    Opis:
    Artykuł poświęcony jest trendom w obszarze nadawanych w kraju stopni naukowych doktora i doktora habilitowanego, stopni w zakresie sztuki oraz tytułu naukowego profesora i tytułu profesora w zakresie sztuki. Podczas prezentacji wyników uwzględniono podział osób uzyskujących stopnie i tytuły według płci. Pokazano, jak zmienia się liczba osób, którym nadano stopnie i tytuły w kolejnych latach. Omówiono strukturę nadanych stopni/tytułów w poszczególnych obszarach nauki i sztuki. Określono również, jak zmienia się liczba nadanych stopni i tytułów w poszczególnych latach w zależności od wieku osób uzyskujących stopień lub tytuł. Analizy oparto na danych jednostkowych znajdujących się w Bazie Wiedzy o Nauce Polskiej i obejmujących ostatnie 16 lat (2000-2015).
    The article is devoted to trends observed in the numbers of scientific degrees and scientific titles granted in Poland for women and men. It is shown how the numbers of scientific degrees and titles granted in consecutive years were changed due to age of person for which degree/title was granted and region of science and art for which it was granted. Analysis is made basing on data collected in the Knowledge Base for Polish Science and the cover smokers last 16 years (2000-2015).

    Opis:
    Artykuł przedstawia kluczowe problemy polskiego systemu awansów naukowych przeprowadzanych na uczelniach oraz w instytutach PAS i instytutach badawczych. Idzie o nadawanie – przez uprawnione jednostki naukowe – stopni naukowych: doktora i doktora habilitowanego. Autor, po krótkim przedstawieniu tej problematyki w czasach Polski Ludowej (lata 1945-1989) skupia się na ukazaniu ewolucji – i tej pozytywnej i tej złej, psującej ten system – systemu awansów naukowych. Artykuł odwołuje się (w warstwie „dowodowej”) do podstawowych aktów prawnych (ustaw i rozporządzeń) regulujących funkcjonowanie uczelni wyższych oraz – w szczególności – procedury nadawania stopni naukowych. Zdaniem autora w ostatnich kilkunastu latach zaczęły zachodzić w tym obszarze niepokojące zjawiska, które wymagają podjęcia (ale nie pozbawiających autonomii uczelni) działań usprawniających ten ważny system. Aby to uczynić, potrzebny jest konstruktywny dialog obu stron: państwa i uniwersytetu.
    The paper presents the key problems of the Polish system of academic promotions conducted in higher education institutions and institutes of the Polish Academy of Sciences. The issue discussed is conferring – by legitimate scientific units – scientific degrees of PhD and habilitation (postdoctoral degree). The author, following the presentation of these issues in Poland under communism (1945-1989), focuses on showing the evolution of the system of academic promotions, both a positive and a negative, spoiling the system, one. The paper refers (in its evidence dimension) to fundamental legal acts (laws and regulations) which regulate the functioning of higher education institutions and – in particular – the procedures of academic promotions. In the last decade or so, phenomena have been emerging which raise serious concerns in this field. The phenomena in question require actions which would make the system more efficient (without depriving universities of their autonomy). What is needed is a constructive dialogue between the state and the university.

    Opis:
    The interpretation of the law plays a specific role in the whole legal system. In the vast area of constantly changing provisions of administrative law, with all their numerous imperfections, this interpretation takes on particular importance. An interpretative decision may be a simple reflection of a provision’s content, or it may take a slightly different form determined as a result of decoding it in the process of interpretation. The interpreter of the law must be guided by the requirements of the law, and achievements of the general theory of law, it must be based on rational grounds that allow for a reasonable and fair balance of arguments that are important in each case. It is primarily the letter of the law, the place of regulation in the legal system and the functions and purposes assigned to the interpreted provisions that determine the result of the interpretation. In the process of applying the law, this result determines the content of a decision taken. It has a significant influence on the position of the individual bound by such a decision, also in situations where this decision may cause justifiable apprehensions about its fairness. The interpretation of the law ordinarily focuses on resolving doubts against the background of specific cases under consideration. The article presents such a situation. I describe controversies relating to the interpretation of one of the provisions formulating the conditions that must be met by a person applying for the title of professor. In this case, it is a matter of the conditions for achievements obtained by her in training academic staff. The assumption that these conditions had not been cumulatively met affected a decision of the Central Commission for Degrees and Titles to refuse the presentation of the candidate to the President of the Republic of Poland for conferral of this title. But is there always a legal justification for challenging the fulfilment of these conditions? I will try to answer this question in this paper.

