W artykule przeprowadzono analizę realizacji inicjatywy ustawodawczej przez Prezydentów Rzeczypospolitej Polskiej (RP) w latach 1990–2019. W publikacji przedstawione zostały podstawy prawne obowiązujące w poszczególnych ustawach konstytucyjnych z lat 1989–1992 oraz w obecnej Konstytucji z dnia 2 kwietnia 1997 r., na mocy których Prezydenci RP korzystali z konstytucyjnych prerogatyw, wśród których jest inicjatywa ustawodawcza. W artykule poddano analizie wykonywanie tej kompetencji przez poszczególnych Prezydentów RP. Celem artykułu jest przedstawienie realizacji inicjatywy ustawodawczej Prezydentów w Trzeciej Rzeczypospolitej z uwzględnieniem zadań Kancelarii Prezydenta jako organu pomocniczego. Celowo pominięto zapowiedzi programowe kandydatów ubiegających się o urząd prezydenta, stanowiące realną realizację inicjatywy ustawodawczej w przypadku objęcia urzędu prezydenta, w tym także okresu kohabitacji, ponieważ kwestie te wymagają podjęcia odrębnych badań i analiz. W zakończeniu niniejszego artykułu dokonano podsumowania realizacji inicjatywy ustawodawczej przez poszczególnych Prezydentów RP z uwzględnieniem ich aktywności na przestrzeni ostatnich 29 lat.
In the article, the author analyses the implementation of the legislative initiative by the Presidents of the Republic of Poland in the years 1990–2019. The publication presents the legal basis for the individual constitutional laws of 1989–1992 and the current Constitution of 2 April 1997, under which the Presidents of the Republic of Poland exercised their constitutional prerogatives, among which is legislative initiative. The article analyses the exercise of this competence by individual Presidents of the Republic of Poland taking into account the procedure of submitting the act for signature by the President. The aim of the article was to present the implementation of the presidents’ legislative initiative in the Third Republic, taking into account the tasks of the Chancellery of the President as an auxiliary body. This article deliberately omits the programme announcements of candidates applying for the office of the President, constituting a real implementation of the legislative initiative in the event of taking up the office of the President, including the period of cohabitation, as these issues require separate research and analysis. At the end of this article the author summarizes the implementation of the legislative initiative by individual Presidents of the Republic of Poland taking into account their activities over the last 29 years.

The Constitution of the Republic of Poland does not define in a comprehensive manner the matter to be standardized in laws and grants the legislator considerable freedom in determining their content. In view of the subject matter of this opinion, based on views founded on the doctrine of Polish constitutional law and on the jurisprudence of the Constitutional Tribunal and the Supreme Court, it can be concluded that the legislator should regulate by law, among other matters, the following matters reserved for statutory regulation (the principle of exclusivity of the act): regulations concerning citizenship and the rights, freedoms and duties of the individual, as well as the basic competences, principles of how public authorities are organised and function. On the basis of this assumption, it was examined whether there is any indication to the legislator from the constitutional norms relevant to the judicial authority. The following were taken into account: the right to a fair trial (Article 45), the principle of the separateness and independence of the judiciary (Article 173), the principle of bi-instantiality of court proceedings and the principle of statutory determination of the system and jurisdiction of courts (Article 176), the principle of the presumption of competence being assigned to common courts (Article 177), and the principle of the non-removability and non-transferability of judges (Article 180). On the basis of an analysis of these constitutional norms, it was concluded that the Constitution of the Republic of Poland enforces statutory regulation of the organisational structure and the material, local and appeal jurisdiction of common courts, and only allows for entrusting specific matters to be regulated by executive bodies by means of a regulation. In the event of any doubts as to whether a given case should be classified into the category of specific matters, the principle of exclusivity of the Act applies.

