    Opis:
    The author of the article presents the influence of physical activities on socially maladjusted youth, on the basis of desk research analysis, as well as using personal observations conducted during serving as a probation officer for a period of two years. The observations were conducted on a group of 11 male and female minors advised physical activities, as one of the means of influence in the process of resocialization. The article focuses on two social environments, where the resocialization process may take place – the open environment and the institutional environment. The author presents the process of resocialization, its goals, methods used in it, and the reasons why this process is so significant. The aim of the article is to show the changes occurring in the behaviour of young and socially maladjusted people as a result of participating in sports activities. The author’s final conclusions indicate the positive effects of physical activity as a means of influence.

    Opis:
    Unaccompanied child migration, propelled by war, political strife and instability is an increasingly serious global problem. Refugee youth contends with numerous challenges as they adjust to living in a new country. Although their capacity for resilience is being given the deserved recognition, studies where their views are taken into account greatly outweigh in number those where the voices of young refugees directly narrate how they bounce forward in the face of an uncertain future (Walsh 2002). Resilience scholars are challenged to move beyond a narrow understanding of youth refugee resilience by conducting research on their life situations exploring their own perspectives. This article describes some of the insights gained from a phenomenological study— whose methods are particularly effective at capturing and illuminating the experiences and perceptions of individuals from their own perspectives— undertaken with unaccompanied minors living in Germany. The narrative approach used to explicate their narratives highlights seven major coping strategies: (1) Treasuring personal identity, (2) Maintaining cultural identity, (3) Networks of support and social negotiations, (4) Nurturing the need to belong, (5) Embracing a positive outlook, (6) Perceived self-efficacy and personal characteristics, (7) Adopting a growth mindset & self-enhancement expectations. The empirical data of this research show that URMs are active agents in choosing meaningful pathways to resilience and purposefully navigate through the numerous challenges in their lives.

    The article is of a theoretical and research nature. The theoretical part outlines the specificity of a social rehabilitation centres for minors and refers to the definition of self-sufficiency. The subject of the research was the empowerment of juveniles staying in youth educational centres. Their aim was to find out the answer to the problem: what methods and forms of work are used by youth educational centres to prepare minors for a self-sufficient life after leaving them in the following spheres: family, professional, social and civic? The project was carried out in three selected youth educational centres. The data was obtained using the pedagogical monograph method, for which the document analysis technique was selected, supplemented with an original data sheet acting as a research tool. The research was conducted in the mainstream of the qualitative approach identified with the interpretative paradigm, which allowed for the abandonment of hypotheses.

W ten sposób została wyrażona wola papieża Franciszka, aby podkreślić znaczenie tych działań, które czynią Kościół katolicki bezpiecznym miejscem dla nieletnich. Głównym celem dociekań podjętych w artykule jest analiza najważniejszych etapów walki z nadużyciami seksualnymi duchownych katolickich w latach 1984-2022 oraz prezentacja wybranych aspektów etyczno-prawnych dramatu wykorzystywania seksualnego dzieci i młodzieży.
    In 2022, the Pontifical Commission for the Protection of Minors became an integral part of the Dicastery of the Doctrine of the Faith. In this way, the will of Pope Francis was expressed to emphasize the importance of these activities that make the Catholic Church a safe place for minors. The main purpose of the research undertaken in the article is to analyze the most important stages of the fight against sexual abuse by Catholic clergy in the years 1984-2022 and to present selected ethical and legal aspects of the drama of sexual abuse of children and adolescents.

