This paper is an attempt to examine the senses and meanings attributed by physicians to the medical profession. The collected material is part of a larger project devoted to the physician-patient relationship reconstructed on the basis of individual narrations provided by physicians. The conducted research is closely linked to the qualitative perspective: Interpretative Paradigm and Interpretive Paradigm. The study was performed in the period 2015-2017. The examined group consisted of 16 subjects (6 female and 10 male physicians) from several provinces of Poland who were highly esteemed (subjective opinions) by their patients. The empirical data were collected by means of narrative interviews and the methodology applied for the analysis of the content was that of phenomenography.

The subject of the article are the issues related to problems arising in the practice of entities conducting therapeutic activity concerning the stay of a patient who is a minor or incapable of independent living and who no longer requires treatment in an entity providing health services, but is in need of permanent care, when the family does not want to provide this care and does not take the patient from this entity. The legal regulation relating to the subject matter in question contained in the current regulations provides entities providing health care services with instruments aimed at disciplining the patient’s family so that the family can fulfil their duty of care and collect the patient from this entity after the end of treatment. The persons obliged to do so are the legal representatives and persons who have a statutory duty to maintain the patient. If they refuse to collect the patient, health care providers are entitled to arrange for sanitary transport to bring the patient to the place of his or her previous stay. The costs of such transport are borne by a specific municipality, which has the right of recourse against the persons responsible. It is also possible to charge these persons or the patient himself with the costs of further, unjustified stay in this entity. However, the solutions adopted are not without drawbacks that make it difficult to enforce the care of the patient and to cover the costs of further unnecessary hospitalisation. The aim of the study is to identify the weaknesses of the current regulation, which is to bring about a solution to the problem of patients not collected by the family, so important for the practice of medical entities, and to propose the way of solving them.

The following paper deals with the issues of doctor’s image in the doctor-patient relationship in the Internet era and the influence of Internet on patient’s compliance. Both positive and negative standpoints have been discussed briefly, followed by a description of a research model proposed by Laugesen, Hassanein and Yufei (2015) applicable for this type of study. The study examines the impact of patients’ use of Internet health information on various elements of patient-doctor relation (including compliance) through a theoretical model based on principal-agent theory as well as the information asymmetry perspective. A pilot survey and interview study performed on one Polish doctor and a group of his patients, a specialist in Family Medicine has been described. The study carried out by three coworkers: Laugesen, Hassanein and Yufei (2015) revealed that patient-doctor concordance and perceived information asymmetry have relevant effects on patient’s compliance while patient-doctor concordance reveals a stronger relationship. The final conclusions were such that only doctor’s quality had a significant influence on the information asymmetry; the Internet health information gathered by a patient had no impact on perceived information asymmetry; the pilot study performed on the Polish physician confirms the theses presented in this paper but further investigations concerning the formerly discussed issues should be done.

The present paper constitutes a qualitative discursive investigation of the nineteenth century case reports from ophthalmology derived from a specialist American medical journal, and focuses on citation as well as on authorial and patient’s presence. Regarding the first aspect, the present study generally confirms the results of the previous research, i.e. significant subjectivity, directness and informal character of the texts at hand. However, it also provides another insight into the scholarly communication in the nineteenth century, focusing on how patients are positioned therein, which has not received significant attention in the literature of the subject. Additionally, the paper offers an overview of the studies on specific aspects of scientific prose of the nineteenth century, including the medical context, as well as attempts to show the relation between the texts analysed and the context of their production and functioning, following the tradition of Genre Rhetorical Studies.

The right to use health services, including spa treatment, is one of the basic patient rights. The specificity of the issues undertaken stems from at least two sources. First of all, patients are a special category of people, because human health, as the highest value possessed by every human being, is subject to legal protection and requires their rights and freedoms are guaranteed. Secondly, spa treatment, which is an integral part of the health care system, corresponds to art. 68 of the Polish Constitution, assuming the fundamental principle according to which every citizen has the right to health care. On the other hand, this treatment means providing health services, which are conducted only in a separate area of the spa commune – a spa and in specially adapted medical entities – spa treatment centers. The study covers the concise genesis of patient rights and the notion of the patient in terms of doctrine and legislation. Moreover, it contains the basic concepts related to spas. Recognition of the health needs of society is associated with a presentation of the individual types of spa treatment centers and spa treatment facilities, as well as the necessary conditions that they should meet. Due to the existing different status of patients in spa treatment institutions, the analysis covers the basis for admission, for referring and qualifying patients to these centers, and also the rules for using services guaranteed in the field of spa treatment. The patient’s right to health services is also examined in the context of using these services. Despite the fact that patients’ interest in this form of treatment increases every year, as is shown by the available data, there are a number of legal and organizational problems related to access to treatment as part of spa services.

