The aim of the paper is to present forms of shortening the food chain, which are being supported in the Rural Development Program 2014-2020 and to determine whether the legal conditions to obtain the financial support are consistent with the legislation, especially with the amended regulations on direct sales. Four actions („Help to start a business for the development of small farms”, „Support for investment in agricultural holdings”, „Support for investments in processing and marketing,” „Help in start-up investments for young farmers”) are intended for farmers for investments related to agricultural processing and preparation for the sale, without the obligation to register a business, fitting into the content of the amended Art. 3 of Law on Freedom of Economic Activity. „Creating groups and producers’ organizations”, „Cooperation”, „Leader”, are aimed at integrating stakeholders in the food chain, strengthen the position of the agricultural producer in the food chain and contribute to building a local food system. On this basis there is a chance that the short chains and local food production will become more significant in the food system in Poland.

Opis:
One of the human expansions on Earth there is substantial increase of species extinction rate. And this process leads to significant reduction in biodiversity. However, its protection is necessary for the most elementary reasons: – to maintain mechanisms of living nature action, – to maintain nature’s capacity to survive the environment changes; – to prevent the loss of natural values, not yet identified and used, which may constitute the basis for development and guarantee for survival of future generations. The notion of biodiversity was defined by the Convention on biodiversity adopted at the United Nations Conference on the Environment and Development (so called “Earth Summit”) in Rio de Janeiro, 5th June 1992. Both the Republic of Poland and the European Union is the Signatory of this Convention. Therefore, the obligations imposed on the Convention signatories shall be reflected both in the national and the European Union legislation. Undoubtedly, the legal regulations, both of the Community and the national ones concerning support for rural development include solutions purposed to protect biodiversity. It also appears that these solutions intend to approach the coherent system to support biodiversity.

The draft of the Code of Urban Planning and Construction is going to replace the regulation of the spatial planning and construction, including the public investments. Its objective is to restore and make more efficient spatial policy and strengthening public participation in policy-making at all levels of spatial planning”. The aim of the paper is to evaluate the draft Code of Urban Planning and Construction in terms of possible effects on the development needs of the rural areas formulated by the doctrine and in the light of the requirements of strategic documents. The Code provides that the adoption of the local planning act remains an optional task of the community. It should be noted, however, the Code limits the possibility of regulating the destination of areas by administrative decisions.

Today, the issue related to spatial planning in rural areas takes on particular significance. In this context a reference to the views of Professor W. Pańko is justified, as they remain perfectly stable. The planning is an instrument promoted by EU which enables permanent and sustainable development of rural areas. The planning is an imminent and integral element of the notion covering the management, as it concerns spatial planning in any economy system. The issue of spatial planning in rural areas should be viewed from the point of view of its functions (synchronisation, coordination and information), where the two last ones takes on particular significance for development of them. The coordination function plays an important role for the policy to support development of rural areas from the Union and national resources; it is expressed in the contents of local master plans and relates to the coordination of actions, as well as the organisation of cooperation among entities operating on the areas in concern and bringing together their interests. The information function, their place and actions in which satisfies openness and transparency of planning procedures gives all entities the awareness of their place and actions in economic space and its value. Construction elements of the prescriptive model of spatial planning ensure logic link between documents which designs spatial management of a commune (strategies of commune development, the spatial development conditions and directions study, local master plans) aim to ensure the spatial order and the sustainable development of communes in rural areas. The process of using the specified mechanisms is a very comprehensive, long-lasting, time consuming and expensive process, therefore there is a huge gap between the prescriptive model and the actual process of spatial development of rural communes. Current prescriptive model of spatial planning gives almost the same attention to the organisation of agricultural space as the legal regulation of 70s of the XX century. This raises the question on the adequacy of the referred model to organise development processes of the current agriculture, as on the one hand the model (the study and the local master plan) seems all perfect, then costly and heavy, and on the other hand a stream of funds for development of rural areas it is intended not only for the agriculture, but also for the whole multi-functional rural area. As the notion of a rural area is not the same as the notion of an agricultural manufacturing space then the concept of multi-functional rural areas should be matched by its expression and reflection in the instruments of spatial planning. However, the provisions of the act on spatial planning and development fail to pay attention to this issue special interest. In the paper’s content the Author seeks to respond to the dilemmas on this matter.

Opis:
The new financial perspective covering the period 2014-2020 has brought many changes. The main priority of the new rural development policy is to improve the competitiveness of farms, having regard to environmental objectives. Rural Development Programme for years 2014-2020 will encourage further restructuring and modernization of farms and development of agri-food processing as well as strengthening their competitiveness in EU and global food market. Development of farms will also be supported by seven sub-measures of current Rural Development Programme. The most important needs of rural areas have been established using the popular SWOT analysis. Implementation of these needs is to induce specific criteria for the access to the various forms of financial assistance as provided for in the Program. Author of this article takes the view that they have been aptly chosen and should result in effective implementation of the objectives of the current Rural Development Programme.
