    Opis:
    This article explains how environmental awareness was raised among primary school pupils in the Second Polish Republic illustrated with an example of “Nasi Przyjaciele” magazine, published by the Society for Protection and Care of Animals in Krakow. The monthly was recommended by the Ministry of Religious Denominations and Public Enlightment for school use. In the specific sections of the magazine, environmental attitudes were promoted by means of articles, appeals to provide environmental education, environmental protection and, last but not least, children’s practical activities as part of the Young Friends of Animals Circle, contests for pupils of elementary schools and their creative co-participation in editing the magazine (stories and poems written by the children were published as the winning contest works). The editors regularly provided answers to children’s questions about care of animals and environmental protection.

    Opis:
    The aim of the article is to justify the formulated postulate to separate in the Polish legal system an autonomous type of offence consisting in the counterfeiting, alteration or illegal reproduction of a work of art, which would comprehensively – similarly to the protection of monuments, or maybe even more broadly – cover the most important phases of this behaviour, taking into consideration also those of a secondary nature related to marketing the forgery or its distribution. The concept of ‘work of art’ has been narrowed down to works of plastic art for the purpose of the article and in this text is understood as an independent object separated from other objects of individual and independent specificity, being man-made, possessing aesthetic value, and expressing emotional qualities (Gołaszewska, Zarys estetyki. Warsaw 1986: 277). The most important problems connected with activation of criminal law protection in the event that a perpetrator engages in conduct commonly referred to as ‘forgery of a work of art’ are presented. The research was conducted primarily using the dogmatic method, and to a lesser extent the historical and comparative method. Finally, it is established that the system of legal interests surrounding the current art market rules makes it necessary for the scope of legal protection of a work of art, including a historical monument in case of forgery, to focus equally on the rights of purchasers – as it has been the case so far – but consideration should also be given to the rights of original creators, so that they can react effectively if they are violated. As a result, having identified the need for legislative intervention with regard to the crime of altering or forging an item and the crime of sale of a forgery, a proposal is formulated to modify the existing legal solutions.
    Celem prowadzonych rozważań jest uzasadnienie sformułowanego postulatu wyodrębnienia w polskim systemie prawnym autonomicznego typu przestępstwa obejmującego podrobienie albo przerobienie bądź nielegalną reprodukcję dzieła sztuki, które kompleksowo – podobnie jak w wypadku ochrony zabytków, a może nawet szerzej – obejmowałoby najważniejsze fazy tego zachowania, uwzględniając również i te o ubocznym charakterze, związane z wprowadzeniem falsyfikatu do obrotu lub jego rozpowszechnieniem. Dla prowadzonych rozważań pojęcie dzieła sztuki zawężone zostało do dzieł sztuki plastycznej, a przez „dzieło sztuki” rozumie się samodzielny przedmiot oddzielony od innych przedmiotów o indywidualnej i niezależnej specyfice, stworzony przez człowieka, posiadający wartość estetyczną i wyrażający walory emocjonalne (M. Gołaszewska, Zarys estetyki. Problematyka, metody, teorie. Warszawa 1986: 277). W poszczególnych częściach artykułu przedstawiono najważniejsze problemy związane z uruchomieniem karnoprawnej ochrony w razie realizacji przez sprawcę zachowania określanego powszechnie jako „fałszerstwo dzieła sztuki”. W prowadzonych badaniach wykorzystano przede wszystkim metodę dogmatyczną oraz w węższym zakresie historyczną i komparatystyczną. Finalnie ustalono, że układ interesów prawnych wokół aktualnych reguł funkcjonowania rynku sztuki sprawia, że zakres ochrony prawnej dzieła sztuki, w tym również zabytku w razie fałszerstwa, w równej mierze powinien koncentrować się na prawach nabywców – jak dotychczas – ale także powinien uwzględniać prawa twórców oryginałów, tak aby mogli w razie ich naruszenia skutecznie reagować. W rezultacie, dostrzegając potrzebę interwencji legislacyjnej także wobec przestępstwa przerobienia albo podrobienia zabytku oraz przestępstwa zbycia falsyfikatu zabytku, wskazano na konieczność wprowadzenia do polskiego systemu prawnego autonomicznego typu przestępstwa fałszerstwa działa sztuki.

