Opis:
Ukraine has chosen its way of development towards Europe, European values and respect for human dignity and human rights. The signing of the Association Agreement in 2014 obliged Ukraine to harmonize its legislation in priority spheres of life with the legislation of the European Union. But legislative approximation should touch not only upon the fields of public law, but private law too and, in particular, tort law. The main problem of tort law approximation is that there are no joint tort rules in the EU. All attempts to harmonize tort law stopped at the creation of acts of “soft law” – general non-binding rules and principles. One of the most significant examples is the PETL – the Principles of European Tort Law. The PETL show a modern understanding of torts, spell out the conditions of tort liability, as well as other relevant requirements. Ukrainian rules of tort law do provide protection of a victim’s violated rights, however some recommendations of the PETL, such as provisions governing the conditions of tort liability, the understanding of causation and fault should be taken into account when Ukrainian tort law is modernised.

Opis:
The paper refers to the issue of the limitation period for instituting disciplinary proceedings for student disciplinary tort under the provisions of the Law on Higher Education and Science. The aim is to determine the legal nature of these institutions, assess the basic exponential problems associated with it, and finally consider the possible directions of amendment to the provisions in this regard. The considerations relate to the prescription of a student disciplinary tort, but apply to an identically regulated prescription for disciplinary doctoral torts. The study concludes with an amendment to art. 324 paragraph 4 of the Act.

Opis:
The purpose of this article is to analyze legal regulations pertaining to disciplinary liability of academic staff in Poland. It is composed of two integral parts: first, it describes questions connected with the basics of disciplinary liability of academic staff, including premise of liability and penalty and second, it centers around notions of legal system and disciplinary litigations initiated by university disciplinary committees for academic staff. Due to the vastness of the topic, this paper is confined to proceedings conducted by the authority of first instance exclusively. It also analyses disciplinary proceedings of academic teachers in a draft law amending the Law on Higher Education.

The article addresses the problem of uncertainty over causation in tort cases. It reveals the interconnection between burden of proof and standard of proof. The author provides a comparative overview of approaches to standard of proof in common law and civil law systems. It is argued that while in common law there are two different standards viz: beyond-reasonable-doubt-standard for criminal cases and balanceof-probabilities standard for civil cases in civil law system there is only one standard applicable both to criminal and civil cases. With comparative analysis in the background the article also reveals the peculiarities of Ukrainian law in the respect of the issue raised. The problem is approached in a pragmatic manner: using a hypothetical case the author models practical outcomes entailed by each of the approaches being applied to the case. Eventually the conclusion is made that there are four ways of coping with uncertainty over causation: (1) to reverse the burden of proof; (2) to calibrate the standard of proof for certain cases; (3) to recognize the very creation of the abnormal risk as a compensable damage; and (4) to multiply damage plaintiff sustained by the probability factor indicating the likelihood of the damage being actually caused by the defendant.

This article is discussing certain issues concerning the liability within the reliance interest under modern Polish civil law having as a background and a starting point Prof. Czachórski’s considerations over the idea of culpa in contrahendo, the reliance and expectation damages, their contemporary meaning in Polish Law of Obligations and also some present opinions of Polish legal doctrine on the essence and functions of the precontractual responsibility. The structure of the presentation is twofold. The first, shorter section gives a brief overview of the Professor Czachórski’s opinions about the legal character of the reliance interest presented in His two eminent articles published in the 60-ies of the XXth century and his comparative analysis of the differences & discrepancies among the German, Swiss and Polish civil law regarding the notions: Vertrauensinterese and Erfülungsinterese, the scope of their application in case of damages, the existence of individual prerequisites which would determine the obligation to pay compensation and their legal source. The second section is divided into five subsections in which I analyze actual problems concerning the present character of the liability based on the reliance interest and its evolution under Polish law well anticipated by Professor Czachórski, among others, the general idea of the fault in contracting (culpa in contrahendo), the legal consequences of the unsuccessful formation of contract procedure, the reliance as a delictual or “the third truck” (sui generis) liability, the grounds and further sense of the division between the reliance and expectation interest and the scope of reliance damages. The fifth subsection refers to the possibility of indemnification of non-pecuniary damages suffered ante contractum and the sixth concerns the interesting problem, only mentioned by Professor Czachórski – the aggrieved person’s contribution to the emergence or increase of the reliance damages. De lege lata the Polish Civil Code is clearly harmonized with the recent European interpretation of culpa in contrahendo regulating it explicitly (art. 72 § 2) as an autonomous source of the liability for the frustrated confidence (trust), resulting from the common obligation to negotiate loyally and in a good faith.

The principle of state liability has been widely recognised in 20th century and codified in certain jurisdictions. English law, however, has been traditionally reluctant to recognise the liability of Crown distinct from the of its servants. According to the long-standing principle of rule of law, servants of the Crown should be liable for torts committed in their official capacity just as individuals. The principle has been allegedly designed to protect the individuals from arbitrary decisions of public authorities, which fall in their actions under jurisdiction of common courts. It was not until the advance of Crown Proceedings Act 1974 when the Crown took material liability for torts committed by its servants. The nature of tortious liability of the public bodies, however, remained peculiar. The aim of this article is to indicate that the underlying concept of individual liability of servants, once designed to protect the individuals, now restricts the scope of civil liability of public bodies in English law.
