Information is an important element of human life and accompanies him in his everyday life. It has contributed to the development of civilization since ancient times. With the development of technology, its share in human life has only increased. Thanks to modern technologies, everyone has almost unlimited access to information. For example, thanks to the Internet, information can be sent from one place in the world to another in the blink of an eye. Such easy access to information makes it easier to make business and life decisions. However, not every piece of information produced, for example, by a company or state institution, should be easily accessible to everyone. This resulted in the need to use information protection measures that will ensure its security. The need to protect information has led to the creation of legal standards that regulate its protection.
Informacja jest ważnym elementem życia człowieka i towarzyszy mu w jego codziennym życiu. Od dawnych czasów przyczyniała się do rozwoju cywilizacji. Wraz z rozwojem technologii jej udział w życiu człowieka tylko się zwiększył. Dzięki współczesnym technologiom każdy człowiek ma prawie nieograniczony dostęp do informacji. Na przykład dzięki Internetowi informacja w mgnieniu oka może zostać przesłana z jednego miejsca na świecie do drugiego. Tak łatwy dostęp do informacji ułatwia podejmowanie decyzji biznesowych oraz życiowych. Jednak nie każda informacja wytworzona na przykład przez firmę lub instytucje państwową powinna być łatwo dostępna dla każdego. Spowodowało to konieczność stosowania środków ochrony informacji, które zapewnią jej bezpieczeństwo. Konieczność ochrony informacji doprowadziła do powstania norm prawnych, które regulują jej ochronę.

The article presents the lowest level of local government – a commune – against the background of international local government standards formulated by such organizations as the Council of Europe, UNDP, OECD, the World Bank, the European Union. Firstly, the evolution of these standards is presented – starting from European Charter of Local Self-Government, through European Charter of Local Self-Government, ending with The Strategy for Innovation and Good Governance at Local Level and European Governance. Then, the range of implementation of these principles in Polish local government is analyzed. It can be determined that external influence in the form of international standards has been one of the key factors shaping the Polish self-government in the last 25 years.

The term State appropriately reflects the dichotomous condition of contemporary journalism. The tension between the commercial and the functional side of the mass media leaves the journalist standing alone on the battlefiield facing a harsh dilemma to remain faithful to professional ethics or to give way to the pressure of ratings. In other words, striving to describe objectively, inform critically, and earnestly, leaves some space for your opponents or makes you dig out seemingly meaningful information and present it in the form of a factoid or a story that probably will not bring you closer to the truth but generates more buzz around the news and entertain the audience. It all comes down to a single choice – serious journalism versus tabloid journalism. In my opinion, it is a serious issue which has to be brought up in any discussion concerning the media. One can see it more clearly by looking closely at both notions. Serious journalism is responsible for its words, along with the awareness of the influence it has on the audience. Tabloid journalism, on the other hand, is marked by a nonchalant audience attitude. It is aware of its influence on the fans, but its impact is simplified compared to mass media doctrines, and comes down to the brutal slogan “riffraff would buy”. Though, not making a big fuss, it is worth saying that with journalism, having the meaning of a public service and letting down society, we are dealing with conflict of values and hitting rock bottom.

