The aim of the article is to present the beginnings and the subsequent development and evolution of church law in the sphere of education from the 4th to the beginning of the 16th century. The roots of the acts of law presented by the Popes, synods and councils were based on the traditions of Roman law, but a variety of reasons from the field of policy, economy and society led to the need to establish a church school system. The aim of the Church was to create an independent school system with its own purposes, different from civil schools. The article shows the main factors in the development of the legislation in the sphere of education and the functioning of the schools, and the relationship between civil and Church leaders. Another field of analysis is to search for the inspirations, aims and reception of the law in cathedral, collegiate, parish and monastic schools.

The official reception of the conciliar legislation in medieval Poland was greatly influenced by the papal legates, ambassadors endowed with papal authority, who brought conciliar canons to the country ruled at the time by the Piasts and made them public at councils convened with the participation of papal legates, closely monitored the observance of Canon Law and its scope expansion, concurred statutes of Polish provincial and diocesan councils, approved or rejected nominations of bishops, etc. They also acted as intermediaries in personal interventions of popes in their involvement in the functioning of the Church in Poland. Their duties also included inspections in dioceses. Visits of papal legates in Poland were relatively frequent and their main goal was to enforce and implement ecclesiastical reforms in the country. In some instances, a strict relationship between a stay of a papal representative in Poland and the process of the creation and spread of schools is clearly observable. The article examines source accounts concerning the visits of papal legates in Poland, as well as analyses the available statues of legate councils in terms of the provisions included in them regarding education of representatives of the clergy and laymen alike.

From time to time, there is a proposal in the public debate in Poland to break the 1993 concordat, and this has also recently been the case. However, in the current systemic and political reality of contemporary Poland, the issue of the invalidity or expiry of the Polish concordat is one purely for theoretical (academic) discussion. It is worth analyzing this through the prism of the Vienna Convention on the Law of Treaties of 1969 and the Constitution of the Republic of Poland of 1997. The only hypothetical grounds for an annulment of the 1993 Concordat would be the allegation that it was concluded in violation of Art. 46 of the Vienna Convention, i.e. in breach of the rules of national law concerning the competence to conclude a treaty of fundamental importance. The Government of the Republic of Poland did not raise this objection within a reasonable time. There are also no circumstances that could constitute obvious reasons for considering the Polish concordat of 1993 as expired. One might try to defend the position that the concordat may be terminated unilaterally, despite the fact that it does not contain an appropriate clause in this regard. It can be compared to a friendship treaty. Such contracts are, by their very nature, subject to termination. It also seems that if need be, the Polish side might be able to terminate the concordat due to a fundamental change in circumstances, e.g. by referring to the rapidly progressing secularization process of Polish society. A very serious barrier to the termination of the concordat by the Polish side is the Constitution of the Republic of Poland of 1997. In Art. 25 sec. 4 it provides for the obligation to define the relations between the state and the Catholic Church, especially in the form of an international agreement with the Holy See. The hypothetical termination of the 1993 concordat would require prior appropriate amendment of Poland’s constitution and the consent of a number of state bodies. In the current legal situation in Poland, the termination of the treaty with the Vatican is very difficult in procedural terms, and is politically unrealistic.

The stabilising function is one of the main intended functions of the concordats. It consists in striving to ensure the immutability (stability) of legal norms resulting from the provisions of this type of treaties, and consequently to ensure the relative immutability of legal (and factual) states created or shaped under the concordat government. The Concordat petrifies a model of relations between the state and the Catholic Church. In fact, it protects a certain system of social, political and, to some extent, economic relations. This function in the Polish legal system is guaranteed in particular by the provisions of the Constitution of the Republic of Poland of 1997 (Article 25(3) and (5)) and the provisions of the 1969 Vienna Convention on the Law of Treaties. The Concordat of 1993 is therefore legally difficult to denounce. The Treaty provides a differentiated implementation of the stabilising function. Individual norms of this act, to varying degrees, implement its stabilising function. It seems that it is most fully implemented through detailed standards of an absolutely binding nature. The second category of concordat norms from the point of view of the implementation of the stabilising function should include norms whose implementation depends on a later agreement between the Church and the relevant state authorities. As a third category, one should mention regulations which, when formulating legal norms, refer to canon law or state law. The last group consists of norms, the implementation of which depends, in fact, on a unilateral decision of the state authorities. The degree to which a stabilising function is carried out by the provisions of the Concordat also depends on the level of detail. The Concordat of 1993 is not a full concordat and therefore provides limited stability in the financial and property affairs of the Catholic Church and clergy. In practice, however, the 1993 Treaty, combined with the political strength of the Church, has ensured relatively good legal stability for the Church, although it has not yet been fully implemented and has seen some obvious violations. In many aspects, however, there has been an improvement in the legal position of the Church.

