The article looks at the history of childhood in the society, the country of Germany, and abroad. Today’s view of children as legal persons, recognizing their endowment with competencies and resources but also their ontological dependence, is a rather ‘new’ perspective in human history. Therefore the article first focuses onto the UN-Child-Right’s-Convention which was ratified in Germany in 1992. Second, a closer look at the development of the legal foundations of child protection in Germany shows how child protection in Germany was developed. The reader will get an overview about the child protection system in Germany, afterwards. The article ends with some recommendations to establish a child-rights-focused perspective in the child protection system in Germany.

The aim of this article is to present the development of Polish and EU regulations on child pornography. Four amendments to the Polish Criminal Code, which were passed with the purpose of effecting tools to protect children, are strictly connected with the changes in the EU law – from the Green Paper of 1996 to Directive No. 2011/92/EU of the European Parliament and of the Council. The paper presents the current definition of child pornography, the understanding of which has evolved since the 90s. Changes in the EU law and the Polish regulations can be divided into three stages – first attempts at specifying instruments on child protection, widening the scope of the definition of child pornography and stiffening sanctions for child pornography. Amendments tothe Polish Criminal Code reflect the actual tendency to adopt more precise tools to prevent children from sexual exploitation. However, it does not lead to desired effects. Child pornography is a growing problem due to the relentless technological development but current regulations in their casuistic form are not a suitable tool to combat sexual exploitation of children.

Opis:
Family divorce is undoubtedly one of the most painful experiences in the lives of spouses and their children. However, the immaturity of younger family members, their dependence on parents, and the strong need for security and susceptibility to injury mean that the breakup of marriage is more strongly experienced by children than parents. Divorce is a kind of emotional shock for them, a critical and crisis period. As indicated by research reports and the analysis of court files, in many cases the right of minors to the contact with both parents is not respected, which is largely due to the behaviour of the parents themselves. It should be emphasized that all parents’ activities, such as: rivalry between them for the child’s feelings, engaging him or her in conflict with the former partner, striving to form a coalition with the child, as well as obtaining physical and mental exclusivity for the child by isolation from the other parent and devaluing him or her – should be considered as forms of emotional abuse of the youngest family members and manifestations of violation of one of the basic rights of children, which is the right to both parents.

Despite the continued tendency of 19th century literature to use traditional fables with animal characters to reveal human virtues and vices, there rapidly grew up a movement of literature for young people whose only aim was to cultivate moral attitudes towards animals. By means of various literary genres, the younger generation was educated to achieve a sensitivity towards the pain and suffering of animals. Learning about the consequences of cruelty, young readers were taught to avoid maltreating animals. Literature prompted compassion in the young readers. Not only were particular examples condemned – of cruelty, beating, abuse – but the moral consequences of these violations were demonstrated. Following Immanuel Kant, it was assumed that harming animals weakens our moral sensitivity, which leads to a person becoming cruel not only towards animals but towards people as well.

Article 23 sentence 1 of the Polish Family and Guardianship Code (the FGC) of 1964 emphasises that spouses have equal rights and obligations in marriage. This regulation is commonly understood as establishing the principle of equality between a wife and a husband in Polish family law. That principle has its foundations in international law, including the Universal Declaration of Human Rights, which provides that men and women are entitled to equal rights as to marriage, during marriage, and at its dissolution. After the enactment of the Polish Constitution of 1997, the principle of equality between a husband and a wife derives directly from Article 32(1) and Article 33(1). It constitutes a basic element of the institutional guarantee of marriage which cannot be altered by ordinary legislation. The aim of this article is to discuss how the principle of equality of spouses ought to be understood and correctly applied under Polish family law. It should also be considered whether Polish law on marriage provides exceptions from the rule of equality between spouses and, if so, whether they are justified. Furthermore, it can be argued that Article 23 sentence 1 of the Family and Guardianship Code stipulates not only the fundamental principle of Polish law, but also grants each of the spouses a subjective right to be treated equally in the relationship by the other person. It should be analysed what exactly this right entails. There is no doubt that one spouse has neither more rights nor responsibilities in the marriage than the other. However, a properly understood right to equal treatment should also mean that one spouse cannot demand the other to perform specific functions and roles.
