The article discusses the legal and systemic issues of the creation of a modern mediation institution in Georgia. It discusses Georgia’s historic experience traditions of settlements of disputes by means of peaceful methods, part of which are still preserved in the high mountainous regions of the country. In 2013, the country was also introduced to the mediation for settlement of collective labour disputes, which is implemented by active involvement from the government. Already existing statistics demonstrate that mediation in the given sphere is effective and actually serves for the settlement of disputes between employers and groups of employees. In 2019, Georgia adopted the law on mediation, which regulates the issue of private mediation conduction andexecution of achieved agreements. Mediators training and professional development system were created. By the adoption of the given Law ended the almost eightyear phase of mediation legal and institutional regulation,which,  according to the opinion of the author of the article, was a process prolonged in time. Unified Law could have been adopted at the early stage of the reform which would have made the process of extensive usage of mediation in the country faster. As reason for introduction of mediation institution in Georgia is named the obligations of the country in the process of integration with the European Union, overloading of civil courts in the country and prolonged disputes.

Conflict-related and disputable situations have been present in our lives since ancient times, when people have become aware of the need to protect their rights and interests, sometimes at odds with the aspirations of others. The conflict that emerges between people disturbs their relationships and poses a threat to the proper functioning of people, bringing with them negative emotions. However, it can be an opportunity for development, be treated as a change in interpersonal relationships and can ultimately produce positive effects. Mediation offers a possibility of converting the negative aspects of the conflict into constructive solutions. Being voluntary, confidential, non-formal, out-of-court proceedings, it enables the parties to come to an agreement, offering them the opportunity to actively participate in shaping the legal and social situation and exercising their rights and interests in the spirit of consensus. In the mediation process, the parties use the support of a professional, impartial, neutral mediator. The authors of the article promote the idea of mediation with full conviction that it is a valuable and effective way for conflicted parties and third parties and their relatives to reach a consensus on various issues, including family matters.

The changes attendant to the social and political system had an impact on Polish schools. Due to these changes, teachers need to handle such challenges as a tarnished image of schools and teachers, hyperactive parents, excessively direct students’ behaviors and social problems, especially school violence; all of them are greatly deconstructive for the school system. An effective coping method is not only teachers’ lifelong development, especially in terms of social competencies, but also establishing students’ competencies from the very early stage of education. To achieve that, teachers should create a suitable atmosphere in the area of interpersonal relations, which can be achieved by creating a very effective internal communication system. A constructive dialog at school may importantly influence not only the development of students’ mediation skills, but also the mitigation of conflicts and tensions. This is also a key component of facilitating the mediation process.

The aim of this paper is to analyze the potential connected with using mediation as an educational method. The role of technology in contemporary society is constantly growing. The COVID-19 pandemic makes us aware of how elementary and fundamental presence is. Encounter as a pedagogical category shows many dimensions and educational benefits. Peer mediation offers a constructive approach to peer conflict, resolving it through meeting and conversation in the presence of an impartial and neutral mediator (school peer). A mediation session teaches responsibility for the decisions taken and creates a sense of agency. Mediation is conducive to the development of key competences in the postmodern world.

Conflict is inseparable from human everyday life. Inscribed in the functioning of an individual who enters various social interactions, its occurrence at some stage of life is inevitable. It is based on the divergent interests of the parties striving to achieve a specific goal. Many conflict situations, destructive in their effects and causing a sense of instability and frustration, appear in the school environment among young people. Peer mediation offers a constructive approach to peer conflict, resolving it through conversation, exchange of thoughts and views by parties representing different positions, in the presence of an impartial and neutral mediator, who is their adequately prepared and trained peer. Peer mediation offers a chance for active participation in the search for a mutually satisfactory solution, teaches responsibility for the decisions taken and creates a sense of agency, which is so important in adulthood.

