The article provides an analysis of the notion of competitiveness as a legal category allowing the operation of the economy. Various understandings of competitiveness has been analyzed through examples from economic law, in particular from agricultural law. Both European and national legal acts were analyzed. It was noted that a functional interpretation was required to decipher the meaning of competition in the law. Its common understanding does not coincide with the specification of the legal definition of that concept. Such a situation can create uncertainty, particularly when increasing competitiveness determines the effectiveness of the funds spent.

Opis:
The purpose of the paper is to discuss the usefulness of application of various philosophical conceptions of vagueness to the problem of vagueness in law. Although it cannot be expected that any philosophical conception may solve the practical problems of interpretation and application of vague terms in legal texts, the philosophy of language may help lawyers to better understand their problems. The paper describes main philosophical conceptions of vagueness and in particular metaphysical, epistemic, semantic, and pragmatic theories. It is argued that the pragmatic conception of vagueness has the best explanatory force with respect to the problem of vagueness in law. The application of this conception, however, must be based on acceptance of internalistic theory of meaning and on the assumption that the purpose of legal interpretation is to reveal the intention of the legislator. Both assumptions are controversial.

The article presents selected issues with the functioning of new linguistic phenomena in agricultural law. An analysis of the impact of changes in agricultural policy on the emergence of new concepts related to climate and environmental protection was performed. In this respect, the assumptions of the new Common Agricultural Policy concerning climate protection were analyzed in detail. The article also presents the basic new assumptions concerning the implemented innovative activities in agriculture. The evolution of particular terms in agricultural law, both in terms of meaning and linguistics, was also indicated.

Opis:
The article concerns the Polish legal language. The author presents several expressions that are both professionalisms (i.e. are used only by lawyers and have survived only in legal language) and archaisms (i.e. come from distant ages and are no longer used in everyday language), explains their origin and provides information concerning the frequency of their occurrence in judicial decisions over the last 100 years. The research results indicate that there are archaisms-professionalisms in the legal language, dating back to the Middle Ages and the times of the Polish-Lithuanian Commonwealth. In the Polish legal system they are scarce remnants of these periods. There are also many archaisms of Germanic origin, which infiltrated the Polish judicial language during the partitions and in some regions of Poland are more popular than other expressions.

The aim of this paper is to analyze the terms of the subjects of acts in law in Chinese legal language. Morphologically, Chinese is an isolating language. It also uses a non‑alphabetic writing system. Creating the terms of the subjects of acts in law is governed by fairly strict language rules; however, there are numerous exceptions that may be misleading for the translator. These terms are commonly used, among others, in the civil law contracts and therefore are an important element of the legal language, also used by non-specialists (e.g. parties to the contract). The analysis of particular terms has allowed to identify the aforementioned general rules in the legal language, as well as to find some exceptions. The research material included the civil law acts (General Principles of Civil Law of the PRC, new General Provisions of Civil Law of the PRC, the Contract Law, and the Inheritance Law – in modern Chinese law, as yet, no unified civil code has been adopted, therefore its role is played by the general law and the so-called satellite laws). The study is complemented by the comparison of the Chinese legal terms and their suggested Polish equivalents, which can be a valuable help for translators.

The legal lexicon covering the lexical field of words related to the financial collapse of a company in Polish has changed significantly over the years. The most important word today, upadłość (from the verb upadać, Eng. to fall/fail) used to have a general meaning, while 200 years ago, the two words used in this sense were bankructwo (from Italian) and konkurs (from Latin). This latter word is also mentioned in sources from 100 years ago, when it occurred alongside a new word plajta (from German), referring to a specific, premeditated type of bankruptcy. In the following decades of the 20th century, the word upadłość became a specialist term, in contrast to bankructwo, which took on a general meaning, while konkurs fell out of use and plajta began to refer to fields other than economics. The presented analysis, which uses the method of lexical paradigmatic fields, is one of the historical-linguistic tools that can be used in jurislinguistics. Also other methods and concepts, e.g. syntagmatic fields, grammatical analyses, the use of utterance frame or modal frame offer many possibilities to conduct cognitively valuable diachronic analyses of legal language.
