The labour inspector’s statement constitutes a non-statutory form of enforcing labour rights. In this context, we can see a variety of problems related both to the impact of the legal measure itself, appealing against it, as well as to the role it plays in ensuring compliance with employment rights. The jurisprudence and literature to date indicates explicitly that the employer’s failure to comply with the content of the labour inspector’s speech does not give rise to any negative legal consequences. Nevertheless, employers who do not agree with the solutions recommended by the authority through the labour inspector’s speech perceive this specific measure as a special type of decision. The decision itself, in turn, seems to be a natural manifestation of the state, the authority indicating to the subject of law the individual directions of its behaviour. However, this is, in fact, a different act. The article doubts the implementation of the model of labour supervision and control assumed by the legislator in the light of the measure outlined in the labour inspector’s speech. As a result, allowing this measure to be left to the inspector’s discretionary use may lead to the reinforcement of the feeling of a lack of efficiency on the part of the state bodies in the field of protection of workers’ rights, especially that the cases of its use are an open catalogue, which includes issues such as working time or the employment of young people. In order to better understand these trends, two examples are discussed where the National Labour Inspectorate had an impact on situations of a gross violation of labour law standards. A de lege ferenda direction has also been indicated, which means the creation of the institution of “re-inspection” of the employer. The existence of a non-authoritative “recommendation”, which is a statement by the labour inspector, is in fact a manifestation of the implementation of Article 17, paragraph 2 of the ILO Convention No. 81, which would not be incompatible with the consequence in the form of addressing a statement.

Social market economy has been the desired model of economy since the beginning of the political and economic transformations in Poland initiated in 1989. In 1997, pursuant to the provision of article 20 of the new Constitution of the Republic of Poland, it became the normative foundation of the country’s political regime. Today, twenty five years later, one may wish to analyse the effects of these changes and compare the contents of currently binding regulations of employment issues and labour market practices with the social market economy model which lay at their formulation. Social relations, regulated by collective labour law achieved through the activity of trade unions and employers’ organisations, collective negotiations and creation of the sources of autonomous law, belong to these areas, which are most neglected in Poland in terms of their compliance with the basic assumptions of social market economy. They aim, among other things, at implementing a social partnership model and workers’ participation as active subjects in the dialogue with employers on matters concerning the conditions of an enterprise, resolving problems and disputes by way of collective negotiations leading to collective agreements. In Poland, this concept is still given only marginal attention. This paper also identifies problems that arise from implementation of the idea of a social market economy in the practice of individual labour law. Legislative tendencies of the recent years focus on the economic efficiency of enterprises, also at the cost workers’ status, rather than sustained development of economy, fostering for the needs of all subjects involved in the functioning of the enterprise. With due respect to the achievements of the transformations in Poland after 1989, full implementation and realisation of the constitutional provisions of article 20 constituting grounds for the political regime, has not yet been achieved.
Społeczna gospodarka rynkowa od początku zainicjowanych w 1989 r. w Polsce przemian politycznych i gospodarczych była modelem gospodarczym stanowiącym cel podjętej transformacji. W 1997 r. ten typ gospodarki stał się normatywną podstawą ustroju, na podstawie treści art. 20 nowej Konstytytucji. Upływ ćwierćwiecza przemian upoważnia do analizy efektów transformacji i porównania obowiązującej treści regulacji prawnej w dziedzinie zatrudnienia oraz praktyki rynku pracy do modelowych założeń ustroju społecznej gospodarki rynkowej. Stosunki społeczne regulowane przez zbiorowe prawo pracy, a więc aktywność związków zawodowych i organizacji pracodawców, negocjacje zbiorowe i tworzenie źródeł autonomicznego prawa pracy są w Polsce dziedzinami najbardziej odległymi od założeń społecznej gospodarki rynkowej. Zakładają one powstawanie partnerstwa społecznego, upodmiotowienie i włączenie załóg zakładów w dialog z pracodawcami dotyczący sytuacji zakładu, rozwiązywanie problemów w drodze negocjacji zbiorowych, których efektem będzie uchwalanie aktów autonomicznego prawa pracy. Te pozytywne zjawiska mają w Polsce nadal marginalne znaczenie. W artykule wskazano także problemy z realizacją idei społecznej gospodarki rynkowej w normach o praktyce indywidualnego prawa pracy. Tendencje legislacyjne ostatnich lat eksponują raczej dążenie do ekonomicznej efektywności przedsiębiorstw, także kosztem statusu pracowników, a nie typowe dla omawianego modelu gospodarki zrównoważone uwzględnianie potrzeb wszystkich podmiotów zaangażowanych działanie zakładu pracy. Mimo szacunku dla osiągnięć transformacji, która dokonała się w Polsce po 1989 r., trzeba wskazać na konieczność dążenia do pełnej realizacji założeń ustrojowych ustanowionych w art. 20 Konstytucji.