This paper discusses the amendments to the code of administrative procedure of 7th April 2017, referring inter alia to the amicable settlement of matters in dispute. The regulation to date concerning conciliation has ceased to be the only method of amicable settlement. An additional method has emerged consisting in mediatory proceedings, which requires a definition of the reciprocal relation between the existing conciliatory proceedings and the mediatory proceedings being introduced. Moreover, this paper analyses the change of the scope of duties of public administration bodies that are about to seek the implementation of arbitrary proceedings. The scope of duties of administration bodies has been considerably extended within this scope. At present, the relevant authorities are obliged to seek to convince the parties that mediatory proceedings are possible and justifiable, this including also the possibility to carry out conciliatory proceedings. Another issue discussed in the paper is the permissible object of mediatory proceedings. Mediatory proceedings may be applied to nearly any type of proceedings. The legislator has not introduced any restrictions in this respect, both as regards the subject or object of the proceedings. Irrespective of the fact whether the proceedings involve parties with conflicting interests or not, an amicable settlement of the dispute is recommended. The introduction of mediatory proceedings should be considered any time, even if there is only one party involved. This is a novelty, compared to the existing possibility of carrying out conciliatory proceedings. No restrictions have been made as regards the object of the proceedings. Consequently mediatory proceedings may be applied to solve the doubts concerning the facts as well as the contents of the applicable legal regulations. This may concern both the disputes regarding the regulations in cases which cannot be solved by the adopted interpretation rules, and in cases where public administration bodies are left with certain freedom of interpretation by the legislator. Also, the nature of the decision to be made in the result of the proceedings may not constitute sufficient grounds for questioning or rejecting the possibility to implement arbitration proceedings. Mediatory proceedings are possible not only in the proceedings ended with acts issued within the discretionary authority or administrative recognition, combined acts, or constitutive or declaratory acts. The only restriction may be the nature of the case contrary to the implementation of amicable proceedings. Also this last question has been thoroughly analysed in this paper.

The objective of this research paper is to explore and analyse mediation in the People’s Republic of China and in the Republic of China (Taiwan). The author also investigates the historical, philosophical and social origin of mediation and its development since the Han Dynasty. Mediation has a long tradition in China, and its importance can be traced back to the philosophy of Confucianism. Nowadays mediation is known as the key to resolving all disputes and linking it to the “harmonious society” political doctrine. There are currently a few types of mediation practices in China: mediation by People’s Mediation Committees outside the court, judicial mediation in civil disputes and minor criminal cases inside the court, mediation and arbitration of rural land contract disputes or mediation and arbitration in labour disputes. The importance of mediation is demonstrated by Article 111 of the Constitution of the People’s Republic of China, which provides that “People’s Mediation Committees are a working committee under grassroots autonomous organisations – the Residents Committee and the Villagers Committee – whose mission is to mediate civil disputes.” The Committees and the courts should also popularise, through mediation and arbitration, the laws and the policy and educate citizens to abide by the laws and respect universally accepted morals. As can be seen, owing to the government’s guidance on mediation procedures the number of cases settled through mediation has markedly increased. The statistics show that the parties not only resolve their dispute but are also willing to resort to mediation again. The high success rate of mediation is, among other things, due to the fact that it is a safe and neutral process, and the mediators’ role in facilitating resolution does not impose a solution. Another advantage of mediation is speed and effectiveness as well as a reduction of costs. This article also discusses the Taiwanese experience with mediation, as well as its development. To sum up it may be said that mediation in the People’s Republic of China and in the Republic of China (Taiwan) functions well and is increasingly winning trust of citizens.

