    The purpose of this article is to present the operational capabilities of the OSCE in regulating armed conflicts and their application in the former Eastern bloc countries. In order to show the role of the OSCE in the regulation of armed conflicts, OSCE operational capabilities have been structured in a conceptual grid including: OSCE regulatory tools – in the form of missions, field offices and field coordinators; regulatory mechanisms and emergency mechanisms applied in the light of the peaceful pathways of OSCE involvement in the regulatory process. The common feature of operation at each phase is the broadly understood maintenance of stability or achieving stability. There are armed conflicts against which the OSCE has selectively used regulatory activity, omitting certain phases of the conflict, and those against which the application of regulatory tools has not led to lasting stabilisation. The results presented in the paper confirm the correctness of considering the above theories against the background of the conflict cycle concept. Institutional and legal analysis and comparative analysis were used in this paper.

    Opis:
    This article focuses on the Central and Eastern European in the process of shaping their security relations. The aim of the paper is to present and analyze the evolution of security relations in the region under the aegis of the EU, NATO and the Organization for Security and Co-operation in Europe (OSCE). The interplay of the institutions shows that the EU is not a single power in the European security system thus the maintenance of stable and peaceful relations depend mostly on cooperation between a number of institutions and groupings. The EU and NATO’ s role was central due to their policies of enlargement and the stabilization effects on third partner countries. The OSCE with its well promising position in Europe has been weaken due to decline of interests of major power states and its functions performed simultaneously by the EU and NATO. Both organizations have taken to a large extent the place of the OSCE.

    Opis:
    Democracy, rule of law and human rights are addressed by the Organization for Security and Cooperation in Europe, the Council of Europe and the European Union. Nonetheless, while the Council of Europe and the European Union develop their own legal regimes and ensue legal standards for democracy, the rule of law and human rights, the OSCE generally operates in politics and political standards pertinent to these values. However, by their very nature and definition, OSCE policy commitments are reflected in legal context, being transpired to legally binding European and international treaties. A situation hence unfolds in which a non-binding act contains content that binds beyond it. The nature of the activities of the OSCE institutions complements and corresponds to the ‘soft’ nature of the OSCE’s obligations, which is reflected in the non-authoritarian activities of these institutions: notably monitoring, formulating findings, follow-up, work of experts and reporting. This contributes to consistent relationship between the nature of OSCE commitments and the nature of the activities of its institutions.
    Demokracja, rządy prawa i prawa człowieka stanowią wspólny obszar aktywności Organizacji Bezpieczeństwa i Współpracy w Europie, Rady Europy oraz Unii Europejskiej. O ile jednak Rada Europy i Unia Europejska tworzą własne reżimy prawne a w konsekwencji prawne standardy demokracji, praworządności i praw człowieka, to OBWE zasadniczo operuje w obszarze polityki i politycznych standardów dotyczących w/w wartości. Z założenia i charakteru polityczne zobowiązania OBWE doznają jednak pewnego prawnego refleksu za sprawą ich powielania na gruncie prawnie wiążących, europejskich i międzynarodowych traktatów. Powstaje zatem sytuacja, w której akt pozbawiony prawnie wiążącej mocy zawiera treści, które poza nim moc taką posiadają. Dopełniająco, charakter działań instytucji OBWE koresponduje z „miękkim” charakterem zobowiązań tej organizacji, co znajduje wyraz w niestanowczych, a konkretnie monitorujących, wnioskowych, przeglądowych, eksperckich i sprawozdawczych działaniach tych instytucji. Zatem relację między charakterem zobowiązań OBWE a charakterem działań jej instytucji cechuje spójność.

    Opis:
    In the paper, we present new threats and dangers in the present international arena and their impact on the system of international security. We analyze the causes and development of these issues the international law system, paying particular attention to the case of Armenian-Azerbaijan Nagorno-Karabakh conflicts. We also discuss possible solutions to these problems proposed by experts. Some of the most interesting issues we address in the paper include the increasing activity of ISIL, cybercrimes, Ukraine crisis, immigration flow to Europe in recent years. All these problems are viewed from the multicultural perspective. We also analyze the genesis of ethnic conflicts, and put forward some recommendations for resolving them. We discuss the factors that led to the Nagorno-Karabakh conflicts, possible solutions to this problem, and a dangerous double standard policy. Terrorist threats, as well as “frozen” conflicts, resulted in the need for deepening interstate cooperation in the security sector.
    В настоящем документе представляются новые угрозы и опасности на ны- нешней международной арене и их влияние на систему международной без- опасности. Мы анализируем причины и развитие этих проблем в системе международного права, уделяя особое внимание случаю армяно-азербайд- жанских нагорно-карабахских конфликтов. Обсуждаются также возможные решения этих проблем, предложенные экспертами. Некоторые из наиболее интересных вопросов, которые мы рассматриваем в документе, включают увеличение активности ISIL, киберпреступлений, кризиса в Украине, им- миграционного потока в Европу в последние годы. Все эти проблемы рас- сматриваются с точки зрения многокультурности. Мы также анализиру- ем генезис этнических конфликтов и выдвигаем некоторые рекомендации по их разрешению. Мы обсуждаем факторы, которые привели к конфлик- там нагорно-карабахского конфликта, возможные решения этой проблемы и опасная политика двойного стандарта. Террористические угрозы, а также «замороженные» конфликты привели к необходимости углубления межго- сударственного сотрудничества в секторе безопасности.
