This essay discusses the main perspectives in the contemporary debate on university. In recent years the university became one of the most problematic institutions of our society. Debate on the future of the university began in the moment of transition from the industrial societies to the post-industrial societies. In the second half of the 20th century we witnessed a long process of replacing the old form of university by the institution of multiversity or a university governed by the rule of excellence. The process of transformation of university is still discussed within the academic milieu and we can observe a constant proliferation of critical approaches which tend to undermine conviction that the ongoing process of subjugation of the university to the economic rules is inevitable.

Art. 116 of the Constitution of the Republic of Poland provides that a state of war and the conclusion of peace are declared by the Sejm acting in the name of the Republic of Poland. These two notions, having no constitutional definition, come under the rubric of established notions, i.e. concepts whose meaning derives from doctrinal findings and provisions of law, as well as from constitutional principles and values. The Sejm’s power to declare a state of war and, consequently, declare the conclusion of peace is part of Polish system-of-governance traditions. The parliament’s power to declare war actually characterizes most of the democratic systems, even if it could be argued that waiving this prerogative in practice characterizes it as well, reflecting the preponderance of the executive power in the domain of foreign policy. The wording of Art. 116 rules out an invasive war, also in the form of a war of prevention or a preventive self-defence. The Sejm may adopt the relevant resolution only in case of armed aggression against the territory of the Republic of Poland, or if international treaties impose an obligation of common defence against aggression, i.e. as a consequence of an act of aggression. Being of key importance for the constitutional regulation of war and peace, this constraint is commensurate with international law, which the Republic of Poland is required to respect pursuant to Art. 9 of the Constitution, and is also commensurate with the Preamble to the Constitution. In a democracy, acts of war – as an important government prerogative – may only be conducted pursuant to the relevant constitutional provisions which define the conditions that must be met for such acts to be legitimate. The conduct of a war, after all, does not warrant the suspension of the Constitution. A democratic state ruled by law must not conduct a war otherwise than on the basis, and within the constraints, of law – if it is to retain its constitutional identity. For the use of armed forces abroad to be commensurate with the Constitution, such use must not represent an act of aggression, nor can it represent any acts violating the principles of the United Nations Charter. If past experience is to be a guide, democratic constitutions are not capable of preventing anti-democratic changes in the system of governance, nor are they capable of preventing wars. War represents a failure of the Constitution, by destroying its foundation, the belief in inalienable and inherent dignity of the person.

This paper proposes a research design which allows for a comprehensive assessment of the effectiveness of the European citizens’ initiative (ECI) – the first EU transnational participatory tool. It provides an analytical framework based on a broader conceptualisation of the notion of “effectiveness” which goes beyond the sole legislative function of the ECI. Consequently, the paper suggests to evaluate the ECI in five different dimensions: as a dialogue and communication enhancing tool, an awareness-raising tool, a deliberative space, a citizen-activating mechanism, as well as an agenda-setting instrument. Operationalisation of the dependent variable through a set of democratic functions that the ECI might perform allows not only to evaluate its capacity to enhance the democratic legitimacy of the EU but also to identify the tool’s limitations and propose ways of improvement. The paper also suggests a qualitative method of testing the hypothesised effects of the ECI.

Utilizando os conceitos de justiça social e participação paritária de Nancy Fraser, esse artigo pre-tende avaliar a afirmação de que a nova lei de migração é um avanço em relação ao antigo Esta-tuto do Estrangeiro, baseado na lógica de Segurança Nacional e criado durante a Ditadura Mili-tar. Para isso, todas versões da lei foram analisadas, evidenciando seus avanços e retrocessos, bem como a participação da Sociedade Civil no processo. Após isso, é possível concluir que as desigualdades institucionais dos migrantes impediram a mudança completa de paradigma da lei e a participação efetiva dos atores interessados.
Utilizing Nancy Fraser’s concepts of social justice and participatory parity, this article assesses the claim that the New Migration Statute in Brazil is an improvement compared to the previous 1980 Foreigners Statute which was permeated by the doctrine of national security and was adop-ted during the military dictatorship. To do so, every draft of the statute was analyzed, putting in evidence its improvements and setbacks, as well as the participation of civil society during the process of approving the Statute. In doing so, we concluded that the institutional inequalities between migrants and nationals prevented a complete change of the legal paradigm as well as ef-fective participation of the interested actors.