In the light of the applicable regulations governing administrative proceedings, electronic communication is an acceptable form of communication between the authority and other parties in the area of activities regulated by the provision of Article 13 of the Act of 14 June 1960, the Code of Administrative Procedure, in its current wording. Since this provision provides for the use of mediation in the resolution of disputes relating to the settlement of matters which are the subject of administrative proceedings in the first and second instance, electronic communication may also be used in mediation at both stages of the administrative proceedings. The mediation process itself may be carried out using Internet means of communication, and the mediator may in the same way contact the body referring the case to mediation. Teleconferencing and other methods of electronic communication, such as e-mails, chat-rooms and teleconferences, are all possible under the current legal framework. However, it is not allowed to conduct automated mediation, i.e. mediation in which identification of a specific mediator will not be possible. In the light of current legislation in force, a mediator must be involved in the supervision of the mediation process and be responsible for its course. This is the personal responsibility of the mediator. The trend to use electronic communication in the public sphere will continue. This will apply both to the communication within the internal structures of the administration and to its external relations. The development of e-administration may also facilitate the development of ADR (Alternative Dispute Resolution) methods in administrative proceedings. This corresponds to the global trend where the methods and procedures of administration are being adopted to the environment which is increasingly using different forms of electronic communication.

The article concentrates on the non-transparency of ekphrasis, including the relevance - in the case of a full, in-depth analysis of particular ekphrasis - not only of the description but also of the artefact itself. The text reflects upon subjects rarely dealt with in ekphrasis research, such as on the meaning and relations of the concepts ‘presentation’ and ‘representation’. There is a focus on the question of multi-layered mediation, which is related to this discourse figure: through language, through the viewer’s perspective who writes about the work, through the reader themself, and also, or perhaps first and foremost, through the work itself. This all results in ekphrasis being treated as a representation of representation. This also gives rise to thoughts on the problem of translating the visual system to verbal and the issues related to this.

The current condition of philosophy as a discipline is quite problematic, in particular if we consider its relationship to other human sciences and to other disciplines in general. The philosophical debate appears fragmented, and philosophy itself has lost any specific role in the present scientific landscape. This situation determines a sort of “identity crisis”, whose main consequence is the coexistence of antinomical views about philosophy in the contemporary scientific and public discourse. Starting from this context, the paper aims at providing a description of philosophy as “theory of mediation”. This description does not want to be ‘original’, but rather tries to emphasize an element that is always been rooted in the very essence of philosophy, but that has also often been neglected. Philosophy has always pointed out the necessity to think the in-between of things, their relation and the passage from one to another, rather than just offering a taxonomy or a factual description of the world. In order to prove this point, the paper offers an analysis of some classical texts, in particular of some fragments by Heraclitus and of a passage taken from Hegel’s early writings. A view that rethinks philosophy as “mediology” allows a rehabilitation of philosophy as a specific discipline and as a systematic enterprise, at the same time providing a new framework for the understanding of the relationship between philosophy and other sciences.

Literatura przedmiotu dotycząca działań mających na celu zapobieganie konfliktom oferuje dwa wyjaśnienia dlaczego ocena wpływu stron trzecich w zakresie zarządzania kryzysowego i rozwiązywania konfliktów poprzez mediacje tak bardzo różni się. Pierwsze wyjaśnienie uzależnia pozytywny wynik mediacji w wojnach domowych od specyficznych cech konfliktu, natomiast drugie wyjaśnienie od umiejętności i doświadczenia mediatora oraz od strategii mediacji zastosowanych w procesie rozwiązywania konfliktu pomiędzy stronami. Celem badań jest ustalenie jakie czynniki w przedstawionych podejściach mają decydujący wpływ na to, że niektóre wysiłki mediatorów kończą się sukcesem a niektóre nie. Badania zostały przeprowadzone na próbie 581 mediacji w wojnach domowych w latach 1945–2004 i potwierdziły nasze założenia dotyczące strategii mediacji. Analiza pokazuje, że mediatorzy, którzy przejmują inicjatywę i sugerują rozwiązania (directive mediation strategies), odnoszą większy sukces w rozwiązaniu konfliktu niż mediatorzy którzy stosują mediacje facylitatywne.
The literature on conflict management offers two explanations of why the effectiveness of third parties to settle militarized disputes differs. The structural research tradition focuses on conflict characteristics, while the individualist approaches highlight the background, skills and power of a mediator, as well as the mediation strategy. This article reconciles these two approaches, and examines especially the effectiveness of mediation strategies. Accounting for the selection of mediation and the success of mediation attempts, we use the CWM 1945–2004 dataset. The analysis demonstrates that mediators who were able to pursue a determined strategy face a higher chance of success.

