Opis:
A deliberative debate is a process of communication focused on finding good arguments for specific evaluations and solutions to the issues discussed, and addressing important stakeholder issues. The aim of the article is to present the course and results of observations made with regards to the theoretical and scientific discourse of deliberation that took place in September 2016. Participants were academic experts, thinkers and representatives of civil society organisations working in European affairs, as well as doctoral students and other activists. The questions concerned the way to understand the guiding motto of the meeting: More Europe and the way to define and to perceive the crisis in the process of European integration. Deliberation concerned the assessment of the model of European integration and the question whether the current formula is endorsed or contested. In addition, arguments on the best and worst effects of the integration process should be identified, who can challenge the integration process and for what reasons. The purpose of the deliberation was to assess the process of European integration, identify the ground for the criticism thereof, diagnose crisis situations and indicate the desired target model.

The aim of the paper is to analyse the sources of the crisis of legitimacy of the EU from the perspective of the intergovernmental paradigm. The paper also focuses on the nature of this crisis and the possibilities of increasing the legitimacy of the EU. The author claims that the crisis of legitimacy is a result of the fact that there is “too much Europe”, not “too little”. According to Andrew Moravcsik’s approach to intergovernmentalism, the EU crisis is a result of feeling that the European Union has ceased to be seen as an effective tool for realising the interests of the states, or that the states started to define their preferences in the integration process in an unreasonable way.

The subject of this publication is the scepticism regarding the future of the European Union in the UK. The research is based on Eurobarometer surveys conducted over the period of five years. A purpose of the research is to show the relationship between the results of the Eurobarometer survey on the future of the EU, and the eurosceptic views in the UK. The main research questions is: is the UK sceptical about the future of the EU? Hypothesis of this publication is that the UK is sceptical about the future of the European Union. The reasons for such attitudes are not analysed here – the article is merely an attempt to present the societal attitudes. The research method employed is the comparative critical analysis of quantitative data. The conclusion is that Great Britain is not significantly eurosceptic. British people are, however, less enthusiastic about what is happening at present in the EU, and also are showing greater anxieties when it comes to the future of the EU. Tematem badawczym niniejszej publikacji jest eurosceptycyzm w Wielkiej Brytanii, opiera się ona na badaniach Eurobarometru, które dotyczyły przyszłości Unii Europejskiej, prowadzonych na przestrzeni pięciu lat. Celem badań jest wykazanie związku pomiędzy wynikami badań Eurobarometru na temat przyszłości UE, a poglądem, że Wielka Brytania jest państwem eurosceptycznym. Głównym pytaniem badawczym jest: czy Wielka Brytania jest sceptycznie nastawiona co do przyszłości UE? Hipoteza potwierdza zadane pytanie i brzmi, że Wielka Brytania jest sceptycznie nastawiona co do przyszłości Unii Europejskiej. W artykule nie są analizowane przyczyny takich postaw. Artykuł jest jedynie próbą przedstawieniem postaw społecznych. Użytą metodą badawczą była porównawcza, krytyczna analiza danych ilościowych. Z analizy wynika, że Wielka Brytania nie jest wyróżniająco się eurosceptycznym państwem. Brytyjczycy mają jednak mniej entuzjastyczne poglądy na to co obecnie dzieje się w UE i otwarcie wyrażają większe obawy w kwestii przyszłości UE.

The main purpose of the article is to ask whether the European Union is a smart power actor. Most of the previous research has treated the EU as a soft power. This work is an analysis of the tools which the European Union uses in its foreign policy. Research has been conducted in the context of types of powers, which have been formulated by Joseph Nye: hard power, soft power and smart power. It was necessary to survey what instruments does the European Union use to have impact on other participants of international relations. Nowadays, a range of these tools is relatively developed, taking into account that the EU is an international organisation. In the conclusion, it is stated that the contemporary European Union should be treated as a soft power, but simultaneously it is an actor which attempts to become a smart power, and has relevant predispositions to it. Głównym celem artykułu jest zbadanie czy Unia Europejska jest aktorem typu smart power. Większość dotychczasowych badań traktowało UE jako podmiot typu soft power. Niniejsze opracowanie jest analizą narzędzi, jakimi posługuje się Unia Europejska w swojej polityce zagranicznej. Badania zostały przeprowadzone w kontekście typów mocarstw (potęg), jakie sformułował Joseph Nye. Mowa tutaj o hard power, soft power i smart power. W pierwszej kolejności należy zbadać jakim instrumentarium posługuje się Unia Europejska, by wywierać wpływ na innych uczestników stosunków międzynarodowych. Obecnie wachlarz tych narzędzi jest dość rozbudowany, biorąc pod uwagę, że UE jest organizacją międzynarodową. We wnioskach stwierdzono, że współczesną Unię Europejską traktować należy jako soft power, aczkolwiek jest ona podmiotem dążącym do stania się smart power, który ma ku temu odpowiednie instrumenty