Trybunał Konstytucyjny nie sprawuje wymiaru sprawiedliwości jednak jest organem władzy sądowniczej, a możliwość domagania się zbadania zgodności aktu normatywnego z Konstytucją stanowi współcześnie nieodłączny element demokratycznego państwa prawa i prawa do sądu. Jak wynika z analizy orzecznictwa TK, polski sąd konstytucyjny stosuje standardy prawa do sądu wynikające z Konwencji i Karty, odwołuje się do orzecznictwa europejskich trybunałów, do kognicji których należy wykładnia odpowiednich postanowień tych aktów prawa międzynarodowego. Praktykę tę należy ocenić jednoznacznie pozytywnie, gdyż prowadzi do tworzenia wspólnego standardu ochrony praw podstawowych w krajach Unii Europejskiej. Respektowanie orzecznictwa ETPCz czyni jednak koniecznym uznanie, że w postępowaniach toczących się w ramach kontroli konkretnej zastosowanie mają gwarancje wynikające z art. 6 Konwencji. Oczywistym jest, że Trybunał Konstytucyjny jako sąd prawa a nie faktów nie może być traktowany jako kolejna instancja odwoławcza, a skarga konstytucyjna nie powinna być wykorzystywana jako instrument korygowania błędów popełnionych na wcześniejszych etapach postępowania. Niemniej także umiejscowienie TK wśród organów władzy sądowniczej, ukształtowanie przez ustawodawcę trybu postępowania przed TK, wreszcie status sędziów TK pozwalają – w moim przekonaniu – na postawienie tezy o konieczności stosowania w postępowaniu skargowym przez TK, europejskich standardów prawa do sądu. Standarów, które jak wynika z orzecznictwa trybunalskiego, gwarantują także przepisy Konstytucji.
The Constitutional Tribunal (TK) does not exercise justice, however, it is a judicial authority. The right to request an examination of compatibility of the normative act with the Constitution is today an integral part of the democratic rule of law and the right to court. As the analysis of the case law of the Constitutional Tribunal shows, the Polish constitutional court applies the standards of the right to a fair trial established under the Convention and the Charter as well as refers to the case law of the European Courts including the interpretation of the relevant provisions of international law. This practice should be assessed unambiguously positive, because it leads to the creation of a common standard of protection of fundamental rights in the European Union. However respecting the ECHR case-law makes necessary to recognize that in proceedings related to the specific constitutional control before Constitutional Tribu- nal should be applied the guarantees arising from Art. 6 of the Convention. It is obvious that the TK as a court of law not facts cannot be treated as another instance of appeal and a constitutional complaint should not be used as an instrument for correcting mistakes made in the earlier stages of the proceedings. However, the constitutional position of TK among the judiciary, the legislative shape of the proceedings before the Tribunal, and finally the status of TK judges allow – in my opinion – to put forward the thesis of the need for abandonment of the European standards of the right to a fair trial before TK. Standards that according to the TK case law, are also guaran- teed by the provisions of the Constitution.

In December 2017 and January 2018, the Sejm and Senate, thanks to the votes of the deputies of ruling party Law and Justice, passed hugely controversial law amending inter alia Polish Electoral Code. Its adoption was opposed by the parliamentary opposition, by the electoral administration bodies and by many experts, however unsuccessfully. The enactment of this law destabilises the electoral system without a clear or evident need and treats the electoral code as a political instrument. Secondly, it does not provide the sufficient time for adaptation (vacatio legis), which may jeopardise free and fair local elections and the stability of the political system. Thirdly, the bill contains numerous unclear provisions and is in many parts written in a careless and contradictory way. Such amendments do not correspond with the European standards, described in the Venice Commission’s Code of Good Practice in Electoral Matters.

The European Commission for Democracy Through Law was created in 1990 and for the last three decades has adopted a number of documents of related to electoral standards in democratic states. They include legal opinions on national laws (or draftlaws), as well as documents of a more general nature, concerning specific topics (studies, reports). In this article, the author aims at presenting the main documents that include the electoral standards developed by the Venice Commission. However, as the opinions of the Venice Commission are not binding, the second part of this contribution presents the way this contribution of the Venice Commission is taken into account in the jurisprudence of the European Court of Human Rights in cases concerning the alleged violations of the right to free elections.
Europejska Komisja na rzecz Demokracji przez Prawo została stworzona w 1990 roku i w ciągu ostatnich trzydziestu lat przyjęła ona szereg dokumentów związanych ze standardami prawa wyborczego w państwach demokratycznych. Są to opinie prawne o krajowych aktach prawnych (lub ich projektach), ale także dokumenty o charakterze ogólnym dotyczące określonych kwestii (studia, raporty). Celem niniejszego artykułu jest przedstawienie podstawowych dokumentów zawierających standardy w zakresie standardów prawa wyborczego wypracowanych przez Komisję Wenecką. Biorąc jednak pod uwagę fakt, że opinie Komisji Weneckiej nie mają charakteru wiążącego, druga część niniejszego opracowania przedstawia w jaki sposób dorobek Komisji Weneckiej brany jest pod uwagę w orzecznictwie Europejskiego Trybunału Praw Człowieka w sprawach, w których zarzucono naruszenie prawa do wolnych wyborów.