The article addresses the issue of interrupting the running of the limitation period through the initiation of mediation. First, this issue is analysed in the context of other circumstances provided for in the Civil Code, which may interrupt the running of the limitation period but frequently provoke controversy. These examples are used to demonstrate that interpretative difficulties arise in respect of the initiation of mediation proceedings as well, as an event interrupting the running of the limitation period. Such difficulties are primarily due to the fact that while Article 1836 § 1 of the Code of Civil Procedure (CCP) states that mediation proceedings are initiated from the moment one of the parties serves the mediator with a petition to conduct mediation proceedings, there is no regulation addressing the matter of formal defects in the petition; legal scholars take diametrically opposing positions in respect of whether it is possible to remedy these defects and initiate the mediation process, and whether the running of the limitation period can thereby be interrupted. In addition, Article 1836 § 2 CCP is another source of uncertainty as it provides for a range of circumstances in which the proper serving of the petition does not lead to the initiation of mediation proceedings. The article subjects these regulations to thorough analysis, with particular attention paid to the impact of these situations on interruption of the limitation period on claims (including assessment of the justifiability of such legal solutions and with reference to the views of scholars, as well as de lege ferenda remarks). Mention is also made of issues associated with the limitation period in cases where the court directs the parties to engage in mediation.
Artykuł dotyczy kwestii przerwania biegu przedawnienia roszczeń przez wszczęcie mediacji. W artykule poddano analizie ten przypadek, przedstawiając go najpierw w kontekście pozostałych przewidzianych w Kodeksie cywilnym przyczyn przerwania biegu przedawnienia, które budzą liczne kontrowersje, i na tym tle pokazano, że wątpliwości interpretacyjne powstają także w odniesieniu do tej przyczyny przerwania biegu przedawnienia, zwłaszcza jeśli chodzi o mediację inicjowaną przez stronę. Wynikają one przede wszystkim z tego, że choć zgodnie z art. 1836 § 1 k.p.c. wszczęcie mediacji następuje z chwilą doręczenia przez stronę mediatorowi wniosku o przeprowadzenie mediacji (z dołączonym dowodem doręczenia jego odpisu drugiej stronie), to jednak nie uregulowano prawnie sytuacji, gdy wniosek taki zawierał będzie braki formalne (a poglądy doktryny co do tego, czy możliwe jest ich uzupełnienie i wszczęcie wówczas mediacji, a co za tym idzie – przerwanie biegu przedawnienia, są diametralnie zróżnicowane). Ponadto źródłem wspomnianych wątpliwości jest też art. 1836 § 2 k.p.c., w którym ustawodawca przewidział cały szereg przypadków, w jakich pomimo prawidłowego doręczenia wspomnianego wyżej wniosku nie będzie dochodzić do wszczęcia mediacji. W artykule poddano je dokładnej analizie, ze szczególnym uwzględnieniem wpływu takich sytuacji na przerwanie biegu przedawnienia roszczeń (w tym oceniając zasadność tych rozwiązań prawnych oraz odnosząc się do poglądów doktryny i zgłaszając uwagi de lege ferenda). Podniesiono także kwestie wiążące się z przedawnieniem w przypadku, w którym to sąd kieruje strony do mediacji.

