Opis:: The term ‘terrorism’ is among the most frequently used words. It accompanies us on an everyday basis. It is apparently understood in a similar manner throughout the world, but it is actually interpreted and defined in different ways. “All vogue words appear to share a similar fate: the more experiences they pretend to make transparent, the more they themselves become opaque”. Terrorism is no exception to that rule. This has become particularly apparent following the events of September 11, Bali, Madrid and London. Terrorism is characterized not only by its manifold nature and complexity but also by the problem with its definition.

Moreover, Prime Minister Tony Blair’s words: “…we will not rest until this evil is driven from our world…” proved that the UK became a zone of fighting with international terrorism, even though it had connections to these strands well before these attacks.

Opis:: The prospect of weapons of mass destruction (WMD) terrorism poses a danger for contemporary societies. However, the incidents related to an application of weapons of mass destruction (that is, nuclear, chemical, biological and radiological weapons) by non-state actors are relatively rare. The aim of the paper is to present recent incidents and to estimate the threat from particular types of WMD. The author focuses both on the question of motivation to undertake these operations and on the problem of technological capabilities. To sum up, the risk of a massive WMD terrorist attack should be perceived as quite moderate due to the technological barrier, but selective attacks carry a greater potential risk because of their higher probability and significant psychological effect.

Opis:: The subject of this dissertation is the European Union policies in the area of combating terrorism. The fact that terrorism is regarded as being one of the biggest threats to European Security determined the choice of the subject. The author has tried to explain the terminology applying to terrorism, the history of terrorism, and present methods of fight against it. The objective of the article is the analysis of the European Union main actions taken and decisions made in this respect. One of many determinants that influenced tightening of this policy were the 9/11 terrorist attacks in the USA on 11 September 2001. Also, frequent terrorist attacks forced the European Union member states constant cooperation and continued efforts regarding actions to counter terrorism which is both social and political phenomenon.
Tematem artykułu jest polityka Unii Europejskiej w zakresie zwalczania terroryzmu. Wybór tematu determinował fakt, że terroryzm uznawany jest za jedno z największych zagrożeń Europy. Autorka starała się przybliżyć terminologię dotyczącą terroryzmu i jego rys historyczny oraz metody walki z terroryzmem w czasach współczesnych. Celem badawczym artykułu jest analiza głównych działań oraz decyzji Unii Europejskiej w tym zakresie. Jedną z wielu determinant wpływających na zaostrzenie tej polityki były zamachy z 11 września 2001 roku w Stanach Zjednoczonych. Z kolei częste ataki terrorystyczne wymusiły na państwach Unii Europejskiej ciągłą współpracę i konsekwentne działania w zakresie przeciwdziałania terroryzmowi, będącemu zjawiskiem o charakterze zarówno społecznym, jak i politycznym.

Opis:: Contemporary terrorism is characterised by a complex and networked model of operation. While the main objectives of terrorist acts remain the same, the attack environment, tactics and tools are changing. The international community is taking steps to strengthen counter-terrorism systems, but these are peaceful solutions. These models do not consider the conditions of hybrid armed conflicts in which terrorism is an element of combat tactics. It is a relatively new phenomenon and particularly dangerous for the civilian population. The acts of terror in hybrid warfare are not mechanisms with a simple scheme of action, and, as we try to show in this article, they represent a deliberate and broad spectrum of action. Therefore, there is an urgent need to understand terrorism in the context of the threat of hybrid war (especially when terrorist acts complement hybrid tactics or significantly replace conventional tactics). This type of threat must be recognised before achieving its strategic goals. From the substantive point of view, the article studies the problem of terrorism as one of the threats of an armed conflict in Ukraine, commonly known as hybrid war.

Opis:: The report presents theoretical framework of relationships between terrorist organisations and media, and it describes them as an interactive modelling of a message. It introduces the concept of mediatisation of terrorism, and it offers a definition of this process. Moreover, the report develops it with six theoretical hypotheses related to: influence of media on selection of terrorists’ targets, adaptation of an act of terror to the ‘logic of media communication’, personalisation of terrorism and celebritisation of terrorists, creation of biased and oversimplified stereotypes, transformation of terrorist objectives into catch-phrases, as well as a role of political violence in agenda-setting of main news broadcasts. The presented concept will be verified in the ongoing comprehensive, quantitative-and-qualitative study on mediatisation of terrorism in American television, that will investigate the process between September 11, 2001 and the Boston Marathon Bombing in 2013.

Opis:: The article analyses the legitimacy of citizens telecommunications data retention usage in the fight against terrorism. Data retention, that is the preventive storage of information on the source, data, hour and duration of a connection, type of the connection, communication tool and location of a recipient, is a powerful source of knowledge about citizens and their use should be soundly justified. However, both the European Union and Polish practices show that behind this interference in privacy there is neither a guarantee that the data stored would be used exclusively to fight terrorism and severe crimes, nor a sufficient access control mechanism. The efficiency of data use in the fight against organized crimes, including terrorism, is also dubious. In her work the author analyses Polish studies concerning information disclosure issues, Internet publications of the European Union and American reports on retention programmes, as well as Polish and foreign positions of non-governmental organizations engaged in the civil rights protection in this respect.

