Opis:
The process of Europeanisation in the legal field results in various conflicts between the Member States and European authorities. Cases concerning State aid are an example of such a conflict, where on one hand Member States want to preserve control over various supporting schemes and on the other the European Commission and the Court of Justice of the European Union through a set of judgements and decisions increase their supervisory power over the supporting schemes. The European jurisprudence tend to stretch the scope of State aid by expanding the definition of State resources, which is one of its prerequisites. Applying of such a broad definition of State resources to Polish green certificates scheme and the auction scheme shows negative results of this approach that not only decreases the efficiency of the Renewable Energy Sources supporting schemes but that has a negative reflection on the whole State aid system.

The recently introduced regulations of the New Investment Promotion Act of 10 V 2018 are in line with the trend of the economic legislator’s actions aimed at modernizing the Polish economy and are a direct continuation of the modernization processes initiated by the Act of 20 X 1994 on Special Economic Zones. The legal regulations analyzed in the article constitute an attempt to adjust legal instruments to the changing social and economic reality. The economic administration’s wider use of the legal instruments set out in the New Investment Promotion Act can contribute to faster economic recovery from the crisis caused by the COVID-19 pandemic. The analysis in this article compares the objectives of the New Investment Promotion Act with those of the Act on Special Economic Zones. The research carried out allows the conclusion that the legislator has significantly modernized the objectives of granting support in the New Investment Promotion Act in relation to the objectives indicated in the Act on special economic zones. At the same time, it was decided not to repeal the Act on Special Economic Zones. The reasons for this decision were the continuation of validity of permits issued under the Act on Special Economic Zones, and performance by entities managing Special Economic Zones of tasks specified in the New Investment Promotion Act. As in the Act on Special Economic Zones, the emphasis is placed on issues related to economic transformation, just as in the New Investment Promotion Act the emphasis is placed on the implementation of objectives related to building an innovative, knowledge-based economy. The objectives of the New Investment Promotion Act should be directly expressed in the Act, although the Act on supporting new investments refers many times to strategic documents in the field of development policy.

Opis:
Social rental housing is one of the possible instruments which are applied to ensure the satisfaction of housing needs. However, public funds which are transferred to entities that operate within this area should be usually classified as State aid. The analysis presented in this paper concerns the following question: is it possible to consider the operation of a social rental housing program as services of general economic interest. This question seems to be a topical issue because of a new legislative initiative aiming at establishing a governmental housing program that was implemented by the Act of 10 September 2015 which amended the Act on certain forms of supporting housing construction. The aforementioned program stipulates the legal frames for refundable and preferential financing that may be granted to specific entities in order to realise investments in social rental housing. The governmental housing program complements earlier local housing policies in force. What is significant is that the Polish legislator decided to qualify support granted as services of general economic interest, as referred to in Commission Decision 2012/21/UE of 20 December 2011 on the Application of Article 106(2) of the Treaty on the Functioning of the European Union to State aid in the form of public service compensation granted to certain undertakings entrusted with the operation of services of general economic interest. Applying Commission Decision 2012/21/UE to this situation raises some doubts as to the lack of clarity of a term “social housing”. Due to a certain controversy over the abovementioned issue, the authors have attempted to examine whether the application of preferential provisions of Commission Decision 2012/21/UE to the social housing program is in accordance with the relevant provisions of EU competition rules.

The main aim of this paper is to determine the ratio legis of the 500+ program in the Polish State Aid for Child Support Act. The study highlights the long-term disregard for supporting families in State policy. It shows also the legal, economic and systemic causes of the current demographic crisis in Poland. This study offers an overview of existing solutions and an analysis of the true purpose of the newly introduced law. In conclusion, the author states that although the legislative work is a milestone in the field of Polish pro-family policy, there are a lot of drawbacks in these solutions. The 500+ Program should be applied as a supplementary tool, rather than the main tool of Polish demographic policy.
Celem niniejszego opracowania było określenie ratio legis Programu 500 plus w ustawie o pomocy państwa w wychowywaniu dzieci. W artykule podkreślono, że przez wiele lat trudno doszukać się skutecznych mechanizmów oddziaływania polityki prorodzinnej w Polsce. Ukazano prawne, ekonomiczne i systemowe przyczyny aktualnego kryzysu demograficznego. Opracowanie stanowi omówienie obowiązujących rozwiązań oraz analizę rzeczywistego celu nowo wprowadzonej regulacji prawnej. W konkluzji autor stwierdza, że podjęte prace legislacyjne to milowy krok w zakresie polskiej polityki prorodzinnej, choć są to rozwiązania nie pozbawione wad. Program 500 plus należy potraktować wspomagająco, nie zaś jako kluczowe narzędzie polityki demograficznej Polski.
