Sotnya’s (hundreds) in the cities of the Grand Duchy of Lithuania in the early New Age are a unique phenomenon in which Belarusian historians see traditions of the ancient Rus. However, in the sources of the 15th–18th centuries there are no mentions of continuity with the urban tradition of the previous era, and the spread of hundreds and tens in the cities on the border of the Grand Duchy of Lithuania was caused by the military confrontation with the Moscow State and the Crimean Khanate. They may have originated on the basis of local traditions of the organization of the infantry, which has its roots in times of ancient Rus, at the same time on their formation could have a significant influence the pattern of organization of the Polish infantry. Hundreds and tens remained of military importance until the middle of the 17th century, but from their appearance until the 18th century, they were equally effective fiscal and administrative units and influenced local government.

Despite drawing on French culture in earlier centuries, it was not until Napoleon created the Duchy of Warsaw in 1807 that a flood of direct and indirect transpositions of French institutions and legal solutions affected Polish lands. Under radically different socio-economic conditions, however, they frequently evolved differently from their country of origin, more than once in an unexpected direction. This article is a part of a series of publications in which, by comparing two different optics for analysing the same phenomenon, the authors encourage us to abandon national subjectivism in favour of a more objective dialogue. Indeed, the same reality can give rise to several interpretations, especially when it comes to the transposition of legal models from one country to another.

From the moment of the creation of a state on the territories of Belarus, the system of taxation was also developing. At first it was quite primitive, based on the size of the population. Later on, when social and economic relations became more developed, new forms of taxation, based on the value of land, likewise developed. In the 10-12th centuries, the taxes were collected from the territories. The treasury of the Grand Duchy of Lithuania consisted of pecuniary and non-pecuniary (natural) taxes. Since the beginning of the 17th century, more than 30 different taxes had existed. Some of the present taxes have roots in this old system. The feature of this system is that it had an individual character. There were many reductions established, so that one may even talk about a – whole system of tax reductions.

The cult of the saints, especially in the sixteenth century, was an important part of religious literature in the Polish-Lithuanian state, due to the Reformation and Counter-Reformation, but also because of the religious Catholic-Orthodox polemics on the eve of the Union of Brest. Among Serbian and South-Slavonic saints the most famous were: St. Paraskeva-Petka of Tyrnovo, St. Sava Serbian, St. Simon and St. John of Suchava.The presence of South-Slavonic element in the liturgical tradition of the Orthodox Church in the Polish-Lithuanian state is the local specificity that distinguishes Orthodoxy in the Republic and the Grand Duchy of Lithuania from the Orthodox Church in the great Russian state.

As is the case in the majority of modern states, the formation of local management and self- management in Belarus is an inevitable process. During the economic and political reforms required for this purpose, there are necessary preconditions. Historically, local government has passed through a long and difficult process of development in Belarus. In working out modern concepts of local government, it is necessary to consider the evolution of the machinery of government and the historical development of most legal regulations of mutual relations between the state as a whole and its parts. Actually, the first forms of self- -management in its modern understanding began to arise in the territory of modern Byelorussia since the XIVth century. In the present legal and historical scientific literature, there was no uniform representation about the stages of formation of local governments in the territory of Belarus. It is represented that these or any other processes are always conditional; nevertheless, in this work, one of the variants of classification and a periodization of the process of formation and the development of local management and self-management in the territory of Belarus is offered.

This article is dedicated to the issue of Polish and Russian language contacts in the 16th and 17th centuries. The analysed Old Belarusian historical assets document the presence of foreign vocabulary assimilated via the Polish language. Research shows that the Polish Language of that period formed a medium used to transfer words of German, Latin, Czech or Italian origin to the Belorusian land. The functioning of such borrowings has been tracked on the basis of two popular literary genres on the territory of the Grand Duchy of Lithuania – chronicles (Kronika Supraska and Kronika Bychowca), representing original Belorusian literature, and chivalric romance (Białoruski Tristan), which was an example of translated literature. Loanwords supplemented native lexical resources with lacking units to name such areas as state, church and military institutions, living needs, war craft and the life of knights.

After being canonically erected in 1388, the Cathedral Chapter of Vilnius did not have any recognized privileges or land grants. It subsisted exclusively off of the bishop of Vilnius’ bona mensae, and it followed the Cathedral Chapter of Cracow’s example with regard to its organization, internal structure, activities, and relationship with the diocesan bishop. Having certain privileges and revenue at its disposal in the 15th century, the canonical corporation of Vilnius began to seek greater legitimacy. It was not until 1515, however, that Bishop Wojciech Radziwiłł ordered that the Chapter write up its rights and duties in the form of statutes and that the Holy See approve them. Pope Leo X subsequently approved the Cathedral Chapter of Vilnius’ statutes through his legate Bishop Zacharias Ferreri on November 29, 1520. The papal confirmation gave the Cathedral Chapter of Vilnius strong legal standing that no one, with the exception of the Holy See, could violate or change. The statutes strengthened the Chapter’s position in relation to the diocesan bishop, which turned out to be both in accordance with the spirit of the times and, with time, affirmed by the Council of Trent (1545-1563).