The aim of the article is to determine the economic situation of people aged over 50 and the conditions of their professional activity. The subject of the analysis is the labour market of Poland – an EU Member State and of the OECD, a country that has undergone a political transformation from a centrally planned economy to a market economy. The research methods applied in the study included: literature analysis, methods of statistical analysis based on descriptive statistics tools, analysis of variability and logical analysis of cause and effect relationships. To achieve the aim of the article, several research questions were formulated. First of all, these addressed several issues: Is the population aged 50+ in Poland is still professionally active? What are the reasons for the decision to be professionally active or inactive? What factors influence changes in the number of pensioners? Is the situation of people aged 50+ on the Polish labour market different from their situation in other EU countries? The research methods used in this study are: literature analysis, statistical analysis method based on descriptive statistic tools, analysis of variability, and logical analysis of cause and effect relationship. By the way of conclusion, an attempt was also made to compare the situation in Poland with the models of life of the elderly in other European economies of such countries as Czechia, Germany, Sweden and Italy. The main findings were the following: the economic situation of the elderly in Poland deteriorated, their willingness to look for work and activity increased, but unfortunately this search was hindered by significant barriers to accessing the labour market. Recommendations for economic policy include demands to take specific actions to extend professional activity, facilitate access to digital job search methods, and social campaigns to counteract ageism.

Young people, regardless of their social environment, place of residence or work, are looking for values and key competencies that enable achieving goals in life. Therefore, an appropriate education system is important, which in the conditions of changing reality will meet these requirements effectively. The contemporary employer is interested in four groups of key competencies, such as intellectual, professional, personal and interpersonal. Geography is a field with great potential for the development of various competencies. In this context, questions about adjusting geographical education to the expectations of employers are justified. Therefore, the aim of the study is to assess the strengths and weaknesses of the current development of competencies and qualifications at the geography speciality of the Faculty of Geographical and Geological Sciences, Adam Mickiewicz University in Poznań, Poland. The reference points included a report on research carried out among 200 employers in 2012, as well as surveys among students graduating from master‘s studies on the assessment of the level of their competencies and qualifications. It was determined that the strength of the current geographical education at the faculty is to prepare mainly specialists with broad general and professional knowledge, and high self-esteem in terms of cooperation in the group and communication. The area of development for the geographical education are intellectual competencies, above all independent thinking and prioritising. The last year geography students fall out the most in terms of personal competencies. The authors suggest building students‘ awareness because, as the above results show, they are not fully aware of what expectations they may face in the labour market. It is worth modifying the study program so as to put more emphasis on soft competencies and support the development of various forms of extra activities of students. Attention was also paid to the importance of didactic competencies, which on the one hand raise the self-esteem of students, and on the other, increase the chance of finding a good job. An interesting aspect of the research is the wide spectrum of professions in which students work. This reflects their diverse skills, including spatial thinking. Combined with increasing attention paid to the issues related to the natural environment and sustainable development, graduates of geography have a strong position to enter the current labour market. The advantage of geographers is the use of modern technologies. Unfortunately, however, the results of the research presented above, both among Polish students and internationally, indicate insufficient skills in the use of modern technologies by students of geography.

Efficiently functioning labour inspectorates play a key role for both fair mobility and the protection of workers’ rights. They contribute, for example, to combating and eliminat-ing hazardous working conditions, and ensuring that remuneration and social insurance premiums are actually paid. This is significant in the context of the posting of workers in the framework of the provision of services. Establishing the liability regarding compli-ance with the occupational health and safety regulations is causing serious practical dif-ficulties. Therefore, it is important above all to identify initiatives undertaken at the EU level designed to enhance cooperation of national labour inspectors in this field. It is also important to carry out an assessment whether they work efficiently, require systematis-ing, or perhaps it is necessary to undertake more formalised initiatives, e.g. in the form of a new EU institution.