In the Middle Ages the relations between man and God were realized among others by means of material offerings which were a form of penance for committed sins and transgressions. Those were the so-called penitential foundations, donations or deeds of gift to the  Church.One of the more important extra-religious aspects of penitential deeds of gift was the pursuit of a greater economic independence of the Church by obtaining and then confirming its economic immunities. Thanks to those foundations, for instance monasteries conducted large scale economic activities which were instrumental in the development of agrarian  culture.The author focuses his studies on Wielkopolska, understood as the territory where the document was issued and as the place of permanent residence of the founder or the recipient of the foundation.

W ustawodawstwem i  nauczaniu, Kościół chce pokazać ich pochodzenie, cel, cechy , znaczenie i wartość jaką posiada rodzina oraz zaoferować pomoc dla małżeństwa i rodziny w wypełnianiu swojego zadania i powołania. Przez nauczanie Kościoła chce podjąć wyraźne stanowisko wobec różnych niekorzystnych lub wrogich sił i systemów mających wpływ ma małżeństwa i rodziny, przypominając z mocą i siłą o wartości, zasad jakie posiada ta "instytucja" społeczna.
The Church, aware of the fact that marriage and the family are one of the most valuable goods of mankind, and at the same time noticing the threats and hazards to them coming from the state legislation and various institutions, places marriage and the family in the centre of its attention. By its legislation and persistent teaching, the Church wants to show their origin, nature, character, purpose, qualities, importance and value as well as to offer help to marriage and the family in the fulfillment of their tasks and vocation. Through its instruction and teaching the Church wants to take an explicit stance towards various unfavorable or inimical forces and systems aimed against marriage and the family, reminding with power and strength about the values, principles and ideas of marriage and the family. At the same time the Church perceives marriage and the family as a subject of its own rights, which the state, consisting of a multiplicity of families, has to correctly interpret, acknowledge and protect. Hence the Church encourages the state to protect and help the marriages and families, encouraging it also to create such a social-economic-cultural system and such legal and system protection, in which the rights of marriage and family will be fully respected. Thanks to the energetic activity of the Holy See in the field of researches on the problems of contemporary family, the ground is being prepared for a complete and comprehensive picture of the rights of marriage and the family; the beginning and a sample of this was given in the exhortation Familiaris consortio of John Paul II, which on the foundation of the teaching of the Second Vatican Council and the Code of Canon Law, clearly demarcates the direction of the Church's stipulations for the code of family rights. The Church holds deeply at heart the defense and protection of the fundamental and essential rights of marriage and the family. It can be said that the Gospel of marriage and the family, which is propagated by the Church and offered by it to the world and Europe, gives marriage and the family an unchangeable position and dynamism, showing the necessity for assistance and service on the part of the state, society and the Church itself. The objective of that teaching is welfare and proper development of marriages as such and at the same time it provides a full view of the rights of marriage and the family including their spiritual and personal dimension. Marriage and the family are consequently presented as subjects of rights both in the Church and the state, by virtue of their own and inalienable natural right to existence, proper functioning and realization of vocation, tasks and development. The problem is how induce Europe and the world to voluntarily accept and implement the teaching, vision, rights and values, which are propagated by the Church with reference to marriage and the family.

Opis:
Knowledge of the moral teaching of the Roman Catholic Church is generally scarce, even among believers. This situation contributes to numerous misunderstandings concerning the Church’s position within the public debates of new proposals like IVF or sexual morality (eg. the LGBT movement). It seems to outsiders that the Church’s standpoint is based on some old and outdated convictions incomprehensible for people today. Meanwhile for the Church, which is concerned with the overall well-being of each man, this well-being is the main reason for its viewpoint and teaching. Although the Church’s explanation is not based exclusively on philosophical reasons (i.e. based on human reason and thus intelligible for all people of good will) these reasons play an important role in the dialogue between the Church and the contemporary world. One of the Church’s most important rationales refers to the concept of human personal fulfilment and basic human goods.