There are several characteristic patterns to be observed. First of all, despite the fact that the pioneering monograph on the subject appeared in 1978 (I. Huml), one can still observe terminological diversity, with various terms, such as applied arts and design, being used as synonyms. Secondly, looking at the history of the research, one may draw up a calendar of key events (publications, exhibitions) which led to the development and/or consolidation of the basic vision of Polish design from the end of the 19th century to the beginning of the 21st century, related primarily to the political and artistic history of the country. Thirdly, the increase in historical knowledge on the subject has been generated not only by different environments but also in the context of diverse institutions (academic and museum research, art market, collecting/connoisseurship). Consequently, the research conducted so far has been methodologically diversified, influenced by different goals and results. As a result, in the social reception there is a specific coexistence of projects of a scientific, popular science and commercial nature. A critical point in the dynamics of research was marked by two events which took place at the beginning of the 21st century: the exhibition Rzeczy pospolite and the subsequent publication (2000/2001), and founding of the quarterly “2+3D” (2001). Another marked increase in initiatives has occurred since the end of the 2000s. The demand for knowledge about design history is also, to some extent, animated by the art market. On the one hand, old design collecting generates a spontaneous exchange of messages on social media, while on the other, it stimulates the creation of reliable popular science studies. Research on Polish design has been dominated by the perspective of art history, usually in its traditional version focusing on style as well as the artistic and theoretical context, and highlighting issues of uniqueness and individual authorship, which prevail over functional, technological or social aspects in the discourse. Consequently, there has been no approach that would perceive Polish design and its multiple contexts as a dynamic system, a set of practices and mediations, such as the approach proposed several years ago by Grace Lees-Maffei (Production-Consumption-Mediation Paradigm) for design history. Such a perspective would enhance and stress the importance of research on the relations between various actors in the Polish design community, such as institutions (educational, experimental and research, manufacturing), transmitters (exhibitions, advice) and mediators between production and consumption.

Celem niniejszego artykułu jest omówienie instytucji mediacji jako realizacji zasady polubownego rozstrzygania kwestii spornych, zawartej w art. 13 Kodeksu postępowania administracyjnego. Na wstępie zostało przedstawione znaczenie mediacji jako alternatywnej metody rozwiązywania sporów zarówno w kontekście społecznym, jak i prawnym. Ponadto poddano analizie cel wprowadzenia do polskiego ustawodawstwa zasady polubownego rozstrzygania kwestii spornych oraz instytucji mediacji, zasady dopuszczalności mediacji z uwzględnieniem przesłanek pozytywnych oraz negatywnych, a także omówiono przebieg samej mediacji.
The purpose of this article is to discuss the institution of mediation as an instrument for the implementation of the principle of amicable settlement of disputes set forth in article 13 of the Code of Administrative Procedure. At the beginning, the importance of mediation as an alternative method of resolving disputes in both the social and legal context was presented. In addition, the purpose of introducing the principle of amicable resolution of disputes and the institution of mediation to the Polish legislation was analyzed, as well as the principle of admissibility of mediation taking into account positive and negative premises, and the course of mediation itself was briefly discussed.

The aim of the article is to explain the reasons for the introduction of mediation in administrative law. Mediation is presented in the light of the Recommendation of the Committee of the Council of Ministers R (2001)9 of 5 September 2001 on Alternatives to Litigation Between Administrative Authorities and Private Parties. The adoption of this act was justified by the situation of administrative courts in the member states of the Council of Europe. The common problems in the area of justice were the excessive number of court cases, excessive formalisation of court proceedings and a dispute resolution model that would disregard solutions that could satisfy both parties to the administrative dispute. It was also stated that these problems might have a negative impact on citizens’ access to justice and lead to the violation of the rights of the parties to court proceedings, referred to in Article 6 par. 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms. The measures that may constitute an alternative to the judicial resolution of administrative disputes in the Recommendation include: internal control of administrative acts, amicable proceedings/conciliation, mediation, settlement and arbitration. This Recommendation has shaped the Polish solutions in the field of introducing alternative dispute resolution methods to administrative law. However, in the realities of the Polish legal conditions included in the Recommendation, the proposals have become an incentive to introduce only the institution of mediation. First, it became part of the court-administrative proceedings, and then it was introduced to the administrative proceedings. Currently, when after the introduction of mediation to the Code of Administrative Procedure, the use of ADR methods under administrative law has again become the subject of a broader interest in the doctrine, it is worth recalling the reasons why in 2001 the Council of Europe recommended introducing alternatives to national legal orders.