Research about health loss shows that the way we experience critical moments and build a new identity are important in giving meaning to disease. It allow to integrate the experience of illness into the whole of life. The aim of the research was to analyze the narrative identity reflected in the life history and to explore the factors contributing to the differences in the formed narratives. A research question was: what narrative about one’s life does a person with an oncological disease create? The Polish adaptation of Dan McAdams’ life story interview was used. The study was conducted in group of four people with cancer remission. The research material was subjected to McAdams’ proposed sequence and consistency analysis. Elements of hermeneutic analysis were also used. The patients identity is coherent and mature, their narrative include the time from childhood to the present. Narratives differ in the degree of paying attention on the description of emotional experiences, the level of detail and the way of moving to the next stages of the story. Patient include the disease in their narratives, doing so in an individual way. However, it is possible to distinguish two ways of storytelling. One of them is the location of the disease in the broader background of the life situation, the other – recognizing the disease as the main moment in a given part of the story, constituting its title. It seems interesting to perform comparative research in a group of people, who are during diagnosis of cancer and relate them to the results of people in remission stage.

The article points out that the problem of the main binary relation in speech-language therapist (therapist-patient) and the interrelated relationship (speech-language therapist-patient-family/carer) should be addressed with respect to dialogue personalization, respecting the autonomy of each participant in speech-language therapy as well as the specificity of the primary group (family) and secondary (organizational, contractual). The sequence of appropriate interactions, that is, the interactions of the main actors of the diagnostic and therapeutic process, can transform into a lasting relationship and thereby influence the progress in speech-language therapy and the quality of the patient's life, if personal contacts and language announcements are reciprocated with kindness, respect and willingness partner collaboration.

Artykuł dotyczy problematyki granic obowiązku gwaranta, czyli osoby, na której ciąży prawny, szczególny obowiązek zapobiegnięcia skutkowi przestępnemu na gruncie prawa karnego materialnego. Autorka rozważa, czy granice tego obowiązku są w odniesieniu do osoby wykonującej zawód lekarza w jakikolwiek sposób limitowane. W tym celu poddaje analizie przepisy ustawy o zawodach lekarza i lekarza dentysty oraz Kodeksu etyki lekarskiej oraz przepisy Kodeksu karnego. Następnie, odwołując się do dorobku doktryny prawa karnego, wyróżnia poszczególne rodzaje ryzyka. Zakończenie artykułu stanowi odpowiedź na pytanie, czy lekarz ma obowiązek ratowania zdrowia lub życia pacjenta z narażeniem się na niebezpieczeństwo osobiste.
is under a specific legal obligation to prevent a criminal effect, on the basis of substantive criminal law. The author considers whether the limits of this obligation are in any way limited with regard to a person performing the profession of a doctor. For this purpose, she analyses the provisions of the Act on the Professions of a Doctor and Dentist and the Code of Medical Ethics and the provisions of the Penal Code. Then, referring to the achievements of the criminal law doctrine, she distinguishes particular types of risk. The article ends by providing an answer to the question of whether the doctor is obliged to save the health or life of the patient if this involves exposure to personal danger.

Pursuant to Article 68(3) of the Constitution of the Republic of Poland, a pregnant woman is entitled to special care from the State. Therefore, it seems extremely important to indicate uniform, universally binding standards in order to improve the quality of services provided and to respect the fundamental rights due to women and their children in maternity care. Unfortunately, as the analysis and reports concerning the observance of patients’ rights during the perinatal period show, the current standards are not always properly implemented by medical institutions, and the legal guarantees of observance of perinatal care standards are not sufficient. The aim of the article is to discuss the legal regulations in force in the field of perinatal care, to indicate their subject and subject scope and to conduct a legal analysis of the proposal of new organisational standards of perinatal care, which are to enter into force as of 1 January 2019. The basis for the discussion is the presentation of the legal form of the existing standards of perinatal care. It is extremely important to answer the question whether the principles of medical knowledge should be enacted in the form of standards of medical procedure in the form of universally binding normative act, or whether they should constitute guidelines and recommendations that are legally non-binding. Perinatal care standards in the context of the duty of doctors and medical staff to apply current medical knowledge and to act with due diligence deserves additional attention. The article contains a detailed analysis of the proposal of new standards and presents de lege ferenda postulates, especially in the field of legal guarantees of observance of perinatal care standards in Poland.