The scientific article is devoted to the study of the content of the legal provision of the constitutional right to peaceful assemblies in Ukraine as a means of ensuring the observance of citizens’ rights. Types of liability for violation of the order of organization and holding of meetings and rallies are considered. The study emphasizes the importance of enforcement of court decisions that have entered into force. The changes taking place in Ukrainian society arouse high activity and the desire of people to take a direct part in solving problems that concern their common interests, including the use of the right to peaceful assembly. However, despite the importance of this type of political rights, the constitutional provisions on freedom of assembly, assembly, street demonstrations and demonstrations, which are still not properly specified in the current legislation, are often limited or even violated. Based on the international experience of regulating the right to peaceful assembly, ways to increase the effectiveness of the mechanism of administrative and legal support of the right to peaceful assembly are proposed, which are to create a domestic mechanism to monitor compliance with international standards of human rights and freedoms. human being, if this or that problem is not solved at the national level. It is proved that even a rather small range of current norms enshrined in legislative acts of various levels, which guarantee the right to peaceful assembly, often show some inconsistency in the content of the outlined rights, especially from the standpoint of the right to freedom of peaceful assembly. the subject is called a citizen, and civil law - an individual. The necessity of introduction of international standards of ensuring the right to peaceful assembly, first of all the standards of the European community, which is connected with the European integration aspirations of Ukraine, is proved. After all, the implementation of European standards and their observance by the subjects of public administration is one of the preconditions for Ukraine’s integration into the European legal space. Since the right to freedom of peaceful assembly cannot be exercised in the absence of corresponding responsibilities imposed on the state by its authorized bodies, the analysis of the Constitution and laws of Ukraine allowed to separate such bodies into the category of subjects of power to ensure the right to peaceful assembly. In order to improve the situation in the studied area, it is advisable to review the current legislation, which ensures the implementation of court decisions, to continue reforming public authorities for the effective operation of the judiciary and the protection of citizens’ rights.

The paper concentrates on the right to self-determination of indigenous peoples on the basis of the Nisga’a Nation. The author analyzes the most important provisions of the Nisga’a Final Agreement, in particular those envisaging self-determination of the Nisga’a Nation. Then the author briefly examines the Nisga’a Constitution which may be regarded as a means to implement the Nisga’a Final Agreement. It shows how the Nisga’a selfgovernance model fits into the provisions on self-determination of indigenous peoples. The thesis of this paper is that the Nisga’a self-governance is consonant with international legal standards expressed in the UN Declaration on the Rights of Indigenous Peoples. Nisga’a selfgovernment model is much more than just cultural autonomy: it actually amounts to political autonomy. This subject is worth exploring because it may serve as a pattern to be followed with reference to other indigenous peoples, not only in Canada.

The article purpose is to study digitalization of certain phases of Ukraine electoral processes, taking into account the European Union experience. The research design consists in a comparative analysis of electoral processes digitalization and its legislative provision. The article describes the legal field of EU electoral processes. The recommendations of the Council of Europe on e-voting standards are considered. The role of the administrator of the Ukraine State Voter Register is considered. The phases of electoral processes that require gradual digitalization are given. Scientific novelty of the study is to use a comparative approach in studying the electoral law of the EU and Ukraine. The research field is limited to the electoral law of the EU and Ukraine. The practical effects of the study make it possible to identify the advantages and disadvantages of digitalizing the phase of the electoral process. The scientific novelty of the study conducted in this article is to study the digital transformation restrictions at individual stages of electoral processes. The fundamental provisions in Ukrainian legislation on digitalization of electoral processes are determined. The article summarizes that the widespread means of electoral processes digitalization is the formation and updating of the voters registers and conducting their statistics. The author revealed that electoral processes digitalization has a fragmentary character in the EU countries, since the legal field in providing cyber security requires continuous improvement.

