Opis:
One of the aspects of food security is the cultural adequacy of food. This means that food security cannot be sufficiently ensured when this factor is ignored. Unfortunately, no approach has been developed, either in the regulations or on conceptual grounds, which would help classify food products for the needs of food security and account for the aforementioned cultural aspect. However, not every product is equally significant for this policy and some may not be important at all. Therefore, the paper proposes that product classification criteria be established for food security, including in particular the cultural criterion. In addition, examples of its adoption (or omission) in the current regulations are presented.

Recurrent events of a terrorist character, especially those occurring not in arenas of armed conflict or in countries that are not – at least formally – at war with others, make it necessary not only to consider a redefinition of the state security systems, but also to reflect deeply on the human rights-inspired paradigms accepted hitherto. Regardless of one’s convictions and interpretation of current events, it is difficult to avoid repeating questions concerning the efficiency of public authorities and our legal system in the context of European experiences with terrorism. It is necessary to examine whether the commonly recognized constitutional and human rights standards facilitate the development by the state of instruments aimed at the effective prevention of terrorism. In the process of enacting and applying anti-terrorist laws one must pay heed to the mutual relations between goods protected and violated by a given regulation. As noted above, there is no freedom without security, but also there is no security without freedom. This tension makes a proportionality test very troublesome. The legislator should, above all, harmonize the axiological contexts of the provisions constructed thereby, so that they are orientated towards the protection of both security and freedom.

The subject of this article are issues related to the functioning of the food safety system in terms of institutions and administrative entities established for this purpose at the EU level. The aim of the considerations is to answer the question whether the adopted legal solutions will enable effective official control of agri-food products. They are based on the assumption that only coordinated control and monitoring programmes serve to prevent or minimise exposure to food hazards. At the same time, they should cover the entire agri-food chain, and the application of a coherent approach to official controls and enforcement measures should serve this purpose. Member States are responsible for compliance with EU legislation in this regard. They shall indicate the competent central authority or authorities to which they entrust control competences. Their specific role is, among other things, the development of procedures or solutions used to ensure the efficiency and usefulness of official controls and other official activities. Official food control is one of the most important instruments of the food safety system. Therefore, the extension of its scope to the entire agri-food sector should be evaluated positively. The EU control model created allows for its effective organisation. At the same time, it should be stressed that the environment of the agri-food chain is constantly changing, which requires constant adaptation of the official control system by the EU legislator.

Opis:
The aim of the paper is to identify the challenges facing agricultural law and to undertake their assessment in the light of the development of this branch of law. On the one hand, new regulations and CAP instruments for the upcoming funding period will have to be followed as of January 2023. On the other hand, it will be necessary to confront the effects brought about by COVID-19, the war in Ukraine and the changing climate. Agricultural law, itself being subject to change and undergoing various stages of development, has always responded to the contemporary challenges, at a particular place and time. It can be concluded that the numerous and complex problems faced by agricultural law today go beyond agriculture alone, understood as a branch of primary production. Agricultural activity must ensure food security and food safety but should be pursued under conditions respecting the environment and combatting climate change through sustainable development. The negative consequences of such activity need to be reduced, however, without causing damage to primary production. In these difficult times, the pursuit of food security must not undermine the manufacturing role played by agriculture.

Opis:
Ensuring food security, i.e. achieving the state of relative physical and economic availability of safe food, is becoming one of the most critical challenges of the present day, both on the scale of individual countries and the entire world. In this context, a closer look at the limitations and guidelines resulting from the Constitution of the Republic of Poland for the directions of creating the national food security policy become a topical issue. So far, no consideration has been given to the constitutional legal framework for such a policy in Polish literature. Based on the analysis carried out, it has been indicated what guidelines for such a policy result from the crucial food security principle of protecting family farms and other provisions of the Polish constitution.

Opis:
The analysis of the elements of Gustaw Radbruch’s idea of law and their transfer to the theory of taxation area unlocks the potential to formulate important postulates for the tax legislator and the tax administration. Particular attention should be paid to the purposefulness of law, which calls for an entirely new perspective on establishing tax law, which may revolutionize the state-taxpayer relationship. The other postulates can also inspire the development of better tax law. Tax law may be better for both sides of the public-law relationship, and not only for taxpayers who (as it seems), especially in the legislator’s opinion, have been a priority of the tax law doctrine in recent years.

Opis:
Many issues need to be considered and tackled before moving data into the cloud. Adoption of cloud computing raises concerns and questions in particular with respect to security, control and privacy in cloud computing environment. Users should be aware where their data will be stored and what law governs. In a case where personal data are to be processed it is important for the contracting parties to ensure that requirements and obligations placed on them pursuant to the EU data protection laws will be fulfilled. This article also includes an overview of typical terms and conditions of cloud computing contracts, stressing that most of contractual arrangements in current practice fall short of achieving a fair balance of rights and obligations arising under the contract between cloud providers and users. The aim of this study is to indicate regulations and guidelines which are applicable to cloud computing contracts as well as initiatives undertaken at the EU level and their role in building legal certainty and trust to cloud computing technology.