    The uncomfortable situation of Poles in Lithuania is, among other things, the effect of Lithuanian historical education. Excerpts from the textbook on the history of Lithuania show diametrical differences in contemporary ideas about the past of both nations. Shared heroes are useful to overcome prejudices of the previous century (which affect the image of 1385-1795). One of them is Michał Kleofas Ogiński, Lithuanian nobleman, a political activist during the last years of the Polish-Lithuanian Commonwealth and two decades after its collapse. He has the rank of a great national hero in Lithuania and Belarus but is valued in Poland above all because of his piano compositions. The analysis of fragments of his work Memoirs about Poland and Poles helps us to regard a representative of the noble nation from a different perspective. It makes us aware of the cohesion of Polish and Lithuanian national identity at the turn of the 19th century, helps us to appreciate the heritage of the past and offers a chance to build positive relations between us. Rectifying a distorted vision of history is a prospect for a mature partnership now and in the future.

    Artykuł przedstawia aspekty procesów digitalizacyjnych na przykładzie polskiego projektu Fundacji Ośrodka Karta „Cyfrowe Archiwa Tradycji Lokalnej”. Szczególną uwagę zwrócono na istotę działań ratowniczych w społecznościach lokalnych z uwzględnieniem tendencji ogólnoświatowych, które mają na celu utrwalanie dziedzictwa przez aktywne współdziałanie społeczności internetowej. Omówiono również rangę Narodowego Archiwum Cyfrowego – repozytorium narodowego jako przykładu instytucji przodującej w pracach cyfryzacji archiwalnej. Położono nacisk na współczesne tendencje społeczne związane z ocalaniem i oddolnymi działaniami o charakterze społecznikowskim. Uwypuklono fakt, iż sprawny proces tworzenia repozytorium lokalnego poparty jest zaangażowaniem wolontariuszy – przedstawicieli wspólnoty (np. seniorów), którzy mają duży udział w kompletowaniu zbiorów cyfrowych. Zwrócono uwagę na aspekty prawne, zwłaszcza prawa autorskie, które niejednokrotnie blokują skuteczność prac digitalizacyjnych. Postawiono tezę, że działania cyfryzacyjne o charakterze oddolnym, regionalnym dają społecznościom skuteczny akces do przestrzeni internetowej i tym samym dziedzictwo wspólnoty zyskuje wymiar globalny. Podkreślono, że waga tworzenia repozytorium elektronicznego jest tym istotniejsza, że niejako ocala biblioteki od katastroficznego scenariusza dewaluacji kulturowej i postępującej anachroniczności cywilizacyjnej.
    The article presents different aspects of digitization processes, focusing on the case example of the project Digital Archives of Local Tradition undertaken by the Karta Foundation. A particular attention is given to the significance of those activities in and dependent on local communities that would include worldwide trends that aim at preserving heritage through an active collaboration with the internet community. The article also discusses the significance of the National Digital Archives, a national repository, as an example of a leading institution in archival digitization. In particular, emphasis is given to modern social trends related to preservation and to grass-root activities of public-spirited interest groups. The article highlights the fact that an efficient local repository creative process can be supported and driven by the commitment of volunteers – representatives of the community (e.g. OAP’s) – who play an important part in completing items for digital resources. The author focuses on legal aspects, copyright issues in particular, that oftentimes hamper, or even block, the efficacy of any digitization project. According to the author, digitization activities of grass-root and regional nature make way for a provision of efficient access to the internet space to communities, and thus the shared heritage of a community takes on a global dimension. The significance of a creation of an electronic repository is even more important in view of the fact that, in a way, it comes to the rescue of libraries that could face a catastrophic scenario of cultural devaluation and increasing civilizational outdateness.
