This article, apart from explanations concerning bishop’s insignia, describes his attire: a miter and a stole which can be found in the collection of Franciscan Fathers in Łagiewniki thanks to the friendship between Cardinal Sodano and father Śliwiński. Although the author does not explain the circumstances in which those insignia were transferred, he describes the insignia and informs about their symbolism. Due to insightful analysis of the embroidered coat of arms which is placed on the chasuble he found out who was the owner of this attire.

Pope Francis issued two Apostolic Letters motu proprio on Tuesday, in which he introduced reforms to the legal structures of the Church, which deal with questions of marital nullity. One of the Letters motu proprio, known by its Latin title, Mitis Iudex Dominus Iesus – or “The Lord Jesus, Clement Judge” – reforms the Code of Canon Law (CIC) governing the Lat-in Church, while the other, Mitis et misericors Iesus or “Clement and merciful Jesus” – reforms the Code of Canon Law for Oriental Churches (CCEO). The Holy Father in the preface explains that the reforms are guided by eight specific criteria. Indeed, the prefatory remarks make clear from the very start that the single most important principle guiding the Holy Father’s action and the work of reform undertaken, is that of salus animarum – the salvation of souls – which is the suprema Ecclesiae lex – the supreme law of the Church.

Opis:
The Catholic theology of the primacy of the bishop of Rome received an essential impulse for development thanks to the incentive of John Paul II, which appeared in the encyclical about ecumenical activity Ut unum sint (No. 95). The article undertakes one of the motifs of this development included in the thesis: the essence and form of the service of the bishop of Rome’s primacy in the Church is determined by the very nature of Christian faith, or – more precisely – by ecclesial nature of the faith. The mission of St Peter and of his successors is in the service of this faith (cf. Łk 22, 32). The first part of the article presents the context of a contemporary, post-conciliar perspective of the primacy of the bishop of Rome. In the second part the author points out that the truth about the ecclesial itinerarium of St Peter’s faith (living the faith in the Church and with the Church) constitutes the crucial element of the papal teaching at the end of the 20th and at the beginning of the 21st century. This truth shapes the primatial self-awareness of the Popes of this period and is expressed in the form in which their service is performed. The ecclesial reciprocity in the faith causes the primacy itself to be presented as ministry in the service of communion of faith of the whole Church.

Opis:
The purpose of the article is to share the reflection about the minister of the sacrament of confirmation in light of two binding liturgical books: the Pontifical “Ordo Confirmationis”, the Ritual “Ordo initiationis christianae adultorum” and the Code of Canon Law of 1983. The sacrament of confirmation is usually administered by the bishop, however he isn’t the only minister of this sacrament, since a presbyter may be authorised by the bishop to administer this sacrament as well. Although the Constitution “Lumen gentium”, no 26 defines bishops as appropriate ministers of confirmation (ministri originarii confirmationis) by introducing this new term to terminology, the legislator of the Code calls the bishop an ordinary minister (minister ordinarius), applying the term used in the Church since the church council in Florence. Most canonists share the opinion that the term “ordinary minister”, which is traditionally and historically justified, seems to be more capacious and comprises the church council term “minister originarius”. Here in turn the meaning of the latter one is emphasized by theologians, according to whom the church council by using this new term brings out the truth that the intervention of the bishop in the sacrament of confirmation is the extension of the event of Paschal Pentecost. In this perspective the person of bishop who administers the sacrament of confirmation becomes a connection with Pentecostal Church, a guarantee of Church unity. Due to his presence and service confirmands have stronger feeling of connection with their own diocese and with the universal Church. According to the binding doctrine and the law of universal Church, the sacrament of confirmation is administered legally by presbyters. In Roman Pontifical and in the Code of Canon Law of 1983 an extension of presbyters’ rights can be noticed in terms of administering the sacrament of confirmation in light of the rules which were previously binding.

Adam Lepa – bishop of Łódź in Poland among his other pastoral skills, remains the notable Christian mass medialogist and effective organizer of the Catholic press, radio and television institutions. In the period after the turning point marked by the Solidarity social movement from the 80s. he worked as head of the Commission for Social Communication Instruments of the Polish Episcopate Conference. His academic competence and personal values were the basis for his various institutional and pastoral initiatives. Among others it is necessary to underline his role in the formulation of the charter of the main ideas formulated for the Society of Catholic Journalists. Even in her academic work Msgr Lepa has published many books and articles that are significant for contemporary mass-mediology. His personal life remains as the personal criterion of journalistic values in the field of „logosphere” on which he left us so many pages.

Opis:
This paper, opening a series of publications dedicated to activities of Bishop Michał Klepacz at the Episcopal Conference of Poland, is an introduction to his biography and to the subject. Its first part presents the life and activities of the Bishop. The future Łódź ordinary was born on July 23, 1893, in the village of Wola, a suburb of Warsaw. He was ordained in 1916. He was a graduate of the Roman Catholic Theological Academy in Saint Petersburg and the Catholic University of Lublin, at which he defended his PhD dissertation in 1932. In 1936, he was appointed an Associate Professor of the Christian philosophy at the Stefan Batory University in Vilnius. The years he spent in Vilnius under Soviet, Lithuanian and, again, Soviet occupation, were dedicated to conspirational educational and research activities. During the German occupation in 1942–1944, he was held in prison and in labour camps. Following changes in state borders imposed after the end of the World War II, he was forced to leave Vilnius and settle in Białystok. And it was there where he received his appointment as a bishop of Łódź in 1947. Rev. Michał Klepacz was ordained a bishop on April 13, 1947, and his ingress to the Łódź cathedral took place one week later. During twenty years of his rule as the bishop, the most important events in the life of the Łódź Diocese included regulation of relations with the government, renewal of the priestly formation, reorganisation and development of the Church structures, and convoking of two Diocese Councils in 1948 and 1958. Bishop Michał Klepacz died on January 27, 1967, on a day preceding the millennial celebrations in the Łódź Diocese. The subsequent part of this work briefly presents the legal and structural basis of the Episcopal Conference of Poland and its specialist committees, focusing in particular on Bishop Michał Klepacz’s participation in those bodies. Furthermore, the importance of the office of the Primate of Poland was emphasised, as a person also being a chairman of the Plenary Conference and the Main Committee of the Episcopate of Poland.