The main research aim of this article is an analysis of the length of the parliamentary term of office in Poland based on the analysis of legal rules. According to the art. 98 para. 1 of the Constitution, the parliamentary term of office starts on the day on which the Sejm assembles for its first sitting and ends on the day preceding the first assembly of the newly elected Sejm. Although the mentioned rule also expressly states that parliamentary term of office lasts 4 years, the length of the particular terms of office could be very different. If the parliamentary term of office is shortened, it could last even less than two months. If it is prolongated because of the introduction of the extraordinary measure, it could last approx. 5 years (in case of emergency state), or it maximal length can not be defined. Moreover, even in case of the “normal” terms of office they could have different length – slightly less than 4 years or longer than 4 years by even a few weeks. The presented considerations lead to the conclusion that there is need to make certain amendments of the rules of law concerning this area, which would ensure minimal 4 years length of the “normal” parliamentary term and regulate the organisation of the parliamentary elections after the termination of the extraordinary measure. Author analysed the legal rules basing on legal-dogmatic method and interpreted them by using such methods of their interpretation as: language-logical, teleological and systematic.

Recently, there has been a noticeable tendency to replace the regime of criminal responsibility with administrative responsibility. Administrative responsibility is objective in nature and has a repressive and ordinal character, detached from guilt. The Constitutional Tribunal, in its jurisdiction, states many times that the regime of liability applied by the legislator depends only on its choice. The Tribunal does not control the desirability or appropriateness of the adopted solutions. The task of the Constitutional Tribunal is only to provide an assessment, if the solutions adopted by the legislator do not violate constitutional norms and values, such as, among others, the principle of proportionality,or the ne bis in idem principle.

In 2009, the Republic of Moldova created an alternative to the communist leadership. In 2013, the Alliance for European Integration was replaced by the Alliance for Pro-European Governance, which secured two issues: the signing of the Association Agreement between the Republic of Moldova and the European Union, and the interests of local oligarchs. After the parliamentary elections in 2014, as an alternative to the increasingly powerful Igor Dodon’s Party of Socialists, another coalition, the Political Alliance for European Moldova was created and ‘sealed’ by embezzling $ 1 billion from Moldovan banks (12.5% of GDP). The coalition formed in January 2015, was replaced by the re-launched Alliance for European Integration, and then by another coalition without a definite name in January 2016. This extremely expanded political activity is a backdrop for the façade of democracy and the subsequent parliamentary elections scheduled for 2018. The pro-European coalitions in the Republic of Moldova discredited themselves in front of the society as strongly as their predecessors (the communists), causing a state of general disintegration.

Currently, recognition of the right of all people to education is considered completely natural. Since the mid-1990s, in the Czech Republic, the issue of educating people with multiple disabilities has been increasingly addressed. The main purpose of this study is to characterise the approach to education of persons with multiple disabilities in the Czech Republic. The article contains interpretations of the concept of multiple disabilities, both in the Czech literature and in international literature, with particular emphasis on the Czech approach.

The stabilising function is one of the main intended functions of the concordats. It consists in striving to ensure the immutability (stability) of legal norms resulting from the provisions of this type of treaties, and consequently to ensure the relative immutability of legal (and factual) states created or shaped under the concordat government. The Concordat petrifies a model of relations between the state and the Catholic Church. In fact, it protects a certain system of social, political and, to some extent, economic relations. This function in the Polish legal system is guaranteed in particular by the provisions of the Constitution of the Republic of Poland of 1997 (Article 25(3) and (5)) and the provisions of the 1969 Vienna Convention on the Law of Treaties. The Concordat of 1993 is therefore legally difficult to denounce. The Treaty provides a differentiated implementation of the stabilising function. Individual norms of this act, to varying degrees, implement its stabilising function. It seems that it is most fully implemented through detailed standards of an absolutely binding nature. The second category of concordat norms from the point of view of the implementation of the stabilising function should include norms whose implementation depends on a later agreement between the Church and the relevant state authorities. As a third category, one should mention regulations which, when formulating legal norms, refer to canon law or state law. The last group consists of norms, the implementation of which depends, in fact, on a unilateral decision of the state authorities. The degree to which a stabilising function is carried out by the provisions of the Concordat also depends on the level of detail. The Concordat of 1993 is not a full concordat and therefore provides limited stability in the financial and property affairs of the Catholic Church and clergy. In practice, however, the 1993 Treaty, combined with the political strength of the Church, has ensured relatively good legal stability for the Church, although it has not yet been fully implemented and has seen some obvious violations. In many aspects, however, there has been an improvement in the legal position of the Church.

