This article explores various forms of self-presentation of the hetman on the path of self-knowledge in the conditions of hopelessness caused by emigration. Pylyp Orlyk’s handwritten diary of 1725, 1726, and 1727 is dominated by motives of accustoming to emigration conditions, protection of privacy, discourses, illness and recovery, friendship, solitude with reading, and fi nally, more clearly than before, the self-awareness of the soul. “Peregrine”, as Orlyk calls himself in 1727, aft er eighteen years of emigration. He orders two or three services at once for the children on their birthdays, for the health of his wife Anna of the Hercyk family. Orlyk visits all the churches in Th essaloniki, is a good Christian, but nowhere emphasizes his denomination. He believes in the power of praying for the health of his family and friends. Sincere prayer becomes medicine. One of the described disasters of that time is perceived today in a very modern way - “bad air”. Th is euphemism is repeated in the manuscript when it comes to the plague pandemic in Th essaloniki, Smyrna, Istanbul.

The main subject of this paper is an overview of legal regulations on neurotechnology. The purpose of the analysis is also to define threats posed by the development of neurotechnology, to present proposals of laws and regulations that would counteract these threats, referred to as ‘neurolaws’, which have already been formulated in science, to review and analyse national regulatory solutions adopted in recent years (Chile) and international standards (OECD). The study is also an attempt at encouraging debate about the advancement in neurotechnology and the validity of the laws in view of this innovation.

Opis:
Biobanks for research purposes legal regulation is currently under debate. An important issue discussed is protection of the personal data collected in the biobank, including genetic data and other health data. This subject is extremely important given the current development of information technologies that allow for mass aggregation and analysis of personal information. This article describes the constitutional requirements for the discussed regulation, in particular regarding the privacy and informational autonomy of the individuals. The author refers in particular to the application of the proportionality principle.

Opis:
Many issues need to be considered and tackled before moving data into the cloud. Adoption of cloud computing raises concerns and questions in particular with respect to security, control and privacy in cloud computing environment. Users should be aware where their data will be stored and what law governs. In a case where personal data are to be processed it is important for the contracting parties to ensure that requirements and obligations placed on them pursuant to the EU data protection laws will be fulfilled. This article also includes an overview of typical terms and conditions of cloud computing contracts, stressing that most of contractual arrangements in current practice fall short of achieving a fair balance of rights and obligations arising under the contract between cloud providers and users. The aim of this study is to indicate regulations and guidelines which are applicable to cloud computing contracts as well as initiatives undertaken at the EU level and their role in building legal certainty and trust to cloud computing technology.

Technological development increased abilities of data analysis collecting gathering and obtaining from wide range of sources including national health registries. Aim of, entering into force on May 2018, General Data Protection Regulation (GDPR) is to regulate analysis of wide range of personal data from profiling to healthy issues. New regulations may hamper the implementation of research, or realization of projects under Horizon 2020 or Digital Poland, that based on data sharing. In order not to waste the opportunities and benefits for humanity that modern technology and „open data” can bring, appropriate measures must be taken to protect the privacy of individuals. But then there is next trap. The more data is protected in the context of privacy protection, the less useful they are for scientific purposes. The key point is to find right balance between security and usability.

The principle of checks and balances counts among the most fundamental constitutional values, as it is connected with the recognition and guaranteeing of human rights – in other words is the very essence of the Constitution, an act that limits the majority rule to allow for the rights and freedoms of the individual. Also of key importance is the connection of this precept with the essence of the democratic system, understood as one where the majority rule is constrained by human rights. The principle of checks and balances could function in full only in correspondence with culture of respect for human rights. The status of the sovereign needs legitimacy, which derives from the sovereign’s subordination to the Constitution. Being sovereign means being unsubordinated to anybody. It is thus fair to conclude that the attribute of sovereignty actually belongs to the values that have been shaped by culture and linked to the timeless moral rules and principles corresponding to humanity’s eternal dilemmas – the values that create the constitutional culture, i.e. a community’s set of values. The sovereign does not exercise the supreme authority over values, and the values are embodied in the Constitution, which is inseparably linked with the people and their sovereignty. The Constitution of the Republic of Poland reflects the precepts of liberal democracy, or such kind of democracy where the sources of human rights do not stem from the will of the majority. The model of governance adopted in the Constitution could be described as consensual democracy. Constitutional practice has taken a course where the system of consensual democracy – as laid down in the Constitution of Poland, with the power of the majority being constrained by rights of the minority – is turning into a system of a majority democracy, based not on a dialogue between the majority and the opposition, but on the power of a parliamentary majority who disregards the systemic role of the opposition.

The rapid development of information and communication technology has made it imperative that new human rights be spelled out, to cope with an array of expected threats associated with this process. With artificial intelligence being increasingly put to practical uses, the prospect arises of Man’s becoming more and more AI-dependant in multiple walks of life. This necessitates that a constitutional and international dimension be imparted to a right that stipulates that key state-level decisions impacting human condition, life and freedom must be made by humans, not automated systems or other AI contraptions. But if artificial intelligence were to make decisions, then it should be properly equipped with value-based criteria. The culture of abdication of privacy protection may breed consent to the creation and practical use of technologies capable to penetrate an individual consciousness without his or her consent. Evidence based on such thought interference must be barred from court proceedings. Everyone’s right to intellectual identity and integrity, the right to one’s thoughts being free from technological interference, is as essential for the survival of the democratic system as the right to privacy – and it may well prove equally endangered.