Opis:
The aim of this article is to present the main lines of the primacy theology as presented by Joseph Ratzinger (Pope Benedict XVI) and its significance in an ecumenical dialogue. Ratzinger, following Catholic ecclesiology, points out that the bishop of Rome carries out the task which was entrusted to Peter by Jesus. Referring to the biblical sources, he researches Peter’s place in all New Testament writings and analyses texts describing his mission. Quoting the arguments from the Bible supporting Christ's origin of Peter’s prerogatives in the area of leading and directing the Church, Ratzinger argues that Peter’s primacy has its Biblical roots and comes from God. The Bavarian theologian points out a personal character of the primacy, thus assessing that the foundation of the Church is both the person and the statement of faith, whose subject is the person. Ratzinger presents the papal office in relation to the Passion of Christ so the Peter’s primacy has a testimonial structure and is related to matryrology through following. The essence of Papacy’s message includes witnessing about Jesus Christ and His salvific message. Thus, the primacy always witnesses about a relationship of the Church with Christ, legitimizes and strengthens it. Stressing a personal character of the primacy, which is expressed in the attitude of being “on the way with Jesus” in the perspective of the Passion and the Cross, we can conclude that authenticity and authority of Christianity takes place not through law, norms and rules but through the miracle of the person of the Church Shepherd, who is responsible for the faith purity and Church unity.

Opis:
The fresco painted by Giotto Bondone showing the Renunciation of Worldly Goods by St. Francis undoubtedly arouses aesthetic and spiritual feelings. Nevertheless, the scene presented by Giotto also bears some legal characteristics. Thus, it may become a subject of some interesting discussions in the legal sense. First of all, its convention resembles to some extent a dispute before court where the parties and a judge take part in the proceedings. The characters presented, particularly father, son and the bishop, indirectly refer to such important legal institutions as patria potestas and audientia episcopalis. The subject of the dispute is also significant. In the analyzed scene, it relates to the inheritance of property rights and a demand to be obedient to the paternal authority. The relationship between the secular and spiritual power also constitutes a certain problem. Moreover, the issue of divine and human justice is raised. Therefore, the fresco of the Italian master bearing an artistic value might become a subject of a legal reflection and in this way fit the suggested approach: art in the law and law in the art .

Opis:
Biskup Michał Klepacz odegrał, w okresie powojennym, kluczową rolę w pracach Konferencji Episkopatu Polski. Latem 1949 r. powołany został w skład Komisji Głównej, pełniącej rolę prezydium Episkopatu. Aktywność ta miała związek z zasiadaniem przez ordynariusza łódzkiego w Komisji do Rozmów z Rządem/Komisji Wspólnej przedstawicieli Rządu PRL i Episkopatu Polski.
This article focuses on activities of Bishop Michał Klepacz at the Plenary Session of the Episcopal Conference of Poland and the Main Committee of the Episcopal Conference of Poland. In 1953–1956, during imprisonment and internment of the Primate of Poland, Cardinal Stefan Wyszyński, the Łódź ordinary was a chairman of the Episcopal Conference of Poland. Circumstances of his election and his attitude towards problems of social and political life were marked by a direct interference of the Polish People’s Republic (PRL) authorities. The most important tasks executed by Bishop Michał Klepacz included: 1) specifying main directions and contents for pastoral teaching; 2) shaping relationships with the PRL authorities; 3) control and supervision over vicars capitular with powers of the residential bishop in Western and Northern Lands; and 4) general supervision over activities of religious congregations. At the same time, Bishop Michał Klepacz held a position of a chairman of the Main Committee of the Episcopal Conference of Poland, of which he had been a member already since 1949. On the return of Cardinal Stefan Wyszyński to primatial sees in autumn of 1956, he remained his faithful co-worker, mainly involved in shaping relationships between the state and the Church.

Opis:
This article focuses on activities of Bishop Michał Klepacz in the specialised committees of the Episcopate of Poland. Already in 1947, the Łódź Bishop was appointed to the Committee for Theological Studies at Church Faculties and in Seminaries, later transformed into the Studies/Studies and Seminars Committee chaired by the bishop in 1959–1967. Since 1947, he had also worked in the School Committee. Two years later, he was appointed a member of the Committee for Negotiations with the Government representing the Church (since 1956, that Committee operated as the Joint Committee of the PRL Government and the Episcopate of Poland Representatives), which was to standardise and organise relations between the Church and the Communist authorities. As a part of works of that Committee, he was one of the authors of the agreement of April 14, 1950. His activities in that body ended in 1963, with a unilateral freezing of its functioning by the PRL government. Bishop Michał Klepacz also made a substantial contribution to the works of the Press Committee, of which he was a member in the first half of the 1950s, and of the Council Committee. It should be added here that his involvement into that last body was strongly influenced by the fact that he was one of the few dignitaries of the Polish Church participating in all four sessions of the Second Vatican Council.