The article poses a question about the existence of the rule of separation of powers in the EU institutional system, as it is suggested by the wording of the treaties. The analysis led to the conclusion, that in the EU institutional system there are three separated functions (powers) assigned to different institutions. The Council and the European Parliament are legislative powers, the Commission and the European Council create a “divided executive”. The Court of Justice is a judicial power. The above mentioned institutions gained strong position within their main functions (legislative, executive, judicial), but the proper mechanisms of checks and balances have not been developed, especially in the relations between legislative and executive power. These powers do not limit one another in the EU system. In the EU there are therefore three separated but arbitrary powers – because they do not limit and balance one another, and are not fully controlled by the member states.

The article concerns primarily the effects of the membership of the European Union on national (Polish) law and, to a limited extent, on the political system of a state. The conclusions presented in the article are of universal value. Although the article deals with Polish affairs, the principles, tendencies and consequences identified are typical of the relationship state – the EU, both before and after accession, regardless of the state concerned. It should be, however, noted that the path to membership and the membership itself are different in each case. The practice of the Polish membership of the European Union, its systemic dimension and the changes in the national legal system (Europeanisation) do not differ significantly than in the case of other Member States. Europeanisation of Polish law, politics, economy, culture and society has been in progress since the 1990s. One can differentiate between two stages of Europeanisation: before and after Poland’s EU accession, each characterised by different conditions. Over time, this process, on the whole, has been undergoing numerous changes but it has never weakened in importance. Poland faces issues such as poor legitimation of integration processes, supremacy of the government over the parliament, passivity of parliamentary committees in controlling the government and EU institutions in the decision making process, as well as dilution of responsibility for decisions taken within the EU. The process of Europeanisation relies mostly on direct application of the standards of EU law in the national legal system, implementation of directives into national law and harmonisation or standardisation of national legal solutions so that they comply with the EU framework. It is also reception of a common, European (Union) axiology.

Recent years confirm that new media have become one of the basic elements of creating communication strategies for the EU institutions. Officials and main decision-makers are increasingly involved in the realm of social media. It is even more significant when we observe that they make use of this tools in a fully transparent way. Such activities add new dynamics to European communication policy. This paper discusses the real-time nature of the Internet communication sphere of the EU institutions created within the guidelines of the European Commission’s new communication strategy, which makes social media complementary to conventional informational operations.

The article’s aim is to identify the features of EU external energy policy. The author analyses the evolution of EU energy policy and ongoing energy transition, using the primary and secondary legislation and scientific literature. Particular attention is paid to the European Green Deal, which affects EU energy relations with third countries. Azerbaijan was chosen as the case of analysis, because this country is the one of important suppliers of the natural gas to the European Union. The author concludes that the Europeanisation of Azerbaijan through mechanisms of conditionality and externalisation is beneficial to both the EU and Azerbaijan, and this, in turn, will push Azerbaijan to follow the European Green Deal.

