Opis:
Title issue that will be discussed in this article is a dispute, which began during the postglossators, as to the nature of possession, it means whether it is a legal state or fact. In its resolution doesn’t help a multiplicity of types of possession, which at least six were distinguished by the ancient Romans. Polish legislator continues this trend, because now in Polish law occur, modeled on the roman tradition, possession of things and possession of law, and modeled on the concept of Germanic possession spontaneous and possession dependent. From the roman theory derive contemporary elements of possession, however, have a different meaning. Today very important role is played by factor of will (animus), which allows distinguish autonomous possession from a dependent possession. This is confirmed in the jurisprudence of the Polish Supreme Court, which confirms that, in contrary to Roman law, under Polish law it is possible to transform dependent possession in to spontaneous possession, just by having the will clearly disclosed. Exceptionally there are also situations where about the character decides objective element, ie. The rule of law, with the result that spontaneous possessor may act as a wielder. Possession is certainly a legal institution, but it does not justify the statement that it is a legal state that without legislation would not exist. The author strongly inclined to consider that possession is the factual state, because its recognition as a legal state would make unjustified functioning of acquisitive prescription, which has been introduced precisely in order to ensure legal acceptance of long-term relations of fact.

Opis:
The aim of this paper is to present the development of the legal concept of good faith in European legal tradition by means of claim in case of building on someone else’s land – art. 231 § 1 of Polish Civil Code. This claim pretends to be an exception to the superficies solo cedit – rule, offering some possibility to avoid its strict results. The paper takes particularly Polish and Austrian regulations into consideration. The author describes the history of meaning of good faith from roman law until today. He indicates the Germanic origins of the claim from art. 231 § 1 and the influences of Austrian Civil Code (ABGB) § 418. The paper contains a review of statements of doctrine and Polish Supreme Court in 20th century. The described example is also a model of application of historic-comparative method in legal sciences.

Opis:
Twentieth century Polish legal debate on possession adds an original element to the European legal tradition. The author has focused on the inspiring and limiting impact of the legal experience on this field. Legal debate on possession is meant here as legal experience of the discussion of academic lawyers, statutory regulations and judicial practice. The structure of the paper reflects three – distinguished be the author – key issues of this debate: how to precise the object of possession in the positive law? What should be the function of the possessor’s intention in the statutory regulation this legal concept? Are possessory remedies, if independent from the title to the object, legitimate and if so: should these remedies be limited by an exceptio iuris? Each question provokes tension between tradition and reinterpretation of the reasonability of possessory remedies. That tension shows the links between possession and political and economic context of law in action. The controversies have been accompanied by yearning for the balance between tradition and practicality. This Polish legal experience enriches historical-comparative discussion on the evolution and changes of the concept of possession in the Roman law tradition. The author concludes: in democratically made and independently applied private law, the possessory remedies should not be completely separated from the protection of property rights.