The principle of cooperation between the state and religious associations gives a positive meaning to the relations of these entities. However, if it is improperly implemented, it risks giving the state a religious character, or the political instrumentalization of religious communities. The principle of cooperation “blurs” the separation of church and state. The cooperation between these entities should be optional, and its goals should be as precise as possible. The principle of cooperation, therefore, deserves relative, not indisputable acceptance.In Polish law, the principle of cooperation between the state and religious associations has both Catholic and secular roots. It became a constitutional and concordat requirement in the sphere of religious relations. At the same time, the Constitution of 1997 and the Concordat of 1993/1998 set out in very general terms the goals of obligatory cooperation between the state and religious associations (the Church). In ordinary legislation, the principle of cooperation between the state and religious associations is articulated primarily in the Act of May 17, 1989 on Guarantees of Freedom of Conscience and Religion, in Individual Religious Acts of 1989–1997, and in the legislation on social welfare and combating social pathologies (alcoholism). The statutory wording is often general and declarative. Detailed legal guarantees for the implementation of the title rule in the aforementioned acts are infrequent. Since 1990, the Church Fund has been such a financial and legal guarantee. All in all, its implementation depends to a large extent on the possibilities and will of the partners of the potential cooperation.The correct implementation of the principle of cooperation between the state and religious associations (the Church) is still a challenge in the sphere of religious relations in contemporary Poland.

The Act of 20 July 2018 on Higher Education and Science is the eighth Polish normative act of statutory rank since 1920 to deal with matters concerning the title of professor, not counting separate acts and their amendments. It is also the first act based on the regulations in force before 1965 to regulate in a single act matters of higher education and science. Despite their new formulation, not all of the solutions implemented by this Act imply a full withdrawal from the regulations adopted in previous years. What is absolutely new in it, however, is the simplification of the procedure and conditions of the proceedings for conferring the title of professor through: (1) a new definition of fields of science (arts) and scientific disciplines (artistic disciplines) based, following the OECD classification, on the two-tier qualification of sciences (with some exceptions); (2) the constitution of the Council for Scientific Excellence, as a new institution, as of 1 January 2021 exclusively endowed with the right to initiate proceedings for the conferment of the title of professor (including refusal) and the subsequent process, ending with a positive or negative decision of that Council. Other solutions of this law have been subject to broader or narrower changes or have been retained in their current wording. Those of such a nature constitute answers to the following questions: (1) On whom may the title of professor be conferred, and in relation to whom, despite meeting the requirements for it, is this unacceptable, for other statutory reasons?; (2) What requirements does the legislator expect from a candidate for this academic title, and to what extent do the expectations placed on them – outstanding scientific (artistic) achievements – go beyond the framework of the previously binding standards in this regard?; (3) What determines the selection of candidates for reviewers in this procedure, and what is the procedure for selecting them?; (4) What are the conditions for a candidate’s legal protection against negative decisions by the Council for Scientific Excellence, taking into account (5) the conditions for the President of the Republic of Poland’s participation in this procedure, which have remained unchanged since 1990?