The text is a supplement to the chronological presentation of the Estate’s Assemblies of the Duchy of Głogów, prepared in 1991 by the author in his monographic book on this topic. One can prove that the first traces of the Assembly, composed from the chivalry, can be found in the middle of the 13th century. The well developed system of the estate’s assemblies in the Duchy of Głogów was liquidated after the annexion of Silesia by Prussia in 1742. The king of Prussia decided to retain only one of its elements, the so called Weichbildtag, composed of circles (Kreis) of noblemen with only limited competences. The lack of archive documents from this period results in the supplement providing only one reference to Weichbildtag in Głogów in 1786.

Originally, the members of cathedral chapters were organizationally and structurally divided into two categories: general prelates and canons. During the early stages of organization, prelatures were simultaneously dignities and capitular offices. After the Middle Ages, however, prelatures ceased to be offices and became titular dignities instead. Due to the evolution of the structure and the development of the organization of the chapters and the ways in which they functioned, it was necessary to appoint new officials who were independent of the particular dignities. From the moment that the college of prelates and canons was founded and established in Vilnius, they functioned and acted in spiritualibus and in temporalibus by following the example of the chapter in Cracow that had existed for centuries and adapted the practices to the local conditions of Vilnius. This influence is very clear in the selection and competencies of the officials chosen for the Cathedral Chapter of Vilnius. Among the officials chosen before the partition of Poland took place, those who had the most lasting effects were the capitular procuators, inspectors of capitular goods and property, chancellors, notaries, architivists, and deputies to the Lithuanian Tribunal.

Celem artykułu jest przedstawienie dotychczasowego stanu edycji akt sejmikowych z ziem Wielkiego Księstwa Litewskiego od 1566 do 1794 r. Choć pierwsze wydanie drukiem litewskiej (wileńskiej) uchwały sejmikowej miało miejsce jeszcze w końcu XVIII w., to w przeciwieństwie do ziem Korony Polskiej historycy polscy w późniejszych wiekach w zasadzie mało się nimi interesowali. Stosunkowo dużo akt sejmikowych wydała w XIX w. Wileńska Archeograficzna Komisja, ale należy do tych edycji mieć nadzwyczajny krytycyzm, gdyż miała ona wyraźne zlecenie kształtowania obrazu Rzeczypospolitej (a zwłaszcza Wielkiego Księstwa Litewskiego) przez pryzmat wymagań politycznych i wyznaniowych. Dla polskich badaczy przeszłości ważne były zaś przede wszystkim ziemie polskie i sytuacji nie poprawiło odzyskanie przez Polskę niepodległości w 1918 r. Chcę więc zaprezentować poglądy niektórych z owych historyków na potrzebę takich edycji (zwłaszcza na zjeździe historyków w Wilnie w 1935 r.), ich formę i dorobek edycyjny akt sejmikowych w wiekach XIX–XXI z podziałem na tomy stricte prezentujące takowe akta (wydawane przez wspomnianą Komisję Archeograficzną), na okazjonalne i przypadkowe ich edycje, na dorobek historiografii rosyjskiej, polskiej, litewskiej i białoruskiej. Jakie są widoczne już efekty istnego wybuchu edycji akt sejmikowych w ostatnim dziesięcioleciu i jakie perspektywy? W jakich ośrodkach naukowych podjęte zostały projekty edycyjne i jak wyglądają zespoły je realizujące?
The aim of the article is to present the current state of editing sejmiks’ records from the lands of the Grand Duchy of Lithuania from 1566 to 1794. Although the first printed edition of Lithuanian (Vilnius) sejmiks’ resolutions took place as late as the end of the 18th century, in contrast to the lands of the Polish Crown, Polish historians took little interest in them in later centuries. A relatively large number of sejmik records were published in the 19th century by Vilnius Archaeographical Commission, but one should be extremely critical of these editions, as it was clearly commissioned to shape the picture of the Commonwealth (and especially the Grand Duchy of Lithuania) through the prism of political and confessional requirements. For Polish scholars of the past, on the other hand, it was primarily the Polish lands that were important and the situation was not improved by Poland’s regaining of independence in 1918. Therefore, I would like to present the views of some of these historians on the need for such editions (especially at the historians’ congress in Vilnius in 1935), their form and the achievements of editing sejm records in the 19th – 21st centuries, divided into volumes strictly presenting such records (published by the abovementioned Archaeographical Commission), occasional and incidental editions, and the achievements of Russian, Polish, Lithuanian and Byelorussian historiography. What are the already visible effects of the veritable explosion of editions of sejmik records in the last decade and what are the prospects? In which research centres have editing projects been undertaken and what are the teams carrying them out?