Two colours dominated the imagery representing social reality in the press of interwar Belarusian Christian Democracy. Various social phenomena, people, or material objects could be perceived as either “good” (“white”) or “evil” (“black”). In the realm of “good” material objects, phenomena, and people, it was actually pragmatism that mattered in the context of what was perceived as useful for the Belarusian nation. The latter was represented in the press as the “moral community”, which included the authors and editors as well as readers and supporters of BChD in rural areas. The realm of material objects is also of interest, as they likewise could be perceived as either “good” or “evil” from the community’s point of view. On the one hand, the objects were the symbols of this community; however, on the other, they could be viewed as powerful protecting fetishes.

An electoral defeat usually marks a significant turning point in the life of political parties. It is often the beginning of the changes taking place within them (Harmel, Janda 1994; Gauja 2016: p. 50–51). Existing research suggest that the desire to improve the electoral outcome is the main argument for reform within political parties (Janda 1990; Harmel et al. 1995). This article looks at a relationship between the reactions of political parties to electoral defeat and one factor found to be important in this respect – i.e. the level of intra-party democracy (IPD) analysed at the organisational level. The study uses the IPD measurement model developed by Benjamin von dem Berge and his team (see: von dem Berge et al. 2013). The article provides the analysis of the level of intra-party democracy of the selected four Polish political parties (on the basis of their statutes) continuously present on the Polish political scene after 2001 and its impact on changes within political groupings after electoral defeats. The author examined the statutes of the Law and Justice (PiS), the Civic Platform (PO), the Polish People’s Party (PSL) and the Democratic Left Alliance (SLD). These parties suffered defeats either in the 2011 or 2015 elections. The main research problem is to determine how the level of IPD of the examined parties influences their reactions after electoral defeats. The research hypothesis is: political parties with a higher level of IPD should change under the influence of electoral defeats more than parties with a lower level of this indicator. The study used also the methodology of data analysis (party’s statutes and other documents) and 21 structured in-depth interviews with representatives of party elites. Based on the results, the index of change after defeat in political parties is created.

This article substantiates theoretical and methodological approaches regarding the impact of the power–opposition interrelations on the strengthening and weakening of democracy. Based on the analysis of a number of indicators and modern political process in Poland, it has been concluded that democratisation takes place against the backdrop of the permanent formation and preservation of two opposed poles in the political space. Deflection from democracy increases the distance between two competing/conflicting parties – pro-government and opposition. This situation automatically accumulates the potential of pole’s force. Therefore, the interrelations between the power and the opposition turn into the force of stratification and equalisation that allows reducing the “democracy deficit” and bring the political system into the state of equilibrium.
W artykule wskazano teoretyczne i metodologiczne ujęcia dotyczące wpływu wzajemnych relacji władza–opozycja na wzmacnianie i osłabianie demokracji. Na podstawie analizy szeregu wskaźników i współczesnego procesu politycznego w Polsce ustalono, że demokratyzacja przebiega na tle trwałego formowania i utrwalania relacji między dwoma przeciwstawnymi biegunami w sferze politycznej. Odchodzenie od demokracji zwiększa dystans między dwiema konkurującymi ze sobą stronami – prorządową i opozycyjną. Automatycznie gromadzi to potencjał siły bieguna. Współzależności między władzą a opozycją zamieniają się w siłę rozwarstwienia i wyrównywania, co pozwala na zmniejszenie „deficytu demokracji” i doprowadzenie ustroju do stanu równowagi.