This paper contains the author’s own opinions on the legal regulations governing a nationwide referendum referred to in Article 125 of the Constitution of the Republic of Poland. The basic framework of these regulations fits within the limits of standards applicable in democratic countries. Their exercise, however, may be obstructed due to the absence of effective institutional and procedural guarantees ensuring enforcement of a decision arrived at in a referendum. Obligatory organisation of a referendum initiated by citizens (conditioned on collection of a required number of supporters) is challenged, as well as the introduction to the Polish political regime of a recall option in respect of the head of state. A suggestion is also made that the premises for organising nationwide referenda provided for in the above mentioned article of the Constitution be precised, although without binding legal consequences.
Opracowanie zawiera autorskie opinie na temat regulacji prawnych dotyczących referendów ogólnokrajowych, o których mowa w art. 125 Konstytucji Rzeczypospolitej Polskiej. Regulacje te, gdy idzie o ich podstawowy zrąb, mieszczą się w granicach standardów stosowanych w tym względzie w państwach demokratycznych. Jednakże ich realizacja może natrafiać na przeszkody wynikające z tego, że nie istnieją skuteczne gwarancje instytucjonalne i proceduralne wykonania decyzji podjętych w drodze referendum. Autor opowiada się za wprowadzeniem referendum, w wyniku którego obywatele będą mogli bezpośrednio podejmować akty ustawodawcze poddawane kontroli ich konstytucyjności. Ponadto podaje w wątpliwość wprowadzenie referendum obligatoryjnego rozpisywanego z inicjatywy obywateli (po zebraniu pod wnioskiem w tej sprawie odpowiedniej ilości podpisów), a także wprowadzenie do polskiego systemu ustrojowego instytucji ‘recall’ w zastosowaniu do głowy państwa. Sugeruje, aby przesłanki referendum ogólnokrajowego, o jakich mowa w art. 125 Konstytucji RP, uściślić, choć bez wiążących następstw prawnych.

Pretekstem do podjęcia tej problematyki ochrony dobrego imienia Narodu Polskiego i Rzeczypospolitej Polskiej było uchwalenie w styczniu 2018 r. wzbudzającej ogromne kontrowersje ustawy o zmianie ustawy o Instytucie Pamięci Narodowej. W ten sposób wprowadzono przepisy przewidujące ochronę dobrego imienia Rzeczypospolitej Polskiej i Narodu Polskiego. Pośród nich zaproponowano przepisy art. 53o i 53p przewidujące odpowiedzialność cywilnoprawną. Ten fragment ustawy przeszedł właściwie niezauważony, inaczej niż wzbudzające ogromne emocje przepisy przewidujące odpowiedzialność karną. Z pewnością pełna analiza tego aktu normatywnego wymaga znacznie dłuższego czasu. Jak wyżej próbowano wykazać, przyjęta regulacja rodzi szereg wątpliwości i pytań o jej właściwą wykładnię. Pomija w zasadzie całkowicie dorobek judykatury, który w poprzednim stanie prawnym pozwalał członkowi określonej grupy np. Narodu Polskiego dochodzenia roszczeń w przypadku naruszenia poczucia godności narodowej.
A pretext for taking up this topic was the adoption in January 2018 of the new Act of the Institute of National Remembrance, which aroused huge controversy. In this way, provisions were enacted to protect the reputation of the Republic of Poland and the Polish Nation. Among them, there are regulations such art. 53o and 53p providing civil liability for violating the reputation of the Republic of Poland and the Polish Nation. This part of the bill passed almost unnoticed, unlike the criminal law in this bill. Certainly, a full analysis of this normative act requires more time. For now, we can say that – as it was presented in this paper – the adopted regulation raises a number of doubts and questions about its proper interpretation.

The purpose of the paper is to present the problem of so-called “legal bigamy” in the light of the rulings of the District Court in Poznan. The marriage law regulations in The Second Polish Republic were completely different in various parts of the country and attempts to unify them failed. This situation caused significant problems: for example, many civil courts refused to recognize some of the divorce judgments issued by church courts in the former Russian partition because of their improper jurisdiction. The paper focuses on two matrimonial cases that were ruled upon by the District Court in Poznan. In both cases the District Court in Poznan was to decide whether divorce judgments issued by the church court of the Polish Orthodox Church in Warsaw were also binding in the former Prussian district.

As Poland regained independence in 1918, it immediately had to deal with the question of how to shape its political and economic system. One important but at the same time controversial issue was the level of the state’s involvement in the economic life of the country and the measures used. In numerous debates among economists, the dominant topics included problems in the industry - in particular issues such as statism, monopolization, policy towards cartels and, in the later period, economic planning. The article presents the course of the discussion on the role of the state in the economy that took place in Poland in the years 1918-1939, as well as a review of arguments put forward by the proponents and opponents of state’s economic interventionism. For the purpose of this article, three groups that were most active in the debate were selected: the Kraków School, the Leviathan organization and the First Economic Brigade.