This paper explores extramarital affair as a ground for civil divorce in the practice of courts of the Duchy of Warsaw. In 1808 the Napoleonic Code was enforced on this territory. Under the rules of the Code Civil a couple could petition for a divorce with mutual consent (article 233). There were also three grounds entitling either spouse to demand a divorce, when it was possible to attribute fault to the second party. In the case of the husband’s infidelity, the wife could demand a divorce only when he brought his concubine into their common residence (article 230). On the other hand, the husband could demand a divorce as a result of every act of his wife’s adultery (article 229). Moreover, each spouse could demand a divorce for outrageous conduct, ill-usage or grievous injuries exercised by the other (article 231). Condemnation of one of the married parties to infamous punishment was also a ground for a divorce to the second party (article 232). In spite of the discrimination of women in cases of adultery, more than 75% of all divorce judgments were issued as a result of actions filed by wives. This was probably caused by the Polish Courts which applied a broad interpretation to article 230 in their jurisprudence. Each act of a husbands’ adultery in a common residence was treated as a ground for divorce, although, according to article 230, a wife had to prove that her husband lived with his concubine in a conjugal home. The husbands’ adultery can be easily distinguished from that of wives’. Generally, men committed adultery out of lust. Female infidelity was usually connected with leaving a husband. Husbands often committed adultery with maids, whereas wives – with soldiers.

This article presents various layers of vocabulary constituting lexis of the Tatar tefsir, i.e. the translation of the Quran to the Polish language of the northern borderland, performed in the 16th century by Tatars of the Grand Duchy of Lithuania. Most emphasis was put on the northern borderland, separated on the basis of criteria adopted in the literature of the subject. Selected vocabulary was arranged alphabetically. A context was given in which it occurs and a semantic characteristic was provided on the basis of lexicographic sources – Polish and the East Slavic Languages. It was found that Tatar tefsir contains words previously not described or present in other historic assets of north-eastern borderland. This is particularly true with respect to forms borrowed from the East Slavic Languages, including hybrid forms. What is more, it is characterised by the existence of Old Polish lexis, including names of people performing activities which were not recorded in dictionaries, and other, words used infrequently and in specific text types. Tatar tefsir is also a perfect source for historical studies of Slavic-Oriental relations.

Artykuł prezentuje założenia wstępne projektu polegającego na wydaniu akt sejmikowych województwa połockiego. Ukazana została koncepcja pracy, podstawa źródłowa oraz szerzej scharakteryzowano działalność zgromadzeń szlachty połockiej. Przybliżono terytorium i wskazano cechy ustrojowo-polityczne województwa połockiego w XVI–XVIII stuleciu, akcentując jego znaczenie na tle innych jednostek terytorialnych Wielkiego Księstwa Litewskiego. W tym celu zebrano istniejącą wiedzę o tym województwie, aby ukazać specyfikę regionu. W szczególności zaprezentowano genezę powstania nowożytnych sejmików na terenie Połocczyzny wraz z odnotowaniem istnienia „sejmu małego” sprzed reform z lat 1565–1566. Wskazano, jakie konsekwencje wiązały się z działalnością peryferyjnego sejmiku, który obejmował ziemie przez długi czas zagrożone agresją militarną. W końcu zaakcentowano cechy charakterystyczne życia sejmikowego na Połocczyźnie. Przy tych zagadnieniach, oprócz analizy aktów prawnych i źródeł praktyki sejmikowej, wykorzystano analizę kwantytatywną (wykresy 1 i 2) oraz zastosowano metody właściwe dla geografii historycznej (mapy 1 i 2). Zgromadzone dane ukazują peryferyjność Połocczyzny, a w szczególności lokalnego zgromadzenia szlacheckiego. Po pierwsze, wynikało to z małego znaczenia w kontekście funkcjonowania sejmu walnego, czy też Trybunału Głównego Wielkiego Księstwa Litewskiego. Po drugie, był to obszar nieustanie zagrożony konfliktami militarnymi. Uzewnętrznia się to dużą faktyczną zmiennością miejsc obrad sejmikowych. Możemy wyodrębnić aż dziewięć stolic sejmikowych, poza tym znanych jest przynajmniej sześć innych lokacji. Stanowi to rekord na rozpoznanych obszarach Rzeczypospolitej Obojga Narodów.
The article presents the initial assumptions of the project to publish the sejmik records of the Polotsk voivodeship. The conception of the work, the source basis and the activities of the assemblies of the Polotsk nobility are presented. The territory of the Polotsk voivodeship in the 16th-18th centuries has been approximated and the political features of the Polotsk voivodeship in the 16th–18th centuries have been indicated, emphasising its significance in comparison with other territorial units of the Grand Duchy of Lithuania. To this end, existing knowledge about the province was gathered to show the specifics of the region. In particular, the origins of the modern sejmiks in the Polotczyzna region are presented, including the existence of the „small sejm” before the reforms of 1565–1566. The consequences of the peripheral sejmik, which covered lands long threatened by military aggression, are indicated. Finally, the characteristics of sejmik life in the Polotsk region are highlighted. For these issues, in addition to the analysis of legal acts and sources of sejmic practice, a quantitative analysis was used (Charts 1 and 2) and methods appropriate to historical geography were applied (Maps 1 and 2). The collected data shows the peripherality of Polotsk and, in particular, of the local noble assembly. Firstly, this was due to its low importance in the context of the functioning of the General Sejm or the Lithuanian Tribunal. Secondly, it was an area constantly threatened by military conflicts. This is externalized by the great variability of the places of sejmiks sessions. We can distinguish as many as nine sejmik capitals, besides which at least six other locations are known. This is a record in the recognised areas of the Polish-Lithuanian Commonwealth.

