The purpose of the paper is to discuss the usefulness of application of various philosophical conceptions of vagueness to the problem of vagueness in law. Although it cannot be expected that any philosophical conception may solve the practical problems of interpretation and application of vague terms in legal texts, the philosophy of language may help lawyers to better understand their problems. The paper describes main philosophical conceptions of vagueness and in particular metaphysical, epistemic, semantic, and pragmatic theories. It is argued that the pragmatic conception of vagueness has the best explanatory force with respect to the problem of vagueness in law. The application of this conception, however, must be based on acceptance of internalistic theory of meaning and on the assumption that the purpose of legal interpretation is to reveal the intention of the legislator. Both assumptions are controversial.

In this paper I present a difficulty for Matczak’s sophisticated textualism. I argue that, due to his claims about the descriptive character of legal language and the unity of the possible world postulated by the legal text, his theory cannot successfully account for norms that express factors that an authority should take into account when determining the measure of sanction. I reject two replies to this objection that do not require a modification of Matczak’s account. The upshot of my argument is that in order to accommodate norms pertaining to sanctions, Matczak should drop the assumption of unity of the possible world described by the legal text.

The present text discusses the role of a special kind of research into criminal law in the continental legal tradition, for which the term “legal-dogmatic research” has been adopted and used by many scholars from outside the common law system and which is described in more detail below, its place among other scholarly disciplines, and its significance for legal practice. The concept of this “legal-dogmatic research” can be understood in two ways. Based on the first approach, it is perceived as an abstract study of law independent on the legal rules in force at a given time and place. In this sense, it appears as synonymous to terms used in the German language: Doktrin or Lehre (study). In the second sense, this research is seen as a study of existing law (lex lata) – and nothing else. It differs from other areas of jurisprudence in that it does not strive to be universally valid, but is confined to a time and place. The article presents a point of view in the light of which this research aims to render the normative system coherent and comprehensible, i.e. to establish the correct meaning of the law by clarifying and systematizing it. In this context, the author shows that the purpose of legal scholarship is to reveal and subsequently to conceptualize reality. At the same time, the importance of investigation of the law as it is (legal-dogmatic research) is by no means limited to the hermeneutical analysis of the legal text, but that it faces equally ambitious tasks, such as the development of criminal law and the need to find material legitimacy for the use of coercion by the state against citizens.

The legislative standard is the coding of legal norms in legal regulations, because the lawmaker has no need, or even the possibility, to directly present the fully developed legal norms. This coding process enforces the fragmentation of a legal norm, which in turn results in the fact that the interpretation of a legal text, as a process opposite to the activities of the lawmaker, must be non-fragmentary. The lawmaker can and should provide the interpreter with guidelines on how to carry out this non-fragmentary interpretation, and especially indicate which fragments of the legal text are to be related to each other in this interpretation and how to bind them together. The lawmaker may find it extremely helpful in the implementation of this task to make appropriate use of the means of legislative technique, in particular the systematics of a normative act and the references contained in these acts.

The paper presents factors influencing the choice of verbal aspects in Polish legal texts. Imperfective verbs in the present tense are usually used in the Polish legal norm. The first part of the text features a theoretical analysis against the linguistic and legal background. In the second part of the paper, the authors present the results of a survey conducted with the use of a fictional statute where respondents had to select an appropriate verbal aspect. Such a method makes it possible to assess the significance of different factors influencing the choice of the verbal aspect described in the first part of the text and other factors covered by the survey.