In our article we outline the development of the specialized Health Pedagogy programme at the University of Silesia, and students’ perceptions of the effectiveness of educational experience. Our presentation employs quantitative and qualitative research approaches. Using the institution monograph method we present quantitative data on the content of the learning programme and learning outcomes in Health Pedagogy. Document analysis covers 12 years, beginning with 2001 when the specialization was introduced in the University of Silesia. Using content analysis we present the learning outcomes, including knowledge, skills and competencies acquired by graduates in the first and second cycle degree programmes, according to the Bologna process. To complete these findings we present individual cases, based on interviews, as examples of the occupational path of our graduates.

The aim of this paper is an analysis of the formation and functioning of the anti-corruption system of Ukraine: National Agency on Corruption Prevention, National Anti-Corruption Bureau of Ukraine, Specialized Anti-Corruption Prosecutor’s Office, National Bureau of Investigation and National Agency of Ukraine for finding, tracing and management of assets derived from corruption and other crimes. The study stresses that despite the strong regulatory framework created to prevent and combat it, corruption remains a systemic problem that exists at all levels of government in Ukraine. The above-mentioned bodies have been created taking into account the European experience in the formation of anti-corruption bodies in the system of government, their activities are aimed at overcoming corruption in the country. The article highlights the feasibility of the existence and functioning of anti-corruption bodies and substantiates the importance of all their powers in the field of preventing and combating corruption. It has been concluded that these bodies need further improvement to combat corruption more effectively.

In the presented work, an attempt is made to specify the theory-cognitive significance of J. Reykowski’s concept of multidimensional moral development for intercultural studies. This proposal seems to be particularly useful in pedagogical analyses dealing with moral reasoning of children. The presented research results and their interpretation confirm the presence of intercultural differentiation in the development of evaluation standards of learners in late childhood. Therefore, this concept may have broader application in intercultural studies in education.

There is neither consensus whether the category of linguistic rights shall be distinguished, nor international agreement on the catalogue of such rights. Nevertheless, access to education in mother tongue constitutes a core element of most of the international and national frameworks of minority protection. Academic and legal disputes are particularly absorbing in Europe, where linguistic policies frequently intertwine with politics (e.g. Cyprus, Moldova, Ukraine). Thus, it is essential to pose the question, whether the right to education in mother tongue is always granted the equal scope of protection or is such protection differentiated by any additional criteria. Most of all, it shall be considered whether the analyzed right has an independent character or its protection is associated with perception of other fundamental rights and freedoms. This paper investigates the scope of the protection of this right within the framework of the Council of Europe.

Opis:
The author analyses presumption of innocence in the media’s reporting of the judicial procedures. The principle of presumption of innocence says that the accused will be considered not guilty, unless his guilt will be proved in the final judgment of the court. This principle is written down in art. 42.2 of the Polish Constitution and art. 5 § 2 of the criminal procedure code. The above principle concerns all people, i.e. authorities of criminal process, police, administration agencies and even simple citizens. The Polish press law prohibits publication of personal data of the accused without the consent of public prosecutor or court as well as data of the injured person and witnesses without their consent. The press law also prohibits to prejudge the guilt of the accused before his conviction by the court of first instance. Alas, there are numerous cases of violation of such rules. Today one observes the increasing process of infotainment of mass media becoming more and more tabloid. They have a negative influence on realization of principle of presumption of innocence in everyday practice.

The LGBT rights are lately one of the aspects of a social and political discourse both in the Russian Federation and in Ukraine. In these countries of a common historical heritage there are some analogies in the perspective on human rights and their realization. It may be also noted that the LGBT rights have become an instrument of politics. In the following article the authors present a comparative analysis of the way in which the LGBT rights are respected in the Russian Federation and in Ukraine. They will depict the similarities and differences between these two countries which result from historical conditions, and will provide an analysis of the current perception of non-heterosexual people in both countries.