This paper concerns Franciszek Ksawery Szaniawki and his interpretations of legal re- gulation of divorce in the Napoleonic Code. In 1808, the Napoleonic Code was enforced on territory of the Duchy of Warsaw. This modern civil code included regulations of divorce unknown in traditional Polish law (there was no institution of divorce). Soon it appeared that Polish society, especially the Catholic Church but not only, was strongly opposed to divorce in the newly restored Polish State. Szaniawski was both Catholic priest and state official working in the Ministry of Justice. As the very first translator of Napoleonic Code into the Polish language, he took part in national debate on the regulation of divorce under the Code. Szaniawski pointed to several general disadvan- tages of divorce; the ruination of family life, the negative impact on social customs and behaviour and the uncertain future for the children of a broken marriage. However, In spite of these disadvantages, Szaniawski stated that the institution of divorce, used under limits protected by judges in Polish Courts, is highly compatible with other pro- visions of the Napoleonic Code and should remain in place. According to Szaniawski, divorce can be applied but only when it is necessary and in a very precise and narrow way. Exercising such a pragmatic view on divorce was very uncommon for a Catholic priest. Szaniawski eventually popularized a new hybrid idea of marriage in the Duchy of Warsaw reflecting its religious and civil aspects separately.

Celem artykułu jest wskazanie czym zajmował się Sąd Pokoju w Śremie w okresie Księstwa Warszawskiego, i jakie problemy były istotne dla społeczeństwa wielkopolskiego początku XIX w., we wstępnej fazie epoki przechodzenia od feudalizmu do kapitalizmu. W badaniach zastosowano metodę statystyczną. Wybór Sądu Pokoju w Śremie podyktowany jest okolicznością, że jego akta zachowały się do naszych czasów we względnie najpełniejszym stopniu. Spuścizny sądów tego szczebla z reguły zostały całkowicie utracone lub zachowały się w stopniu szczątkowym. Ponadto autor pragnie udzielić odpowiedzi na pytanie na ile sędziowie ze Śremu stosowali się do litery ustaw obowiązujących w Księstwie Warszawskim, a w jakim stopniu orzekali w oparciu o własne poczucie sprawiedliwości. Istotne jest przy tym to, że w Księstwie Warszawskim równolegle pozostawały w mocy Kodeks Napoleona (KN) i Landrecht Pruski z 1794 r., co musiało stawiać przed sędziami liczne wyzwania. Kodeks Napoleona jest ustawą o czysto kapitalistycznym charakterze, podczas gdy Landrecht jest kodyfikacją epoki przejściowej o pierwiastkach zarówno feudalnych, jak i kapitalistycznych. Autor stara się ocenić na ile poprawnie radzili oni sobie z tym problemem.
The aim of the article is to indicate what the court of the peace in Śrem dealt with during the period of the Duchy of Warsaw, and thus what problems were important for the society of Greater Poland at the beginning of the 19th century, in the initial phase of the transition from feudalism to capitalism. The statistical method was used in the research. The choice of the court in Śrem is dictated by the fact that its files have been preserved to our times in a relatively complete way. The records of courts of this level have usually been completely lost or have been poorly preserved. In addition, the author wishes to answer the question to what extent the judges from Śrem complied with the letter of the laws in force in the Duchy of Warsaw, and to what extent they ruled based on their own sense of justice. It is important that the Napoleonic Code and the Prussian Landrecht of 1794 were in force in the Duchy of Warsaw at the same time, which must have posed numerous challenges to the judges. The Napoleonic Code is a purely capitalist law, while the Landrecht is a transitional era codification with both feudal and capitalist elements. The author tries to assess how well they dealt with this issue.