The aim of this study is to present the case law of the Court of Justice of the European Union (CJEU) regarding the admissibility of parallel punishments in proceedings conducted separately before criminal courts and administrative authorities. Pursuant to Article 50 of the Charter of Fundamental Rights of the European Union, no one shall be liable to be tried or punished again in criminal proceedings for an offence for which he or she has already been finally acquitted or convicted within the Union in accordance with the law (the ne bis in idem principle). According to the CJEU, this principle does not constitute a legal obstacle to the application of sanctions for the same unlawful conduct of the same person in both criminal and administrative proceedings, if the sanction imposed by the administrative authority does not have the nature of a criminal penalty (the case C-617/10 Fransson). Assessment of such a nature in accordance with the case law of the CJEU (influenced by the judgment of the European Court of Human Rights in the Engel case) needs to be based on three criteria: the classification of a given procedure in domestic law, the existence of a repressive function of the measure adjudicated under the procedure and the degree of its severity (the case C-489/10 Bonda). In the opinion of the CJEU, the ne bis in idem principle mentioned in Article 50 of the Charter is also not absolute, because the restrictions on the use of the rights granted by the Charter are allowed pursuant to Article 52 (1) of the Charter. Therefore, according to the CJUE, it is possible to double sanction a given behaviour with measures of a penal nature, if it is justified by general objectives such as the protection of the tax system or of the regularity of stock exchange trading, provided that each of the proceedings performs its own specific additional objectives and that the accumulation of sanctions is based on the principle of proportionality. While administrative sanctions could be meant to counteract any transgressions, criminal sanctions should be limited to the most serious, culpable abuses. Moreover, the Member States should regulate the mutual influence of both proceedings, so as not to punish too severely the same behaviour and so that the sanctions applied jointly are absolutely necessary (the case C-545/15 Menci, the case C-537/16 Garlsson Real Estate and Others). On the other hand, according to the CJUE, Article 50 of the Charter excludes the possibility of bringing a given entity to administrative responsibility in the event that it had already been legally acquitted of committing the same offence with a final court ruling, because the acquittal judgement definitively determines that no act has been committed, and thus it is pointless to consider whether an exception to the ne bis in idem principle in such a case is justified in the light of Article 52 (1) of the Charter (joint cases C-596/16 and C-597/16, Enzo Di Puma and Consob). Finally, the CJUE states that Article 50 of the Charter must be interpreted in such a way that it does not preclude the application of the national provision which allows for conducting criminal proceedings, if a definitive administrative penalty for the same acts has been imposed on a company with a legal personality and criminal proceedings have been initiated against a natural person (joint cases C-217/15 and C-350/15, Orsi, Baldetti).

The main purpose of this article is to show the forms of lobbying utilized by interest groups in the times of COVID-19 (ex-ante, ongoing, ex-post). A comparative approach was adopted to the forms of influence used in the pre-COVID and post-COVID times. In addition, the article discusses the articulated forms of influence and verifies the impact evolving from the impact of the SARS-CoV-2 pandemic used by interest groups towards public administration. The analysis was carried out aimed at a predictive look at the forms of influence used in relation to the current postpandemic situation, which are used by interest groups in lobbying campaigns in relations with decision-makers in public administration. In addition to the theoretical dimensions, practical insight are also offered into the functioning of interest groups through the presented sets of tools for lobbying campaign and exerting influence on public authorities.

The year 1993 marked the establishment of formal EU citizenship and, subsequently, special relations were forged between the earlier status of the individual, a subject of internal market freedoms, and the notion of political EU citizenship. The social and welfare rights of individuals were strengthened, thus enabling a deeper integration. The social rights in the EU’s legal system play a special role in the construction of EU citizenship as they add meaning to the notion of citizenship and go beyond the traditional, economic dimension of integration. What links the constructs of market citizenship and social citizenship is the strong emphasis on the individual’s right to their status, and to rights which can be exercised effectively. Recently, political and economic citizenships have merged. However, this process has been confronted with resistance from some member states, particularly the ones with wealthy social protection systems. This has been caused by the abuse of rights by migrants from other member states, i.e., through so-called social tourism.

Opis:
The aim of the article is to explain why the EU integration efforts have different outcomes in times of crisis with regards to impact on key stakeholders. Besides traditional political theories of European integration, authors suggest to take into account the importance of behavioural intentions and stimuli to adhere to the reforms agenda. The research results presented in this article explain two recent deep EU crises: energy crisis and fiscal crisis, which evolved simultaneously, but resulted in different integration projects within the same political and institutional background. Authors analysed Eurobarometer public opinion surveys together with empirical data on the impact on stakeholders, based on available indicators in Eurostat. Authors found that the key for a policy to succeed in targeting agents’ and groups’ behaviour is its direct ties with stakeholders’ motivation which can be done only at market level. Thus, policy shift in integration areas should be reinforced by direct and clear market solutions and corrective mechanisms avoiding politically-relevant targets.