Opis:: During the codification of the new Hungarian Criminal Code, the Hungarian Legislator passed amendment of several criminal offences. Among other criminal offences, this rethinking concerned the regulation of acts of terrorism. The number of terrorist offences relating to illegal migration has increased in the past few years in the territory of the European Union, therefore the attitude of the Member States – including Hungary, as well – has changed with reference to the statutory definition of the acts of terrorism. The connection between irregular border crossings and terrorism was recognized by the European Union. Terrorist offences have proved the vulnerability of the European Union and the democratic, rule-of-law States. Furthermore, the last few years have also clearly proved that Europe cannot cope with the influx of refugees set out for the Western Europe from various parts of the world. In this respect, illegal migration cannot be only a tool, but also a catalyst for terrorist offences. It means that case conflicts and violent affairs are caused by the migration, and the illegal entry and the integration of terrorists are supported by migratory networks at the same time. In 2015 and 2016, the European Union experienced a massive number of casualties caused by terrorist attacks. The most affected Member State was France. It had to cope with attacks which caused 148 citizens’ death and more than 350 people injured only in January and November 2015 (TE-SAT 2016, p. 5.). For the abovementioned recognition, many regulations (included but not limited to the Fundamental Law of Hungary, the Hungarian Criminal Code and the Act on Criminal Procedure) were passed in 2016 by the Hungarian legislator in order to stop illegal migration and to strengthen the fight against the new forms of terrorism. In the context of the present paper, the Act LXIX of 2016, which came into force on 17 July 2016, is of importance. Not only the General Part, but also the Special Part of the Hungarian Criminal Code was amended by the above Act. However, many new rules may be challenged from the perspective of the rule of law and the European commitments of Hungary. The aim of the paper is to describe the new regulations regarding the Hungarian statutory definition of acts of terrorism, and to analyse them within the Hungarian criminal legal frame and the abovementioned European requirements. Therefore, the characteristic of the paper will be the analytical method with the aim of creating de lege ferenda proposals for the Hungarian legislator, as well. In our paper, we are going to deal with the new European directive, as well, which will replace the Council Framework Decision 2002/475/JHA and will amend the Council Decision 2005/671/JHA from 20 April 2017.

Opis:: Terrorism is harmful to democratic governments and societies. In addition to the visible and the direct effects of attacks on bystanders, aim bombers are undermining democratic values, including the weakening of confidence in state institutions and laws that regulate their functioning. As a result of the use of violence can permanently give birth to create a socio-political divisions, antagonize certain entities and groups, and thus provoke conflicts thus destroying the existing compromises, agreements or arrangements between the parties concerned. In matters of international terrorism it is not only a challenge for the rule of law, but because it also applies to relations between states, poses a serious threat to security and stability.
Terroryzm jest zjawiskiem szkodliwym dla demokratycznych rządów i społeczeństw. Poza widocznymi i bezpośrednimi skutkami ataków na osoby postronne, zamachy terrorystyczne osłabiają wartości demokratyczne, w tym również zaufanie do instytucji państwowych i praw regulujących ich funkcjonowanie. W wyniku użycia ograniczeń instytucjonalno-prawnych ze strony państwa mogą pojawić się podziały społeczno-polityczne oparte na wzajemnej eskalacji i antagonizmie wobec określonych jednostek lub grup. Tak zaistniała sytuacja wywołuje konflikty, niszcząc istniejące kompromisy i często z trudem wypracowane porozumienia między poszczególnymi stronami. Zjawisko terroryzmu jest nie tylko wyzwaniem dla rządów demokratycznych, ale także odnosi się do polityki bezpieczeństwa oraz stosunków między państwami. Skutki terroryzmu stwarzają poważne zagrożenia dla bezpieczeństwa i stabilności przestrzeni publicznej.

Opis:: This article addresses the issue of terrorism and its counteraction in Polish legislation. Its aim is to demonstrate how Polish law is prepared to prevent terrorist incidents and which agencies and authorities are responsible for these actions. The article applies the method of institutional-legal analysis. Based on it, conclusions can be drawn that Polish legislation is relatively well-prepared to combat terrorism.
Niniejszy artykuł porusza tematykę związaną z terroryzmem oraz jego zwalczaniem w polskim prawodawstwie. Jego celem jest pokazanie, w jaki sposób polskie ustawodawstwo jest przygotowane do zapobiegania zdarzeniom o charakterze terrorystycznym. Wskazuje także, jakie służby oraz organy są odpowiedzialne za te działania. Przy pisaniu artykułu zastosowano metodę analizy instytucjonalno-prawnej. Na jego podstawie można wysnuć wnioski, że polskie ustawodawstwo jest relatywnie dobrze przygotowane do zwalczania terroryzmu.

Opis:: The paper aims to define the psychological foundations of lone wolf activism. The analysis that facilitated attaining this goal was based on the Nietzschean concept of resentment theory of compensatory revaluating values that explain the relationships between inferiority and fundamentalism, fanaticism, and ideologically motivated violence. Based on a phenomenological examination of the phenomenon, the author demonstrates that lone wolf activism is founded on two psychologically and sociologically determined successive processes. The first one occurs when a sense of personal inferiority becomes the source of an envy-based hostile attitude toward the world. Later on, this feeling, due to personality defence mechanisms, which bring about the falsification of “primary desires” and the generation of “secondary desires”, transforms into fundamentalism. The second process takes place when, as the result of fundamentalist legitimisation that arise on the level of social rivalry, given fundamentalism is destituted, resulting in fanaticism. The author believes that the knowledge of both processes is necessary to recognise and combat the terrorist activity of lone ideologically motivated individuals.