Autor na wstępie zauważa, że prawnicy zawsze odgrywali istotną rolę państwotwórczą nie tylko poprzez kreowanie porządku prawnego, ale także przywództwo polityczne, stając się „architektami demokracji” zarówno w Polsce, jak i w USA. Szkoły prawnicze na całym świecie podjęły wyzwanie, by kształcić przyszłych liderów, którzy rozumieją otaczający ich świat. Autor podaje przykłady zajęć i inicjatyw wspierających przyszłych liderów: nauka prawa obcego i prawa międzynarodowego, udział w wymianach zagranicznych, a także działalność pro publico bono, podejmowanie inicjatyw społecznych. Zadaniem prawników we współczesnym społeczeństwie jest wspieranie demokracji i przewodzenie inicjatywom społecznym. Zdaniem autora, rolą uczelni jest należyte zapoznanie studentów z teraźniejszymi problemami przez praktyczne, eksperymentalne nauczanie. Przykładem tego jest odbywanie praktyk w instytucjach publicznych. Autor konkluduje też, że współpraca między Uniwersytetem Warszawskim a University of Florida Levin College of Law to doskonały przykład kształcenia przyszłych liderów poprzez praktyczne zajęcia, wymianę studencką i naukę prawa obcego.

Since the parliamentary elections in 2015, Poland shifted towards an illiberal model of democracy, largely inspired by the Hungarian experience. One of the first and key signs of the shift towards illiberal democracy in Hungary in the era of FIDESZ was undermining the capacities and autonomy of local governments. Taking into account the ideological proximity of the Hungarian and the Polish ruling parties, there were strong grounds to expect similar tendencies in Poland. This paper reviews the legislation adopted since 2015 in order to explore whether the supposed shift towards recentralization occurred. It proves that while a “creeping centralization” is a fact, the foundations of local and regional self-government have not been dismantled. The nature of this “creeping centralization” is sectoral rather than horizontal, i.e. it focuses on limiting the capacities and powers of local and regional governments in selected areas (particularly education and environmental protection) rather than dismantling the fundamental institutional guarantees of local and regional autonomy or enhancing central supervision over them. This may lead to a conclusion that the foundations of local and regional self-government in Poland are not at risk, yet the scope of decentralization is being gradually rolled out. This paper also demonstrates potential explanations for lack of radical shift towards recentralization. The major hypothesis analyzed in this context relates to the massive public support for local governments and decentralization, manifested in the opinion polls showing the highest trust rate to local governments in their history.

Central ethical concepts in education should be interpreted in a global frame, beyond the conceptual confines of the nation state. My underlying claim is that globalisation’s effects and significance are profound, but that while new global practices, norms and structures are increasingly evident, developing our key ethical concepts and assumptions accordingly is limited by the narrow and outdated moral universe of the nation state. The intertwined demands of justice and democracy in education now require conceptual adjustment to meet a different world. First, the features and significance of globalisation are considered, with particular reference to globalisation in education, as well as political globalisation as indicative of the now outdated model of the Westphalian state. Secondly, a revised conception of justice based on recognition of global association is sketched and illustrated by the case of the global campaign for Education for All. Thirdly, possibilities for globally democratic decision-making after the monopoly of the nation state are outlined, advancing the discussion towards some concluding observations about the implications of the argument for the education of global citizens.

En el contexto de la Guerra Fría y de apertura de la Iglesia al mundo, las relaciones entre la Iglesia y el Estado evolucionaron hacia más complementariedad o más tensión en función del color político del Presidente de la República. A finales de los años 1940, la Iglesia católica chilena se abrió a la “cuestión social” mientras que el Estado chileno entró en un periodo de reformas y de transformaciones a veces bajo presiones estadounidenses. No obstante, a finales de los años 1960, una parte de los cristianos se entusiasmó por proyectos políticos radicales. El Golpe y la dictadura dividieron otra vez a los católicos y la Iglesia, pero la jerarquía católica se opuso frontalmente al general Pinochet que buscó un apoyo evangélico. La vuelta a la democracia, en 1990, coincidió con un cambio de contexto internacional, el fin del bloque del Este y la secularización de la sociedad. En Chile, los obispos volvieron a actividades meramente espirituales. Este artículo pone de relieve la evolución política de los católicos en un contexto internacional de Guerra Fría y de Posguerra. Por fin, se abarcaran los distintos niveles de la Iglesia católica (jerarquía, congregaciones, sacerdotes) y sus matices políticos
In the context of the Cold War and open-mindedness of the Church to the world, the relationships between the Church and the State had progressed toward more complementarities or more tensions depending on the political color of the President of the Republic. In the late forties, the Chilean Catholic Church was open to the “social question” while the Chilean State began a period of reforms and transformations sometimes under the United States influence. Nevertheless, in the late sixties, a part of the Christians supported more radical political projects. The Coup and the dictatorship had divided once again the Catholics and the Church; however, the Catholic hierarchy was frontally opposed to the general Pinochet who had looked for an evangelical support. The restoration of the democracy in 1990 coincided with a change of international context, the end of the Eastern bloc and the secularization of the society. In Chile, the bishops returned to purely religious activities. This article discusses the political evolution of the Chilean Catholics in terms of the Cold War and post-Cold War. Finally, the different levels of the Catholics Church (hierarchy, congregations, priests) and their political nuances will be analyzed