The paper deals with mechanisms used for reducing unemployment among women in Poland after the World War II, the so-called “women productivisation.” I discussed women’s attitude to employment and the state’s standpoint as far as the problem of women’s unemployment is concerned, and analyzed women’s unemployment figures in the introductory part. Employment policy in the early days of the Polish People’s Republic was a combination of many factors, among which the most important were ideology, pre-war tradition, and war-related experiences. Women found employment in the industry since the beginning of industrialization of the Polish lands in 19th century. In the interwar period and the early days of the Polish People’s Republic, employment increased mainly out of economic reasons (necessity to support family and oneself). It was in keeping with the Marxist ideology in place after the World War II. The “new woman” was to be free from capitalist exploitation and on par with a man in terms of professional career. The role model of the woman was in particular a female-worker employed in industry. After the war, in 1940s, the number of women registered at labor offices was rising. According to labor offices’ figures, the number of job offers for women was insufficient or these were unattractive. Hence, the Ministry of Labor and Social Policy (Ministerstwo Pracy i Opieki Społecznej) conceived the idea of developing short-term training for women and employing them in the cottage industry - action “AZ”. It lasted from 1947 to 1950; it was evolved due to changing regulations. Undoubtedly, the action “AZ” contributed to the development of “female” cooperatives, but with time it was considered as ineffective and its scope was limited. My fundamental goal was to discuss the ‘AZ’ program, including its course, scope, and scale, as well as its evaluation. The subject matter in question has not been discussed in detail to date but only briefly addressed in the literature listed below.

The spread of urban policies based on a set of standardised ‘creative city’ strategies has been criticised on a number of counts. In Scott’s (2006: 11) view, focusing just on “creating a high-quality urban environment, rich in cultural amenities and conducive to diversity in local social life” is too limited. He points out that the relationship between the presence of creative people and the development of a city is far more complex. The research undertaken as part of the European ACRE project (Accommodating Creative Knowledge: Competitiveness of Metropolitan Regions within the Enlarged Union) has revealed that access to a diversity of creative-labour-market opportunities is vital to both attract and retain talent in the longer term. Accessible and inclusive networks of creative workers are also vital, but their importance is often overlooked. The functionality of such networks has a huge impact on the possibility of finding a new job, and can be particularly important for lowering entry barriers for newcomers in creative occupations. Here, these issues are explored on the basis of a research conducted among managers of creative firms and international creative-class migrants in Poznań (Poland). This city has recently experienced major economic restructuring and a shift from the manufacturing industry towards a more creative and knowledge-based one.

Following my research interests, I would like to reflect on professional work and focus on its new realities and challenges that the various participants of the labour market will face. As the new shape and system of forces creating the changing labour market become a challenge not only for employers, business owners, but also for employees, contractors and finally for counsellors and educators, the initial part of the study will include a short analysis of the current situation on the labour market modified by the pandemic. Next, the author will present the consequences of these changes which will be analysed from the perspective of the employer and the employee. At this point, it is worth noting that a large part of the sources on the basis of which this study was created are the internet sources, current reports, and messages which during the pandemic seem to be the most up-to-date source material.

The paper by Jan Wolski — a Polish theoretician and cooperative activist — constitutes the third section of the book Spółdzielczy samorząd pracy [Cooperative Labour Self-Management], which he wrote over the years of 1943-1956, but which was never published as a whole. The manuscript, from the author’s family archives, includes the information that this piece was ―written in 1943 for the Inter-union Cooperative Committee (functioning underground in Warsaw during II World War) and the Socialist Planning Commission‖. Entitled Cooperative Labour Self-Management, this section of the planned book was published in the monthly magazine Więź [Bond], issue no. 2 of 1972, and in 2011 on the website Lewicowo.pl. It contains Wolski’s deliberations regarding the functioning of cooperative labour self-management under the conditions of a social and economic transformation heading towards a classless society. Wolski believed a universal labour-based political system to be one of the essential conditions of socialism, supplanting the old organisational forms originating from the capitalist period. As such, universal labour self-management together with other forms of popular self-government, and particularly user self-government, constitutes a transmission belt between the populace’s grassroots activity and top-down political organisation. Mindful of Edward Abramowski’s teachings, Wolski considered that only having the state based on self-governing cooperative institutions consisted the true realisation of universal will, and thereby the realisation of socialist ideals.

Theoretically, there are many good arguments that unions should support a proposal on basic income. The main reason for the Danish trade unions resistance to basic income reform is that it would go against the short-term interest of the unions in organisational self-maintenance. Trade unions will lose power in relation to their members with a basic income. Trade unions have control over individual members by virtue of the collective agreement system and the labour law system. If you have a basic income system, the individual worker will decide when he or she wants to leave his workplace and strike. Suppose a single worker or a group of workers leave their workplace because of dissatisfaction with the working condition. In that case, they will be punished financially according to the rules of labour law rely on any support from their trade union.

