-international nature. She provides the example of the ongoing conflict in Syria and Iraq as one in which cultural property of universal importance has been at risk of destruction. Based on the definition of non-international armed conflict, she notes that only a limited number of treaties belonging to the field of international humanitarian law include provisions aimed at protecting cultural property during an armed conflict. She praises the inclusion of rules concerning the safeguarding of cultural property to the general body of international customary law. She also notes that the introduction of the concept of individual responsibility for violations of international humanitarian law may pave the way for a more efficient exercise of rules concerning the safeguarding of cultural property in armed conflicts.
    Autorka wskazuje w artykule, że współcześnie mamy do czynienia z konfliktami zbrojnymi nieposiadającymi charakteru międzynarodowego. Jako przykład podaje konflikt w Syrii i Iraku, podczas którego były i nadal są zagrożone dobra kultury stanowiące komponent dziedzictwa kulturowego wszystkich narodów. Wychodząc od definicji niemiędzynarodowego konfliktu zbrojnego, autorka dostrzega, że tylko nieznaczna część aktów międzynarodowego prawa humanitarnego zapewnia ochronę dóbr kultury w sytuacji zaistnienia konfliktu wewnętrznego. Za dobry krok w kierunku uzupełnienia tej luki prawnej uznaje włączenie przez społeczność międzynarodową zasad poszanowania dóbr kultury w zakres prawa zwyczajowego. Ponadto zauważa, że zasada odpowiedzialności jednostki za naruszenie międzynarodowego prawa humanitarnego może w przyszłości służyć skutecznemu egzekwowaniu ochrony dóbr kultury w konfliktach zbrojnych.

    The protection of cultural heritage does not only have social but political and economic consequences as well. While the contents of a national and personal identity are closely tied to inherited cultural heritage, this heritage, as far as material culture is concerned, requires political support often beyond the means of the countries concerned. International support is rendered by organizations such as UNESCO with its World Heritage List, which includes World Cultural treasures as well as Natural Monuments. Politically, cultural heritage can be either a cohesive force or a divisive one when exploited for political purposes directed towards political hegemony. Economically, the cost of preserving cultural heritage can be a lucrative source of income as a result of the global promotion of cultural tourism. By this research, we can come to the idea that the State should facilitate the community empowerment through preservation and development of the cultural heritage – its organic environment, because without protection of the cultural environment and misusing the opportunities offered by it we cannot achieve the proper – i.e., feasible, sustainable – social and economic development of a country.
    Ochrona dziedzictwa kulturowego ma nie tylko konsekwencje społeczne, ale także polityczne i ekonomiczne. Podczas gdy zawartość tożsamości narodowej i osobistej jest ściśle powiązana z dziedzictwem kulturowym, dziedzictwo to, jeśli chodzi o kulturę materialną, wymaga wsparcia politycznego często poza zasięgiem zainteresowanego kraju. Międzynarodowe wsparcie udzielane jest przez organizacje światowe takie jak UNESCO – z jego listą światowego dziedzictwa, która obejmuje skarby kultury światowej oraz pomniki przyrody. Politycznie dziedzictwo kulturowe może być pojmowane jako spójna siła, albo i podział, gdy wykorzystywane jest do celów skierowanych na hegemonię polityczną. Z ekonomicznego punktu widzenia istota zachowania dziedzictwa kulturowego może być intratnym źródłem dochodów w wyniku globalnej promocji turystyki kulturowej. Dzięki niniejszym badaniom możemy dojść do przekonania, że dane państwo powinno ułatwiać wzmocnienie pozycji społeczności przez zachowanie i rozwój dziedzictwa kulturowego, a więc naturalnego otoczenia owej społeczności, ponieważ bez ochrony środowiska kulturowego i przez nadużywanie oferowanych przez nie możliwości nie możemy osiągnąć właściwego – tj. realnego, zrównoważonego – rozwoju społecznego i gospodarczego kraju.

    The cultural autonomy of the Indigenous Sami Region within Finland is an example of autonomous status, based on the criterion of ethnic, linguistic and cultural distinctiveness of the indigenous Sami people living in the Northern territories of the state. It aims to protect their fundamental rights and freedoms and their own cultural heritage, including the endangered Sami languages. The aim of this study is the legal analysis of the cultural autonomy status of the Indigenous Sami Region self-government. The subject of the study includes the exegesis of the provisions of the Finnish Basic Law of 1999 and the relevant statute, as well as the practice of the region functioning within the state.
    Autonomia kulturowa Rdzennego Regionu Saamów w obrębie Finlandii stanowi przykład statusu autonomicznego, powstałego w oparciu o kryterium odrębności etnicznej, językowej i kulturowej tubylczej ludności Lapónczyków zamieszkujących północne terytoria państwa. Ma na celu ochronę ich podstawowych praw i wolności oraz własnego dziedzictwa kulturowego, w tym zagrożonych wymarciem języków saamskich. Cel niniejszego opracowania stanowi analiza prawna statusu autonomii kulturowej samorządu Rdzennego Regionu Saamów. Przedmiot opracowania obejmuje egzegezę postanowień Ustawy zasadniczej Finlandii z 1999 r. i stosownej ustawy oraz praktyki funkcjonowania tego regionu w obrębie państwa.