Choroba dla większości ludzi stanowi bardzo trudne doświadczenie egzystencjalne. Choć dotyka ona w pierwszej mierze ludzkiego ciała, to jednak cierpi tak naprawdę wtedy cały człowiek, w swej jedności duszy i ciała. Postęp medycyny sprawia, że lekarze są dziś w stanie walczyć skutecznie z wieloma schorzeniami i nieść ulgę w cierpieniu. Niestety bardzo często w swych medycznych działaniach, skupiając się na „chorobowym przypadku” gubią gdzieś człowieka jako całość, pomijają jego godność osobową, traktują go przedmiotowo. Tymczasem właśnie ta osobowa godność pacjenta winna być podstawową kategorią aksjologiczną w zawodzie medyka. Gdy bowiem pracownikowi służby zdrowia będzie towarzyszyć integralna wizja osoby ludzkiej, świadomość wartości cierpienia oraz wzniosłości powołania medycznego wówczas jego relacja z pacjentem będzie opierać się na partnerstwie i zaufaniu, a to przyczyni się także do skuteczności zabiegów terapeutycznych.
For most people illness is a very difficult existential experience. In the first place illness concerns human body but the whole person suffers, so the body and soul as well. Medical progress makes it possible to cure many illnesses and to relieve suffering. Unfortunately, quite often in medical treatment doctors lose from sight the person as a whole being in dealing with man as with an object. Personal dignity has to be a basic axiological category in the medical profession. When the medical treatment is united with a vision of the good of the whole person the relation of mutual trust begins and medical care could produce better fruits.

The SARS-CoV-2 coronavirus pandemic has changed how almost every sphere of our lives functions. Its greatest impact can be seen in the functioning of the health care sector, whose task was not only to care for the sick or people suspected of infection, but also to take all measures to prevent the spread of infections. The imposition of a state of epidemic threat in Poland, and then the state of epidemic, provided a basis for imposing a number of restrictions that had a significant impact on the realisation of patients’ fundamental rights. The purpose of the considerations is to present and analyse the limitations of selected patient rights during the SARSCoV-2 pandemic. This article first presents issues related to patient rights in genere, emphasizing their importance for the proper functioning of the health care system in the country. Next, the limitations of selected patient rights, which unquestionably occurred in the era of COVID-19, are presented. It is shown that the rights indicated were not only limited, and sometimes even excluded. The article also presents an analysis of the annual reports of the Patients’ Rights Ombudsman, which in their content confirms the great increase in the number of violations of patient rights in the period of SARS-CoV-2 pandemic. Consequently, this resulted in a far-reaching negative impact on the perception of the health care system in our country.

What we usually call loneliness is surely something experienced by: Palamedes and Ajax at Troy – the victims of Odysseus’s envy, Antygone – after meeting her sister Ismene, Prince Hamlet – after speeking to his mother. The author added to K. Jaspers b order situations his own loneliness research model: about invasive modality in surgery. It consists of two obligatory components parts: 1. Surgeon’s decision given to the patient in the form of proposal – suggestion.2. Patient’s approval – consent. Without surgeon’s proposal – patient consent is meaningless. Without the patient’s approval, the operation cannot usually take place. Patient’s approval, or refuse, is this part of the surgical decision, were we can distinguish: 1. Man’s sovereignty in disposing of his health and life. 2. Existence of a distinct self – individuality of existence “I”. The research model reveals, perhaps even more clearly than the another ones, the ontic dimension of loneliness. Loneliness is the price of identity – oneselfness. In conclusions the author stressed: Necessity of discussing patient’s consent in conjunction with surgeon’s decision. Attempts to isolate the issue of patient’s approval lead to aporia, in particular cases to unhappiness. Whilst describing, by the surgeon, diagnosis and treatment plan, the patient does not gain any competence in the branch of surgery; he is preoccupied with examining the doctor. The most important thing is whether he can trust him. Even the best functioning institutions and community customs cannot remove loneliness completely, especially in border situation s. Therefore they may not be blamed for the fact that the loneliness exists. Time is a strong generator of tensions connected with loneliness. Agreeing with N. Hartmann, that the man exists in his achievements, the author adds: and in decisions made in solitude. There is also creativity here.

This paper gives an overview of three discourses of time in philosophy ofmedicine distinguished by the authors: the discourse of immortality (aiming at an objectiveprolongation of life), the discourse of the present (aiming at the quality of subjectivetemporal experience) and the discourse of eternity (aiming at transgressing the limits oftemporality). Views of renowned representatives of each of these discourses are beingdiscussed, including members of the so-called Polish School of Philosophy of MedicineH. Nusbaum, H. Święcicki), phenomenological psychiatrists (L. Binswanger, V. E. vonGebsattel, E. Straus) as well as some more contemporary authors (Z. Bauman, A. de Grey,A. Szczeklik).