This paper aims to demonstrate the main aspects and weaknesses of children's rights in Sudan and describe how to work towards enhancing the immediate response to violations against children. This discussion will help develop future plans to strengthen the enforcement of children’s rights in Sudan and create an environment that protects children's rights against all kinds of violations. This paper presents the current situation of children’s rights violations in Sudan and factors that have a great and direct impact on these situations, especially social and cultural factors concerning female circumcision, genital mutilation, and marriage of underage girls; and laws that violate the dignity of Sudanese children, such as laws related to flogging, imprisonment, and death. The article also addresses issues of wars and internal conflicts and their impact on children, including their recruitment and trafficking. It also discusses the weaknesses of laws in place to protect children in Sudan and the changes these laws have undergone in recent years, especially the fundamental changes following the revolution that broke out in Sudan in 2018, which replaced the dictatorial military regime with Islamic orientations and trying to find objective solutions.

Although social concerns are strongly present in the laws of the European Union and the United States, antitrust, or competition, law whose predominant objective is securing the correct working of the competition mechanism, constitutes a vital element of both legal systems. Social concerns remain outside the scope of antitrust (competition) law, which may lead to a very complicated situation between that law and social regulations. There are fields in which those sets of rules are complementary, yet it must be underlined that in some areas the objectives of labour law are different from, and even contrary to, the aims of antitrust (competition) law. The area most sensitive to potential conflicts are the regulations of labour law which are connected with collective bargaining. According to the EU and US law, antitrust (competition) law should not undermine the social objectives recognised by the laws of those states. There is, however, space in those laws in which collective labour agreements may be subject to antitrust (competition) law scrutiny.
Względy społeczne są silnie chronione w prawie Unii Europejskiej i Stanów Zjednoczonych. Ważnym elementem wskazanych systemów prawnych jest również prawo antymonopolowe, którego cel, najogólniej rzecz ujmując, stanowi zapewnienie właściwego funkcjonowania rynku. Kwestie socjalne nie mieszczą się w optyce prawa antymonopolowego. Może to prowadzić do powstania bardzo skomplikowanej sytuacji między prawem antymonopolowym a unormowaniami służącymi ochronie względów socjalnych. Istnieją obszary, na których te dwa zespoły norm są komplementarne, ale zauważyć należy również, że na pewnych płaszczyznach cele prawa pracy są odmienne, a nawet przeciwstawne wobec zadań stawianych przed prawem antymonopolowym. Sferę, w której powstanie konfliktów jest najbardziej prawdopodobne stanowią układy zbiorowe pracy. Zgodnie z unijnym i amerykańskim orzecznictwem prawo antymonopolowe nie może być wykorzystywane do uniemożliwienia osiągnięcia celów socjalnych chronionych przez prawo. Istnieją jednak przypadki, w których stosownie prawa antymonopolowego do układów zbiorowych pracy jest możliwe.

Educational mobility as a determinant of students’ personal and professional development

The aim of the article is to analyze the extent, to which the participation of students in learning mobility projects on the example of the Erasmus+ programme influences the improvement of their individual skills desired from the perspective of the labour market. The text begins with an introduction that outlines the background to the considerations undertaken. Next, the historical context of learning mobility in Europe and the process of internationalization of universities are presented as one of the consequences of the globalizing labour market. In the following part of the article we characterized the best known European programme promoting academic mobility Erasmus+. The end of the article contains a review of the research on the competences of beneficiaries of learning mobility projects, supported by statistical data, and an attempt to draw a link between participation in student exchange and the chances of finding a satisfactory employment after graduation. The analysis shows that graduates with foreign mobility experience develop a number of characteristics and skills, that increase their employability and career opportunities.

The contemporary labour market is characterised by broadly understood flexibility which conditions the uncertainty of the professional situation of a person participating therein. One of the factors increasing their chances to have a successful career are not only relevant competences, qualifications and proactive behaviours to the benefit of their own development, but also their trust in their own abilities. In this article it has been attempted to confirm the thesis on the existence of co-dependence between the individual’s proactivity and self-efficacy in the process of developing a professional career. To this end, a review of selected theoretical depictions on both, constructs and results of research explorations specifying mutual relations, was conducted. The observations made have both, theoretical and practical implications that are interesting in cognitive terms. The analysis thereof may prove to be especially important with regard to young people who are preparing to enter the labour market.