    Nadużycia seksualne wobec nieletnich boleśnie ranią całą wspólnotę Kościoła katolickiego. Sakrament pokuty i pojednania jest jedną z fundamentalnych rzeczywistości, w której dokonuje się leczenie ran ofiar, a także apelowanie do sumień sprawców. Celem artykułu jest ukazanie różnych dylematów sakramentu pokuty i pojednania w kontekście nadużyć seksualnych wobec nieletnich, zwłaszcza w świetle nauczania papieża Franciszka. Omówione trudne kwestie moralne dotyczą zarówno spowiedzi ofiar pedofilii, jak i sprawców tych grzechów. Zostaje również podjęty problem odpowiedzialności moralnej przełożonych sprawców nadużyć, jak i pytanie o odpowiedzialność całej wspólnoty Kościoła katolickiego za kształtowanie właściwego myślenia moralnego o grzechach nadużyć.
    Sexual abuse against minors painfully hurts the entire community of the Catholic Church. The sacrament of penance and reconciliation is one of the fundamental realities in which healing the wounds of victims is carried out, as well as appealing to the consciences of perpetrators. The purpose of the article is to show the various dilemmas of the sacrament of penance and reconciliation in the context of sexual abuses of minors, especially in the light of the teaching of Pope Francis. The difficult moral issues discussed concern both confession of victims of pedophilia and perpetrators of these sins. The problem of the moral responsibility of the superiors of abusers is also raised, as well as the question of the responsibility of the entire community of the Catholic Church for shaping proper moral thinking about the sins of abuse.

    Amerykański Kościół katolicki od ponad dwóch dekad boryka się z kryzysem w związku z ujawnieniem czynów pedofilskich popełnianych przez osoby duchowne. Artykuł przedstawia działania amerykańskich biskupów na rzecz ofiar wykorzystywania seksualnego przez duchownych zarówno w zakresie prewencyjnym, jak i profilaktycznym. W pierwszej jego części zaprezentowano sposób funkcjonowania Komisji ds. ochrony dzieci i młodzieży, która działa przy Episkopacie, następnie omawia najważniejsze, opublikowane w ostatnim czasie dokumenty dotyczące problemu pedofilii w Kościele.

    Opis:
    According to the prevailing opinion, the period of time allowed for the acceptance or rejection of succession (Article 1015 para. 1 of the Civil Code) requires modification when the parents submit to the court a motion to be granted the permission to reject succession on a minor’s behalf (Article 101 para. 3 of the Family and Guardianship Code). There is a risk the Court may grant its permission after the lapse of the strict time limit and the minor would lose his or her right to reject the succession. To avoid such a situation, in the way of analogia legis, the provisions on limitation of claims or the provisions on transmission are applied to the period of the time allowed for acceptance or rejection of succession. The paper proves that Article 1015 para. 1 of the Civil Code is not burdened with the constructional loophole, therefore there are no reasons for applying analogia legis. The time limit may be preserved if the parents submit a motion to make the declaration to reject succession to the court. If they fail to do so and the time limit has lapsed, it is possible to avoid the legal consequences of a lack of declaration to reject succession in the time limit due to an error of law (Article 1019 of the Civil Code).
    Według dominującego poglądu bieg terminu na przyjęcie lub odrzucenie spadku (art. 1015 § 1 k.c.) wymaga modyfikacji w przypadku złożenia przez rodziców wniosku o udzielenie zezwolenia na odrzucenie spadku w imieniu małoletniego (art. 101 § 3 k.r.o.). Istnieje ryzyko, że sąd udzieli zezwolenia już po upływie terminu zawitego i małoletni utraci prawo do odrzucenia spadku. Aby tego uniknąć, do biegu terminu na przyjęcie lub odrzucenie spadku w drodze analogia legis stosuje się przepisy o przedawnieniu względnie przepisy o transmisji. W artykule wykazano, że art. 1015 § 1 k.c. nie jest dotknięty luką konstrukcyjną, a więc brak jest przesłanek dla stosowania analogia legis. Termin bowiem może zostać zachowany, jeżeli rodzice w czasie jego biegu złożą w sądzie wniosek o odebranie oświadczenia o odrzuceniu spadku. Jeżeli tego nie uczynili i termin upłynął, istnieje możliwość uchylenia się od skutków prawnych niezłożenia oświadczenia o przyjęciu lub odrzuceniu spadku w terminie z uwagi na błąd co do prawa (art. 1019 k.c.).