    W 2018 r. dokonana została w Polsce reforma szkolnictwa wyższego. Jednym z efektów tej reformy była modyfikacja wymagań związanych z nadawaniem stopnia doktora habilitowanego. Artykuł traktuje o aktualnych ogólnych wymaganiach koniecznych do nadania stopnia doktora habilitowanego z wyłączeniem zagadnień omówionych w dodatkowej publikacji, a poświęconych szczególnym przesłankom nadania habilitacji. W publikacji wyrażono autorskie poglądy będące wynikiem analizy stanu prawnego, poglądów wyrażanych w nauce prawa oraz w orzecznictwie sądowym. W artykule omówiono takie zagadnienia, jak: pozaustawowe kryteria nadania habilitacji, znaczenie bibliometrii dla oceny osiągnięć habilitacyjnych, zakres dorobku naukowego przedstawianego w przewodzie habilitacyjnym, w tym znaczenie doktoratu i dorobku naukowego sprzed doktoratu oraz ograniczenia wynikające z przepisów przejściowych do reformy szkolnictwa wyższego.
    In 2018, there was a reform of higher education in Poland. One of the effects of this reform was the modification of the requirements for awarding the degree of habilitated doctor. The article deals with the current general requirements necessary to award the degree of habilitated doctor, excluding the issues discussed in the additional publication, and is devoted to specific conditions for awarding the habilitation. The article expresses the author’s views resulting from an analysis of the legal status, and of the views expressed in legal science and in judicial decisions. The article discusses such issues as: non-statutory criteria for granting habilitation, the importance of bibliometrics for the evaluation of habilitation achievements, the scope of scientific achievements presented in the habilitation thesis, including the importance of a doctorate and scientific achievements before the doctorate, and limitations resulting from transitional provisions to the reform of higher education.

    W 2018 r. dokonana została w Polsce reforma szkolnictwa wyższego. Jednym z efektów tej reformy była modyfikacja wymagań związanych z nadawaniem stopnia doktora habilitowanego. Celem artykułu jest udzielenie odpowiedzi na pytanie, jakie warunki szczegółowe należy spełnić, aby uzyskać stopień doktora habilitowanego w obowiązującym stanie prawnym. Artykuł wypełnia lukę w literaturze naukowej, gdyż brak wyczerpującego opracowania monograficznego w tym temacie. W publikacji wyrażono autorskie poglądy będące wynikiem analizy stanu prawnego, poglądów wyrażanych w nauce prawa oraz w orzecznictwie sądowym. Uwzględniono również założenia reformy związane z habilitacją, a zawarte w uzasadnieniu do projektu ustawy o szkolnictwie wyższym i nauce, a także doprecyzowano wymagania wskazane przez Radę Doskonałości Naukowej jako gremium i organ administracji publicznej nadzorujący nadawanie habilitacji w Polsce. W analizie wykorzystano metodę dogmatycznoprawną, metodę hermeneutyczną oraz metodę argumentacyjną. W podsumowaniu wskazano warunki szczegółowe, które należy spełnić, aby uzyskać stopień doktora habilitowanego w obowiązującym stanie prawnym: posiadanie stopnia doktora nauk, posiadanie w dorobku osiągnięcia naukowego albo artystycznego, stanowiącego znaczny wkład w rozwój określonej dyscypliny, wykazywanie się istotną aktywnością naukową albo artystyczną realizowaną w więcej niż jednej uczelni, instytucji naukowej lub instytucji kultury, w szczególności zagranicznej. Oprócz przesłanek szczegółowych trzeba mieć na uwadze konieczność spełnienia przesłanek ogólnych, które wykraczają poza zakres niniejszego opracowania.
    In 2018, there was a reform of higher education in Poland. One of the effects of this reform was the modification of the requirements for awarding the degree of habilitated doctor (doktor habilitowany). The article aims to answer the question of what specific conditions must be met in order to obtain a postdoctoral degree under the current law. The article fills a gap in the science of law, since no comprehensive study has been devoted to this topic. The author presents conclusions based on an analysis of the legal status, and of the views expressed in the science of law and in judicial decisions. Consideration is also given to the purposes of the reform related to habilitation, and those included in the justification to the draft Act on Higher Education and Science, as well as the clarification of the requirements indicated by the Council for Scientific Excellence – the assembly and public administration body supervising the awarding of habilitation in Poland. In the analyses, the author used the dogmatic-legal method, the hermeneutic method, and the argumentative method. In the conclusion, the specific prerequisites that must be met in order to obtain a postdoctoral degree under the current law are indicated, namely: possession of a doctoral degree in science, possession of a scientific or artistic achievement that represents a significant contribution to the development of a specific discipline, and the demonstration of significant scientific or artistic activity carried out in more than one university, scientific institution or cultural institution, especially outside of Poland. In addition to the specific prerequisites, it is necessary to bear in mind the need to meet the general prerequisites, which are beyond the scope of this study.