A deliberative debate is a process of communication focused on finding good arguments for specific evaluations and solutions to the issues discussed, and addressing important stakeholder issues. The aim of the article is to present the course and results of observations made with regards to the theoretical and scientific discourse of deliberation that took place in September 2016. Participants were academic experts, thinkers and representatives of civil society organisations working in European affairs, as well as doctoral students and other activists. The questions concerned the way to understand the guiding motto of the meeting: More Europe and the way to define and to perceive the crisis in the process of European integration. Deliberation concerned the assessment of the model of European integration and the question whether the current formula is endorsed or contested. In addition, arguments on the best and worst effects of the integration process should be identified, who can challenge the integration process and for what reasons. The purpose of the deliberation was to assess the process of European integration, identify the ground for the criticism thereof, diagnose crisis situations and indicate the desired target model.

The aim of the article is to present possible scenarios on maintaining democracy in the EU, while assuming different hypothetical directions in which it could develop as a federation, empire and Europe à la carte. Selected mechanisms, norms and values of the EU system that are crucial for the functioning of democracy in the European Union are the subject of this research. The abovementioned objective of scenario development is achieved through distinguishing the notions of policy, politics and polity in the research. In the analysis of the state of democracy in the European Union both the process (politics) and the normative approach (policy) have been adopted. The characterised norms, structures, values and democratic procedures in force in the EU will become a reference point for the projected scenarios. The projection refers to a situation when the existing polity transforms into a federation, empire or Europe à la carte. The article is to serve as a projection and is a part of a wider discussion on the future of the basis on which the European Union is build.

In this article, we will first analyse, in a resumed way, the various lines of thought related to cultural resistance, radical democracy critical pedagogy; then we will present an example of a critical pedagogy, the punk pedagogy, in order to demonstrate that the reality we describe is not only present at the abstract level; then, and finally, we proceed with the research methodology that we intend to trigger in order to analyse the educational contexts of cultural resistance in Portugal and Poland. In this article we are talking about two countries with very dissonant stories. Even today, in the context of membership of the European Union, the course of both countries seems to diverge. However, we argue that the comparison between these two distant and different countries may open new perspectives on the contexts of cultural resistance and critical pedagogy. Like the example of punk, these practices of cultural resistance can serve as a way to empower active civic and political participation, going beyond the simple act of voting every four years and promoting a radical democracy.

W artykule przeanalizowano wpływ dynamiki partii na zmienność liderów partii, argumentując, że można spodziewać się znacznych różnic w zakresie ideologii, siły parlamentu i zaangażowania w rządzenie. Autorzy twierdzą, że liderzy są bardziej skłonni do zmian, gdy ich partie przegrywają wybory lub odchodzą od rządu. Ponadto zbadano różnice w długości sprawowania przywództwa w odniesieniu do stopnia demokratycznej konsolidacji, na podstawie analizy doświadczeń z Bałkanów Zachodnich i krajów Grupy Wyszehradzkiej. Wyniki potwierdzają hipotezy dotyczące porażki wyborczej i odejścia od rządu, a także regionalnych różnic między demokracjami przejściowymi i bardziej skonsolidowanymi.
This article is examining the effects of party dynamics on changeability of party leaders, arguing that significant differences can be expected with regard to ideology, parliamentary strength, and involvement in government. Authors claim that leaders are more prone to change, when their parties lose elections or depart from the government. Moreover, they explore variations in leadership longevity in relation to degree of democratic consolidation, based on the analysis of experience from the Western Balkans and Visegrad Group countries. Findings confirm the hypotheses regarding electoral failure and departure from government, as well as regional differences between transitional and more consolidated democracies.
